722.115m(2) Child care center, group child care home, or family child care home; requirements for licensure; disclosure of ownership interest. A person, local or state governmental organization, trust, or legal entity shall not establish or maintain a child care center, group child care home, or family child care home unless licensed by the department. Application for a child care center, group child care home, or family child care home license must be made on forms provided, and in the manner prescribed, by the department, including the fees required under subsection (11). Before issuing or renewing a child care center, group child care home, or family child care home license, the department must investigate the applicant's activities and proposed standards of care and must make an on-site visit of the proposed or established child care center, group child care home, or family child care home. Except as otherwise provided in this subsection and sections 5q and 5r, if the department is satisfied as to the need for a child care center, group child care home, or family child care home, as to its financial stability, and that the service, facility, applicant, licensee, child care staff member, or member of the household is conducive to the welfare of the children, the department shall issue or renew the child care center, group child care home, or family child care home license. If the department determines that a service, facility, applicant, licensee, child care staff member, or member of the household is not conducive to the welfare of the children, the department shall deny that application or revoke that licensee's license according to section 11.

On January 2, 2024, I received the complaint that Sydney LaDere is providing child care to unrelated children at her home. This is the third compliant made regarding unlicensed care being provided. The first complaint, SI2023D0206012, was completed August 11, 2023. I reviewed the document returned to the department signed July 7,2023, by Sydney LaDere indicating, "I have been caring for unrelated children, will not provide for more than 4 weeks" and "I have been caring for 1-6 and will not earn $600 annually." The second complaint, SI-00081118, was received on September 14, 2023. On September 19, 2023, during an unannounced inspection, Sydney LaDere was not observed at her home providing care to unrelated children. On October 6, 2023, the department received a returned document completed and signed by Sydney LaDere indicating "I have not been caring for unrelated children in my home." The second report was completed on October 23, 2023, with no evidence that Syndney LaDere is providing unlicensed child care. On January 2, 2024, I made email contact with the referral source requesting further information, such as, parents contact information. She reported she does not know any of the parents that take their children to Sydney LaDere for child care, but that Syndney LaDere posted pictures on Facebook on December 29, 2023 and she appears to have up to 14 children in her care including infants and toddlers. I reviewed the pictures provided and they appear to be old, as the children are wearing short sleeves and shorts. On January 4, 2024, I completed an unannounced onsite inspection. Sydney LaDere was not home and there were no unrelated children observed at her home. While onsite I made telephone contact with Syndey LaDere. She reported she was at and appointment with her daughter, but is not providing child care from her home. She reported she has applied for a license at the home she is building, but the home will not be done until Spring at the earliest. I asked about the photos posted on Facebook, and Syndney LaDere stated they were pictures from the entire year because it was a “year in review” post. She said she does watch her nieces sometimes but does not provide care for any unrelated children. On January 24, 2024, I received a returned document completed and signed by Sydney LaDere indicating "I have not been caring for unrelated children in my home." RULE/STATUTORY VIOLATIONS: 611 W.
