    R 400.1903 · R 400.1903 Licensee responsibilities. (1) A licensee shall be responsible for all of the following: (a) When the child care home is in operation, the licensee shall be present in the home on a daily basis and provide direct care and supervision for the majority of time children are in care, except for any of the following circumstances: (i) Vacation or personal leave, which must not exceed 20 days within a calendar year. The 20 days of vacation or personal leave means the licensee is absent the entire day or at least 51 % of the day when the child care home is operating. A licensee may have a short periodic absence from the home. (ii) Medical treatment and subsequent recovery.

    On 07/28/2023, the special investigation was initiated by contacting the assigned licensing consultant, Tania Allard via telephone and an interview was conducted. Ms. Mettert does not currently have any assistant caregivers. The last renewal inspection was completed by Ms. Allard and area 2 manager Rose Rafferty. Ms. Mettert was the only caregiver present and there were not six infants being cared for. On 07/31/2023, I conducted an unannounced onsite inspection at Bobbie's Day Care. I met with the licensee, Roberta "Bobbie" Mettert and an interview was conducted. Ms. Mettert does not have any assistant caregivers or any other child care staff members. There is not an 11-year-old or 13-year-old working at her family child care home. The last time she had another child care staff member was approximately five years ago. Ms. Mettert did recently have two former children who she provided care for in the past request to come visit as they missed her and the children. The two former children; Child A (female, age 11) and Child B (male, age 13) did not provide care to any of the children and were never left alone with the child care children. Child A and Child B have never changed diapers or fed the children in care. Child A and B did play with the children while she was providing direct supervision. Ms. Mettert has never been upstairs sleeping while Child A and Child B were in her home visiting. Ms. Mettert reports that when Child A and Child B visited, she remained within ratio and capacity requirements at all times. Ms. Mettert only has one infant enrolled in care at this time. Ms. Mettert has one toddler enrolled at this time. The rest of the children are preschoolers. I observed Ms. Mettert to be within ratio and capacity at the time of the unannounced onsite inspection. I reviewed Ms. Mettert's child information cards of all of the children enrolled and there is only one infant, one toddler and six preschoolers enrolled in care. On 07/31/2023, I attempted to contact Child A and Child B's mother and there was no answer. A voice mail message was left requesting a return phone call. On 07/31/2023, I received a telephone call from Child A and Child B's mother and an interview was conducted. This summer she decided that Child A and Child B were getting too old to attend child care so she kept them home. However, Child A and Child B missed attending Bobbie's Day Care and she reached out to Ms. Mettert to see if they could come visit and Ms. Mettert allowed them to do so. Child A and Child B have gone to Ms. Mettert's family child care home a few times this summer. They are not employed as assistant child care providers. Child A and Child B have not provided care to infants or to any other child. Child A and Child B have never been left alone while Ms. Mettert was upstairs sleeping. Child A and Child B have not changed diapers or fed any children. Child A and Child B were only visiting their former child care provider as they missed her and the children. She would never allow them to go and do Ms. Mettert's job for her as they are not qualified or interested in doing so, nor would she allow it. On 09/08/2023, I contacted Ms. Mettert via telephone and an exit conference was held. 3
