On 05/12/2023, Santrece Roberts, owner, called Darlese McConnell, area manager, to report that two children left the child care center unsupervised. Later that day, I received a written report regarding the incident. LMTS Child Care Center is shaped like a "U" with squared edges. There is a gymnasium in the middle of the "U" that you can cut through to access one side from another. The bottom of the "U" faces east, and the top of the "U" faces west. The south hallway is where the school-aged programs are located. The north hallway is where the main child care is located and the children under school-age attend. The main entrance is located in the middle of the bottom of the "U". There are side exits at each end of the bottom of the "U" that exit to the north and south. At the top of the "U" there are exits at the end of each hallway on the west side of the building. The kitchen is located at the end of the south hallway and the infant classroom is located at the end of the north hallway. The outdoor play area is located outside of the end of the north hallway. Regina Fancher, interim program director and licensee designee, stated that on 05/12/2023, she was standing outside the doorway of the school-age classroom, which is located at the east end of the south hallway. She asked Child Care Staff Member 5 how many children she had. Child Care Staff Member 5 was supposed to have eight children with her, but two were missing. Child Care Staff Member 5 explained that Child A (8 years, female) had to use the restroom. Child Care Staff Member 5 can view the restroom door from the door of the classroom, so Child Care Staff Member 5 let Child A use the restroom and Child Care Staff Member 5 watched from the doorway. While Child Care Staff Member 5 was standing in the doorway, Child B (5 years, male) started to have a hard time. Child Care Staff Member 5 started to talk to Child B and help him feel better. While Child Care Staff Member 5 was talking to Child B, another child walked up to her with a cut on her finger. Child Care Staff Member 5 was helping to apply first aid to the cut. She had her back turned to Child B, who must have slipped out of the classroom. When Child Care Staff Member 5 discovered that Child B was missing from the classroom, she told Ms. Fancher that Child B was having a hard time and may have gone to sit at the front desk with Child Care Staff Member 3. Child B was not with Child Care Staff Member 3 at the front desk. Child Care Staff Member 3 was just coming out of the restroom when Ms. Fancher walked over there. Child A was no longer in the restroom nor near that area. It was presumed that Child B met up with Child A as she was exiting the restroom and they decided to go on a walk. Ms. Fancher, Child Care Staff Member 3, and Child Care Staff Member 4, and Child Care Staff Member 2, who were all nearby started looking for Child A and Child B. Ms. Fancher went toward the main child care hallway. She heard footsteps in that hallway as she started to round the corner. Child Care Staff Member 2 checked out 3 the southeast door, Child Care Staff Member 3 checked out the main door, and Child Care Staff Member 2 also checked out the southwest door. Ms. Fancher saw Child Care Staff Member 1 putting on her shoes. She informed Ms. Fancher that she witnessed two children walk by without a child care staff member. Ms. Fancher headed out to the playground. She saw Child A and Child B approximately 64 feet away in between the door and the fenced in play area. She tried to approach the children, but she was not fast enough. Child Care Staff Member 1 started to chase them. She would approach the children, but as soon as she got close, they would run away again. Child A seemed to want to listen and return to Child Care Staff Member 1, but Child B kept telling her to keep going. Child B has been repeatedly injuring Child A while in care. The center is not communicating the injuries to Child A's Mother. on1 féTéff sided her face. There was an approximately two-inch superficial injuries scratch with no skin broken and a light blue bruise near the scratch that was approximately one inch in length. Child A's Father told that the marks on Child A's face were about a week old. 3 I conducted an unannounced inspection at the child care center. Kia Johnson, program director, stated that Child A and Child B attend the elephant classroom. Typically, there are eight children with two child care staff members in the room; however, sometimes there is an additional child care staff member in the room. Ms. Johnson stated that she received a text message from Child A's Mother on the evening of 04/14/2022 indicating that Child A received a bruise on her face and was bitten and Child A's Mother was not informed. Ms. Johnson spoke to Brittany Bynum and Chrysten Brice, both child care staff members in the elephant classroom, and was informed that Child A was injured by Child B. Ms. Johnson stated that she was informed that Child B pushed Child A into a bookshelf on 04'04/2022, bit Child A on her chest on 04/05/2022, and scratched Child A on the cheek on 04/06/2022. After she became aware of Child A's Mother's concerns regarding Child B injuring Child A, Ms. Johnson met with the classroom child care staff members on 04/11/2022. They put Child A and Child B in separate family groups. The child care staff member in charge of each family group would provide the primary care for the children in their group, but the other child care staff members could assist if needed. Ms. Bynum is responsible for Child A and Ms. Brice is responsible for Child B. They also started documenting Child B's behavior. They discussed having Child B within arm's reach at all times so that a child care staff member can intervene before Child B hurts another child. Ms. Johnson stated that Child B has been exhibiting a lot of aggressive behavior in the classroom recently. She has been hitting and biting. She does this with other children in the classroom, not just Child A. Prior to her hitting and biting the other children, the main issue with Child B's behavior was her taking toys from other children and running out of the classroom. Ms. Johnson stated that the previous child care staff members in the elephant classroom left suddenly about a month ago and Ms. Bynum and Ms. Brice were placed in that classroom. It seems like Child B's behavior started to get worse around that time. Prior to the several incidents with Child A, Ms. Johnson was only aware of Child B biting one or two times. After Child B injured Child A several days in a row, Ms. Johnson decided that action needed to be taken to prevent further injury to children. After Child B pushed Child A into the bookshelf, Ms. Johnson spoke to Child B's Mother about her behavior. Child B's Mother told Ms. Johnson that she has noticed more aggressive behavior at home as well. Child B's Mother suspected that Child B was reacting due to the transition of child care staff members in the classroom that occurred when the previous child care staff members left suddenly. Child B only attends a few days a week, so it is also harder for her to transition back and forth CI between care and home. Ms. Johnson stated that she spoke with Child B's Mother in more general terms about Child B's behavior, not specific incidents that had occurred. Ms. Johnson's understanding is that the classroom child care staff members had informed Child B's Mother about specific incidents. An incident report was later created to document Child B pushing Child A into the bookshelf on 04/04/2022. Ms. Johnson provided me with a copy of the incident report. The incident report notes that there was not originally an injury, but Child A's Mother noticed one later on and notified the center on 04/05/2022. It was discovered that Child B pushed Child A had a bruise on her buttocks on 04114/2022. Child A's Mother agreed to take Child A to the doctor to have the marks examined. Ms. Jackson later told that she did not think that anyone at the center intentionally injure Ms. Johnson stated that she received text messages from Child A's Mother on 04/14/2022 regarding bruising to Child A's buttocks. Child A's Mother indicated that Child A kept saying "ouch" or she would not have noticed the marks. Ms. Johnson spoke with Ms. Bynum and Ms. Brice. Ms. Brice indicated that she changed Child A's diaper at 3:30 p.m. shortly before she was picked up for the day and there were no bruises on her bottom. Ms. Richardson was not aware of Child A having bruises on her buttocks until Ms. Johnson informed her. She had no knowledge of how the bruises occurred. Ms. Bynum stated that she had no knowledge of a bruise on Child A's buttocks. She remembered Child A having what looked like a slight diaper rash on her bottom, but not any bruises. Ms. Bynum stated that Child A will throw a tantrum and plop down on the floor when she is upset. Ms. Bynum has not witnessed her plop down on a toy or other item when she has done that. 10 Ms. Brice stated that she changed Child A's diaper at around 3:00 p.m. on 4/14/2022. Ms. Bynum was preparing for snack, so Ms. Brice changed Child A's diaper. Ms. Brice laid Child A on the diaper table and pulled Child A's leg up near her head so she could clean Child A. Ms. Brice recalled that Child A's diaper was wet. Ms. Brice noticed what appeared to be a healing diaper rash on Child A's buttocks. She showed Ms. Bynum. There was no bruise on Child A's buttocks at that time. Ms. Brice stated that Child A's right side would have been closest to her on the changing table. Ms. Pittman was not aware of any bruises on Child A's buttocks. Ms. Majeed was not aware of any bruises on Child A's buttocks. Child E's Mother and Father stated that Child E has not received any unexplained injuries while in care. Any injuries that Child E has received have been reported to them. Child F's Mother stated that there was one time that Child F had a scratch on his face when he was picked up from care. Child F's Mother stated that she did not ask the child care staff members about the scratch, so it is possible that Child F injured himself and they weren't aware of it. There have not been any other unexplained injures. Child G's Mother stated that Child G has not received any injuries while in care. I followed up with Child A's Mother regarding the bruising to Child A's buttocks. She stated that incident was an isolated injury and there have not been other unexplained injuries to Child A. I asked her about Child A plopping down on the ground when she is upset. She stated that Child A does not do this behavior at home, but she was aware of her doing it at child care. She stated that Child A does this because she is tired. Child A's Mother has changed Child A's sleep schedule to help her not be as tired during the day. APPLICABLE RULE I R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. ANALYSIS: The child care staff members in the elephant classroom provide appropriate care and supervision of the children in care. CONCLUSION: I VIOLATION NOT ESTABLISHED 11 Child A had a wet diaper when she was picked up from care on 04/13/2022. Ms. Chrysten Brice, child care staff member, is not allowed to be alone with the children because she cannot keep the classroom under control.

(2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization shall not establish or maintain a child care center, group child care home, or family child care home unless licensed by the department. Application for a child care center, group child care home, or family child care home license shall be made on forms provided, and in the manner prescribed, by the department, including the fees required under subsection (10). Before issuing or renewing a child care center, group child care home, or family child care home license, the department shall investigate the applicant's activities and proposed standards of care and shall make an on-site visit of the proposed or established child care center, group child care home, or family child care home. On 05/04/2023, I received a phone call from Regina Fancher, interim program director and licensee designee, informing me of an incident where a child care staff member handled a child inappropriately. A written report regarding the incident was received shortly after the verbal notification. I originally completed an unannounced on-site inspection on 05/05/2023. I later conducted a follow-up unannounced on-site inspection with ,on n additional unscheduled on-site insoec €on was conducted on 05/1612023. Ms. Fancher, interim program director, stated that on 05/0412023, she was observing Child Care Staff Member I in her classroom. Ms. Fancher recently had some concerns regarding Child Care Staff Member 1 brought to her attention, so she was trying to do some classroom observations. When Ms. Fancher started watching the video, she witnessed Child Care Staff Member 1 handing Child A male) 3 while making him pick up papers from the floor. As soon as she Rsstaa rted to !Wc the incident, Child A's Mother called the center. Ms. Fancher informed Child A's Mother that she was watching the incident and that she was going down to the classroom to address the situation. Ms. Fancher walked down to the classroom to speak to Child Care Staff Member 1. When Ms. Fancher reached the classroom, she informed Child Care Staff Member 1 that she needed to speak with her in the office. Once in the office, Ms. Fancher reviewed the video footage of the incident with Child Care Staff Member 1. Child Care Staff Member 1 stated that she remembered Child A laughing while she was helping him pick up the papers, but she agreed that the interaction was . Child Care Staff Member I stated that the incident looked 1 ended er emDlovment at e center followina Ms. Fancher stated that there have been concerns about Child Care Staff Member 1 using unkind words with the children and not following lesson plans. That is why she was doing observations of Child Care Staff Member 1 in the classroom. There have not been concerns from child care staff members regarding Child Care Staff Member 1 being physically inappropriate with the children. Child B's Mother has expressed concerns about Child Care Staff Member 1's handing of Child B male) in _, the past. An investigation was completed by child care licensing in February 2823, and it was determined that Child Care Staff Member 1 did not act inappropriately. Child A and Child B's Mothers are not "fond" of Child Care Staff Member. They have made Child Care Staff Member 1 uncomfortable by telling Child Care Staff Member 1 that they talk about her at home. Ms. Fancher had to have conversations with Child A's Mother and Child B's Mother regarding their interactions with Child Care Staff Member 1 when at the center. Child Care Staff Member 1 has been employed at the center for almost two years and has never had any disciplinary action occur. Child Care Staff Member 1 received a disciplinary action for this incident. Ms. Fancher provided a copy of the disciplinary action as well as the written statement completed by Child Care Staff Member 1. Ms. Fancher was planning to terminate Child Care Staff Member 1's employment, but Child Care Staff Member 1 ended her employment at the center voluntarily. Ms. Fancher stated that Child Care Staff Member 2 was in the classroom with Child Care Staff Member 1 when the incident occurred, but she did not witness the interaction. Ms. Fancher added that Child A did not have any marks on his body immediately following the incident, but she was informed by Child A's Mother that Child A had a that evening. The disciplinary action form for Child Care Staff Member 1 indicated that Child Care Staff Member 1 was assisting a child clean up but was being too rough with the child. The written statement completed by Child Care Staff Member 1 indicated that Child Care Staff Member 1 witnessed Child A pull a bunch of papers from a shelf. Child A's Mother stated that on 01/13/2023, she was watching the video feed for Child A's classroom. She observed Child Care Staff Member 1 grab Child A, who wouldn't lie on his mat, by his arm and throw him onto his mat. Child A was not injured during this, but Child A's Mother stated that the act looked aggressive. Child A's Mother called and spoke to Kia Crawford, program director. Child A's Mother was told to message the classroom staff to find out what was going on and that Ms. Crawford would watch the cameras closely for any inappropriate behavior. When Child A's Mother addressed the incident with Child Care Staff 2 Member 1, she stated that Child A was flailing his body around and that she didn't mean to lay him down so hard. She apologized for the incident appearing aggressive. Child A's Mother stated that the other child care staff member in the classroom also stated that the incident appeared to be aggressive. Child A's Mother was upset that Child Care Staff Member 1 did not get written up or sent home for the incident. Child A's Mother stated that Child A doesn't like Child Care Staff Member 1 Child Care Staff Member 1 stated that on 1/13/2023, Child A was not wanting to lie down for his nap. Child A doesn't like to nap. Typically, he will sit on his mat with a book while his classmates fall asleep. On this day he was screaming and moving around the classroom. He crawled under a table and was waking the other children up. Child Care Staff Member 1 asked Child A to get out from under the table. When he didn't listen. She guided him out with her hand on his back. Child Care Staff Member 1 stated to Child A, "I am going to lay you down now." Child Care Staff Member 1 placed Child A in her arms and attempted to lay him down on his mat. He was jerking his body and kicking his legs. This movement started to pull Child Care Staff Member 1 down as she was laying Child A down. She had to quickly lay him down so that he didn't fall from her arms. She agreed that the motion probably looked aggressive as she was laying him down quickly, so he didn't fall from her arms. Ms. Crawford came down to the classroom to inquire about the incident and to hear from Child Care Staff Member 1 what happened. Ms. Crawford stated that the behavior appeared aggressive. Child Care Staff Member 1 explained to Ms. Crawford what happened and informed her that Child A was slipping from her arms when she was laying him down, which is why it appeared aggressive. Child Care Staff Member 1 reached out to Child A's Mother and explained what happened. Child Care Staff Member 1 told Child A's Mother that she understood her concerns. She explained that Child A jerked out of her arms while she was laying him down. Child A's Mother stated that it didn't look that way to her and she would appreciate it if Child Care Staff Member 1 would not do that again. Child Care Staff Member 1 stated that she would be extra cautious with Child A. Child Care Staff Member 1 stated that Child A gives her hugs and is appropriately affectionate with her. His behavior has improved recently as he has been involved with a social/emotional and speech intervention. Ms. Crawford stated that on 01/13/2023, she was contacted by Child A's Mother regarding an incident that she observed on the classroom's video system. Child A's Mother reported that she witnessed Child Care Staff Member 1 "body slam" Child A on his mat. Ms. Crawford was already watching the video feed and watched Child Care Staff Member 1 place Child A on his mat. Ms. Crawford watched Child Care Staff Member 1 get down on Child A's level and place her hands on each side by his shoulder and laid him down. She felt that the action looked aggressive, so she went down to the classroom to discuss the incident with Child Care Staff Member 1. On 10/06/2022, I received an allegation that Child A (31 months, male) received two black eyes from Child B (5 years, male), who is aggressive. Child B should not be in the same classroom with Child A due to their age differences. Child B is aggressive with other children in care. Other children may have been injured as well. The director does not take the situation seriously. Kia Crawford, program director, stated that on 08/10/2022, Child A's Mother, who was also employed at the center, approached her regarding a picture that Child Care Staff Member 1 sent her when Child Care Staff Member 1 arrived to work in Child A's classroom. The picture showed Child A with a reddish bruise under his left eye. 2 Ms. Crawford asked Child A's Mother if she asked Child Care Staff Member 2 about the injury. Child A's Mother reported that she spoke to the child care staff members in Child A's classroom and no one knew how the injury occurred. Ms. Crawford mentioned to Child A's Mother that the children played on a bounce house earlier that day. Ms. Crawford told Child A's Mother that she would look into the incident and get back to her. Ms. Crawford spoke to the classroom child care staff members. Child Care Staff Member 3, who was on break when Child A's Mother spoke to the classroom child care staff members, stated that earlier that day, Child A and Child B were playing in the bounce house together. They bumped heads while bouncing. Neither of them cried or indicated that they were injured and went right back to bouncing. Child Care Staff Member 3 was not aware that there was an injury to Child A's face. An incident report was completed, and Child A's Mother was provided with a copy of it. Ms. Crawford stated that Child A's Mother was upset because she wasn't notified immediately. Ms. Crawford stated that Child B is a tall and energetic child. He is one of the older children in the class. Sometimes the children in the class will play rough, but she was not aware of any injuries that took place due to that type of play. She was not aware of any concerns regarding Child B's behavior. Ms. Crawford added that Child A was moved down to the Early Head Start classroom, so that he could benefit from that program and so he could be in a classroom with children closer in age to him. Ms. Crawford also added that Child B does not attend the program regularly anymore as he is in school full-time. Ms. Crawford stated that typically the center tries to keep the school-aged children separated from the preschool children, but sometimes if the numbers are low, they will be combined. Ms. Crawford provided me with a copy of the center policy regarding reporting accidents and injuries to parents. The policy stated that for minor accidents and injuries, parents will be notified and provided with a written incident report. The policy does not indicate that this notification will occur immediately. Child Care Staff Member 2 stated that she recalled the day that there was a bounce house for the children to play in. She did not remember an incident when Child A and Child B bumped heads. Child Care Staff Member 2 stated that on that day when she returned to the classroom from break, Child A's Mother was upset because Child A had an injury to his eye. Child Care Staff Member 2 stated that Child Care Staff Member 3 recalled Child A and Child B bumping their heads together while in the bounce house. She added that sometimes the diaper changes do not get entered into the app. Child A is over 30 months of age; therefore, the center is not required to document diaper changes. Ms. Bynum stated that diapers are changed at 3:00 p.m., are checked again around 3:50 p.m., and checked again before Ms. Brice goes home around 4:30 p.m. Ms. Bynum stated that Child A could have urinated in her diaper after she was changed, but the diapers are checked and changed frequently. Ms. Brice stated that she was not aware of Child A going home in a wet diaper. Child A gets her diaper changed at around 3:00 p.m. and then again around 4:30 p.m. before Ms. Brice leaves for the day. Ms. Brice stated that Child A could have urinated in her diaper after it was changed. Ms. Brice stated that she tries to check Child A's diaper every hour due to her potty training. Ms. Johnson stated that Ms. Brice has been employed at the center since She started out working with the school-aged children and then was transferred to the elephant classroom when the other child care staff members suddenly left. Child A's Mother stated that she was not comfortable with Ms. Brice caring for Child A. Ms. Johnson was not aware of Ms. Brice losing her patience with the children in care. Ms. Johnson added that Child A's Mother was close with the previous child care staff member in the classroom that left suddenly and thinks that Child A's Mother doesn't like Ms. Brice as much as her. Ms. Johnson stated that she has been coaching Ms. Brice on being engaged with the children and making sure that there are activities out for them to do. Since Ms. Johnson has been coaching Ms. Brice, she has noticed improvement in her behavior. She has never had any concerns regarding Ms. Brice interacting with the children in care inappropriately. Ms. Brice has received written reprimands for calling in sick a lot, but never for treating a child inappropriately. Ms. Johnson added that 13 she has also been coaching Ms. Bynum as well, so it is not just Ms. Brice that she has been working with. Ms. Johnson regularly watches the in-classroom video camera and has never witnessed any questionable treatment of the children in care by any child care staff member in the elephant classroom. Ms. Brice stated that for discipline with the children in care, she responds quickly to the situation and separates the children if there is a conflict. She places her hand on the child while she speaks with them so that they can feel her presence and she gets down to their level. Sometimes a child needs to be redirected to a different activity. She verbally asks the child to relocate. If there are enough child care staff members in the classroom, she might take the child on a walk to help them calm down. Ms. Brice stated that if she ever felt like she was losing her patience, she would contact Ms. Johnson and ask for assistance. She would step out of the classroom to calm down if she ever felt like she was going to lose her temper. When I first spoke to Child E's Mother, she expressed concern regarding the child care staff member turnover at the center. She didn't really know the child care staff members in the elephant room well. When I followed up with her, she told me that the child care staff members have been consistent since we last spoke and that she has no concerns regarding their supervision or handling of the children. Child E has become attached to the child care staff members in the elephant classroom. On 03/14/2022, I received an email from Chadelle Richardson, assistant director of the center, informing me that earlier that day a child care staff member threw a chair at the wall aggressively, pushed a child back with her hand, and yelled at the children in care. This was all noticed by a parent on the center's video camera system. Ms. Richardson noted that parents of the children in care were notified, and the incident was reported to Michigan Department of Health and Human Services (MDHHS). She also noted that the child care staff member was terminated. On 3/16/2022, I conducted an unannounced on-site inspection at the center. I met with Ms. Richardson, Kia Johnson, program director, and Santrece Roberts, owner. I watched the leopard classroom video from 03/14/2022. The video showed Tabitha Anthony, child care staff member, in the leopard classroom with nine children, all of whom were 3years of age. Ms. Anthony was speaking with Child A, who was in the restroom. The remaining eight children were gathered near the rug in the center of the classroom. Child B was sitting on a short shelf that appeared to be approximately 12 inches tall. At five seconds into the video Ms. Anthony walked over toward the children at the rug area and yelled "[Child B!]." Ms. Antony was carrying two chairs, one in each arm. As Ms. Anthony sat one of the chairs down at a table, she said loudly to Child B something about sitting down on the rug. The exact statement could not be heard as Ms. Anthony sat the chair down as she was speaking, and it made a noise as it hit the floor which interfered with what she was saying. Child B leapt up from the shelf and landed on the rug. At 12 seconds into the video, Ms. Anthony said, "All right. Let's see. Who am I going to call to come sit down?" Several children can be heard saying, "Me!" "Me!" At 18 seconds into the video Ms. Anthony walked over toward the wall. She looked at the group of children sitting on the rug and started to say Child C's name. She threw the remaining chair she was holding down to the floor against the wall. The chair made a loud noise as it hit the floor and wall. She said to Child C, "What did I tell you to do with the mask? Put it down or put it on." At 25 seconds into the video, Ms. Anthony said, "Alright [Child D]." Child D got up from the rug. Ms. Anthony said, "Come sit down [Child D]." Child D walked to the table where Ms. Anthony pointed for her to sit. At 30 seconds into the video, Ms. 3 Anthony said, "Uh. [Child E]" as she pointed to a seat for Child E to come sit at. Child E got up and walked toward the tables. He walked toward the seat that Ms. Anthony was pointing to but appeared to change his mind and headed toward another seat. Ms. Anthony said, "[Child F], stop hitting." At 39 seconds into the video, Ms. Anthony said, "[Child G]" and then said, "no" as she saw Child E sitting down in a different seat than she told him to sit at. Ms. Anthony grabbed Child E from behind with her right hand on his right forearm by his elbow and her left hand on his left arm near his elbow and she directed him to the seat she wanted him to sit at and said, "right here" to Child E. She then pointed to a seat for Child G, who was walking toward the tables, and said "[Child G], right here." At 47 seconds in to the video, Ms. Anthony said, "Alright. Let's see." She then looked at Child G and pointed to his seat and said, "sit." Ms. Anthony walked over to Child B, who had moved back to sitting on the short shelf and started to grab him as he stood up and moved back down on the rug. Ms. Anthony said something to Child B, but it was not completely audible. She could be heard saying "sit down." At one minute, three seconds into the video, as Ms. Anthony started to walk back toward the tables, she saw Child F and Child H tickling each other on the rug. Child F could be heard laughing.
