The department received an incident report from licensee designee, Rebecca Adamski on 07/22/2022. On 07/26/2022, I completed a telephone interview with CCSM and Child A's Mother, Arianna Kainz. Ms. Kainz her classroom, and Child A's room were outside on the playground. Ms. Michelle Falvo, Ms. Monica Koivela, and Ms. Margaret Parham were the CCSMs outside with her. Ms. Kainz was working with Ms. Koivela. Child A is enrolled in Ms. Falvo and Ms. Parham's room; Child B is enrolled in Ms. Kainz and Ms. Koivela's room. Ms. Kainz had her back turned to the area that Child A's room was playing in, however, Child B kept coming over to Ms. Kainz and tattling on Child A for one thing or another. Ms. Kainz kept telling Child B that in Ms. Koivela's room "the kids do not tattle" instead they try and work it out amongst themselves. Ms. Kainz turned to see Child A. As Child A was walking, Child B was hitting him with a closed fist. Ms. Kainz has always told her son to defend himself and not to let anyone bully him. Ms. Kainz went over to Child A and Child B. Ms. Kainz grabbed Child B's hands to direct Child B to face her. Ms. Kainz states that she was down at eye level with Child B and turned her so that she could face her eye to eye. Ms. Kainz told Child B, "we don't hit our friends, how would you feel if someone hit you?" Child A was crying during this interaction. Ms. Kainz then told Child A, "...go ahead and see how she likes it." Child A swung to hit Child B. Ms. Kainz stated that Child A barely hit Child B and instead hit her more than Child B. Ms. Kainz was still holding on to Child B when she encouraged Child A to hit Child B. Ms. Kainz is not sure if any of the other staff members saw Child B hit Child A. Ms. Koivela came over to Ms. Kainz and said someone was going to tell on her. Ms. Koivela told her, "You know Child B is going to tell her mom." After that, her classroom in went in for nap time. Ms. Kainz knows that Ms. Falvo called down to Ms. Koivela's room when she was leaving out for lunch; she is not sure why or what she wanted. Ms. Kainz took her lunch and then around 2:00p.m., Ms. Rebecca Adamski came in and got her out of the room and brought her down to the office. Ms. Adamski asked her what happened on the playground. Ms. Adamski told her that she was informed that Child A looked scared when she encouraged him to hit Child B. Ms. Kainz told her that of course he was scared after Child B had hit him a ton of times. Ms. Adamski told her that she was terminated immediately. Ms. Kainz states that Child A and Child B have never had any issues in the past. Ms. Kainz stated that Child B is "generally sassy", but Child A could be a "stinker" as well. Ms. Kainz feels that the staff allow kids to hit each other too much and they turn a blind eye. On 07/26/2022, I completed a telephone interview with Child B's Mother. Child B's Mother has two children that attend the center. Both children have been attending since they were 12 weeks, four years for one child, and three years for the other. Child B's Mother was informed of the incident by licensee designee Ms. Adamski. 3 Child B's Mother asked Child B what happened on the playground and Child B began to cry. Child B's Mother told Child B she was not in trouble. Child B told her mother that she hit another kid, and then Ms. Kainz grabbed her by the arm and brought her over to Child A. Ms. Kainz then told Child A to hit Child B. Child B told her mother that Child A hit her three times; Child A hit her two times on the left shoulder and once on the right shoulder. Ms. Kainz said, "See [Child B] how do you like that." Child B said she was crying, and that Ms. Kainz made her go stand by the tree, but she did not want to stand by the tree. Ms. Adamski told Child B's Mother that other staff walked up to Ms. Kainz and told her this is not how we discipline children. Ms. Adamski told her that all the staff on the playground saw the entire incident. Child B's Mother spoke directly to Ms. Kai

On 06/13/2022, I completed a telephone interview with Child A's Mother. On 06/11/2022 Child A (3-year-old, female) was asked about the center in general. Child A's Mother asked her if the staff was nice to her and if she gets in trouble. Child A said that she does not get in trouble, but that Child B does get in trouble. Child A's Mother noticed that Child A often tells her that Child B gets into trouble and asked Child A what happens when Child B gets in trouble. Child A informed her that Ms. Margaret spanks Child B and puts her in the wooden chair. Child A's Mother asked Child A what it looks like to make sure that she was not misinterpreting what happens. Child A got up and tried to spank her behind to demonstrate what Ms. Margaret does. Child A's Mother then asked Child A if she has ever been spanked, Child A said that she never had, only Child B, Child D, and Child E get spanked. Child A's Mother asked Child A why they were spanked, Child A said because they are bad, Child B cries, and Child D and E runs around the room. Child A's Mother showed Child A the classroom picture and asked her if the teachers in the picture spanked her. Child A said, "I told you I don't get spanked because I am not bad." Child A's Mother asked Child A to point to the kids who are spanked. Child A pointed at Child B, Child D, and Child E. Child A's Mother asked her again the next day and Child A told her that does not get spanked and provided her the exact same information she did the day before. Child A has been attending the center since in the 3-4-year-old split classroom. Child A's Mother knows that the room has a few new staff members, and the lead teacher has been on maternity leave since about February 2022. Child A has often come home and told her that Child B was misbehaving, she never thought to ask her what happens when Child B misbehaved. Child A's Mother has never had any concerns about care, supervision, or discipline. Child A's Mother was shocked that Child A said Margaret Parham spanked the children, Ms. Parham has been very nice to Child A's 3 family. Child As Mother stated that is why she questioned Child A further and then again, the next day. Child As Mother feels that Child A is honest and knows right from wrong. On 0611312022, 1 completed a telephone interview with the complaint source. The compliant source provided the same information as Child A's Mother. On 0611412022, I completed an unannounced inspection a on essori i eve opment Center. We interviewed CCSM Margaret Parham, Alma Curiel, Arianna Kainz, Child A, Child B, Child 1D,. Child D's Mother, and Child E. CCSM, Margaret Parham has been employed at the center for four years and working in the 3.5-year-old split room since August 2021. The other staff members in the room with her were Ms. Arianna, , Ms. Michelle, and Ms. Samantha. When children misbehave, she pulls thRcWto the side and has a talk with them. Ms. Margaret feels that she has a good relationship with the children and their parents. Ms. Margaret can talk through discipline issues with the children and will sometimes inform parents if she feels that it is necessary. Ms. Margaret has never used any form of physical discipline with any children. The room has a safe area that has sensory items and brown bean bag chair. Children are sent to that area to allow them time to calm down; they are to sit in the relaxing chair and use the sensory items to calm themselves. There are a few children who are often sent to that area. Child C is considered more of a problem child and has behavior issues. Child D has and would become angry. Child B does not like to be told `'no", and often throws things and spits at the staff. Child B was moved to Ms. Margaret's room in November or December due to Child B's Mother not liking the lead teacher in Child B's previous room.
