On 1211412021 child care staff member Lauren Loop grabbed Child A (male, 4 years) and threw him to the ground. We completed a forensic interview with hCI d A. Ms. Lauren (Loop) picked me up, held me down and threw me on the ground. Ms. Lauren (Loop) picked me up and took me away from mommy. I didn't like that and I tried to get away from her. She was holding me like a bear; at this time Child A's mother entered the room and stated that "bear hug° ' was a term she used to describe the incident. When asked if he was hurt, Child A pointed to a spot on his stomach under his ribcage. No bruise or mark could be seen. Child A did not want to be interviewed and left the room several times during the interview, Child A's mother entered the room several times during the interview to help Child A answer questions and clarify his responses. Child A's interview appeared coached as he used language that his mother stated were her words. We interviewed Child A's mother. On 1 /1412021Child A was crying and did not want to go to school. This was Child A's fourth day of school, Child A had no previous child care or school enrollment. Child A went into the school and ran back to give her a hug. Child A was crying and she was coaxing him to go in. He ran back and forth to her several times. Child care staff member Lauren Loop came up behind Child A and lifted him up and took him to remove his coat. Child A came running back and Ms. Loop grabbed him from behind and took steps backward. Ms. Loop was holding Child A's arms down. She did not see how Ms. Loop and Child A got to the ground. Child A was kicking and screaming and Ms. Loop was on her knees bent over Child A with her hands holding Child A's hands down. This went on for about 10 seconds. Witness I was present and was signing Child A in. Witness 1 did not see the incident occur. The door was locked and she was not allowed in the building. We interviewed Witness 1. On 12/1412021 he was signing Child A into school and saw Ms. Loop pick Child A up from behind and move him back to the cabbies. He heard some screaming and Child A's mother asked if she could go into the school and help. There was no communication from child care staff members at all. Child A started coughing from all his screaming and Ms. Loop let him go. He did not witness Child A or lbs. Loop on the ground. On 12/1512021 1 completed an on-site inspection with We interviewed child care staff member Tanya Greenfield. On _, A was crying at drop off. Child As mother was telling Child A he needed to go to school and pushing him in the door.. Ms. Loop went over to help Child A. Ms. Loop picked Child A up under his arms facing him, took a few steps and set him down. Child A was over by the lockers and was becoming more and more upset. Child A ran to the corner and threw up. They took Child A to the door where Child A's mother was. Child A's mother stated that they would try again tomorrow and left with Child A. She never observed Child A on the ground. This was only Child A's fourth day at school. There were no previous issues with Child A at drop off. We interviewed child care staff member Katie Handrich. On 12/14/2021 at drop off she looked over and saw Ms. Loop standing with Child A at the lockers attempting to calm him down. She was assisting another child when she heard Child A getting sick. Child A was standing. Ms. Greenfield brought Child A over to Child A's mother. Child A's mother stated they would try again tomorrow. The door was open during the incident as she was letting children in off the bus. There were no previous issues with Child A at drop off. We interviewed child care staff member Lauren Loop. Child A arrived with his mother. Child A did not want to come in. She picked Child A up under Child A's arms facing Child A. She moved about two steps and put him down.

R 400.8140 · R 400.8140 Discipline. (2) All of the following means of punishment are prohibited: (a) Hitting, spanking, shaking, biting, pinching, or inflicting other forms of corporal punishment. (b) Placing any substances in a child's mouth, including but not limited to, soap, hot sauce, or vinegar. (c) Restricting a child's movement by binding or tying him or her. (d) Inflicting mental or emotional punishment, such as humiliating, shaming, or threatening a child. (e) Depriving a child of meals, snacks, rest, or necessary toilet use. (f) Excluding a child from outdoor play or other gross motor activities. (g) Excluding a child from daily learning experiences. (h) Confining a child in an enclosed area, such as a closet, locked room, box, or similar enclosure. (i) Time out must not be used for children under 3 years of age.
There is insufficient evidence to determine that any physical discipline was used during the incident involving Child A on 12/14/2021. Of the six adults interviewed who all witnessed this incident on 12/14/2021, only Child A's mother reports Child A being held down by child care staff member Lauren Loop. Child A's forensic interview appeared to be coached by Child A's mother and could not be used as a reliable interview.
