(2) A licensee, licensee designee, or program director shall report to the child's parent and the department, directly or 7 via phone, fax, or email, within 24 hours of the occurrence of any of the following: (b) An incident involving an allegation of inappropriate contact.
On 3/8/2023 I spoke to Child A's Mother. Child A's Mother informed me that Child A has been attending the child care facility for almost three years. She informed me that outside of this incident, there have been no other concerns regarding the care and supervision of the child care children or the Child care staff member(s) (CCSMs) informing her of concerns/incident reports. Child A's Mother reported that Child A "loved to go there," but stated this changed during the last month. Child A's Mother denied being aware of the date in which the incident was thought to have happened, but advised it was over a month ago. Child A's Mother stated that Child A disclosed the allegations after she was talking with him and attempting to reassure Child A that he could tell her "anything he ever needed to talk about." Child A's Mother reported that after she made this statement, Child A began to make the disclosure that while he was at the child care facility, Education Station, Child B Child A's Mother continued to ask ouestions, and discovered t at t is occurre , and stated Child B Child A's while t ey were p a in near the Barbies. s Mother stated that Child A ten informed her that , but it makes me feel sad and angry." Child A's Mother noted that in the disclosure, Child A reported that the CCSMs observed this occur, and they "got angry and they gave him a thinking time." Child A identified the workers at the facility as CCSM1 and CCSM2, but Child A's Mother denied ever being informed of the incident. Child A's Mother stated that she has not returned to the child care facility since the allegations were reported, and that she had recently met with "State Trooper" regarding the incident. She advised that the State Trooper directed her not to have Child A return to the child care facility or inform them of the trooper's involvement until he was able to conduct interviews. Child A's Mother could not recall the identity of the State Trooper, which department he worked for, or the incident report that was provided to her. 3 On 3/16/2023 I made and onsite inspection at the child care facility. During the inspection I interviewed the Program Director for the Education Station, Ms. Carey Kruger. Ms. Kruger stated that the incident concerning Child A and Child B was never reported to the department, due to them having no previous knowledge of the concern. Ms. Kruger stated that they did not know about the alleged incident until 3/8/2023 when the State Trooper arrived at the child care facility to conduct interviews with the CCSMs. Ms. Kruger denied believing the incident occurred at the child care facility, stating she believed the CCSMs would have witnessed it if it had occurred. Ms. Kruger also reported that the Child A and Child B rarely play with one another. Ms. Kruger also noted that while there wasn't a definitive time provided by Child A's Mother as to when the incident occurred, there was a period of three weeks where Child B was not present in the child care facility. At my request, Ms. Kruger also searched the ProCare app to determine if there were any incident reports drafted for either Child A or Child B from the 1/01/2023 through the current day. There were no incident reports for either child during this timeframe. Ms. Kruger reported that Child A has not returned to the child care facility since the allegations were reported to law enforcement, but reported that this was due to financial reasons. Ms. Kruger also noted that the State Trooper advised that he suspected the incident occurred at Child A's temporary residence, which was noted to be a shelter. Ms. Kruger informed me that both CCSM1 and CCSM2 would be present at the child care facility on 3/20/2023. On 3/20/2023 I conducted a follow-up onsite inspection at the child care facility. During the inspection, I interviewed CCSM1 and CCSM2. CCSM1 reported that she has been employed at the child care facility for approximately one year, and that she was the lead CCSM in the toddl

During my interview with Ms. Kruger in a fully enclosed room, CCSM3 was overheard aggressively yelling at her child care children for a period that exceeded 10 minutes in duration. The form of redirection being used by CCSM3 is not regarded as a positive method of discipline that would promote self- control/direction/esteem.

(1) Pursuant to section 5n of the act, MCL 722.115n, before an individual has unsupervised contact with children, the department shall determine the individual's eligibility to be any of the following: (c) A child care staff member.
On May 12, 2022, I received an allegation that child care staff member, Anselma Barnett, for unknown reasons, could not be around children at the center unsupervised. I immediately logged into the Child Care Background Check System (CCBC) to see if Ms. Barnett had been affiliated as a child care staff member at the center. Ms. Barnett had been determined eligible by the department and was affiliated with the center since April 7, 2022. Then I logged into MiRegistry to see if Ms. Barnett had completed the required trainings in MiRegistry before having unsupervised contact with children and could see that Ms. Barnett had completed Parts 1 and Parts 2 in MiRegistry on August 6, 2020. Those trainings included training in the prevention and control of infectious diseases, including immunizations, which is required before unsupervised contact with children. On May 12, 2022, I contacted the Complainant by telephone, and she stated that she had spoken with Program Director, Ashley Barringer, since the complaint was made and believed it was just a situation of miscommunication. The Complainant stated that Ms. Barnett had been forgetting to document diaper changes and feedings in their online system, so Ms. Barringer wanted another person with Ms. Barnett to be sure that procedures were followed in the center. On May 13, 2022, I made an unscheduled inspection to the child care center and spoke to Program Director, Ashley Barringer, and child care staff members, Ms. Barnett, and Emily Bush about the allegation. Ms. Barringer stated that Ms. Barnett has been employed for the child care center since the beginning of April 2022, and that she was determined eligible in the Child Care Background Check system before she was ever unsupervised with children. Ms. Barringer provided me with a copy of Ms. Barnett's employment file. I reviewed it and saw her negative TB test, signed abuse and neglect policy, Consent & Disclosure form to authorize fingerprinting in the CCBC system, Infant, child, and adult CPR and first aid training, and a signed orientation form to acknowledge that she had training in the center's policies and practices and the child care administrative rules. Ms. Barnet's employment file was complete. Ms. Barringer stated that Ms. Barnett did have an issue with remembering to log things such as infant and toddler feedings and diaper changes into the online system they use called ProCare and that was a concern for a couple of parents, so Ms. Barringer did want to have Ms. Barnett partnered with another child care staff member in the room until Ms. Barnett got into the habit of remembering the procedures. She denied any other concerns with Ms. Barnett's performance and said she is permitted to work unsupervised in the center. Ms. Barnett said she began working for the child care center one or two months ago and there were a few days when she first started training that she could not work unsupervised because they were waiting for the results of her fingerprints but she has been working unsupervised in the center since she was determined eligible by the department. I asked Ms. Barnett if there was any reason why someone might think she could not be unsupervised with children and she said maybe someone 3 overheard her telling that story to someone else. Ms. Barnett said, "As far as I know, I can be in a room alone with children." She acknowledged that there were a couple parents who complained one day because she forgot to document diaper changes in the ProCare system. She said there was another day when a parent arrived while she was transitioning children and complained that they were a "little rowdy." Ms. Barnett said that Ms. Barringer spoke to her about it and the procedures were reviewed with her. Emily Bush is the lead caregiver in the Wobbler Room that Ms. Barnett works in.
