There is insufficient evidence that Mandy’s Daycare violated care and supervision of children in care. Interviews were conducted with Licensee, Child Care Staff Member 1, MiLEAP Child Daycare Consultant and parents. There were no concerns with the quality of care being provided.

On 03/09/2021, I spoke with the complainant who stated Mandy Gower, licensee, and the other staff members do not supervise the children properly. Child A (female, 3.5 years) attends the child care home and a truck was thrown at her on one occasion. According to what Child A told the complainant, she has bruises on her legs stemming from Child B (male, 3.5 years) and from Child C (female, 3.5 years), however she did not state exactly how she got them. There are bruises on Child A's legs. Child B and Child C also kick, punch and pull her hair. The complainant does not talk to Child A's mother but believes it is happening at the child care home. On 03/09/2021, I received a photo of Child A, who had a bruise on the back of her upper right thigh and a linear faded bruise on the front of her left thigh above her knees. On 03/11/2021, I attempted a phone call to Child A's mother. I left a message for her to contact me. On 03/16/2021, I had an onsite inspection with Mandy Gower. I also met with the child care staff members, Jessica Butts and Jennifer Southworth. Per Ms. Gower, Child A does currently have bruises on her but she does not know what happened to her. The bruises are primarily on her legs and did not get there at the same time. Ms. Gower does not think any of the bruises she has had is or has been abuse or neglect, nor does she think she received them at her facility. Child A has never told her or her staff she was hurt recently. Child A is very independent so she uses the bathroom by herself and Ms. Gower did not see the bruise that is on her upper thigh. She does not remember her falling or getting hurt at the child care home. On 03/08/2021, Child A's father did accuse her of not supervising Child A. Child A, Child B and Child C are all the same age. They play together but they also fight or sometimes will pull someone else's hair or throw a toy. Child C did throw a truck at Child A at hit her the other day. They intervene when they can but sometimes the action happens to quickly. She is aware that Child A's father does not want her to attend child care because he wants more visiting time with her. Child A's mother has physical custody and Child A's father has visitation and does not want her to be in child care at all, as he would like additional time with her. I met with Ms. Butts, who has been working at the child care home since August, 2019. She is not aware of how Child A received any bruises on her legs. Child A as not complained recently about getting hurt nor has she fallen. All of the children play around with each other. Child A and Child C do play together and most of the time it is normal play. I met with Ms. Southworth. She is aware of the bruises on Child A but states she does not know how she got them. She has never complained about anyone hitting or throwing something at her that would bruise her legs. She has not seen any other 4 child hit Child A. All of the children play together and sometimes they fight. On 03/23/2021, I spoke with Child A's mother. She does not even believe the bruises came from being at child care but does not know how she got them. She is the biggest child at Ms. Gower's child care home, asked to go there and has fun. She said sometimes Child A is aggressive to the other children and sometimes they are to her but it is nothing out of the ordinary. Child A's father does not want her to take Child A to child care at all and very much against Child A attending Ms. Gower's home child care. Ms. Gower is in frequent contact with her if there are any concerns that come up at the child care home so she is not concerned. On 04/28/2021 I spoke with Child B's mother and Child D's (male, 4 years) mother. On 04/29/2021, I spoke with Child E's (male, 2 years) mother and Child F's (male, 2 years) mother. Parents had no issues or concerns. On 04/29/2021, I had an exit conference with Ms. Gower. I let her know I did not find any rule violations. On 04/30/2021, I spoke with Child C's mother. She has
