R 400.8213(1)(a) · R 400.8213(1)(a) Staff; volunteer (1) All staff and volunteers present at the center shall: (a) Provide appropriate care and supervision of c hildren at all times.
Allegations of care and supervision were investigated. The licensee, PA, Lead Teacher, Teacher 1, Teacher 2, Witness 1, Witness 2, and Child A's Mother were interviewed. Video footage was observed. Interviews with the licensee, PA, Lead Teacher, Teacher 1, Teacher 2, Witness 1, Witness 2, and Child A's Mother and the video footage support the allegation that appropriate care and supervision was not provided to Child A on 10/09/2025 when she was left unsupervised on the playground from 11:56 a.m. to 12:00 p.m. by Longview Early Childhood Center teachers.

There are no findings that Longview Early Childhood Center utilized prohibited punishment of physical discipline. Interviews were conducted with Program Director, Child Care Staff Members, Law Enforcement, and parent. Parent had no concerns with quality of care.

On 03/04/2022 I completed an onsite inspection . Licensee designee/program director Ms. Kimberly Clark reported that the center has a high percentage of children with special needs. They 2 utilize weighted blankets and "pressure points" to calm children. Ms. Clark also reported that prior to this there have not been any complaints regarding Mr. Zinger. We interviewed Child A (female, years) on 03/04/2022. Child A did not pass forensic interview protocol truth verses lie. When asked if it was snowing in the room Child A stated "yes". We were able to establish that Child A knew the difference between right and wrong and Child A agreed to only talk about the truth in the interview. Child A was easily distracted and did not initially want to come into the room or be interviewed. She did eventually get comfortable and was able to do the interview. Child A stated "(Mr. Zinger) puts me on my tummy and pushes on my back". When asked where on her back Mr. Zinger pushes Child A responded, "pushes on the top". When asked what it feels like Child A responded," it hurts". Child A also made statements that Mr. Zinger "lays on me at nap time". And "two hands pushes on my back". Child A did not want to return to her class after the interview. Child A continually asked is she could stay in the room with us instead. When asked why Child A stated she didn't want to take a nap. When asked what else she can do during nap time such as books or puzzles; Child A reported "no" they" have to sleep". 0 We forensically interviewed Child B (male, years months) on 03/04/2022. Child B passed all the forensic interview protoco s. Child stated, He (Mr. Zinger) "lays on me, on my cot, it hurts." Child B clarified that Mr. Zinger "lays on" Child B's back while Child B is laying on his stomach on the cot. When asked, Child B reported that he told other child care staff members in the room about Mr. Zinger. Child B reported that he sometimes doesn't like Mr. Zinger, when Mr. Zinger lays on him. Other times Child B likes Mr. Zinger. Child B told his father that Mr. Zinger lays on him but his father didn't believe him and said he was "fibbing". Child B was asked if Mr. Zinger touches any other body parts. Child B responded "no". Child B reported he saw Mr. Zinger "lay on" another child in the room at a different time. Child B was asked if children are given books or other quiet things to do if they don't sleep during rest time. Child B reported they are not given other things. They all have to lay down and sleep. Child care staff member 1 (CCSM 1) was interviewed on 03/04/2022. Ms. Bruns advised CCSM 1 of the allegations. CCSM 1 reported she is in the room during nap time when Mr. Zinger is there. Nap time is from 12:30-3:00pm. Typically there are three child care staff members during nap time but starting this week they will have five. The staff members rotate around the room and "rub backs" to help children fall asleep. Some children do better for certain staff members over other staff members. CCSM 1 reported that she has not seen Mr. Zinger do anything inappropriate with children when she is in the same room with him. Child A reported to her that Mr. Zinger "lays on her" and Child A keeps asking if Mr. Zinger is coming today. No other children have expressed concerns, but some do ask if Mr. Zinger is coming. CCSM 1 reported she has observed Mr. Zinger do something that she doesn't feel comfortable with. Mr. Zinger "lays his legs across the children's backs or over their legs". CCSM 1 stated she doesn't feel he does this to hurt the children or "pin them 3 down". CCSM I reported Mr.. Zinger does this to "calm children", When asked CCSM 1 responded she did not share this concern with Ms. Clark or anyone else. None of the other child care staff members do this. CCSM 1 reported she has never received training on using "pressure points" or other techniques to be used with children who have special needs. Program director Ms. Clark, Ms. Zinger, child care staff member 1 and child care staff member 2 all stated the center uses "pressurepoints" therapy with the children in care because they have , and it helps calm them. Child A, Child B, and Child C do not have anything in their records that indicated "pressure points" therapy was recommended for the children. Additionally, none of the child care staff members were trained in the proper use of this therapy.
