R 400.1920 · 1 R 400.1920 Outdoor play area and equipment. (1) A child care home shall provide a clean, safe, and hazard free outdoor play area, on the premises or within a reasonable walking distance of the home.
On February 21, 2023, I completed a home inspection. Ms. Magadanz was providing care to children at the time. Two large dogs and a cat live at the home. During my inspection, children were seated at the dining area table playing with play dough. The main living room, dining area, and approved child use space in the basement is appropriately equipped and maintained for children to remain safe. The floors of these areas did not have debris, feces, or other hazardous items. There are stacks of papers, boxes, totes, clothing, backpacks, clean diapers, books, and toys around the house in various corners. None of these items in the approved child use areas are arranged in a manner that would be a hazard to children. The kitchen is gated off from the children. The kitchen has most of the counter space full of clean and dirty dishes, food, returnable cans, cleaning supplies, plastic containers, clothes, The counter space between the kitchen and dining area is covered with household items, as well. These are generally out of the children's reach and no hazardous items were found. The hallway to the bathroom is blocked by a gate and children need supervision to access the bathroom. At the end of the hall near the bedrooms that are not 2 approved child use space, there was a cat litter box. Although the children have some supervision when they visit the bathroom, the litter box is accessible to them. The bathroom had multiple toiletries accessible to the children including shampoo, conditioner, mouthwash, hair and skin care products, deodorant, and essential oils. These items were on the counter, the edge of the bathtub, back of the toilet, and shelves within reach of children. The back porch has high stacks of boxes, equipment, seasonal items, an aquarium, bags, a grill, a fan, a portable air compressor, a space heater, child cots, many toys that are new in boxes, dressers, and many household items. Although this storage area is not used by children for play, it is the route that is used to access the backyard play area. The path between the items in the back porch has become hazardous due to the amount of storage in the area. The totes or boxes could fall on a child as they walk through the back porch to the outdoor play area. This back porch area is full of dog hair, dust, and various debris. The dogs are often in this back porch area and look through the sliding glass door into the dining area. The large lower level of the home has multiple good quality play spaces available to the children. There is new equipment that is set up to promote imaginative play, as well as blocks, balls, crafting, dollhouses, shopping carts, manipulative toys, a train table, dress-up with mirror, tables and chairs, games, and stuffed animals organized into inviting locations. This lower level is clean, except for a storage room in the back that is gated off from the children. That storage room is not approved child use space. It has boxes, totes, and various household items that nearly reach the ceiling. The outdoor play area did not have any visible feces. The dogs have an outdoor kennel that is separated from the play area. I observed a rake near the kennel that Ms. Magadanz stated she uses to clean the yard of dog feces daily. There was a couple of inches of fresh snow on the date of the inspection.
