On 06/10/2022, I initiated the special investigation by conducting a telephone call with licensing consultant Mike Skonieczny, who completed a renewal inspection on 05/04/2022. Additional information was gathered regarding the findings at the renewal onsite inspection relevant to the current allegations. On 06/14/2022, I conducted on unannounced onsite inspection along with licensing consultant, Tania Allard. Due to the allegations regarding capacity violations, a walk- through inspection was completed upon arrival. Initially, I observed the licensee and 2 another child care staff member caring for eight children on the main level of the home. Upon inspecting the lower level of the home, I discovered a child care staff member caring for nine children alone in the basement. I then explained to the licensee, Ms. Nieman that she is over capacity and that five children would need to be picked up in order for the group child care home to be in compliance with capacity. Ms. Nieman began calling parents to come pick up their children. Ms. Nieman claimed that parents who were not scheduled to drop off their children had arrived unexpectantly and she allowed it, which caused her to be over capacity and out of ratio. The mats used for napping were observed to be clean and in good condition. I observed children napping on clean mats in the living room upon my arrival. The group child care home did not smell of smoke and there was no evidence found that smoking or vaping was occurring in the group child care home. I then met with and interviewed child care staff member, Brooke Jones. Ms. Jones has been employed at the group child care home since October 2021. She admits that there have been times that they have cared for more than 12 children at one time. Ms. Jones was not aware that they were only allowed to care for 12 children at a time. Ms. Jones admits that she was currently caring for nine children in the basement alone. Ms. Jones was aware that she can only care for six children at a time. Ms. Jones denies that she or anyone else smokes or vapes in the group child care home. She has never smelled smoke or seen evidence of anyone smoking or vaping on the premises. Ms. Jones denies that the children sleep on unclean mats. I then met with and interviewed child care staff member, Emma Somerville. Ms. Somerville has only worked at the group child care home for two days. Ms. Somerville was unaware of the rules regarding capacity or ratio. Ms. Somerville was educated on the rules regarding the capacity being limited to 12 unrelated children and the ratio being 1:6. Ms. Somerville denies that anyone smokes or vapes in the group child care home. She denies smelling any smoke or evidence of smoking in the group child care home. Ms. Somerville denies that the children sleep on unclean mats. I then met with and interviewed the license, Ms. Nieman. Ms. Nieman denies that anyone smokes or vapes on the premises. Smoking is not allowed in the home or on the premises. She has never smelled smoke or caught anyone smoking or vaping in the group child care home. Ms. Nieman reports that children do not sleep on unclean mats and that the mats are cleaned using the three-step process after each use. Ms. Nieman admits that she is over capacity and that it was unintentional. She reports she has a hard time telling parents "no". She did contact three parents to come pick up a total of five children. Ms. Nieman was asked to provide her attendance records and she could not provide them. Ms. Nieman reports she does not keep attendance records on a daily basis. Ms. Nieman was educated on the requirements of keeping daily attendance records which includes first name, last name, date, time in and time out. Ms. Nieman was reminded that the ratio is 1:6. The licensee failed to have dated daily attendance records during the unannounced onsite inspection on 06/14/2022. The licensee claimed she was unaware that she had to keep dated daily attendance records that included the children's name, date and time of arrival and departure. On 06/16/2022, during a follow up inspection, the licensee had begun keeping dated daily attendance records on file.

On 06/14/2022, the group child care home was over capacity and had 17 unrelated children in care upon my arrival for an unannounced onsite inspection. The group child care home is licensed for 12 unrelated children and was found to be over capacity.
