(2) A licensee, licensee designee, or program director shall report to the child's parent and the department, directly or via phone, fax, or email, within 24 hours of the occurrence of any of the following: (b) An incident involving an allegation of inappropriate contact.
On 02/09/2022, I conducted an unannounced onsite inspection at Mancelona Middle School. I interviewed licensee designee and program director Ms. Amy Derrer, middle school Principal Mr. Larry Rager, and child care staff member Ms. Catherine Crandall. Ms. Derrer stated that on 02/02/2022 she was informed that Child A told the school counselor that she touched Child B's penis during the Communities in Schools after school program on 02/01/2022. The incident happened during a movie that was being shown in the computer lab. Two staff 2 members and eighteen children, some of whom were age eleven and twelve, were present in the room during the incident. A third staff member was present in the room but left just before it likely happened. Ms. Derrer did not have direct knowledge of what occurred because she was not present in the room at the time. School personnel investigated the issue because Child A reported it to the school counselor during the school day. Prior to 02/01/2022, Child A had never engaged in inappropriate sexual behavior during after school programming nor had there been any concerns about her conduct. She did not make a verbal report of the incident to the department within 24 hours of the incident because the school was still investigating the matter as of 02/03/2022, and then school was closed the following Monday, 02/06/2022. She was also unsure if she was required to report what happened to child care licensing because all of the students involved were over age 12. On 02/09/2022, middle school Principal Mr. Larry Rager stated that on 02/02/2022, school staff found out that Child A touched Child B's penis during Communities in Schools' programming on 02/01/2022. An internal investigation was conducted during which Child A and Child B both admitted that the incident did happen. Mr. Rager reviewed classroom video footage of the event and determined it likely occurred between 4:48 and 4:58 PM because that was the only time when both of Child A's hands were not visible. Given the location of the camera in relationship to where Child A and Child B were sitting, actual physical contact was not observable. Another child, identified as Child C (13-year-old, male), was in close proximity to Child A and Child B throughout the movie. Child C denied witnessing any inappropriate contact between Child A and Child B. During the onsite investigation on 02/09/2022, I observed the video footage of the computer lab from the day and time of the incident between Child A and Child B. Child care staff members Ms. Crandall and Mr. Jacob Kauffman were present in the classroom at that time. Ms. Karen VonOppen was seen on camera just prior to the likely time of the incident. Video footage shows that Child A, Child B, and Child C were seated in the far right-hand corner of the room, kitty-corner from the door, and opposite the classroom video camera. The movie screed was located at the front of the classroom several feet from the door. Mr. Kauffman was seated on the left side of the room along the back wall approximately 20 feet from the corner where Child A, Child B, and Child C were sitting. All of the other students in attendance were seated in front of Child A, Child B, and Child C. Just prior to 4:48 PM, Ms. Crandall was seated at a table approximately 6 feet from Child A, Child B, and Child C. She got up from the table to assist another student and Ms. VonOppen left the room around the same time. On 02/09/2022, Ms. Crandall stated that Child A and Child B were long-time friends, and prior to the 02/01/2022 incident, she had no reason to believe that anything inappropriate would happen between them. In her mind it was a normal day. The only thing she recalled about that day was that she had to tell Child A, Child B, and Child C to be quiet during the movie because they were too chatty.
