Child A was not allowed to sleep on demand. Child A just turned 12 months old. All of the child care staff in the infant room consistently reported that Child A was difficult to get down for a nap, that he cried consistently from between thirty minutes and two hours, as reported by various staff. Child A was not conforming to the nap time schedule, however due to his age he does not have to and must be provided with other quiet activities.

On 06/14/2023 I conducted an onsite inspection. I asked to speak to the program director and was ushered into an office where I spoke with Child Care Staff Member (CCSM) 1, informed her of the complaint and of my need to conduct interviews with staff and collect and review records. I requested the employee handbook, board meeting minutes from February and April, and by-laws for the board of directors. I interviewed nine child care staff members (CCSM) one by one individually in a break room regarding their experiences and observations of CCSM 10. CCSM 1 did not know where CCSM 10 was at, only that CCSM 10 was placed on administrative leave, CCSM 1 was not told why. The last day that CCSM 10 was physically present at the center was on 05/26/2023. CCSM 1 did not have observations of CCSM 10 to share. There is a new board of directors this year, the communication has been poor. I was provided with information for the president of the board. CCSM 2 confirmed what CCSM 1 said and shared the same thing. I clarified that CCSM 10 was still employed and had not been let go, just that she was on a leave of absence. CCSM 2 was asked to send the by-laws to a human resources employee hired by the board of directors. CCSM 2 was informed by CCSM 1 that CCSM 10 would be out of the office. CCSM 2 did not have any observations to share regarding CCSM 10. CCSM 3 is a new employee who works in CCSM 10's classroom in the afternoons sometimes. CCSM 3 said the experience with CCSM 10 depends on the day, some days are fine and other days CCSM 10 handles things differently. CCSM 3 has seen CCSM 10 treat children and staff differently, she said it is subtle and not "in your face." CCSM 3 provided the example that if two children were doing the same age- appropriate activity as running or being too noisy, CCSM 10 would discipline Child A (3 years, 5 months/male) more harshly. CCSM 10 has favorite children. CCSM 3 has observed CCSM 10 humiliate and shame Child A on the playground by removing him from the group and making him sit on the step for the entire time while nothing would happen to another child engaged in the same behavior. CCSM 10 has no patience with staff and expects staff to know everything, even when new. CCSM 3 does not have any interactions with the board of directors. CCSM 4 has worked at the center for eight years and is familiar with CCSM 10. She has subbed in that classroom before and sometimes at the end of the day her classroom will join with CCSM 10's classroom. Her classroom experience has been fine. When CCSM 4 was first hired CCSM 10 did not seem very nice, but since their last director left, CCSM 10 has been fine. CCSM 4 has not observed CCSM 10 to have done or said anything inappropriate regarding children in care or staff. She is familiar with Child A because he was recently moved into her classroom. She was told Child A was ready to move up and nothing else. CCSM 4 was not aware that CCSM 10 was on a leave of absence. Nothing was communicated to staff about CCSM 10's absence. 4 CCSM 5 has worked at the center for three years and spent her first two years in the classroom with CCSM 10. CCSM 10 is described as "pretty rough." CCSM 5 indicated she was one of CCSM 10's favorites, so she was not treated as poorly as she has seen some of the other staff treated. CCSM 5 has observed CCSM 10 put a child in a chair harshly and get in his face and yell due to nonstop crying. CCSM 5 has observed CCSM 10 to treat children of ethnicities different than hers with less empathy, and unfairly in comparison to their counterparts. CCSM 5 could not give an exact date or time, but this school year Child A was caught tearing a book. CCSM 10 called all the children over and made direct eye contact with Child A and publicly shamed Child A by singling him out and yelling at him in front of the group and then making him sit in the book area in front of his peers. CCSM 5 has seen CCSM 10 red in the face and breathing heavily in frustration with childr

During the course of this investigation it came to the attention of the Child Care Licensing Bureau (CCLB) that a completed 001 form and credentials for the proposed program director had not been submitted for review and approval before making an offer of employment to the proposed program director.
