On 04/06/2023 while onsite at the center, CCSM 1 advised that all ill children are separated from the rest of the group when she is present. They take temperatures and call parents if necessary. The children are separated into another room and then they disinfect the entire center. Depending on the time of day, the children are separated into the room used for circle time or the eating and craft area. The children remain separated until parents pick up. 23 I spoke with Child A's Father over the telephone on 04/06/2023. He said Child A has continually remained sick. On 03/02/2023, the center shut down for the day because so many children had vomiting and diarrhea. He has observed several children with green and brown snot coming out of their noses and a really bad cough in care at the center, and they are not separated. He doesn't feel like they should be able to attend if they are sick and does not think the center is excluding children when they should be and that is why Child A is still sick. I interviewed CCSM 2, CCSM 3, and CCSM 4 while onsite on 04/10/2023. CCSM 2 said the center does exclude children when they have a fever or any of the other exclusionary symptoms. They call the parent and block the child off into another room, usually the eating area unless it is lunch time and then they would use the circle time room until the child is picked up. CCSM 3 stated that children are always separated when ill. Depending on the time of day, they are either in the circle room or in the eating area. CCSM 4 indicated they separate the children as far away as they can at the first sign of illness. They put any ill child onto a mat with some blankets or at the table by themselves. The children are either in the circle room or in the eating area. I spoke to Child B's Father and Child C's Mother on 05/16/2023 over the telephone. Child B's Father said he was not sure if children are separated. He has picked Child B up when ill. Child B was separated from the few children left in care because it was at the end of the day. Child C's Mother was not sure if children are separated. She thinks that if children get sick, they will be sent home. She advised the center shut down recently because there was a stomach bug going around.
Individuals providing care to children at the center do not meet the requirements of a Child Care Staff Member. The center does not have a qualified program director. Children are not washing hands after being diapered. The diapering area does not have a non-absorbent pad. The diapering area is not being cleaned after use. Gloves worn by Child Care Staff Members are worn to change multiple children's diapers and are not changed in between. Children's attendance is not being accurately maintained. Parents are not provided with a written information packet at the time of enrollment. The center is not separating ill children from the rest of the group. Children's mats are not being cleaned after use. One Child Care Staff Member is caring for up to 12 children at one time alone. Child Care Staff Members are not using positive, age- appropriate discipline.

On 02/15/2021 at approximately 1:40 PM, Janice Crum was alone at the center with children. It is unknown if Janice Crum should be providing care at the center. Janice Crum yelled at a child.

I conducted an unannounced onsite inspection with Child Care Licensing Consultant, Roxanne Duckworth, on 04/06/2023. Child Care Staff Member (CCSM) 1 was present at the center. I asked if licensee designee, Richard Ashbaugh, or CCSM 2 were available to discuss new allegations. CCSM 1 indicated that she was alone at the center. She said the CCSM 2 might be coming back, and that Mr. Ashbaugh does not really provide care anymore since they are fully staffed so she did not anticipate him coming to the center. I advised CCSM 1 of the allegations and interviewed her while onsite. CCSM 1 indicated that she was hired in January 2023 and completed fingerprinting on 01/17/2023. I requested to see the CCSM files. CCSM 1 stated that all of the CCSM files were upstairs, and she is not sure where. CCSM files are CCSM 2's responsibility. I asked CCSM 1 about training and documents she has provided for her file. She said that she is currently working on the health and safety training courses. She has not completed either of them yet but is in the process. I advised that there were specific trainings that needed to be completed prior to having contact with children, before unsupervised contact with children, and within 90 days of hire. I encouraged her to complete the trainings as soon as possible. I asked what other documentation she provided, and she indicated that she provided tuberculosis (TB) test results, but she does not know where the documentation is now. She indicated that she is working on the rest of the requirements. She was not sure what was in her staff file. I requested child information cards, children's attendance, and CCSM attendance. CCSM 1 said she could access the current attendance for children but that she did not have access to their past attendance records. She provided CCSM attendance records and child information cards. I advised that there should always be someone onsite that can comprehend licensing rules and provide access to required documentation. I advised CCSM 1 that I would contact CCSM 2 regarding the requested paperwork. I spoke with Child A's Father over the telephone on 04/06/2023. He said there were new CCSMs hired recently. He is not sure who is qualified to work as a CCSM. He knows from previous licensing reports that the CCSMs do not always have what they need before being hired. On 04/07/2023, I called the center and CCSM 2 regarding access to CCSM files. The phone contuned to ring and I could not leave a message at either telephone number. 4 On 04/10/2023, I conducted an unannounced onsite inspection at the center with Child Care Licensing Consultant, Jennifer Blake. I advised CCSM 2 of the allegations. I requested to see CCSM files. CCSM 2 went upstairs to retrieve the files. CCSM 2 returned with some documentation. Ms. Blake began sorting the paperwork. CCSM 2 spent approximately two hours looking for paperwork and collecting it from various rooms upstairs and downstairs at the center. Ms. Blake made an individual file for each CCSM. Ms. Blake took photos of the contents of the files. CCSM 2 stated that she was not clear on the training requirements and thought everyone had 90 days to complete all trainings. I advised her of the specific trainings that are required before contact and before unsupervised contact with children. We reviewed the rules in the center licensing rules as well as the trainings that are required within 90 days. We discussed the trainings available in health and safety training courses and CPR/FA requirements. I interviewed CCSM 3 while onsite on 04/10/2023. She has worked at the center for approximately two years. She thinks all her paperwork is on file at the center. While onsite on 04/06/2023, I interviewed CCSM 1. She said that she knows CCSM 2 is going to school to become the program director, but she is not sure of her progress. She expressed an interest in the program director position and said that she does have an administrative credential. They have not talked to her about being a program director. She said the center did not really have standard operating procedures in place and she has been working on some at home to implement at the center. She has reviewed the previous licensing study reports and special investigations and has been working on ways to address those concerns. 13 I spoke with Child A's Father on 04/06/2023 over the telephone. He did not know if the center had a qualified program director. During the onsite inspection on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. I asked CCSM 2 about her qualifications. She has been working on her Child Development Associate's (CDA) and her portfolio. She just needs to finish the administrative portion of the requirements. I encouraged her to send the documentation to me when she was ready for approval. I reminded her that she would need to send me official transcripts, hours of experience, any CEU's, and a BCHS 001 form. I asked CCSM 2 if there has been any effort to find a qualified program director since she still does not qualify. She said that Mr. Ashbaugh has been looking and there is an online posting on Indeed.com. CCSM 3 thought that CCSM 2 qualified as the program director. She said they are looking for someone who does qualify. CCSM 4 said that CCSM 2 is going to school and is qualified. She was not sure if they were looking for someone else. I spoke with Child B's Father and Child C's Mother on 05/16/2023. They did not know if there was a qualified program director at the center. I attempted telephone contact with Mr. Ashbaugh on 05/19/2023 for an exit conference. I sent an email on 05/22/2023 requesting he call me to complete the exit conference. When I spoke to Mr. Ashbaugh on 05/23/2023, he stated that they have requested a variance so that CCSM 2 can be the program director and never heard a response. I advised the variance was not approved due to the disciplinary action being taken against the license. Mr. Ashbaugh advised that CCSM 2 has been working on the credentials and is close to qualifying. They are still interested in pursing a variance so CCSM 2 can be the program director.

I interviewed CCSM 1 while onsite on 04/06/2023. She said that children wash their hands after diapering. All children were napping during the onsite inspection, and I did not observe any diaper changes. 15 I spoke with Child A's Father on 04/06/2023. He has observed CCSMs diapering children while he is picking Child A up from the center. He did not see the children wash their hands. I interviewed CCSM 2, CCSM 3, and CCSM 4 while onsite on 04/10/2023. They all stated that children wash their hands after being diapered. I observed children being diapered while onsite and those children did wash hands after being diapered. I spoke to Child B's Father and Child C's Mother on 05/16/2023 over the telephone. They were not sure of the handwashing practices within the center.

While onsite on 04/06/2023, I asked CCSM 1 about the diapering process. She indicated that after each diaper change, the area is washed, rinsed, and sanitized. She thinks that everyone uses the 3-step cleaning process on the diapering area after each child. That is how she was trained. I spoke with Child A's Father over the telephone on 04/06/2023. He has diapered Child A at the center. He was concerned that the diapering pad was wet once when he used it and assumes it was urine. He told the CCSMs and then CCSM 2 changed two more children and he did not see anyone clean the diapering area. On another occasion, he changed Child A's diaper and cleaned the diapering area as best he could, but he did not know the center's cleaning protocol. He told the CCSM that he was not sure if he cleaned it correctly. He did not see a CCSM clean the diapering area after use and is not sure if it is being cleaned. While onsite on 04/10/2023, CCSMs were diapering children. They washed, rinsed, and sanitized the diapering area after each use. I interviewed CCSM 2, CCSM 3, and CCSM 4 while onsite. CCSM 2 advised they use a 3-step cleaning process on the diapering area. She indicated they let the area air dry unless they are diapering multiple children in a row and then they dry it off with a rag. I encouraged CCSM 2 to read the instructions on the specific sanitizer label and follow those directions. Some directions indicate in order to sanitize the area must air dry for a specific amount of time. CCSM 3 said they always clean the diapering area using the 3-step method. Child A's Father diapered Child A last week and she went in and cleaned the area after he was done. CCSM 4 indicated that they use a 3-step cleaning process after each diaper change. Sometimes parents diaper their children before they leave, and she assumes they did not clean it and makes sure it gets done. I spoke with Child B's Father and Child C's Mother over the telephone on 05/16/2023. They were not aware of the diapering or cleaning methods used.

While onsite on 04/06/2023, CCSM 1 said she does wear gloves while changing diapers. She changes the gloves in between each child. I spoke with Child A's Father over the telephone on 04/06/2023. He observed CCSM 2 wearing gloves while changing children's diapers. CCSM 2 diapered two children and he did not see her change gloves. During the onsite inspection on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. CCSM 2 said she wears gloves when she changes diapers. She pulls the gloves off with the diaper and throws it all away at one time. She said that a parent might not know that she changes her gloves because it is done while she is in a bathroom stall. CCSM 3 advised she wears gloves while diapering children. She takes the gloves off before putting on the clean diaper and then washes hands. CCSM 4 puts gloves on before she starts diapering and stays gloved until she sanitizes the diapering area. She then throws the gloves away and washes hands. I spoke with Child B's Father and Child C's Mother on 05/16/2023. They were not familiar with the diapering practices used at the center.

(10) All child care staff members who work directly with children are required to be trained in first aid and pediatric, child and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child and adult cardiopulmonary resuscitation (CPR). Each child care staff 12 member's first aid and CPR certificates must be valid and retained on file in the center.
While onsite on 04/06/2023, I asked CCSM 1 about children's attendance. She advised there were 10 children present. She has pushed for the center to use an application to track attendance. CCSMs are responsible for signing children in and out of the center. Their expectation is that a child is signed in or out within 10 minutes of arrival or departure. She feels it provides an open line for communication. CCSM 1 showed me the list of children signed in on the app. There were 11 children signed in, but 10 children present at the center. CCSM 1 advised that CCSM 4 forgot to sign her child out when she left. CCSM 1 signed out CCSM 4's child. CCSM 1 always makes sure that children are signed in and out, she was unsure if the other CCSMs do the same, but she assumes they do. She recalled one time that she had to remind CCSM 3 to sign a child out. CCSM 1 said Child A's Father was asking about Child A's attendance on a particular day. Since it was not his parenting time, she told him if Child A was not signed in, then he was not there. I requested children's attendance records. CCSM 1 did not know how to access or print previous attendance records and advised to request them from CCSM 2. I spoke with Child A's Father on 04/06/2023. He has expressed concern to the center regarding Child A's attendance records on four occasions including 03/08/2023, 03/15/2023, 3/30/2023, and 04/04/2023. He generally receives a text message and email when Child A is signed in and out. There have been some occasions this has not occurred. He also advised that Child A's first and last name were originally spelled incorrectly in the system. He asked them to update it with the correct spelling. On 03/08/2023, Child A's Father called the center at approximately 12:30 PM to see if Child A was present. Child A was then signed in for the approximate time he arrived. On 03/15/2023, Child A was not signed in at all. This was during Child A's Mothers parenting time. When he asked the center if Child A was present, no one could tell him. 19 On 03/30/2023, Child A's Father called the center at approximately 9:23 AM asking if Child A was present. Child A is generally signed in before 8:00 AM due to Child A's Mother's work schedule. The center signed Child A in at the time of the call and did not adjust the time in for the time Child A arrived. On 04/04/2023, Child A's Father called the center at approximately 3:20 PM because it was his day to pick up and Child A had not been signed in yet. Child A is generally signed in before 8:00 AM due to Child A's Mothers work schedule. Child A was then signed in for 7:25 AM which is not the usual time. During the onsite inspection on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. CCSM 2 advised that children's attendance is no longer an issue as it is maintained in the app. CCSMs sign children in and out. I advised CCSM 2 that there is still a concern regarding accurate children's attendance records. When I was onsite at the center on 04/06/2023, there were 10 children present and 11 children signed in. CCSM 2 said that sometimes the internet is not working and the time in or out does not show up. She has had a parent call to see if a child was present because it did not show up right away. Sometimes the app does not notify parents immediately and there is a lag. Eventually the app shows the child signed in. I reminded CCSM 2 of the importance of accurate attendance records. I requested children's attendance for March 2023 through April 2023. CCSM 2 stated that she would figure out how to print and send the attendance later that day. I requested she email the attendance records if possible. CCSM 3 indicated the CCSMs log children in and out on the tablet when they arrive and depart. They have been doing attendance this way for a couple months. She stated the only time attendance records would not be accurate was if the internet was not working then they would keep track manually. She has not spoken to any parents regardi

While onsite on 04/06/2023, CCSM 1 said that parents are provided a written information packet. There was one parent that asked about the packet and due to a misunderstanding, she received it the following day. The written information packet was available but was placed in the child's cubby. I spoke to Child A's Father on 04/06/2023 over the telephone. Child A had already been enrolled at the center when he was granted parenting time. He asked for the written information packet for parents, and it took approximately one and half weeks to receive. During the onsite inspection on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. 22 CCSM 2 indicated that parents get a copy of the written information packet when they are filling out paperwork for enrollment. She said there was one mistake when the packet was put into a child's cubby. The parent got it the next day. She stated that there is usually a written information packet by the front door. She will check to see if it is still there and replace if it is missing. CCSM 3 advised that whoever is present would give out the written information packet to parents if they ask. She has never been asked for it before. If anyone requests one, she will give them a copy or let CCSM 2 know. CCSM 4 said that she has been asked for a written information packet. She may not have had one at the time but has made sure that the parent receives the information. I spoke to Child B's Father and Child C's Mother on 05/16/2023 over the telephone. Child B's Father said Child B has been enrolled for long enough that he does not remember if he received a written information packet or not. Child C's Mother did receive a written information packet at the time of enrollment.

While onsite on 04/06/2023, CCSM 1 said the mats used by children for napping are cleaned every day. They use the 3-step process using soap, water, and bleach. The mats must be completely dry before stacking. They do not put the mats away until they are completely dry. I spoke with Child A's Father over the telephone on 04/06/2023. He has seen CCSMs pick up mats and stack them after naptime. He did not see the mats get cleaned. While onsite on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. CCSM 2 said that mats are cleaned every day using the 3-step cleaning process using soap, water, and bleach. They spray, wipe, and let air dry. This is the responsibility of the CCSM who is present at the end of the day. CCSM 3 advised they clean the mats every day. She cleans the mats using the same 3-step process as the other items including the diaper pad and tables. She uses water, soap, and bleach. I advised that the order should be soap, water, and then bleach. She was confused about the order but said she would make sure to use in that order. CCSM 4 indicated that after each use, the mats get soapy water, regular water, and then bleach. They allow the mats to air dry before stacking. She said it is possible the mats would be stacked after nap and then sanitized later in the day by whomever is at the center at the end of the day. I spoke to Child B's Father and Child C's Mother on 05/16/2023. They were not sure about the cleaning process for mats used at naptime.

During the onsite inspection on 04/06/2023, CCSM 1 advised that she was caring for 10 children. She denied that any other adults or CCSMs were present at the center. She said she is familiar with ratio requirements and knows that only one CCSM is required for 10 children as long as they are 3 years old. I advised that there are other ratio rules that are also applicable, including the requirement for a second adult when seven or more children 3 years of age and older are in care. I asked CCSM 1 if there has ever been an instance of one CCSM caring for up to 12 children alone. She stated that she has not cared for more than 10 children alone. She is unsure if other CCSMs have had that many children in care at one time alone. I spoke with Child A's Father on 04/06/2023. On 04/05/2023, he picked Child A up from the center. CCSM 3 and CCSM 4 were outside with the children. When he was leaving, CCSM 3 left the center and pulled out in her car in front of him. He thought that CCSM 4 was left to care for too many children. While onsite on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. CCSM 2 said they have not been out of ratio. I advised that CCSM 1 was alone with 10 children on 04/06/2023. She said she did not know two CCSMs were required and thought that as long as they did not have over 10 children they could have one CCSM. I reminded CCSM 2 that we discussed this rule previously. I asked CCSM 2 if she had a licensing rule book available. CCSM 2 got a copy of the rules, and I showed her the specific rules in the book requiring two CCSMs when seven or more children are in care at the center. CCSM 3 advised there has not been a CCSM alone with 12 children. They can only be alone if there are nine or less children in care at one time. CCSM 4 indicated she was not alone with 12 children. They are only allowed to be alone if there are 10 or less children in care. We discussed that ratio is based on the youngest child in care. CCSM 4 was not sure how old each child was but thinks they are all 3 years of age or older. I reviewed the children and CCSM attendance records for 04/05/2023. He said the building is not in good condition. While I was onsite on 04/10/2023, I interviewed CCSM 2, CCSM 3, and CCSM 4. CCSM 2 said the center is clean and maintained. All CCSMs are expected to clean. They do not have a list of responsibilities but keep a logbook. All CCSMs are required to clean including wiping down the tables, sanitizing toys, cleaning the bathroom and kitchen, and doing dishes. She indicated that they sweep and mop every day. She denied that the center was ever swept and mopped every other day. I pointed out some of the concerns I had observed during the onsite inspection. There was a gouge out of the drywall on a wall in the eating area just above the baseboard accessible to children. There were cords plugged into a multioutlet extension cord dangling in the air next to the shelving unit accessible to children. Although it is not approved child use space, during the onsite inspections on 04/06/2023 and 04/10/2023, numerous children went into the kitchen and had to be redirected out by a CCSM. The kitchen had at least two cupboard doors that were falling off. There was paint and cleaning products accessible to children. I asked CCSM 2 why they were painting over the murals in the eating area. She advised that the paint was chipping and flaking so they needed to cover it up. They were still in the process of painting. Upon arrival to the center on 04/06/2023 and 04/10/2023, I observed the blue paint on the exterior of the building was chipping, including the porch where children enter and exit. CCSM 2 said they had addressed the concerns with the exterior paint in either March 2022 or April 2022. They touched up the paint and had the lead inspectors come back. I asked why the paint was still chipping and she said she was not sure. I advised this would need to be addressed as soon as possible. I requested a copy of the lead inspection. She said she would look for the report and send it when she found it. I have not received any additional reports as of the writing of this report. CCSM 3 said the center is clean and safe for children. The CCSMs clean and sanitize every day. She did not identify any concerns with the cleanliness or maintenance of the center. CCSM 4 denied that she had any concerns regarding the cleanliness of the center or the safety of children in care. They clean every day and she did not think there were any hazards to children. W I spoke with Child B's Father and Child C's Mother on 05/16/2023 over the telephone. Child B's Father said the CCSMs are always cleaning something when he is there. There was one day they had a maintenance issue and had to shut down the center to address it. He thinks it was a plumbing issue and it was taken care of immediately. He does not have any concerns regarding cleanliness or maintenance. Child C's Mother advised the building is "dated" but she is not aware of it being hazardous. She said the center "seems clean enough." Child C is only at the center for a short time after school, so she is not worried. Child A's Mother advised that Child A has been yelling and being mean when he comes home from the center. She thinks that he is mimicking the behaviors he is seeing at the center. She was aware of concerns regarding CCSMs yelling in the past and does not think things have changed. When she was picking up Child A, sometimes she would observe Ms. Fonger's youngest child hit and push Child A. When she expressed concern, Ms. Fonger told her the children have a "love/hate relationship." Child A's Mother indicated that she has also observed other children yelling and pushing Child A and the CCSMs do not do anything to stop it. During the onsite inspection on 01/25/2022, Ms. Bragg advised that Child A's Mother is just upset. No one told Child A he was black, and they were talking about clothing he was wearing. She stated that children do sometimes yell or try to hit other children but the CCSMs stop them and redirect them. They do not allow bullying by CCSMs, or other children and Child A was not getting bullied while at the center. When I spoke with Mr. Ashbaugh on 01/25/2022 over the telephone regarding the allegations, he advised that Child A's Mother has been causing problems since she moved back to the area. The CCSMs do not bully children or allow any child to be bullied at the center. He has not heard CCSMs say anything like that to a child and this is a situation where a parent is just trying to cause problems. I spoke with Child B and Child C's Mother over the telephone on 03/03/2022. She advised that she has never personally had concerns with appropriate care and supervision. There has not been any yelling or bullying to her knowledge. Her children really like attending the center and love Ms. Fonger. She has liked that Ms. Rasmussen does projects with the children. I spoke with Child D's Mother over the telephone on 03/03/2022. She denied any concerns with appropriate care and supervision. She has not heard any yelling but the CCSMs do sometimes use a stern voice when telling children to put the toys away. She has not witnessed children bullying other children by yelling or pushing. I have not spoken to Child E's Mother as of the writing of this report. While onsite on 03/04/2022, Ms. Fonger denied that CCSMs yell at children or bully them. She denied that children yell, or bully other children. She denied that Child A was yelled at or pushed. When I asked Ms. Fonger about Child A saying he was black, she advised they were in circle time learning colors and Child A was wearing a black shirt that day. She indicated that Child A's Mother was just mad and 7 exaggerated. She advised that if children were being mean to one another, she would use redirection. Ms. Rasmussen denied that CCSM or children bully, yell, or hit. She said it is heartbreaking and not true. They use redirection if there is an issue.

When she has come to pick them up, the CCSM usually is walking them to the door. I interviewed Child D's Mother over the telephone on 03/03/2022. She advised that Child D was excluded one time because of hand, foot, and mouth disease. The center called because Child D had a fever and she had to pick up. There are children who have runny noses including Ms. Fonger's children, but she does not think that means they necessarily need to be excluded. I interviewed Ms. Fonger while onsite on 03/04/2022. She stated that they call parents when children are ill and send them home. They separate children into a different room, usually on a mat in the room near the kitchen. I asked Ms. Fonger about Child A potentially being ill. She advised that Child A woke up from nap and was being "extra clingy." He did not have any symptoms. Child A's Mother later told her that he had a temperature when he got home. Ms. Fonger indicated that Child A did not have a temperature while he was at the center. She would have called Child A's Mother if she thought Child A was ill and needed to be excluded from care. Ms. Rasmussen stated that if they suspect a child is ill or has a temperature, they ask how they are doing and will call home if necessary. I received this complaint on 02/16/2021. I made telephone contact with the Reporting Source (RS). She advised that she had concerns after the program director left employment. The current Child Care Staff Members (CCSM) include Rachael Fonger and Janice Crum. On 02/10/2021, Ms. Fonger's car was gone and only Ms. Crum's car was parked at the center. She was not sure if Ms. Crum is supposed to be left alone with children since she is a new CCSM. On 02/11/2021, both Ms. Fonger and Ms. Crum's cars were gone in the middle of the day and only a black Jeep was there. This made her wonder who was caring for her children but when she picked up at the end of the day, both Ms. Fonger and Ms. Crum were back. On 02/15/2021, Ms. Fonger's car was gone again and Ms. Crum's car was the only car there. I reviewed the Child Care Background Check (CCBC) system on 02/19/2021 before conducting an onsite inspection. Ms. Crum was not entered into the CCBC system. I conducted an unannounced onsite inspection on 02/19/2021. There were two vehicles parked at the center. Ms. Fonger was on the main level of the center with four children. I asked if anyone else was present in the facility and she stated her "babysitter", Janice (Annette) Crum, was on the second level with Ms. Fonger's child, Child F. I advised Ms. Fonger of the allegations. 3 Ms. Fonger denied that she leaves the facility during child care hours or that Ms. Crum is alone at the center with children. Ms. Fonger indicated that sometimes other people borrow her car, so it is not always parked at the center even though she is present. I asked if someone driving a black jeep is caring for children. Ms. Fonger stated that she does not know anyone that drives a black jeep, and no black jeep has been parked at the center. Ms. Fonger denied that Ms. Crum provides care to children at the center and only cares for Child F on the second level of the center since Child F is not old enough to be enrolled. This occurs during child care hours. Ms. Fonger stated that she is the only CCSM and only one providing direct care to children. Occasionally Mr. Ashbaugh helps when needed. I reminded her that she and Mr. Ashbaugh were recently advised that Child F should not be present in the center until she is 30 months. Ms. Fonger stated that Ms. Crum was caring for Child F at the center because she does not trust anyone in her home while she is not there. Ms. Crum occasionally comes to the main level with Child F to change her diaper, get food, or various other reasons. Ms. Crum does interact with children and parents but is not considered a Child Care Staff Member (CCSM). I asked if she was a volunteer. Ms. Fonger stated she was only the babysitter for Child F and the center does not have any volunteers. I asked Ms. Fonger if she is always able to hear and see Ms. Crum when she is present with children at the center. Ms. Fonger did not give a clear answer if Ms. Crum is always within her sight and sound while she is present in the center. I reminded Ms. Fonger that supervision of CCSM that are pending eligibility and supervised volunteers required line of sight and sound. I informed Ms. Fonger that private babysitting services could not occur in a licensed child care center and that the second level of the center is not approved as child use space. I asked Ms. Fonger if Ms. Crum had a background check through the Child Care Background Check (CCBC) system. She indicated that they have discussed it and plan to have Ms. Crum complete the background check. I reminded Ms. Fonger that individuals should not be present in the center until they have been deemed eligible and connected through the CCBC system Ms. Fonger stated they did not have any documents for Ms. Crum. I went to the second level to interview Ms. Crum. She and Child F were in a room with the door closed. Child F was laying on a futon with blankets, pillows, and was drinking a bottle. I interviewed the RS over the telephone on 02/16/2021. She advised that when she picked up her child on 02/10/2021, he was acting different. When she asked him what was going on, he said Ms. Crum yelled at him. She could tell something was wrong because of his behavior. The situation appeared to really bother him. During the onsite inspection on 02/19/2021, I asked Ms. Fonger if Ms. Crum has ever yelled at a child. She stated that Ms. Crum does not yell at the children. I interviewed Ms. Crum while onsite on 02/19/2021. She denied yelling at children. asked how often she has to provide discipline to children. She stated she has never disciplined children at the center but if she sees a child standing on a chair she will say "Miss Annette does not want you to get hurt, please get down." I explained to her that asking a child not to climb on the chair is redirection. Redirection is a form of discipline identified in the center's discipline policy. She stated that she is aware of the center's discipline policy as it is posted in the kitchen. She denied ever using any inappropriate discipline methods with children. I spoke with Mr. Ashbaugh over the telephone from the center on 02/19/2021. He did not believe that Ms. Crum would yell at children. I advised that I previously had concerns regarding yelling occurring at the center which was cited under special investigation 2021D 0220006. I reminded him that positive methods of discipline were required. I spoke with Ms. Sneary, Child A and Child B's Mother, Child C's Mother, and Child D's Mother over the telephone on 02/19/2021. None of them had any knowledge of Ms. Crum yelling at children.

I conducted an unannounced onsite inspection on 12/16/2020. I made contact with program director, Ashley Sneary, and Child Care Staff Member 1. I advised Ms. Sneary of the allegations. She denied that anyone yells at children. She stated that a parent contacted her to say that her child's teacher expressed concern on 11/30/2020 about Child Care Staff Members yelling at children. Ms. Sneary indicated that there was a child crying and the adults at the facility were just talking loudly over them and were not yelling at children. A child wanted to be with their sibling, but they were not allowing that because the sibling was on Zoom. Ms. Snary stated that she is "just a loud person" and is not yelling but rather using her normal tone and level. I asked what forms of discipline are used with children and she indicated they use redirection and "calm bodies" with all the children. She denied any type of inappropriate discipline or yelling occur at the center. I interviewed Child Care Staff Member 1. She stated that children were being extra loud one day and there was a child crying who was upset because they couldn't be with their sibling, so they were probably just talking loudly overtop of the noise. She stated that she thinks the teacher heard children yelling and not an adult. Sometimes they will clap their hands together to get the children's attention. Child 3 Care Staff Member 1 denied that anyone yells at children or talks to them inappropriately. They mostly use redirection and talk with children if they are doing something they should not be doing. I made telephone contact with owner, Richard Ashbuagh. I advised him of the allegations. He denied that Child Care Staff Members would ever yell at children. He indicated that he is upset because they are doing families a favor by allowing school age children at the center while school is not in session. He stated that he talked to the parent because the younger sibling was crying for the older sibling. He feels that whoever reported this situation is rude and the Child Care Staff Members are not doing anything wrong. He is considering not allowing Zoom at the center if it is going to cause problems. I encouraged him to allow children to access Zoom at the center as it is how they participate in school. I attempted telephone contact with Complainant 1 on 12/16/2020. We spoke over the telephone on 01/12/2021. Complainant 1 stated that he did not have direct knowledge of the incident, but that Complainant 2 and Complainant 3 would have more specifics of the situation. I attempted telephone contact with Complainant 2 on 01/13/2021 and 01/25/2021. We spoke over the telephone on 01/27/2021. Complainant 2 stated that on at least three separate occasions, she has overheard Child Care Staff Members at Ashbaugh Family Daycare "yell, talk down, and use a demeaning tone" with children. She indicated this occurs with students off camera, so she does not know which children or Child Care Staff Members are involved. She gave examples of things that were said such as "What part of get over here do you not understand?" and "Get over here now" with the person clapping their hands in between each word. She stated that even though she could not see the person, she could tell it was an adult. She advised that Complainant 3 has also expressed concerns and may have more information. I spoke with Complainant 3 on 01/27/2021. She stated that she has a student using Zoom at the center. On numerous occasions, she has overheard concerning interactions between Child Care Staff Members and children. She described the tone as "gruff' and "icky." She advised that they "scream" at children almost every day and she can hear it in the background during the Zoom calls. She recalled one day being particularly bad and thought "this person is in the wrong business and should not be working with kids." On 09125/2020 1 conducted an unannounced onsite inspection to Ashbauah Family Davcare. Present with me was were 1 cnitaren present with two child care staff members, Dakota Dovey and Matthew Sneary. The preschool children were finishing their lunch, and the 3 school-age children were online doing their virtual learning for school. The children also went down for their rest time/nap after lunch. I obtained copies of the attendance records, child information cards, and the center parent handbook, including the discipline and I interviewed child care staff members, Ms. Fonger, Ms. Dovey,p aonlidcyP.Mmaya. We also interviewed several children who were age appropriate. Ms. Fonger is a child care staff member and assists the program director with her duties at the center. Ms. Fonger confirmed she was working at the center on 09/2112020. She denied any children ever being left unattended outside and indicated there is always child care staff members present with the children whether they are inside or outside. She reported the staff follow the same ratio during outdoor play time with the exception of a staff member possibly having to go inside with a child for a bathroom break. Ms. Dovey is a child care staff member at the center. She confirmed she was present on 09/21/2020 from_. She denied any children being left outside unattended during the time she was at the center and has never observed any other staff leaving children unattended outside at any time. She reported that two child care staff members are outside with the children during outdoor play unless a child has to use the bathroom or run inside for some reason. Ms. Amaya was not present at the center on 09/21/2020 but denied that children are left unattended at any time, including outdoor play time. She indicated there is always at least one child care staff member outside, and usually two. depending on how many children are present. Cl On 10/15120201 received a second complaint on this center. Ms_ Sneary denied any children were ever left outdoors unattended and that there are always child care staff members with the children whether they are indoors or outdoors. I asked Ms. Sneary about the complaint I received She resorted that On 11105/20201 spoke with Child A, Child B, Child C, Child D, Child E, Child F, and Child H's Parents. I left a voice mail for Child G's Mother but did not receive a return phone call from her during this investigation. Child A and Child B's Mother reported no concerns with the care and supervision at the center. She indicated there is always multiple child care staff members and she has observed child care staff outside with the children. Child A and Child B's Mother did not have concern with the way the center handled Child C and Child D's Mother did not have concerns with the care and supervision at the center and reported there is always multiple child care staff members with the children. On 09/25/2020 I conducted an unannounced onsite inspection to Ashbaugh Family Daycare. Present with me was Ms. Fonger confirmed she was present on 09/22/2020 at the center. She denied grabbing Child A by the hood of his sweatshirt and carrying him inside. She was not sure why someone would say she did that. She reported that Child A has had a rough couple of weeks and they have had to sit down with him and talk about his behaviors, redirect, and have him take some quiet time, but she had never physically disciplined him or handled him roughly. Ms. Fonger indicated the center uses positive methods of discipline, including redirection, talking about behaviors/trying to find resolutions, and time-outs. I asked her if time-outs are used with all children as I.3 the licensing rule is that time-outs only be used with children age 3 and up. Ms. Fonger denied using time-out on children under the age of 3. Ms. Dovey confirmed she was present on 09122/2020 at the center. She did not observe Ms. Fonger grab Child A by the hood of his sweatshirt, carry him, and him gasping for air. She indicated she has never observed Ms. Fonger, or any other child care staff, handle children roughly or physically discipline them. Ms. Dovey reported that the center uses positive methods for disciplining children, including redirection, talking with the children about the situation/behaviors, and time-out. In regard to Child A, she indicated he sometimes has to have multiple warnings about behaviors, and that they will have him take some quiet time to collect himself. Ms. Amaya was not at the center on 09/22/2020 and was shocked to hear this complaint as she has never observed Ms. Fonger be rough or physical with children. Ms. Amaya reported that she usually holds and consoles Child A if he is upset or having behavior issues. He misses his mother a lot and will usually calm down if you sit and talk to him about his feelings. She indicated she uses the same methods with other children as well, sitting with a child and talking to them about the situation, behavior, and their feelings. Ms. Amaya reported time-outs are also used as a last resort after several warnings. On 10119/2020 I spoke with program director, Ms. Sneary. Ms. Sneary does not have any concerns with Ms. Fonger and has never seen Ms. Fonger handle any child in a rough or physical manner. She reported that the center uses redirection mostly with younger children and will have children sit down and calm their bodies/have a time-out if they are age 3 and older. On 11105/20201 spoke with Child A, Child B, Child C, Child D, Child E, Child F, and Child H's Parents. All parents interviewed reported no concerns with the discipline at ~1 the center and were aware of the discipline policy. They also reported no concerns with the child care staff. Child A and B's Mother did not have concerns with the complaint that Child A was carried by the hood of his sweatshirt by Ms. Fonger. She asked both Child A and Child B if anyone received any "owies" at the center and they both told her no. She indicated Child B would tell her if anything happened to Child A at the center. I reviewed the discipline policy in the parent handbook. The center does not use any corporal or physical punishment. Positive methods of discipline are used, including redirecting the child from an unacceptable behavior to a constructive one by offering them alternative activities, modeling positive behaviors, and positive reinforcement/praising a child for good choices/behaviors. If there is conflict between two children, the child care staff try to separate/remove the children from the situation and come up with a resolution by talking to each child. Time-out is a last resort and used for children age 3 and older, one minute/per age.

On 0912512020 I conducted an unannounced onsite inspection to Ashbaugh Family Daycare. Present with me was There were 13 children present at the center with child care staff s, . Dovey, Ms. Fonger, and Ms. Amaya came in during the onsite. Ms. Fonger reported that she was working on 09121/2020 with Mr. Sneary and Ms. Dovey. She indicated Mr. Sneary is not actually a child care staff member but is a regular volunteer at the center. She denied that she or anyone else left at any time this day, leaving one child care staff member alone with the children. Ms. Fonger reported there are 13 preschool/school-age children enrolled, and there are always two child care staff, or one child care staff member and Mr. Sneary present at the center, with the exception of very early morning before three or more children arrive. Ms. Fonger was aware of the licensing rules for ratio and group size requirements is and reported that they are followed, and that no child care staff would leave the center unless enough other staff are present. Ms. Dovey denied that the center is ever out of ratio for children to child care staff. She indicated there is always multiple child care staff or volunteers unless there are only one or two children present at the center at the beginning or end of the day. She was aware of the licensing rules for ratio and group size for preschool and school-age children. The center does not have an infant/toddler component. Ms. Amaya denied that child care staff are leaving the center, leaving the children and child care staff out of ratio. She reported that they always have multiple child care staff at the center, and a child care staff member would only leave, if they were replaced by another staff member, or there are only one or two children present. Child B. Child C. Child F. and Child G were all able to be interviewed. On 10/19/2020 l spoke with program director, Ashley Sneary, Ms. Sneary denied that child care staff leave the center, leaving one child care staff member alone with all of the children. She reported there is always at least two child care staff present, and that a child care staff would only leave the center if there was extra staff present, or a shift change and the other staff had arrived. I reviewed several weeks of attendance records for the center. Mr. Sneary left shortly after Ms. Fonger had arrived, and then during naptime Ms. Amaya arrived. There was an adequate number of child care staff present for the 13 children present. The program director, child care staff, parents, and children were interviewed. There are at least two adults, one of whom is a child care staff member present at the center. The program director and child care staff denied being out of ratio. The parents interviewed did not have concerns with the number of child care staff present. I reviewed several weeks of attendance records. There are 13 children enrolled, and 13 or less children present each day with at least two caregivers. The center is only preschool and school- age.

On 0912212020 Child care staff member, Rachael Fonger, grabbed Child A by the hood of his sweatshirt, lifted him off the ground, and carried him inside. Child A was gasping for air.
