Jessica Schoo did not ensure that all program staff provided appropriate care and supervision of children. Parents of children in care reported that they have seen program staff sitting on the picnic table during outdoor play. Program staff have been observed yelling at children to come to them rather than up and walking around actively supervising children. Children have been observed playing in blind spots within the play area without supervision. Program staff have also been seen talking/looking at their phones instead of supervising children.

The medication box was located on the bottom self of a bookshelf located in the after-school program classroom that was in easy reach of children in care. Based on the information reviewed, there is no indication of inappropriate care or supervision by staff regarding Child A and Child B. Child A disclosed that inappropriate contact occurred between herself and Child B in 2019 while at the child care center. At the time of the reported incident, staff were not aware that any inappropriate contact had occurred and were not informed until several weeks or months later. Due to the lack of specific details regarding the date and circumstances of the alleged incident, a formal investigation by program administrators could not be completed. Upon receiving the disclosure, program administrators took proactive steps to enhance visibility and supervision within the classroom, including rearranging the playhouses to ensure teachers could maintain a clear line of sight to all play areas. These actions demonstrate appropriate and responsive supervision practices by staff and administration.

On 04/13/2023 I received a complaint stating that Child A has had 20 incident reports while attending Oaktree for approximately 60 days. The 2 complaint states that no communication has been made or meetings set up to discuss with Child A's parents these issues. I obtained the center's policy regarding parent communication. The Family Handbook provided to all families enrolled in Oaktree states, "For all accidents and injuries our staff will have a written report ready for you at pickup". Program Director Jessica Schoo reports that incident reports are provided to whichever parent picks the child up that day. I reviewed 23 incident reports involving Child A from 07/22/2022 to 03/16/2023. Twenty of the 23 incident reports indicate which parent was notified of the incident that happened involving Child A. On 13 of the incident reports, Child A's Father (or Child A's Father's pick-up person) was notified. On 7 of the incident reports, it shows that Child A's Mother (or Child A's Mother's pick-up person) was notified. Three incident reports do not indicate which parent was notified. Child A's Father reports that he is made aware of the incidents involving Child A by child care staff members (CCSMs) at pickup and an incident report is provided. Regarding the incident reports of Child A biting other children, Child A's Father reports that he has had communication with child care staff members regarding how the biting issue is being addressed. Child A's Mother reports that she has received a "couple" incident reports at pickup, but that majority of the incident reports are provided to Child A's Father, even on the days that he does not have Child A.

On 04/13/2023, I obtained 23 incident reports involving Child A while in care. Ms. Schoo acknowledged the incident reports that were sent home regarding Child A. Ms. Schoo reports that her staff completes incident reports for the following reasons; if a child is injured, for biting (whether it leaves a mark or not), if a child causes an injury to another child, if a child is sick, or if a child is not demonstrating developmentally appropriate behavior which results in severe interruptions. Six of the incident reports involved an accident such as a slip or fall that resulted in a minor injury that did not require medical attention. Fifteen of the incident reports were the result of Child A biting or hitting another child. Two of the incident reports were the result of another child biting or grabbing Child A. Details provided in the incident reports do not indicate that Child A was not being appropriately supervised at the time of the accident/incidents. Child A's Father did not have concerns regarding the amount of incident reports that have been sent home involving Child A. He knows that CCSMs are working with Child A on the biting, and that incident reports sent home for injuries were minor injuries and the same thing happens to Child A at home. Child A's Father does not have any concerns regarding supervision or care that Child A is receiving. Child A's Mother expressed concern regarding the number of incident reports involving Child A, and that she was not happy with the care the center provided to Child A. However, she did not specifically identify supervision as an area of concern and expressed concern with the incidents being reported to Child A's Father, even on the days that she has Child A in her care. I spoke with the mother of Child B, who is in the same classroom as Child A. Child B's Mother had no concerns regarding the care or supervision that Child B receives.

The complainant expressed concerns regarding the staff to child ratio at the times of the incident reports for Child A. I obtained 23 incident reports regarding Child A from 07/22/2022 to 03/16/2023. I also obtained staff and child attendance sheets for all of the dates and times of the incident reports for Child A. The center maintained appropriate ratio of child care staff members to children at all times in Child A's classroom when the incidents involving Child A occurred.

On 03/23/2023, an onsite inspection was completed. I interviewed program director Ms. Jessica Schoo, CCSM1, CCSM2, and CCSM3. Ms. Schoo reported that Child A's Mother removed Child A from Oaktree Academy. Child A was receiving care in the 24 to 30-month-old classroom. CCSM1 is the lead caregiver. CCSM1 and CCSM2 were in the classroom when this incident occurred. The children were sitting at the table, and CCSM1 and CCSM2 were preparing to serve the children lunch. CCSM1 noticed that Child A was hitting Child B (two-year- old, male) with her hand under the table, and Child B began swatting back at her. CCSM1 then picked Child A from the table and moved her to a cot. CCSM1 stated, "If you are not ready to be at the table, you can sit on the cot." CCSM2 reported that she is a floater, and on 03/17/2023, she was working in the classroom giving CCSM4 her break. CCSM2 noticed that Child A was having a hard time calming down during group time. She changed Child A's diaper, but she was still upset and did not want to participate in activities. Prior to lunch, CCSM1 had talked to Child A three times attempting to help her to calm down. Child A was still upset while they were preparing for lunch. CCSM1 picked Child A up and sat her on a cot. When Child A stopped crying, she came back to the table and sat down. Child A was given her lunch right away. She was allowed to eat as much as she wanted, and she could have continued eating after the other children left the table if she had chosen to. When Child A's Mother arrived to pick Child A up, CCSM1 tried to explain to her what had been going on, but Child A's Mother did not want to listen. CCSM2 stated that CCSM1 did not grab Child A out of her seat by her arm. CCSM1 reported that Child A had been very emotional all day. She observed Child A hitting another child under the table while the children were sitting at the table waiting for lunch to be served. CCSM1 moved Child A away from the table so she could calm down. When she returned to the table, she was able to eat her lunch. CCSM1 reported that she did not grab Child A by the arm. I watched the camera footage during the time this incident occurred. There is no sound on the video. CCSM1 and CCSM2 were preparing plates for the children. Child A was upset and crying, and she was hitting at Child B who was sitting next to her. Child B then began hitting back at Child A. CCSM1 walked over to the table and picked Child A up to stand. I observed Child A throw herself away from CCSM1, so she sat her on the floor. CCSM1 then got a cot and moved it across the room. Child A then stood up, and CCSM1 guided her over to the cot by her arm. Child A sat on the cot at 1 minute and 13 seconds into the video. At 1 minute and 50 seconds, she stood up and looked around until she sat down at the table at 2 minutes and 29 seconds. Due to there not being any sound on the video, I could not hear what was being said, but CCSM1 and CCSM2 appeared to be talking to Child A before she sat down at the table. CCSM2 had placed Child A's plate on the table before she sat down. CCSM brought over a drink as soon as she sat down. CCSM1 appeared to interact with Child A in a firm manner, but she was not aggressive or inappropriate in any way. Child A got up from the cot when she calmed down and walked over to the 3 table and sat down.Child A sat down at the table within one minute of the other children being served their lunches. On 04/27/2023, I interviewed Child A's Mother. She reported that Child A was coming home from child care extremely hungry and fussy. She talked to child care staff members, and they reported that Child A was eating all of her food. Child A's Mother began watching the cameras at the child care center during lunch time. On 03/17/2023, she noticed that Child A appeared to be very emotional and crying while child care staff members were preparing to feed the children. Child A was sitting at the table crying, and CCSM1 came over to the table and picked

Child A's Mother reported that she received a call from CCSM1 on 02/28/2023. CCSM1 reported that Child A had woken up from her nap coughing, and she threw up. When Child A's Mother arrived at Oaktree Academy to pick Child A up, she noticed that she had a large red spot on her forehead. She asked CCSM1 what had happened, and she told her that Child A had bumped her head on the bookshelf while she was trying to get a book. CCSM 1 reported that she was on 5 break when this happened, and CCSM 3 was in the classroom covering her break. CCSM1 told her that there would be an incident report at the front desk. When Child A's Mother asked about the incident report, she was told that there was not one. Child A's Mother brought Child A to the doctor. The doctor did not have any concerns that Child A had received a concussion from the incident. Child A's Mother reported that she received an incident report the next day, but she noticed that CCSM1 had told her the incident had happened at 10:50, but the incident report stated that it happened at 10:00. Ms. Schoo reported that on 02/27/2023, Child A bumped her head on the bookshelf. Shortly after this happened, Child A threw up. Child A's Mother was contacted, and she was upset that she had to pick Child A up. CCSM3 was covering for CCSM4 while she was on break. When CCSM4 returned from her break, CCSM3 went to another classroom. She brought the incident report with her to complete. The incident report states that it happened on 02/28/2023, but it happened on 02/27/2023.Child A's Mother never told her that she took Child A to the doctor, so an incident report was not sent to the bureau. An incident report was provided to Child A's Mother the next day. CCSM3 reported that she was covering CCSM4's break when the incident occurred. CCSM3 was sitting on the other side of the bookshelf reading to some other children, and she did not see it happen. She thinks that CCSM1 was toileting another child, and she did not see it either. CCSM3 heard a "thunk," and Child A began crying. CCSM3 stated, "Oh no, what happened?" Child A then came over to her, and she saw that she had a small red mark on the center of her forehead. CCSM1 stated that she did not see the incident, because she was toileting other children when it happened. She stated that Child A and her friends were on chairs getting books when she bumped her head on the bookcase. She does not think that they were standing, but she is not positive. I watched the camera footage dated 02/28/2023. I observed that Child A and another child were by the bookcase looking at the books on the shelves. Child A was standing on a preschool sized chair. When she bent down to get a book on a lower shelf, she hit her forehead on the shelf. CCSM3 was sitting on the other side of the bookcase with some other children. Child A began crying and walked across the classroom toward CCSM1 who appeared to be assisting another child with toileting. Child A then walked over to CCSM3 who comforted her. On 05/10/2023, I talked to Ms. Schoo regarding the center's policy on notifying parents of accidents, injuries, or incidents. She reported that the policy states that parents will receive written notice of the incident at the time of pickup. Child A's Mother did not receive an incident report until the next day. I completed an onsite inspection at the child care facility on 3/14/2023. During that inspection I spoke with program director Jessica Schoo. *eIxiained to Ms. Schoo that there are concerns that Child A (male, Child B (female,= while playing a gamem e preschool classroom. 2 On 3/312023, Ms. Schoo reached out to Child B's Mother via the app used for communication with parents while children are in care, to inquire why Child B was not in care that day as there was no communication on her absence. Child B's Mother did not respond to the app inquiry; she did stop into the center to speak with Ms. Schoo. She explained that Child B had come home and informed her mother that while playing the fruit sorter game, Child A Child B was upset. so she Opp FerRom"eo"r eMi is worried that Child A will get in trouble and that he will be mean to her for telling on him. Ms. Schoo explained to Child B's Mother that a safety plan will be put in place to make sure that Child B is safe when in attendance at the child care. Ms. Schoo and I reviewed the camera footage from the classroom on 3/2/2023. At one point, Child A and Child B are playing with another child on the carpet using the fruit sorter. There is a small bookshelf that does block the lower part of Child B's that has sense been moved, but visibility of Child A is observable for their entire interaction. I was unable to see anytime in which Child B reached towards Child A in any manner, the game they were playing with was in the middle of them. Child B's attention appeared to be more on the other child playing with them. The child care staff member in this classroom had a discussion with all the children about our friends when they do not want to of our friends. Child B came back on 3/6/2023 and seemed to have a very good day. The child care staff member assigned to her classroom monitored herself and Child B very closely. That evening Ms. Schoo received an email from Child B's Mother stating that Child B had told her it ha ened with Child A and that he told her that he would do it . Ms. Schoo noted at this time she made a written safety he a so noted a s. Schoo reported that Child A struggles and is at times very hard W Ms. Schoo and child care staff members developed a written safety plan to present to Child B's Mother. Part of this plan was to add an additional child care staff member to this room to just monitor Child A and his interactions with all the children. If at any time they did not have the staff to allow this second person in the classroom, (not needed to meet ratio requirements) they would call Child B's Mother to give her the option of picking Child B up. They also assigned seats for group time and meals, so Child A and Child B were not in close proximity to one another; their cots are also placed on opposite sides of the room from one another during nap. On 3/812023, there were not any reported incidents from Child B or her mother. On 3/9/2023 Child B told a child care staff member that a school age child ~". She said that she walked up behind her and Camera footage was reviewed of Child B's time in the gym. Children gather in the gym when they first arrive and before leaving in the evening, Child B was around the school age child she indicated. for a very short period of time in the gym. All interactions were on the camera Ran iere were no observations made to the school age child _ Child B's ■. I asked Ms. Schoo if there have been any incidents with Child B previously. She stated that there are times when she has said things that they have had to redirect and that she has always . This was addressed with insuring she has Ms. Schoo and I touched base on 3/23/2023 in regard to the additional staff that was assigned to monitor Child A. At this time child care licensing does not have any evidence to support the allegations and has not found a violation in regards to appropriate care and supervision so the additional staff is not required by licensing. On 10/21/2022, I interviewed Child A's Mother. She reported that there is a camera system in Child A's classroom that parents can access to observe the classroom. Child A had been having issues with biting and on 10/05/2022 she decided to observe Child A in the classroom via the camera system to see how she was doing. Child A's Mother observed that there were four children in the classroom with one caregiver. She observed one child lying on a cot, two children were playing, and "Ms. Chris" appeared to be holding Child A down on the cot. Child A's Mother reported that she could not fully see Child A or the child care staff member because there was a bookshelf in the way. This went on for about ten minutes. While she could not fully see Child A, she could see that she was kicking and trying to get away from the staff member. Child A's Mother called Oaktree Academy and reported what was going on to another child care staff member. She was informed that the program director Ms. Jessica Schoo was not working. Child A's Mother asked to have Ms. School call her when she returned to work. Child A's Mother continued to watch the camera and she observed another child care staff member come into the classroom. That child care staff member was able to calm Child A and lay her back on the cot. Child A's Mother did not understand why so much focus was being put on getting Child A to lie down, but other children were allowed to continue playing. When Ms. Schoo did not call her over the next couple of days, so she contacted her. Ms. Schoo did not seem to take her concerns seriously and she explained the incident away by stating that sometimes staf must focus on getting one child settled down before moving on to the other children. Child A's Mother stated that she did not feel like Ms. Chris was trying to abuse Child A, but she was frustrated when there was no follow through or attempt to address her concerns. Child A's Mother reported that she became more concerned when two days later she was told that the cameras were not working. Child A has received care at Oaktree Academy since February 2022. The only other issue she has had was when she was informed in September 2022 that Child A had been biting. She talked to child care staff members and had a meeting with Ms. Schoo to discuss this issue and she felt like she was getting inconsistent stories about the biting incidents. On 10/27/2022, an onsite inspection was completed. I interviewed program director Ms. Jessica Schoo and child care staff members Ms. Christine Jeffreys and Ms. Hannah Schmuhl. Ms. Schoo reported that she was not working on the at the time that this incident occurred, but child care staff members informed her when she returned to the facility at 4:00 that afternoon. Ms. Christine Jeffreys and Ms. April Linke were working at the time. The staff members reported that Ms. Jeffreys was working in the room with four children at the time and Ms. Linke was working in the office area. Ms. Jeffreys was in the process of preparing children for rest time. While Ms. Jeffreys was settling Child A down on her cot, there were still two other children who were playing while waiting to be put down. Ms. April Linke took the call from Child A's Mother. Ms. Linke went into the room to see if Ms. Jeffreys needed help. She observed that Child A was lying on her stomach and Ms. Jeffreys was rubbing 3 her back. Child A was smiling and did not appear to be distressed at all. Ms. Linke then sat with Child A while Ms. Jeffreys got the other two children settled down for nap. Ms. Schoo talked to Child A's Mother when she picked Child A up. Ms. Schoo reported that she apologized to Child A's Mother that Child A could not be fully seen due to the bookshelf being in the way. She explained to Child A's Mother that Child A was not being held down and she was not upset. a couple of days after this incident, the camera system went offline.
