There was insufficient evidence to show that any child had been tapped on the head or called inappropriate names by center staff. The center has a positive discipline policy that also listed prohibited punishment. All the teachers at the center demonstrated adequate explanation and provided good examples of appropriate discipline. Teacher 1, Teacher 2, Teacher 3, Teacher 4, Teacher 5 and Program Administrator 1 denied any knowledge of physical punishment or humiliation of children.

The concern of inappropriate contact by a teacher kissing a child was brought to the program administrator's attention. The incident was not reported to licensing by the child care center. The center did not have a clear policy about physical affection by teachers with children. There had not been training by the center with teachers regarding boundaries and physical contact with children.

On 12/20/2021, prior to receiving the complaint, Jennifer Hayes, licensee designee self-reported that Nancy LaMack, program director notified her that Child A and Child B had been found approximately 2-1/2 blocks from the center and returned to the center by Menominee City Police Officer Kropf. At approximately 11:53am, Ms. Hayes notified Child A and B's parents of the incident by telephone. 2 The child care center is located approximately 2-1/2 blocks from a 4-lane road with a 35 mph posted speed limit. Child A and B were found at a business located on this road which is approximately two miles from the Michigan/Wisconsin state line. The child care center is a one story building with a fenced-in playground located directly behind the center. A hall, approximately 50 feet long, runs from the front of the center, beginning at the entrance, to the rear of the center which has a door to the playground. At the time of the on-site inspection, there were no doorbells or chimes connected to the doors. On the left hand side of the hall, in order, are a child care room, a children's bathroom, and a second child care room. On the right hand side of the hall, in order, is the office, a hallway leading to the right which goes to the kitchen, infant room, as well as the door to the toddler room. Past the hallway to the right is the wall to the toddler room. When facing the back of the center from the playground, a door into a classroom can be seen, as well as large windows and the door to the toddler room. The hallway door is in between the two classroom doors. The children can enter any three of these doors and access a bathroom as each room has a bathroom in addition to the hallway bathroom which is located approximately ten feet from the front entrance. On 12/21/2021, I conducted an on-site inspection in attendance. Nancy LaMack, the program director wat itthhe "tiome e inspection, was interviewed. Ms. LaMack and Sarah Beauchamp, child care staff members were on the playground at approximately 11:00am with 15 children 2-1/2 to 4-1/2 years. Ms. LaMack typically walks around the playground and conducts random head counts. When outside, the children typically use the hallway bathroom and sometimes go in by themselves. She normally sees a child go in to use the bathroom, so she stands by the hallway door which exits to the playground. When Ms. LaMack realized two children were missing, approximately ten minutes after taking the children outside to the playground, she took all of the children inside to a classroom and asked the staff to conduct a sweep of the building. Child A and Child B could not be found, so Ms. LaMack told Ms. Beauchamp to get in her car and look for Child A and Child B. She did not think that the children had been gone long. At the time of the incident all rooms were within appropriate child/adult ratio. Staff and child attendance records for the date of the incident were reviewed during the on-site inspection with no concerns. Ms. LaMack stated Child A and Child B typically do not need help in the restroom, that both have been attending the childcare for years, that they both experience behavioral challenges at the childcare. She has had verbal conversations with the parents. 3 Sarah Beauchamp was interviewed while on site. She was on the playground with Ms. LaMack standing by the slide and conducting occasional head counts while supervising children. Ms. LaMack conducted a head count and believed that two children were in the bathroom. Ms. LaMack sent Ms. Beauchamp and a second child care staff member, who was also on the playground, to look for the two children. The children were in none of the three bathrooms. The front door was observed to be ajar. The perimeter of the center was walked, then Ms. Beauchamp drove up and down the street the center is located on. A gentleman, name unknown, walked out to the side of the street by the center and stated that Child A and Child B were at the local business approximately 2-
