R 400.1911 · 1 R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.
M and I made an unannounced onsite inspection to the child care home on arc24, 2021. We interviewed Nicole Elliott, licensee. Ms. Elliott stated that Child A always had a coat with never went outside without one. Ms. Elliott said there were a couple occasions w en Child A came to child care that did not have snow pants and the children and staff members went outside for 0-15 minutes. The weather was mild on these occasions and Child A's pants did not get wet. During our interview with Phoebe Walter, staff member, said she never witnessed Child A outside without a coat, but did forget snow pants at least once. Al ssa Oates, staff member, stated that Child A always had a winter coat on when went outside during bad weather, but mother forgot to send snow pants a ew times. Madison Largen, staff member, could not remember ever seeing Child A without a coat during the winter but did state that went outside without snow pants at least a few times. ■ played on dry ground and did not get wet. Kearah Johnson, staff member, said there was one time in the late fall that Child A did not have a winter coat. It was not very cold, so ■ just had a light jacket. I interviewed Child B and C's Mother, Child D and E's Mother, Child F's Mother and Child G's Mother. None of them are present during outside play, and have not witnessed children outside without proper clothing. They did not express any additional concerns regarding outside play. I left a voicemail message for Child A's Mother. She did not return my call.

Child A was taken outside without a coat in December 2020. Child A is yelled at and spanked If does not go to the bathroom during bathroom time. During and my interview with Nicole Elliott, she stated that she does not use physical punishment or yelling as discipline and she would not tolerate it from any of her staff. All of them have discipline training and she has an appropriate discipline plan. The main inside child care area is the large child care room in the basement. Ms. Elliott has a video camera set up and she can observe the room from her telephone. She states she has never seen or heard any of her staff being inappropriate with the children. Ms. Elliott also informed me that Child A is very well- behaved and was almost fully potty trained when ■ started child care. Phoebe Walter said there were no issues with Child A using the bathroom. - CI could usually go by , but sometimes needed help with pulling up leggings or hooking pants. Ms. Walter stated she has never heard anyone at the child care yell at the c ildren or call them names. Ms. Walter said she was unaware of any use of physical discipline and knew that she was a mandated reporter. Alyssa Oates stated that she is not aware of anyone yelling or spanking children at the child care. She was able to describe mandated reporting to me. Ms. Oates said, "[Child A] was the best-behaved child here. I don't think ■ ever even went to time out." Madison Largen said that Child A could do most everything in the bathroom without assistance. Sometimes ■ might get a little distracted and need to be reminded to "finish up." Ms. Largen never heard anyone yell or threaten Child A or any of the children. Ms. Largen stated that no one used physical discipline with the children. 0 Kearah Johnson said that Child A needed assistance in the bathroom on first day at child care. Then after that ■ would sometimes need help with getting ■ pants pulled up. The children were not spanked for any reason, and Ms. Johnson also did not hear anyone yell at the children. Ms. Johnson knew she was a mandated reporter and would report anyone spanking the children. Child B and C's Mother said her would report to her if any child was spanked. Both of her children are happy an the staff are always great. Child D and E's Mother did not believe the staff or Ms. Elliott would use ph sical discipline. She believes her would tell her if someone spanked . Both of her children appear happy when she picks them up. Child F's Mother said the child care staff use time-outs and re-direction. No one would yell at the children or spank them. Child G's Mother said her is always excited to go to child care. She has no concerns and does not believe Ms. Elliott or her staff would hurt a child in any way. APPLICABLE RULE R 400.1913 Discipline; child handling. (3) Personnel shall not do any of the following: (a) Hit, spank, shake, bite, pinch, or inflict other forms of corporal punishment. ANALYSIS: Nicole Elliott and her staff do not use physical discipline or yelling as forms of discipline. CONCLUSION: VIOLATION NOT ESTABLISHED Child A tripped over the child care dog. ■ was sent to the dark basement alone to take a nap. The children nap in the basement and there is no egress window. Nicole Elliott said that children are not sent to the basement as punishment. She took and me to the basement and turned off all the lights. There was still plenty of light coming through the windows. Ms. Elliott said if a child wants to sleep longer, she may leave a child sleeping in the child care room alone because she has the camera to observe them. Phoebe Walter could not remember any time that Child A tripped over the dog. Ms. Walter said Child A naps in the basement when the other children nap and usually gets up about the same time. Ms. Walter said the basement is never very dark because light comes in through the window. Alyssa Oates has seen Child A trip over the dog at least once. She does not remember Child A being punished for tripping over the dog. Ms. Oates does not believe any child was sent to the basement as punishment. Madison Largen did not know anything regarding Child A tripping on the child care dog or being sent to the basement as punishment. Kearah Johnson said none of the children were sent to the basement as punishment. She did not know if Child A ever tripped of the child care dog. Child B and C's Mother, Child D and E's Mother, Child F's Mother and Child G's Mother had not heard anything regarding a child tripping over the child care dog and being punished for it by being sent to the basement.

R 400.1943 · 1 R 400.1943 Exit requirements for each floor level used by children. (12) An emergency escape window to the outside is required for basements approved for child use after January 1, 2006. All of the following provisions apply: (a) The total unobstructed window area for egress must be at least 5 square feet. (b) The unobstructed opening must be at least 20 inches wide. (c) The unobstructed opening must be at least 24 inches high. (d) The bottom of the opening must be not more than 44 inches above the floor. (e) If the sill height is below grade, then it must open into a window well with at least 9 square feet of area, 3 feet in length and 3 feet in width. The area of the window well must allow the emergency escape window to be fully opened. If the well depth is over 44 inches, then it must have permanently affixed steps that are approved by the local building inspector. 7
and I did go to the basement and observed the egress window. The was free of any obstructions and met licensing requirements. There also was not a wood fort blocking any exit. During my annual inspections at Ms. Elliot's home, I have never observed any exits being obstructed. I interviewed Child B and C's Mother, Child D and E's Mother, Child F's Mother and Child G's Mother regarding the children napping in the basement. None of them had concerns and new the basement child care area had a camera.
