I interviewed Ms. Cass, license designee. She stated that Child A's Mother emailed the program director, Ms. Cutsinger on 2/16/23. Child A's Mother expressed worry that Child Care Staff Member 1 (CCSM 1) squeezed Child A's leg, it hurt, and it made her cry. Child A was not injured. Based on this concern, Ms. Cutsinger investigated the matter by reviewing the room's video footage. The video footage did not face the area of the room where Child A was located. Ms. Cutsinger also spoke with CCSM 1 and Child Care Staff Member 2 (CCSM 2). CCSM 1 is a substitute child care staff member. CCSM 1 denied that she touched Child A's leg. CCSM 1 did say that she moved Child A from under her arms to turn her over on her cot, but that she did not hurt Child A. CCSM 2 did not see or hear the incident. Ms. Cutsinger then contacted Ms. Cass regarding the situation. Ms. Cass believes that she was contacted the end of the day on Friday 2/17/23. Based on the initial investigation by Ms. Cutsinger, Ms. Cass wanted to wait to meet with Child A's Mother to gain additional information before making formal report to the department. Despite this, Ms. Cass told Ms. Cutsinger that moving forward, she needed to be contacted immediately regarding these types of concerns to be able to assist and to be able to notify the department. Ms. Cass met with Child A's Mother on 2/22/23. Child A's Mother did not want CCSM 1 fired. Child A's Mother wanted a third party to review the incident. As such, Ms. Cass stated that she notified the department the same day that she met with Child A's Mother. Ms. Cass stated that she has worked alongside CCSM 1 in the past in an administrative role as well as observed her in the classroom. There have not been any previous concerns or complaints regarding CCSM 1's treatment of the children. Ms. Cass has not witnessed any negative interactions between CCSM 1 and the children, saying that she has only witnessed positive interactions. She stated that the children in care like CCSM 1. I interviewed Child A's Mother. She stated that she did not pick up Child A from care on 2/16/23. When Child A got home, she could tell that she had a rough day and that she looked tired. Child A told her that she had a bad day. Child A told her that she was acting up at nap time and that CCSM 1 grabbed and pulled her leg and that it hurt. Child A did not have any marks or bruises. Child A said that CCSM 1 was mad at the time. Child A's Mother stated that she was trying to understand the context of what happened. Upon further questioning, Child A also told CCSM 1 that it hurt, but that she did not tell anyone else. Child A's Mother emailed the center. The next day, Child A brought it up again. Child A's Mother asked her to demonstrate what happened. Child A put her hands down on the floor and put one leg in the air while facing the floor. Child A stated that she was awake and that it was not a dream. Child A's Mother stated that she met with Ms. Cass and Ms. Cutsinger. She was told during the meeting that CCSM 1 turned her around on her cot, but what they 3 described did not match what Child A told her. As such, she wanted a third party to look into the situation. Child A continues to attend the center. Child A's Mother does not believe that CCSM 1 had malicious intent. In addition, Child A has not disclosed any previous concerns, and Child A normally likes attended the center. Child A is normally happy being in care. Child A struggles with transitions, so the recent staffing changes have been difficult for her. Child A also struggles with rest time, and it is difficult for her to settle her mind and is not consistent with falling asleep. I completed an onsite inspection to the center. I interviewed Ms. Cutsinger, program director. Ms. Cutsinger stated that Child A attends the preschool room. CCSM 1 works as a floater. Ms. Cutsinger stated that she was first contacted by Child A's Mother on 2/16/23. Child A told her mother that CCSM 1 grabbed and pulled he

I interviewed Ms. Cutsinger, program director. She did not witness the incident. She was emailed by two witnesses. The witnesses indicated that Child A was sitting on the floor with her back against the lockers facing the child care room. Child Care Staff Member 1 (CCSM 1) reached out to Child A, held her hand, and pulled up. CCSM 1 looked as though she was trying to get Child A to stand up. When Child A resisted, CCSM 1 began to pull her across the floor to the classroom. Child A was still resisting, and CCSM 1 continued to drag Child A by her arm to the classroom and close the door. CCSM 1 was observed standing in front of the window of the classroom when they walked past the room. Ms. Cutsinger stated that she contacted the witnesses as well as forwarded the information on the center's administrators. Ms. Cutsinger also viewed the video, saying that CCSM 1 did not appear upset prior to the incident. Child A spent a few minutes in the hallway with CCSM 1, as Child A has a history of struggling with transitions. Child A often wants to spend time in the hallway, which is under the direct supervision of a CCSM. The CCSMS are working with Child A to stay in her room. Ms. Cutsinger stated that the video only shows the lower half of Child A and CCSM 1 at the time of the incident. Despite this video angle, it appears that Child A was pulled across the hallway into the room by the way her feet were positioned. The camera in the room shows Child A get up quickly and begin playing. Child A did not appear injured or upset. Child Care Staff Member 2 (CCSM 2) was present in the room, but she too did not witness what happened. Ms. Cutsinger stated that this type of physical intervention to get a child to move would not be approved by the center. Since this incident, the CCSMS have received additional trainings. They are also planning on having an all staff meeting to discuss the proper handling of children. Ms. Cutsinger has had no prior concerns regarding CCSM 1's care or supervision of the children, saying that CCSM 1 has a history of having positive interactions with the children. Ms. Cutsinger spoke with CCSM 1 who told her that Child A dropped to the floor as she took her hand. CCSM 1 told her that she did "slide" Child A to the room, and that she now realizes that this was not the best decision. Ms. Cutsinger also spoke with Child A's Father who verified that Child A was not injured. I observed the center's video footage. One camera angle shows the main hallway of the center starting at the bathroom at one end of the hall and ending near Child A's Room. The second camera angle shows the inside of Child A's room with the door to the room within view. The video shows that at approximately 10:17a.m., there are four children leaving the bathroom, including Child A. CCSM 1 was with the children. Child A remained in the hallway while the other three children went back into their room where CCSM 2 was located. Child A remained under the direct supervision of CCSM 1. CCSM 1 remained in close location to Child A and followed her while she also worked on the center's IPAD. There were times when Child A and CCSM 1 were out of view, but then would come back into view as Child A traversed the hallway. At approximately 10:21, Child A and CCSM 1 are observed outside of the room door. Child A is standing across the hall from the room against the lockers. The video footage only shows Child A and CCSM 1's legs as the top of their bodies were out of view of the camera range. CCSM 1 approaches Child A. Child A then moves from one side of the hall to the door of the room. Child A's legs appear to be dragging across the hall to the door, which is approximately 12 steps away. On July 13, 2022 I completed an on-site inspection. I observed the classroom where the alleged . There were nine tables in the classroom. The tables were spaced throuahout the classroom and no concerns were noted. I spoke with stated regarding Child B Child A, they are in contact with both families and are working on the incident report right now and will have that as soon as it is completed. stated on July 12, 2022, she received a telephone call from child care staff member and she let her know that Child A's Mother had placed a message in the ProCare application which is the child care management software used by the center. The message noted she needed someone to call right away. called Child A's Mother and she told her Child A informed her that Child B Child A said this occurred while Child A and Child B were at a table in the classroom. Child A told his mother July 12, 2022, but it is unclear when it occurred maybe a few days ago. noted Child A and Child B both have a Not due to this , but for Child A and Child B _ there were already safety plans in place which included that Child A and Child B should not be together. This is because they "mix like oil and water." The two and there is drama when they are together. It is just not a good combination for Child A 3 and Child B to be near one another. Child B is only in attendance Child A and Child B are both children. Moving forward, Child A and Child B will be kept farther away from one another. The classroom is now split and half go to the gym and half go to rest time. Child A and Child B are no longer in the same half of the class. Because of the additional concerns regarding potential for all the child care staff members are aware that there is a safety plan in place. stated she always has two child care staff members in each group. Child care staff members are shadowing or as they call it being a "pocket buddy" for each child which means a child care staff membWisalwasin the vicinity of the child. She has concerns regarding and for this reason Child A and Child B are never alone together, neve with anyone. I was provided a copy of the safety plan regarding Child A, the safety Ian regarding Child B, and an email dated July 13, 2022, from Child B's Mother to The safety plan states while Child A is present at the center, he is to be "kept separate from Child B as much as possible." They safety plan is not signed or dated. The safety plan regarding Child A was reviewed and it states Child B is to be kept separate from Child A as much as possible and she is also not allowed to go to the with other students, she cannot take anything into the with her and a child care staff member should always be present with Child B The email from Child A's Mother was reviewed. It states that Child A let her know she was sitting with Child B and he was humming loudly hitting the desk; the humming and loud noise he was making prevented her from hearing the child care staff members. In response to her frustration, she went to. Child B in the . Child A's Mother voiced her concerns regarding the incident which included that Child A and Child B are not supposed to be near one another. While this cannot be constantly adhered to, Child A's Mother does not believe these two should ever be sitting directly next to each other. Child A's Mother said Child B told her Child A follows her around and when she tells him to leave her alone, she gets in trouble from child care staff members. This is something she asked not to happen. Child A's Mother requested the child care staff members simply redirect the children. Child A's Mother noted Child A is not allowed to watch/use electronics that are not her own.
