CCSM 2 assisted with Child A's injuries as soon as she noticed them. Interviews with Child B's Mother, Child C's Mother, Child D's Mother on 6/16/2025 indicated that there were no concerns about the interactions and demeanor of the child care staff.

    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 5/16/22, Witness 1 said she was walking down the hallway on 5/12/22 when the school secretary alerted her that one of her students was injured and needed first aid. She thought this was odd because she had already dropped off all her "before school" program students to their regular classrooms. When she approached Child A, she did not recognize her as one of her students. Her eye was clearly hurt. She did not remember if it was the right or left eye. One of her eyes was very red and you could see the blood vessels in that eye. Witness 1 asked Child A where she was before school and she said Kids Club. Child A mentioned that she told child care staff members there but no one helped her and they told her they did not have any ice. The school nurse gave Child A first aid. On 5/16/22, I received an email from the school secretary indicating that there was no incident report because the incident did not happen at Sandy Knoll. During my visit to the center on 5/18/22, program director Patricia Williams said she was not there when the accident occurred. She said that they did have ice packs at the center and showed me where they were located. She had a copy of the text message Sara Scheidt, child care staff member, sent to Child A's Mother about the accident. Ms. Scheidt sent the message to Child A's Mother at 8:56am on 5/12/22. The message said: When they were getting ready to go to school, Child A was hit in the left eye with a "pop-it" ball. The ball may have had some dirt on it which got in her eye. I washed out her eye. Her eye is pretty red and she will probably be asking for an ice pack when she gets to school. She was very brave while getting her eye washed and seemed pretty talkative once she got on the bus. (The children are walked from Kids Club to a bus stop where they take a bus to Sandy Knoll school.) Child A's Mother responded by thanking Ms. Scheidt for letting her know. On 5/18/22, Ms. Scheidt confirmed that she sent Child A's Mother this text message. She said that on 5/12/22 at about 8:25a, they were cleaning up to get ready to walk to the bus stop. Some boys had a rubber "pop it" ball that they had brought from home and they were throwing it back and forth. The ball hit Child A in the left eye which caused her to cry. She helped Child A by washing her eye out, it looked very red and irritated. I asked Ms. Scheidt if she completed an incident report and she said she did not but that she would complete one now. She said that they were in a hurry and running late. I asked Ms. Scheidt if she gave Child A an ice pack. Ms. Scheidt said she 3 asked Child A if she needed an ice pack. Child A responded by saying "no, I can probably make it til I get to school and will ask my teachers there". On 5/26/22, I spoke to child care staff member Jeremiah Ogawa. Mr. Ogawa said that on 5/12/22 he saw the ball being thrown hitting Child A in the eye. Child A was crying and Ms. Scheidt took care of her. Child A had stopped crying when they walked to the bus. Mr. Ogawa said he thought Child A asked Ms. Scheidt for an ice pack but he was not sure. I attempted to reach Child A's Mother on 5/26/22, 6/2/22 and 6/6/22 and was unable to speak to her. She did attempt to call me back on 5/26/22 but we never connected. I reviewed the center's injury accident plans and child and staff attendance records. Part of the policy is that an incident report is completed and sent to parents using Bright Wheel. There were enough child care staff members on the morning of 5/12/22 when the incident occurred. On 5/26/22, I emailed Ms. Williams asking if they had a policy on toys bought from home. She said there was a verbal policy that they tell parents but not a written one. The policy is that toddlers can bring stuffed animals to use at rest time. School-age children can bring technology that they need to help them do homework.

    An incident report was received on 10/27/2021, signed by Grace Williams and Patty Williams, stating: "Child A was playing with 3 other friends at the train area, which consists of a train table and train bins. He got up from playing and 2 tried to get around the 3 friends and tripped over the right front leg of the train table landing on his left side and catching his fall with his right arm. He was partially sitting up when Miss Sam approached him and said, "You're alright, right bud?". He said yes and moved on to play in another area." The report listed the incident as occurring at 5:05 pm and the parent was notified at 5:45 pm. On 10/29/2021, I found additional information through phone interviews with Child A's Mother and the reporting person. This person witnessed Child A screaming and crying at 5:08 pm with blood-shot eyes. He was shaking and kept saying, "ow, ow, ow, as he was holding his arm. Two staff members were observed on the other side of the room near the doorway and appeared to be in deep conversation and laughing and not aware of the distraught child. There was some secondhand information that was conveyed to the witness from other parents about understaffing. No one had called Child A's Mother, so this witness contacted her through a third party and Child A's Mother rushed over. The witness was not sure who was present at the site; she doesn't know many of the staff members' names. The witness had the impression that the staff members were trying to come up with a story. Usually at the end of the day, parents have to check a couple rooms to find their child. Staff members are moving all over the place to do their cleaning and finish their day. The witness thought there were about 24 kids in the room with two caregivers. When Child A's Mother picked him up at about 5:40 pm, there were about 12 to 15 kids in the room with two staff members. C.J. (Caitlyn) Johnson, child care staff person, was not there when the injury occurred but came in after to comfort Child A and told Child A's Mother that Child A had tripped and fell on his arm. Child A's Mother sent a copy of the medical report to me after our discussion. The diagnosis on 10/26/2021 was "joint effusion and fracture of the right elbow. Follow up was required with orthopedics. Child A received emergency treatment of a sling and then received a cast. On 11/05/2021, I did an on-site inspection, obtained documentation and interviewed staff members. Two staff-written accident reports, dated 10/27/2021, were provided to me at the center. Samantha Ogea, staff member, wrote: "Child A was playing with 3 other friends at the train area. He got up from playing tried to get around the 3 friends and tripped over the front right leg of the train table, landing on his left side, caught himself with his right arm. He was partially sitting up. I approached him, checked him out and he said he was 'OK'. He seemed visibly fine and went back to playing normally". C.J. (Caitlyn) Johnson, wrote: "CJ walked into 4/5 preschool classroom at 5:25 pm and saw Child A crying. Child A approached CJ and said, "mom." CJ held Child A and comforted him until pick up. Child A stated to CJ that his "arm hurt" and he 3 asked for a kiss on the forearm. CJ hugged Child A until mom came at about 5:40 pm. Child A was content and did not appear upset." The incident occurred in Rooms 303 and 305 (combined), which is the 4- and 5- year-old preschool room. I inspected that classroom and found no visible safety hazards. The center is well equipped with high-quality materials. Staff members consistently described that staff member to child ratios are maintained. I reviewed staff records and child attendance records for the date of the incident and three other weeks in the month of October. These records showed compliance with child- to-staff member ratios.     R 400.8110 · R 400.8110 Applicant; licensee; licensee designee. (2) The applicant, licensee, and licensee designee shall have the administrative capability to operate the center in order to provide the services and facilities that are conducive to the welfare of children.

    Following a renewal inspection on 08/05/2021, a report was received that one group of school age children was brought to the park for an unscheduled field trip because the child care licensing consultant was at the center. The staff members were reportedly advised by a lead caregiver to stay at the park in order to avoid licensing finding two groups of school age children. The center has a classroom for school age children with a capacity of 36 and there were 45 school age children in attendance that day. On Monday, 08/09/2021, an inspection was completed on site. The staff attendance records show that 51 employees are on the schedule for the child care center. There is also one volunteer. Interviews were conducted with eight staff members and one volunteer who work in the school age program. Staff members, Nathan Fox, Brianna Halbower, Karlie Kargela, Jeremiah Ogawa, Sadah Scheidt, Myra Stock, Kjirsten Stumbris, Rachel Hoult, and volunteer Whitney Schampers all stated that the basement church room is consistently used for an age group of either Kindergarten through Grade 2 or Grade 3 through 5 on a daily basis for one to eight hours, depending on the weather and activities scheduled for the day. The bathrooms in this area are also used by these children. These bathrooms are not approved and lack hand washing posters. Ms. Schampers stated that she is doing volunteer work at the center for the summer while she is working on her Master's degree. She knew Ms. Williams from former employment at a child care center in 2017. Her duties include curriculum development for the school age program and serving as a leader for the school age staff members. She had been fingerprinted for the school district where she is employed, but not for the child care center. She thought that she had a TB on file at her doctor's office, but a copy was not available. Subsequently, a TB test completed 08/18/2021 was received. She had not completed an orientation for the child care center or any health and safety training. She spends time in the office but does go to the classroom daily to assist with instruction and provide coverage to meet ratio as needed. She had many materials in the unapproved church basement room, including books, games, and a posted schedule. No one at the center had advised her that this room was not approved. No review of licensing rules, reports, or center policies for child care licensing had been reviewed as part of a training. She felt that she knew enough about licensing from her employment at another child care center from five years prior. She had not seen nor reviewed a current licensing rule book. On 08/09/2021 an interview with Jamie Curtis occurred and she advised that she had no knowledge of the unapproved room being used by a group of children. She stated that she was the acting director on this date in the absence of Grace and 3 Patty. The 08/05/2021 was a pizza party at Graveraet playground. Jamie denied that direction was provided to staff to stay off site during the licensing inspection. The school age children are on field trips daily and she thought that if they were off- site, they did not count in the capacity of the school age room. She does the billing for the child care center, which she describes as very busy with such a large facility. Jamie provided copies of child information cards, permission sheets, attendance sheets, and other materials requested. On 08/11/2021, Jamie sent an email stating "I'm glad you got to talk with Patty and clear up a few things concerning Whitney. I also want to apologize for my outbursts. My frustrations got the best of me and I should've reacted calmly to our conversation. I also want you to know that I have built ten brand new first aid kits to pass out to the staff with all the required equipment. Rest assured they will have this with them as well on their future field trips. Have a great rest of your day." The staff members interviewed about the 08/05/2021 field trip to

Children lacked appropriate food, water, and there were no rest room facilities or shade. Since it was not a scheduled field trip, staff members did not bring a first aid kit, sunscreen, water, or the child information cards. On 08/09/2021, children were placed at risk by inadequate supervision at a hazardous sculpture park. Children did climb on sharp metal sculptures and went to the bog area without staff members' knowledge.

    An unplanned pizza lunch delivered from Dominos by a child care staff member at an unscheduled park field trip on 08/05/2021 did not have the components, nor the quantity of food, required of a center-provided meal. Each child had one piece of pizza and some juice was offered. One child with special needs refused to eat. Although the children were told they would have additional lunch upon return to the center, that did not occur.
