    R 400.8182 · R 400.8182 (2) Ratio and group size requirements. At least 2 adults, 1 of whom is a child care staff member, shall be present at all times when 7 or more children over 3 years of age are present. A second child care staff member 4 is required when needed to comply with subrule (3) of this rule.

    On Thursday, 09/15/2022 I completed an unannounced onsite inspection after receiving the allegations that the center was out of ratio. I interviewed program director, Jen Hamady. I asked her had the center been out of ratio. She said, "yes" they had been out of ratio, however the program directors' step in if they are out of ratio to maintain compliance. Ms. Jen said during the current week of 09/12/2022-09/15/2022, the center had multiple call-ins that affected the preschool classroom. Ms. Jen said the center was out of ratio, but not for more than 5 minutes. Ms. Jen said the region sent substitutes to rectify the problem. I did a walkthrough of the center to count the children to staff ratio while on site. Below is the count of each classroom that shows the child to adult ratio on 09/15/2022. During the onsite inspection, I interviewed child care staff members. Child care staff member, Emily Benitez who has worked at the center for nine years in the infant class said whenever her class is out of ratio, the office sends someone. Child care staff member, Matt McCann who as been at the center since 2013, who works with the summer camp said if they are ever out of ratio, they call the office are immediately relieved. Child care staff member, Cassandra Northcott, who works with the 1 -2 toddlers said 1/2 yes, usually in the mornings for about 30 minutes, the center has been out of ratio; however, they just call the office, and they will send someone to the classroom to fill in. Child care staff member, LaKesha Furniss, who has been at the center for six months in the infant room said she has never seen the center out of ratio. 3 Child care staff member, Stephanie Parks who has been at the center for three years, who works with the 3-year-olds said sometimes in the mornings they are out of ratio; however, the director will step in when needed. Child care staff member, Abby Wiseman-Morris who has been at the center since June, who works with the 4-year-olds said she hasn't seen the center out of ratio. I requested sign in sheets from the week of 09/12/2022 up to 09/15/2022. On 10/10/2022, I completed an unannounced inspection. While onsite, I went to each classroom and counted the number of children to adults. All classes were in ratio. See chart below. I was unsure of how to read their record keeping. During the conversation, I asked Ms. Jen to recall if the center was indeed out of ratio during this week that the allegations were made. Ms. Jen said, "yes, we were out of ratio." Ms. Jen said since that time, they have hired more staff to rectify the issue. On 11/01/2022, I called Ms. Jen for an exit conference and to confirm the room that was out of ratio during the week of 09/12/2022-09/15/2022. Ms. Jen reported that Room 6, the preschool classroom, ages 3-4 years old, was out of ratio during 09/12/2022- 09/15/2022, specifically during nap time.

    On 01/14/2022, I spoke with Child A's Mother. She stated that she was not notified by the center that Child A was injured prior to arriving to the child care center. She failed to report the seriousness of the injury to the director and the center failed to call them to inform her that Child A had been severely injured. Child A's Mother said that prior to taking Child A to see his pediatrician on 01/14/2022, she requested a copy of the incident report from Jennifer Hamady, program director. She stated that Jennifer Hamady indicated that she was not aware of the severity of Child A's injury, she was not aware that he had a nose bleed, and that the staff should have called to report the injury. Child A's Mother stated she showed Jennifer Hamady the photo of Child A's injury and Jennifer Hamady gasped audibly when she looked at the photo of the injury. The photo was taken on 01/13/2022 at 05:45 p.m. On 01/24/2022, I reviewed the accident and incidents policy. The policy stated that parents will receive a call to inform them of the situation and an Accident Report will be completed detailing the circumstances surrounding the injury. Parents will be asked to sign the Accident Report at pick up time. On 01/24/2022, I received a copy of the Learning Tree Child Care Center Accident/Injury/Blood Borne Pathogen Report Child Occurrence. The report was 5 signed by the reporting person, Ms. Northcott, initialed by the supervising personnel, Ms. Suggs, and signed by the parent or guardian, Child A Mother.

    On 12/22/2022, an email was sent to the complainant to gain additional information. To date the complainant has not replied and no additional information was gathered besides the written complaint. According to the written complaint received on 12/21/2021, there were three occasions that the Infant 2 room was out of ratio. The first time, the complainant was picking up and she observed child care staff member, Mainta Zope, taking a laundry basket to another room in the center. There were six infants in the Infant 2 room, Child A (4 month old, male), with one child care staff member. The second 1/2 time was like the first time. The complainant was picking up and she noticed Ms. Zope coming back to the room. There were more than four infants in the room with one child care staff member. The complainant asked Ms. Zope if they are usually out of ratio, and she did not understand what the complainant was asking her. The complainant then said it should be 4:1 and she said yes and went back into the room. The third time, the complainant was dropping off last week. There were 11 infants with two child care staff members in the Infant 2 room. The child care staff members went to take Child A and she told them she was not comfortable handing off Child A, the 12th child, until there was another child care staff member and they were in ratio. The complainant asked if someone else was coming into the room and the child care staff member said yes and closed the door to call the office. The office is around the corner from the Infant 2 room. The complainant heard and saw the lead teacher, Emily Benitez, chatting with the program director, Kaitlynn Suggs, as if she had nowhere to be and just arrived. Their conversation was interrupted by the phone call from the Infant 2 room and Ms. Suggs came right away. Ms. Benitez followed and as Ms. Suggs was about to enter, Ms. Suggs said to Ms. Benitez, "Oh, you're here now?" Like she had not noticed her come in, although they had been causally chatting the whole time beforehand. Ms. Benitez entered the room and took Child A from the complainant. On 12/27/2021, I completed an unannounced onsite inspection at The Learning Tree- South. I spoke to program directors, Ms. Jennifer Hamady and Ms. Suggs, and lead caregiver, Ms. Benitez, regarding the allegations. The Infant 2 room was observed. There were seven infants, 6 weeks to 12 months, with three child care staff members. Copies of the child information cards, The Learning Tree's infant safe sleep policy, and Kids Report was provided for review. According to Ms. Hamady and Ms. Suggs, they are aware of the allegations. Child A was enrolled in the Infant 2 room at the child care center. The child care staff members in the Infant 2 room are Ms. Benitez, Ms. Zope and Caryn Engel. Child A attended the child care center for a month, from 11/15/2021 to 12/17/2021. Child A's Mother wanted someone to provide one on one care to Child A. Child A's 3 Mother had unrealistic expectations and complained often. They tried to please her, but she became upset when the center required her to pay a two-week balance even though she provided notice that Child A would no longer be attending the child care center. Regarding ratio, they are usually overstaffed in the mornings at the center according to Ms. Hamady and Ms. Suggs. The infants usually come in early, and the toddlers come in late. A child care staff member from the toddler class comes in the morning and covers the infant room to provide additional support. The child care staff members call when they need to leave the room for bathroom breaks, etc. They know the child care staff member to child ration in the infant room is 1:4. The incident that occurred last week, they had three parents drop off at the same time. The child care staff member was two minutes late. She was clocking in when they were receiving a call to come down to cover the room. According to Ms. Benitez, she is the lead child care staff in the Infant

    R 400.8188 · R 400.8188 Sleeping, resting, and supervision. (4) Infants shall be placed on their backs for resting and sleeping.

    According to the complainant, a couple weeks ago, she came to pick up Child A and he was sleeping on his belly. Child A has been rolling. When the child care staff member woke him up and handed him to her, Child A had two red marks and indents where his head had been pushed against the rails of the crib. The complainant asked when Child A was last checked while sleeping. It was obvious that he had been like that awhile. The child care staff member wasn't sure and stated maybe 15-20 minutes ago. She had just come in so Ms. Benitez could leave, and she was the last to check Child A. The complainant went to Ms. Hamady and showed her Child A's head. She said that's never happened and she'll talk to the teachers about that. The complainant's concern is that no one was checking Child A while he was sleeping. The marks on Child A's head lasted the rested the evening and were gone by the morning. On 12/27/2021, according to Ms. Hamady and Ms. Suggs, the children in the infant room are checked every 15 minutes. Child A likes to sleep near the rails on the crib. The child care staff members would move him to the center of the crib and he would move right back. There was a mark on Child A's head that would go right away, and 5 Child A was not injured. Child A's Mother complained several times to the child care staff member regarding Child A sleeping near the crib rails. Detail notes were provided to Child A's Mother through the Kids Report application regarding his sleeping. According to Ms. Benitez, the infants are laid on their back, flat surface or in a sleep sack if age appropriate. If the child is unable to roll back and forth, they turn the child back to their backs. The children are checked every 15 minutes, there is a timer on the side the refrigerator that is set to ensure that they check the children timely. Child A was a roller and he rolled in his sleep. Child A would move to side of the crib. They moved him to his back every 15 minutes. Child A's moving during his sleep was addressed with Child A's Mother. On 12/27/2021, the center infant safe sleep policy was reviewed. According to the policy: • All teacher and administrators working in the infant room, or could potentially work in the infant room, must complete a yearly SIDS training. • Infants are always placed to sleep on their back, no matter their age. When infants can easily turn over from their back to their stomach, they can be allowed to adopt to whatever position in which they prefer to sleep. • Sleeping infant must be checked every 15 minutes according to the Infant Sleep Check Policy. • Nothing should be placed in the crib with the infant or draped over the side of the crib- no blankets, pillows, stuffed animals etc. Infants may not use wubbanubs. • Bibs and pacifier clips should be removed before infant is placed in the crib. • Only one infant a crib at a time unless the center is being evacuated in an emergency or drill. • Infants who arrive asleep in their car seat are to be moved immediately to a crib. • Infants may not sleep in or on anything other than a crib. If an infant falls asleep in a bouncy set, swing, or the floor, they are to be moved immediately to a crib. • Infants may be swaddled until 2 months of age. After 2 months infants cannot be swaddled. After 12 months of age infants must be placed on a cot to sleep. • Sides of cribs must be up while infant is sleeping. On 02/08/2022, according to Ms. Zope, the children 11 months and under sleep in the cribs, after their birthday, they are transitioned to the cot. Infants are placed on their back to sleep. If an infant can role, they leave them to sleep comfortable. The children in the Infant 2 room are checked every 15 minutes. Their breathing is checked by observing their stomachs and breathing checked with their fingers. According to Child B's Mother and Child C's Mother, they were unsure about the sleeping allegations. They had never seen their children sleeping on their stomachs A and did not have

    According to the complainant, the enrollment paperwork mentioned a health appraisal, but it was never requested or collected during Child A's enrollment of 1 months, including his immunizations. No forms were given to 1/2 the complainant to complete. The complainant was not aware that the health appraisal was required until Child A was enrolled at another child care center. On 12/27/2021, according to Ms. Hamady and Ms. Suggs, children are enrolled to the child care center through the center's website. All enrollment forms are on the website for the parents to access. The forms can be print and turned in or turned in electronically. Parents have 30 days to turn in the children health appraisal form. They audit the children files monthly. Ms. Hamady and Ms. Suggs reviewed Child A's file and there was no health appraisal on file for Child A. There was a MICR report that stated that Child A immunizations was current. A review of the health appraisal and immunizations were completed of all the children enrolled in the Infant 2 room. Eight of the 15 children records reviewed were incomplete. There was no health appraisal of immunizations on file for the eight children records. According to Ms. Benitez and Ms. Zope they were unsure about the enrollment records for Child A. According to Child B's Mother, a health appraisal was asked for at enrollment for Child B. She provided the information to the child care center. Child C's Mother stated that Child C has been attending since he was 12 months old, and the child care center has not asked for a health appraisal for Child C. Child C's Mother stated that Child C has been to the doctor, and she can provide them with a physical.

(3) For children under school-age, at the time of a child's initial attendance, a center shall obtain, keep on file, and make accessible in the center 1 of the following: (a) A certificate of immunization showing a minimum of 1 dose of each immunizing agent specified by the department of health and human services (DHHS'.

    According to the complainant, Ms. Benitez and Ms. Suggs claimed the infants are taken for walks outside, but she has only seen them going for walks up and down in the hallway, without any outdoor gear on. The child care staff members do not interact with the young infants and they just lay them on the ground with a boppy pillow. The child care staff members do not attend to the children when they cry, and they leave them strapped into the stroller cart. During the day, they do interactive activities with the infants who can sit up, crawl and walk. On 12/27/2021, during the onsite inspection, I observed the Infant 2 room. There were seven infants with three child care staff members. Two of the children were sleeping in the cribs, and four children were finishing their lunch. The seventh child's diaper was being changed by a child care staff member. As the children finished their food, Ms. Benitez, dress four infants in their shoes, hats and coats, and she placed them in the buggy and walked them around the playground. The children were outside for approximately 15 minutes. According to Ms. Hamady and Ms. Suggs, the children are taken outside twice a day, if weather permits them to go outside. In the infant room they go out in shifts, they have three buggies with four seats each. The children also participate in small/ large group, tummy time and sensory bins at the child care center. According to Ms. Benitez, the children are taken for walks twice a day, in the morning and afternoon. If the weather permits them to go outside, they bundle the children up and they take them outside for a walk. If the weather does not permit them to go outside, they will walk them around the building. They go outside for about 30 minutes. Some children may miss the outdoor time if they are sleeping or being feed during that time. The children participate in large group, work time, and rj message board. The children also enjoy painting, books sand, tummy time and they explore the sensory toys in the classroom. On 02/08/2022, according to Ms. Zope, the children are taken outside for daily walks, twice a day and they participate in other activities. According to Child B's Mother and Child C's Mother, the children are taken outside daily. Child B's Mother stated that the child care staff members have requested winter clothing (i.e. snow pants, hats, etc.) for Child B which she has provided so she can be taken outside daily. Child C's Mother stated that Child C is taken outside. She has seen pictures of Child C outside in his snowsuit in the buggy with other children. Child C's Mother also stated that the children paint pictures, play with sensory boxes, and plays with buckets with balls. The children have access to toys and equipment that allow the children to pull themselves up and stand.

(6) Within 30 days of a child's initial attendance, a center shall obtain, keep on file, and make accessible in the center a record of a physical evaluation of the child that notes any restrictions and is signed by a physician or the physician's designee. An electronic record from a physician's office will be accepted. The physical evaluation must be performed within 1 of the following time limits: (a) For an infant, within the preceding 3 months.

    According to the complainant, the cribs in the Infant 2 room sit next to each other, touching. They are not 2 feet apart next to each other. On 12/27/2021, during the onsite inspection the cribs in the Infant 2 room were observed. There were 12 wooden cribs with plexiglass on each end of the cribs. The cribs were placed end to end on one side of the Infant 2 room. The cribs in the infant room are not two feet apart however they have solid panels and are allowed to be end to end. On 12/27/2021, according to Ms. Hamady and Ms. Suggs, the cribs are placed next to each other, end to end. They believe the cribs are in compliance with the licensing rules. According to Ms. Benitez and Ms. Zope, they have cribs for the infants and some cots available for the older children. There is solid plexiglass at the ends of the cribs, and they are placed end to end. Child B's Mother and Child C's Mother were unsure about the crib allegation and stated that they had no concerns about the cribs at the child care center. 11

    On 11/05/2021, l spoke with . . She E stated that the incident happened last Thursday, She ex lamed that Child A's Mother told that Child A had redness to the outside of genital area. On 11/02/2021, Child s Mother told her that the redness and irrita ion was gone. stated that Child A's Mother had a picture that was taken on 10/28/2021 the redness. She reviewed the photo that showed the redness. She said the center reported that they do not assist with bathroom usage. We scheduled an unannounced joint onsite inspection. On 11/08/2021, 1 completed an unannounced joint inspection with Kaitlynn Suggs, program director was interviewed. She explained that on 10129/2021, Child A's Mother alerted the child care center that Child A told her that genital area hurt, and wanted to sleep without. undergarments. ■ I Child A's Mother said she examined Child A and asked what happened at school and Child A said teacher, Jennifer Parks pinched According to Ms. Suggs, Child A was picke up last Thursday b grandfather. here were no reported incidents or problems reported prior to dismissal. Ms. Suggs stated that Child A's Mother came to the child care center on 10/29/2021. She met with her and Jen Hamady, interim program director. They discussed the allegations regarding incident. Child A sent an email to summarize the meeting and included that she did not want the information shared regarding Child A. Child A's Mother said Child A had Ms. Suggs stated that Stephanie Parks, CCSM and Matt McCann, CCSM are assigned to Child A classroom. However, Mr. McCann did not work in the GSRP classroom on 10/28/2021. Ms. Suggs stated that Child A was on the balance bike 0 outside before ■ was picked up by grandfather. Child A did not complain about any irritation or pain. Ms. Su s said Child A has been potty trained for two years and does not wear pull- ups. did not have any accidents or need to change of clothes on 10128/2021. Ms. uggs said the children are not assisted in the bathroom. The staff stay outside 4 of the stall and supervise the children while they are in the bathroom. Therefore, there is no time that staff would have been able to pinch Child A on ■ Ms. Steihi anie Parks; CCSM was interviewed. She said Child A is potty trained when came to her classroom. According to Ms. Parks, Child A did not complain about anything during the time that■ was at the child care center. During the outdoor play transition, the children go to the bathroom as a group. The teacher stands at the door to supervise the children. Child A did not have any accidents or need for change of clothes on 10/28/2021. The center has never received any complaints from Child A's Mother. Matt McCann, CCSM was interviewed. He stated that he did not work in the GSRP classroom on 10/2812021, he said he worked in the toddler transitional preschool classroom. Mr. McCann stated that he worked in the GSRP classroom earlier that week. He said he did not assist in the bathroom and neither did Stephanie Parks. Child A did not seem like anything was bothering is independent and does not wet her clothes. Mr. McCann stated that he does no ave any concern with Ms. Parks interactions with the children. During the onsite inspepctiiocnk I observed the bicycle that Child A was riding when$ grandfather arrived to up. Child A classroom was observed and the bathroom that Child A classroom use was observed. explained that Child A's Mother did not take Child A to the doctor. ■ requested that Child A's Mother take Child A to the doctor, and she refused. On 11118/2021, l left a message for On 11/18/2021. l sooke with Child A's Mother. She said she sooke with A E told er, "My butt hurts, Ms. Stephanie scratched me there". Child A's Mother said there was a slight, light bruise on the outside of genital area. Child A's Mother stated that the bruise is healed. She described t e bruise as being similar to a bruise if you accidently hit your arm on a wall. Child A's Mother explained that Child A is independent at hom

    On 04/20/2021, I spoke with Child A (three-year-old, female)'s Mother. She told me that children walk alone to the next classroom where the bathroom is located. Child A Mother told me that the children are supervised by the receiving classroom that is two doors down the hall. She told me that Child A was not with Desiree Calderon, Child Care Staff Member when she went to the bathroom. According to Child A's Mother, on 04/13/2021 Child A told her that Child B (three-year-old, male) came in the bathroom and touched her vagina and butt with his finger. Child A Mother told me that on 04/13/2021, she emailed the child care center to inform them of the incident that was reported to them by Child A. On 04/14/2021, Child A's Mother and Child A's Father met with the Ms. Kaitlynn Suggs, Program Director and Ms. Mori Anderson, Assistant Director. They explained that they were not aware of the incident that Child A reported to her. They apologized for the incident and told her that they would implement new changes to the current bathroom policy. The new changes would include another child care staff member being hired to work in Child A's classroom and designated bathroom times would be supervised by s child care staff member who will take groups of children to the bathroom. Child A Mother told me Child A continues to attend the child care center. Child A returned to the child care center on 04/20/2021. Child A Father was told that there is a new child care staff member in the classroom, and she would be supervising the children when they go to the bathroom. She told me that she is appreciative of the new changes that have been put in place with the bathroom procedures. On 04/21/2021, I spoke with Detective Marx, Livonia Police Department. She told me that she would be going out to child care center to speak with staff. I told her that I have an unannounced inspection scheduled and I would follow up with her after the inspection was completed. On 04/23/2021, I completed an unannounced inspection at the child care center. I spoke with Mori Anderson. Assistant Program Director. She told me that Child A Parents stopped by the office on 04/14/2021 to report an incident that Child A informed them of. Ms. Anderson told me that she was not aware of the information prior to speaking with Child A Parents. Ms. Anderson told me that Child A is very verbal and would have told her or Ms. Calderon if something happened to her in the bathroom. Ms. Anderson told me that the Child A continues to attend the child care center. Ms. Anderson told me that she was in the Pre-K classroom on 04/13/2021, which is the date that Child A told her mother about the incident with Child B. Ms. Anderson explained that the bathroom doors are always open from the hallway. There is also an opening to the bathroom facing the inside of the classroom. Ms. Anderson told me that the boy's bathroom is connected to the Pre-K classroom and the girl's bathroom is across the hall and is connected to the Transitional Preschool classroom. 4 I completed a walkthrough with Ms. Anderson, she explained the previous bathroom procedure that was utilized for the children. The teachers call down to the classroom to inform the receiving teacher that the child is on the way down to the bathroom. The child care staff member's watch the child down the hallway (two doors down) and the receiving childcare staff member watch the child when they are on the way back to the classroom. Children are never sent together down to the bathroom. When children go in groups there is always a child care staff member present. The new bathroom procedure requires a child care staff member to go with the child to the bathroom. Ms. Anderson told me that on 4/18/2021, she received a follow-up email from Child A's Mother rerequesting that Child B's Parents be notified of the allegations, requesting that the child care staff members in the connecting classrooms be made aware of the allegation and askinga that the new bath
