(4) An individual who lives in a child care home or who cares for children in a child care home, who has a suspected or confirmed case of a communicable disease, shall not come into contact with children in the home's care. Communicable disease includes, but is not limited to, any of the following: (a) Tuberculosis. 4

    On 03/17/2021, a complaint was received stating that Mrs. Hudcosky sent a text to the child care parents informing them that she "felt sick since last week." In the text Mrs. Hudcosky stated that she may close on the following day and added that she does "not have COVID." The complaint also stated that Ms. Hudcosky refused to get COVID-19 testing because she did not have a fever. On 03/17/2021, I conducted a phone interview with Mrs. Hudcosky. I informed Mrs. Hudcosky of the allegations. Ms. Hudcosky stated that she has no idea why someone would state that she refused to get a COVID-19 test. She added that she and her husband were feeling ill after spending time outdoors with their neighbors. Mrs. Hudcosky added that she and her husband maintained a safe distance from their neighbors throughout their visit, so she assumed that her symptoms were related to allergies. She indicated that she suffers from allergies during this time of year, and she is familiar with her symptoms which consisted of a stuffy nose. Ms. Hudcosky 2 denied having a fever or a cough. Ms. Hudcosky stated that if she had other symptoms, she would have gotten tested and she denied refusing a COVID-19 test. Mrs. Hudcosky stated that she sent a text to the parents informing them that she was potentially closing because she has a policy that the children cannot attend when they are ill, so she wanted to also follow that policy. Mrs. Hudcosky stated that she felt safe spending time outside with her neighbors because her neighbor had been COVID-19 tested, and the result was negative. Mrs. Hudcosky explained that she has fully followed all CDC guidelines regarding COVID- 19 even to the point of only leaving her home to go to the grocery store. She also added that the child care parents are not even allowed in her home for drop off and pick up to ensure that exposure is minimized. After getting off of the phone with Mrs. Hudcosky, she sent me a screenshot of the text messages she sent to the child care families. The text dated 03/15/2021 at 8:42am read: "Good Morning. Just a heads up Jeff and I have both been sick with some congestion, achy, since last week. No fevers, No cough. (Jeff had a cough pretty bad all weekend but is gone now.) We considered closing today but it seemed as if we were coming to the end of it and now this morning we're feeling pretty crummy. If we aren't feeling better by tomorrow I will likely close. This has been confusing as we think we're feeling better and it takes on another level. We haven't been sick in over 2 years so I think a simple cold has hit us hard. Just wanted to touch base with everyone and give you a heads up. I'll Keep everyone posted. Mrs. Hudcosky also sent a screenshot of a response from a parent. The text read: "So are you both getting covid tested or?" Mrs. Hudcosky responded: "There's no reason to believe it's covid or covid related. We have no fever. No cough. No other covid symptoms. We have colds. We were out at a fire last Saturday night when it was 40 degrees. I'm 100% certain that's how we came down with it. Parents send their kids here with mild cold like symptoms and I don't require a covid test. This is a simple cold. If I felt it was Covid I wouldn't be open today or would have been tested already." Mrs. Hudcosky stated that she received no more text messages after the parent's initial response. She added that the parent sent their child to her home for care everyday even after expressing concern about her getting tested. On 03/18/2021, I conducted an onsite inspection at the child care home. During the interview I observed Mrs. and Mr. Hudcosky in their home caring for 10 children. I 3 spoke with Mrs. Hudcosky and briefly with Mr. Hudcosky and neither of them appeared to be sick. Mrs. Hudcosky confirmed the information that she shared during our phone interview. She also stated that she did not actually close her child care home because both of their symptoms went away prior to the children arriving. Mrs.
