    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times. 7

    On 10/07/2020, upon returning home after picking Child A up from Ms. Todd's child care home Child A's Mother noticed a red mark on Child A's right cheek. Child A's Mother contacted Ms. Todd, who stated that Child A fell off a toy car on the playground that day. Ms. Todd was unaware that Child A had a mark on cheek and did not write an incident report. On 10/13/2020, Child A's Mother noticed red marks and minor bruising in and around both of Child A's during pickup. She confronted Ms. Todd about it and Ms. Todd replied that she did not know what happened to his Ms. Todd referred Child A's Mother to her assistant caregiver because she thought that she would have more information. Child A's Mother stated that she spoke to the assistant caregiver and was told that Child A bit another child at the home and the other child attacked M. Child A's Mother was told that there was an incident report filed, but Ms. Todd never saw it. It was believed that Ms. Todd or another worker abused Child A while in their care. On 10/15/2020, On 10/16/2020, I conducted an unannounced inspection at the child care home. During the inspection I observed Ms. Todd and her assistant caregiver, Therena Flint, providing care for nine children. I did not conduct interviews during this inspection. During this inspection, Ms. Todd provided me with the two accident/injury reports that were written by Ms. Flint documenting the incident. The incident reports read as follows: • Child's name: [Child B] Date: 10/13/2020 Time of Accident/injury: 10:30am Description of what happened: "[Child A] screamed and grabbed of another child aggressively yelling that was bit by the child. The child in which this incident occurred was 3 Treatment provided: "Checked to see if was Ok and that there were no visible bite marks and • was put in time out and told to be nice to friends especially • babies because the other child wad." • Child's name: [Child A] Date: 10/13/2020 Time of Accident/Injury: 10:30am Description of what happened: "Another child screamed and latched onto [Child A's] ~ saying that bit them. I promptly took actions separating and putting child in time out. [Child A's] seemed red following the incident" Treatment provided: "Checked out and they seemed find but a little red." On 10/18/2020, - and I conducted an unannounced inspection at the child care home. During the onsite inspection, - and I interviewed Ms. Todd, Ms. Flint, Child B, Child C, and Child D. Ms. Todd stated that she was aware of the concerns alleged in the complaint. Regarding the mark on Child A's cheek, Ms. Todd stated that Child A's Mother texted her at approximately 9:30pm-10:00pm on 10/07/2020 and asked how Child A got a mark face. Ms. Todd stated that she was not aware of any incidents. Ms. Todd on• stated that on a later date, when Child A's Mother picked Child A up from the home, she noticed that Child A's were red. Ms. Todd stated that she looked at Child A's ~ and saw that they were red. She initially thought it was due to Child A playing outside as the weather was cool. Ms. Todd stated that when Child A and mother • left, she asked Ms. Flint if something had happened to Child A's and Ms. Flint described an incident between Child A and Child B. Ms. Todd stated that Ms. Flint informed her that she was changing a diaper in the basement when she heard a commotion. Ms. Flint stated that the other children in the basement were calling her name because Child B had Child A on the ground, and E was holding Child A by ~ Ms. Flint intervened once she saw what was happening. After Ms. Flint separated the two children, she asked the other children what occurred. Ms. Flint was told by Child C that Child A bit Child B and Child B reacted by grabbing Child A by the head and Ms. Flint told Ms. Todd that she wrote an incident report but forgot to give it to Ms. Todd. Ms. Todd instructed Ms. Flint to let her know when those incidents occur so that she can report it to the child's parents. Ms. Todd stated that
