    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

    On August 16, 2022, 1 made an unannounced onsite inspection to the child care home of Ms. Aimee Nyembwe. I made Ms. Nyembwe aware of the allegations in the complaint. Ms. Nyembwe was aware of the allegations, as she reported them to Child A's Mother. Ms. Nyembwe stated that on Wednesday August 11, 2022, Child B (male, age 8) brought Child A (female, age 4 years old) to her and said, she had something to tell her. She went on to say that Child A is a quiet child and didn't say anything but looked at her brother {Child B}. Child B then stated that {Child A} told him that {MHM 1} placed his in her mouth. She told {Child B} to let his sister speak for herself, she asked Child what happened and Child A stated `M MHM1 placed his in her mouth. She asked Child A where she was when this happened and Child A said you were there. Ms. Nyembwe said she said to Child A, "No are you saying this thing happened in Ms. Aimee's presence." Child A replied yes, and Ms. Nyembwe stated she replied that just isn't so. Ms. Nyembwe stated she questioned her son (MHM1) who stated that he had not done anything like that and would never do such a thing. Ms. Nyembwe asked MHM 2(male, age 16) if he has ever seen MHM1playing inappropriately with Child A, he told her that he never saw them together doing anything inappropriate. When Child A's Mother arrived, she informed her of what Child B told her. During the onsite inspection there were no child care children present. I asked Ms. Nyembwe if there were other children in her care, besides Child A and Child B. Ms. Nyembwe stated they had one additional sibling Child C (male, age 3 years old). She does not currently have any children enrolled in care, as the three siblings were the only children in her care and they are no longer attending. On August 30, 2022, 1 called Child A's Mother to discuss the allegations in the complaint. Child A's Mother stated her son {Child B} said that {Child A} told him that Ms. Nyembwe's son put his' in her mouth. Child B first told the information to Ms. Nyembwe and then told her. Child A did not tell her directly what happened, but after telling Child B and it being reported, Child A told her grandmother that {MHM 1} told her to get on her knees and then placed his in her mouth. '= On gust 30, 2022, 1 called and left a voicemail message for The complaint allegations were not investigated by the Michigan Department of Health and Humans Services and were referred to Child Care Licensing on August 11, 2022. On September 13, 2022, 1 called Ms. Aimee Nyembwe and conducted an exit conference. I informed her that no rule violations had been established. On September 29, 2022, 1 called Child A's Mother and asked her if she would be open to me interviewing Child A in lieu of law enforcement. Child A's Mother did not want to have Child A interviewed, I asked Child A's Mother about interviewing Child A's Grandmother about the allegations in the complaint. Child A's Mother stated she would contact Child A's Grandmother and provide her with my contact information in case she wanted to call.
