Interviews were completed with Premier Learning and Daycare Center Teachers 1, Teacher 2, Teacher 3, Teacher 4, Teacher 5, Teacher 6, Teacher 7, and Teacher 8. They denied that licensee designee’s Patricia Saleh, and Husain Saleh acted in a manner that is non- conducive to the welfare of children. The Teachers also denied that the designee’s scold or humiliate staff.

The storage room that is identified as a room for emergency coverage (PreK students) was not maintained in a safe condition and poses a threat to health or safety. On 03/22/2021, l called the Child A's Mother i-year-old M. She explained that on 0311612021 after icking up her from Premier Learning Day Care Center, she noticed a bruise on right ear lobe. ecause she thought it was blue ink, she did not do anything. On 117/2021, Child A attended child care and was picked up at " When they arrived home, mother noticed that there was still isco ation on Child A's ear lobe. e realized then that this was a bruise. She 4 called the center to ask what happened but could not reach anyone. On 0312312021, 1 coordinated with to complete an onsite visit to interview Mrs. Patricia Saleh, substitute program director and each CCSM in the _#1 classroom. We arrived at Premier Learning Day Care Center at 8:51a m. In the interview, I asked Mrs. Patricia Saleh if she was aware of an incident resulting in an injury to Child A. She said she was not aware of any incident. She said the CCSMs assigned to Child A's classroom are "good at writing incident reports. They write reports for everything, even the smallest incident." I asked to see their accident and injury policy. There was no accident and injury policy. Mrs_ Saleh said ever since the program director resigned, she had been working on all the policies and procedures for the center. She said she assumed the former program director had created them. I asked Mrs. Saleh which CCSM was assigned to Child A primary caregiver. asi She mentioned she had not yet created primary giver assignments. I provided Technical Assistance to Mrs. Saleh on R400.8185 (2) and R400.8185(5). I asked Mrs. Saleh if the center provided new hires with an orientation to review the center's policies and practices after hire and before unsupervised contact with children. Mrs. Saleh said she did not conduct an orientation for new hires. I provided Technical Assistance to Mrs. Saleh on R400.8131(1). I asked Mrs. Saleh how the teachers were trained who are hired at Premier Learning Child Care Center. She said she places new teachers in the classroom with a more established teacher to observe what they do. On 03/24/2021, I completed an onsite visit with Mrs. Saleh. I asked her for an overview of the orientation that the center conducts with all new employees after hire and before unsupervised contact with children. Note: During an onsite visit on 03/23/2021 while conducting an interview for a related allegation, Mrs. Saleh said she does not provide an orientation regarding the center's policies and practices after hire and before unsupervised contact with children. On 03/23/2021, during the interview with Ms. Patricia Saleh, having knowledge the program director resigned on 03/02/2021, I asked when they were hiring a permanent program director. Ms. Saleh said they were in the process of hiring a new one. Ms. Saleh said they were supposed to have an interview on 03/23/2021 but the young lady did not show up for the interview. Mr. Mohammed Saleh, licensee designee, was called by his ■ to come to the center to speak with me. Mr. Saleh came to show me the documentation that an interview with a potential program director was scheduled on 03/24/2021. He showed me text message exchanges, his outgoing, and incoming phone call log. I observed that they communicated several times regarding her scheduling and confirming an interview with Premier Learning Day Care. The candidate did not keep the schedule to attend the interview. Mrs. Patricia Saleh has been operating in the role of Program Director since 03/03/2021 at Premier Learning Day Care. The center is making efforts to hire a permanent Program Director.

I interviewed the complainant by phone on 03/04/2021. She said she is concerned because there are generally two staff present in the mornings when most parents drop off their children. The complainant stated that parents are not allowed inside the center, so they are unaware that their children are in classrooms that are out of ratio. I made an unannounced onsite visit to Premier Learning and Daycare Center on 03/04/2021 from approximately 8:48 AM to 10:22 AM. The licensee nor the program director was present. The person who was in charge was the wife of the License Designee, Patricia Saleh. When I asked to speak with the Licensee Designee or the Program Director, she stated that the Licensee was not there, and the Program Director was terminated on 03/02/2021. I asked Mrs. Saleh what her role was, and she said, "she helps around the center." Mrs. Saleh accompanied me to each classroom. None of the classrooms were out of ratio. In the infant classroom, there was one child care staff member (CCSM) and four infants present. Toddler #1 classroom had two CCSM and seven children present, ages 1 — 11 /2. Toddler #2 classroom had two CCSM and six children present, ages 2 — 21/2. Pre-K #1 had two CCSM and 12 children present, all age 3. Pre-K #2 had two CCSM and 11 children present, all age 4. I asked for the attendance sheets for the staff and the sign in/sign out sheets for children. Because Mrs. Saleh was not on the staff attendance sheets, I asked her for all required documents for herself to see if she was eligible to be with children. Mrs. Saleh had the following documents on file: fingerprint eligibility letter, current CPR/First Aide certificate, Negative TB test, Blood borne Pathogen certificate, Consent Disclosure Form, Infant Safe Sleep, Shaking Baby and other professional development certificates for 2020. I asked her about the allegation of being out of ratio. Mrs. Saleh said, "yes, we have been out of ratio a few times in the mornings." I asked her which age group she would say had been out of ratio. Mrs. Saleh said, "Toddler #1 and Toddler #2, 21/2 (children ages 1 - years old) would be the group that is sometimes out of ratio." I asked her what they were going to do to change the issue of being out of ratio. Mrs. Saleh said she would ask two of the employees to come in at 7:00 a.m. I asked Mrs. Saleh what the immediate action steps they are taking regarding not having a Program Director. Mrs. Saleh said they are in the process of hiring a new one. I asked her had her consultant been notified that the Program Director was terminated. She said her husband, the Licensee Designee was going to notify the consultant. On Friday, 03/05/2021, I had an exit conference with Mr. Mohammed Ali Saleh, Licensee Designee via telephone. I discussed my unannounced onsite visit from 03/04/2021 and shared with him the conversation I had with Mrs. Saleh, his wife. I asked him if he knew that sometimes the center was out of ratio. He said, "yes." . I 4 asked Mr. Saleh what action steps he would take moving forward as to not be out of ratio. He said, "I will pay my employees to come in earlier and stay later and if staff call in who are absent, I will excuse the child from coming that day." Our exit conference ended. On Thursday, 03/11/2021, I called Premier Learning and Daycare Center to follow up on the ratio allegation. I spoke with Patricia Saleh, CCSM. She said the center has not been out of ratio since my onsite visit on 03/04/2021 and said she is a CCSM and has updated the staffing plan to reflect as such.
