On July 8, 2021, Cheryl Waldmiller left Child A in a licensed area without appropriate supervision for approximately 30-35 minutes. Cheryl Waldmiller was upstairs during a portion of this time, and also went outside at least three times for 5-10 minutes at a time. Cheryl Waldmiller did not check on Child A during that time.

Cheryl Waldmiller was outside and/or on another floor while Child A slept downstairs. Cheryl Waldmiller could not have known the location of Child A when she and/or Audrey Waldmiller did not lay eyes on her and were not in the licensed area of the home for 30- 35 minutes.

Monica Sheets is not listed in Cheryl Waldmiller's child care background check system as an eligible child care staff member or unsupervised volunteer. Cheryl Waldmiller was upstairs during this time, and also went outside at least three times for 5-10 minutes at a time. Cheryl Waldmiller did not check on Child B during that time. Cheryl Waldmiller has left Child B alone without proper supervision while she was allowed to be with Monica Sheets or another staff member from ROI five days a week for the last month.

(1) Pursuant to section 5n of the act, MCL 722.115n, prior to an individual having any unsupervised contact with children, the department shall determine the individual's eligibility to be any of the following: (e) An unsupervised volunteer.

On July 9, 2021, Cheryl Waldmiller left Child B unsupervised with Monica Sheets prior to her having a comprehensive background check; fingerprinting with an eligibility status in Cheryl Waldmiller's child care background check profile. Five days a week for approximately one month Cheryl Waldmiller left Child B unsupervised at times with Monica Sheets or another staff from ROI without Monica Sheets or the other the staff members from the agency having completed a comprehensive background check and a status of eligible in Cheryl Waldmiller's child care background check profile.

Cheryl Waldmiller did not make the Department aware within 24 hours that Child A was left unsupervised. Cheryl Waldmiller did not make the Department aware within 24 hours that Child B was left unsupervised with Monica Sheets multiple times over the period of one month.

(4) A licensee shall submit a written report to the department of the occurrences outlined in subrules (1), (2), and (3) of this rule, in a format provided by the department, within 72 hours of the verbal or emailed report to the department. 13

Cheryl Waldmiller did not submit a written report to the department of the fact that Child A was left unsupervised. Cheryl Waldmiller did not submit a written report to the department of the fact that Child B was left unsupervised with Monica Sheets or another representative of her agency daily for at least the past month.
