Center staff did not use a positive method of discipline when Ms. D'Annunzio pulled Child A's legs forcefully towards her thinking that she could teach the child how to sit away from the child that was troubling her.

The complainant did not leave any contact information; therefore, I was not able to speak to anyone to obtain further information about the allegation. On 03/31/2022 Ms. D'Annunzio stated that the center was not out of ratio. She has five child care staff members working at the center and she is the extra staff person. She stated that there are occasions when four child care staff members are working at the center because the number of children in attendance is low so only four child care staff members are required to maintain the appropriate ratio. She is also present if an additional caregiver is needed in the classroom and to cover breaks. The following three classrooms are open at the center. The Young Preschool, the ages of the children are 2-3-year-olds; the child care staff member to child ratio is 2 1:4, Toddler, the ages of the children are 12-24 months; the child care staff member to child ratio is 1:4, and Preschool, the ages of the children are 3-4-year-olds; the child care staff member to child ratio is 1:10. I observed seven children with two child care staff members in the Young Preschool classroom, two children with two child care staff members in the toddler classroom, and eight children and one child care staff member in the Preschool classroom. The center was in compliance in each classroom. I reviewed the daily attendance sheets for each classroom from 03/25- 03/31 and the child care staff member to child ratio was maintained on each day. Ms. Somo, Ms. Ahenien, Ms. Patrick, and Ms. McWilliams stated that the center was never out of ratio. If their classroom was out of ratio, they would have someone come into the classroom or move a child to another classroom if needed. They have never had more than four children alone in their classrooms. They have never heard of the center being out of ratio in any of the classrooms. Ms. Mansour stated that the center was never out of ratio. She has never had more than ten children in her classroom. She mainly has eight children in attendance. If a classroom was out of ratio for any reason, someone would go into the classroom, or a child would be moved to another classroom if needed. She has never heard of the center being out of ratio.
