Program director Kristy Miller submitted a written incident report regarding the incident that occurred on April 25, 2023. Ms. Miller stated that on April 25, 2023, Child A (male, age 6 years) and Child B (male, age 9 years) were outside with Child Care Staff Member 1 and Supervised Volunteer 1 along with approximately 20-21 school-age children at approximately 4:55 PM. Child Care Staff Member 2 was inside the center with one or two children who were finishing snack. While outside Child B's sister was playing with a ball that rolled away from her. Child A picked up the ball and Child B got angry and pushed Child A who fell into a fence and then onto the ground. Child A hit his head on the fence and the ground and had a scrape on his forehead and a puncture wound on the side of his head. Child A's Mother was walking into the room as Child Care Staff Member 1 was bringing Child A into the center. Ms. Miller stated that neither Child Care Staff Member 1 nor Supervised Volunteer 1 saw Child B push Child A, but Child B explained what happened. Child Care Staff Member 1 was interacting with a group of children while 2 Supervised Volunteer 1 was playing basketball with another group of children. Child A and Child B were standing on the pavement not far from the basketball hoop when the incident occurred. Child B feels terrible about causing injury to Child A and has been extremely well behaved and only plays with his sister since the incident. Ms. Miller stated that Supervised Volunteer 1 only works at the center in the afternoon to assist with the school-age children who arrive after school. Supervised Volunteer 1 no longer works at the center. Child Care Staff Member 1 stated that on April 25, 2023, she was outside with school-age children ranging in age from 6 years to 13 years of age when the children arrived at the center after school. Child Care Staff Member 1 stated that there may have been 30-35 children outside with her and Supervised Volunteer 1. Child Care Staff Member 1 stated that while outside she was talking with a group of children when Child A came over to her crying and stated that Child B pushed him into the fence. Child A had a bump on his head and cut on the side of his head. Child B was honest about what happened stating that he pushed Child A because Child A took his sister's ball. Child Care Staff Member 1 is not sure what Supervised Volunteer 1 was doing at the time of the incident and Child Care Staff Member 2 was inside either finishing up snack or cleaning. Child Care Staff Member 1 stated that the children were only on the paved area of the outdoor play area because it was raining earlier and the large grassy areas were wet. Child Care Staff Member 2 stated that she was inside cleaning up after snack and there may have been one or two children still inside having snack at the time of the incident between Child A and Child B. Child Care Staff Member 1 and Supervised Volunteer 1 were outside with school-age children. During the onsite inspection I observed the outdoor play area. There is a large partially fenced paved area in the front of the building with a basket hoop. There is also a very large grassy area on the side of the building. Ms. Miller stated that on the date of the incident the children were not allowed in the grassy area because it was extremely wet due to rain earlier in the day. I attempted to interview Child A's Mother but I did not receive a return call after leaving a voicemail message. I also attempted to interview Supervised Volunteer 1 but did not review a return call after leaving a voicemail message.

Program director Kristy Miller stated that the outdoor play area was in ratio on April 25, 2023, at the time of the incident between Child A and Child B. Ms. Miller stated that there are two child care staff members and one supervised volunteer who work with the school-age children. Ms. Miller stated that approximately 10-15 children arrive by bus from South Arbor Charter Academy at 3:28 PM. At 4:00 PM 20-21 children arrive at the center by bus from Milan schools. At approximately 5:00 PM when the incident occurred between Child A and Child B attendance records show that there were 35 school-age children ranging in age from 6 years to 13 years of age still present at the center. Approximately 20-21 school- age were outside with Child Care Staff Member 1 and Supervised Volunteer 1, while one or two children were inside with Child Care Staff Member 2 eating snack. Supervised Volunteer 1 does not count in the child care staff member to child ratio requirement. Therefore, the center was not following the required 1:18 child care staff member to child ratio.

It was reported that on April 13, 2023, Child Care Staff Member 1 informed Child A's Mother that Child A (female, age 10 months) almost rolled off the changing table. Child A's Mother stated that on April 13, 2023, at pick-up Child Care Staff Member 1 told her that Child A almost rolled off of the changing table, but Child Care Staff Member 1 caught her. When Child A's Mother arrived at the center Child A was sitting in a swing. Child A's Mother noticed a red mark on the right side of Child A's forehead but thought that the mark was a result of how Child A was positioned in the swing. On April 19, 2023, Child A's Mother received a phone call from Child Care Staff Member 2 who stated that she heard that Child Care Staff Member 3 witnessed Child A's fall off the diaper changing table. Child Care Staff Member 2 informed Child A's Mother that Child A completely fell off the diaper changing table and hit her head on a toy bucket on the floor as she fell to the floor. Child Care Staff Member 1 tried to break Child A's fall with her knee, but Child A still fell onto the floor. Child A's Mother stated that Child Care Staff Member 2 told her that she told Child Care Staff Member 3 to report what she saw to program director Kristy Miller. Child A's Mother called Ms. Miller to report what she was told by Child Care Staff Member 2. Ms. Miller told Child A's Mother that she would speak with Child Care Staff Member 1. After Ms. Miller spoke with Child Care Staff Member 1, she informed Child A's Mother that she would be demoting Child Care Staff Member 1 from her position as lead caregiver and moving her to a different classroom. Program director Kristy Miller stated that on Thursday, April 20, 2023, Child Care Staff Member 2 informed her of an incident with Child A rolling off the changing table while Child Care Staff Member 1 was changing her diaper. Child Care Staff Member 2 stated that Child Care Staff Member 3 told her that she saw Child A fall from the changing table and hit her head on a toy bucket on the floor. Child Care Staff Member 1 broke Child A's fall with her knee. When Child A's Mother picked up Child A, Child Care Staff Member 3 heard Child Care Staff Member 1 tell Child A's Mother that Child A "almost" rolled off the changing table. Child Care Staff Member 3 stated that it did not "sit right" with her that Child Care Staff Member 1 did not tell Child A's Mother the truth, so she spoke with Child Care Staff Member 2 about it. Ms. Miller spoke with Child A's Mother about the incident and informed her that Child Care Staff Member would be moving to a new classroom where she would no longer be a lead caregiver. Child A has not yet returned to the center until Child Care Staff Member is removed from the classroom. Ms. Miller stated that Child Care Staff Member 1 told her that she caught Child A while Child A was falling and Child A did not land on the floor. Child Care Staff 3 Member 1 stated that Child A landed on her knee as she was falling off of the changing table. Child Care Staff Member 1 stated that on April 13, 2023, she placed Child A on the changing table. While Child A was laying on the table Child Care Staff Member 1 kept one hand on her. Child Care Staff Member 1 heard a child scream, so she turned to look. As she turned back to the changing table, she saw Child A rolling off the table, so she caught her with her knee. Child Care Staff Member 1 said she did not know how Child A rolled although she kept her hand on Child A. Child A cried for a few minutes, but she did not have any marks. Child Care Staff Member 1 stated that Child A did not fall all the way on the floor. When asked why Child A cried Child Care Staff Member 1 responded "because she was scared, or I don't know." Child Care Staff Member 1 stated that she did not see a red mark on Child A's forehead, so she did not make an incident report. Child A's Mother stated that when she picked up Child A on April 13, 2023, Child Care Staff Member 1 told her that Child A "almost" rolled off the changing table but that she caught her. Child A's Mother stated that she saw a red mark on Child A's forehead but assumed that it was because of the way that she was sitting in a swing. Child A's Mother later learned that Child A fell to the floor from the changing table and hit her on the way down. Child A's Mother did not receive a report regarding Child A falling to the floor. Ms. Miller stated that she spoke with Child Care Staff Member 1 and informed her that Child A's Mother was upset because she was misinformed about the incident with Child A. Ms. Miller told Child Care Staff Member 1 that if Child A hit her head, she should have notified Child A's Mother as the center's accident/injury policy states so she could have had the opportunity to get medical attention if she wanted to. Ms. Miller stated that she completed an incident report when was made aware of the incident. Child Care Staff Member 1 stated that when Child A began to roll off the changing table, she caught her with her knee. Child Care Staff Member 1 stated that she is not sure if Child A hit her head on the cabinet when she was falling but that Child Care Staff Member 1 caught Child A with her knee. Child Care Staff Member 1 stated that she did not see a red mark on Child A's head. Child Care Staff Member 3 stated that she is aware that she is supposed to make a report to Ms. Miller if she sees an accident or incident, but she was afraid of retaliation from Child Care Staff Member 1. Child Care Staff Member 3 stated that it was making her "physically sick" to not say anything about the incident so she eventually told her about it a week later after speaking with Child Care Staff Member 2. During the onsite inspection I reviewed the center's incident and accident policy which states that parents will be notified on any accidents or injuries to the head or that leave marks or bruises by using a written incident report. Parents will be called immediately for serious injuries.

On February 3, 2021, I spoke to complainant. Complainant reported discussing concerns in November with the program director regarding children not wearing mask. On January 24, 2021, complainant was informed by a child care staff that some classrooms were closed for quarantine at the child care center due to a COVID outbreak. Complainant was told by the child care staff that an email update would be sent but to date complainant has not received an email or information regarding the positive COVID cases from the program director. On February 9, 2021, I completed an unannounced on-site inspection at the child care center. I interviewed program director, Kristy Miller. Ms. Miller stated that she 2 initially notified families on January 23, 2021, of two children testing positive for COVID, and the closure of two classrooms for quarantine. Ms. Miller stated that she notified the Washtenaw County Health Department, and they recommended the closure of the two affected classrooms, and not the entire child care center. Ms. Miller notified the families a second time on January 29, 2021, informing them the child care center would close for 14 days, as additional children tested positive for COVID. All the families were notified through email and were provided resources and recommendations by the Centers for Disease Control and Prevention. Notices were also posted at the child care center. Ms. Miller stated that she did receive a return email message error that an email could not be delivered to one of the families. On February 9, 2021, I reviewed copies of the emails and posted notice provided to families. I informed Ms. Miller that I was not notified of the positive COVID cases, as recommended by the Licensing and Regulatory Affairs Guidelines for Safe Child Care Operations During COVID-19. Ms. Miller stated that she was not aware that she needed to notify child care licensing. Ms. Miller did provide me with all of the information regarding children and staff with positive COVID results. On February 24. 2021, I spoke to Child A &B's Mother, Child C's Mother and Child D's Mother. They all stated that they received two notifications and information regarding the positive COVID cases at the child care center, including classroom and child care center quarantine.

MCL 722.120 Investigation, inspection, and examination of conditions, books, records, and reports; access by department, bureau of fire services, or local authorities; records; report; forms; confidentiality; disclosure of information; availability of confidential records; child information cards to be provided to department; failure of licensee to cooperate with investigation, inspection, or examination. (3) A licensee shall keep the records the department prescribes regarding each child in its control and care and shall report to the department, when requested, the facts the department requires with reference to the children upon forms furnished by the department. Except as otherwise provided in this subsection and subsection (4), records regarding children and facts compiled about children and their parents and relatives are confidential and disclosure of this information shall be properly safeguarded by the child care organization, the department, and any other entity in possession of the information. On November 13, 2020, an anonymous complaint was received. The allegations stated that child care staff, Rachel Bachman, posted videos of children on Snapchat, which is a social media website. On November 16, 2020, I completed an unannounced on-site inspection. I individually interviewed licensee designee and program director, Kristy Miller, and child care staff, Rachel Bachman. Ms. Miller stated that she was not aware of any 2 child care staff posting videos of children on their personal social media accounts. Ms. Miller also stated that the child care center does have a social media policy that parents have signed and only allow pictures of children to be posted to the child care center's websites for promotional reasons. The policy prohibits child care staff from taking pictures or posting pictures of children on the internet without parental permission. On November 16, 2020, I interviewed Rachel Bachman. Ms. Bachman stated that she did post videos of children on her personal Snapchat page. She stated that she was aware of the center's social policy. She thought the children in her classroom were cute as they were taking their naps and posted a video of them on her Snapchat page. I reminded her that she must always maintain confidentiality of children's identity and personal information. I also informed her of potential legal consequences for not maintaining confidentiality. She stated that she understood and agreed to follow the policy. I conducted the exit conference with Ms. Miller and discussed the findings. Ms. Miller completed a corrective action plan. Ms. Miller will review the social media policy again with child care staff and have them sign that they understand and agree to the policy. The policy will also be updated to include disciplinary actions if the child care staff do not adhere to the policy.
