On 1/30/2025, I reviewed the after-school program’s daily attendance for 1/27/2025 there were 36 children present. The youngest child was 3 years old. The ratio for the mixed age group was 1:10 and the group size is 30 children. On 1/30/2025, Ms. Byrd stated that she did not know that the preschool children were in the Gym/Cafeteria mixed with the school age children. On 1/30/2025, CCSM 1 and CCSM 2 stated that on 1/27/2025 They had a total of 36 children, and they were not aware that the CCSM to child ratio dropped to 1:10 and the group size drops to 30 for the afterschool program when the preschool children were mixed with the school age children.

On 2/17/2022, Stacy Byrd, the program director/licensee designee, self-reported to the department the allegations that were told to her. She completed the incident report and submitted written witness statements on 2/18/2022. Ms. Byrd was contacted by Child A's mother on 2/17/2022 with concerns M that Child A had disclosed that Child B and Child C had touched and butt. Child A also mentioned another child's name, but there is nobod in the school with that name. Child A was detailed in explaining to ■ mother that was laying 2 down and crayons and pencils were used to hurt Child A complained that "butt was sore" and asked for some cream for it. I reviewed written statements from staff members Rochelle Cowart, Maria Martorana, Jordan Byrd, Megan Modica, and Anastasia Collins. On 2/23/2022, I completed an unannounced inspection at the center. I observed Room 101, where Child A was enrolled. There are 15 children (ages 2 to 5 years '/2 old) enrolled in the class and two staff members. I observed the napping areas where Child A, Child B, and Child C were assigned. Child A and Child B nap towards the middle of the classroom, while Child C is in another area. I saw where the pencils and crayons are stored on top of a shelving unit near the doorway to the classroom. 107 starting. Ms. Byrd stated that no children are ever left unsupervised in the classroom, making it hard to imagine that Child B and C could do what they are alleged to do, and nobody saw it. Ms. Byrd stated that Child A was still adjusting to the classroom and felt most comfortable when ■ was nearby an adult. Child A was grieving the loss of a sister and would talk about sister (who has the same first name as Child C) often with the staff members. was never without adult supervision in the classroom, hallways, or bathrooms. Ms. Byrd stated that in addition to Child B and Child C, Child A also gave another name of a child (indicating it was Child B and Child C's brother) involved in touching inappropriately. There is no child in the school with that name. Child B and Chi C do not have a brother. Child B and Child C have never displayed the alleged behaviors in the classroom before. I interviewed staff member, Maria Martorana. She stated that Child A only attended school f 0or a bout days and sometimes arrived late. would tell staff that ■ missed mom and dad and would stay right by an a u t s side. was never unsupervised. Child A did not have many interactions with the other c ildren enrolled. Ms. Martorana stated that the children got along, but it was more parallel play. During nap time, Child A would be the first to fall asleep. A staff member sat between the younger children in the class to rub backs and the children were always being watched. Ms. Martorana stated she could not see how children would have time to touch or use pencils and crayons on one another. There is no privacy inside of the classroom and someone would have seen. Child A wore pants to school or a 3 jumper with tights. The pants and tights were never pulled down. Ms. Martorana never heard Child A com lain about an hing or anyone in the classroom. ■ E would just reiterate that wanted mom and dad or that did not want to eat or play. Ms. Martorana as not had any complaints against Child B and Child C. They are nice children, and the allegations are completely out of their character. I interviewed staff member, Rochelle Cowart. Ms. Cowart denied ever seeing any of the alleged behavior occur in the classroom. She stated the room is very "PG". There is no sexual talk or behavior at all. Ms. Cowart has never heard Child A complain or make allegations against any children. Ms. Cowart stated that Child A and Child B were onl in class at the same time for seven school days. Child C is older than them, so leaves them alone and socializes with the children closer to ■ age. She woul never expect the allegations to be against Child B and Child C as they are very well behaved in class and have not displayed any ina
