    R 400.8110 · R 400.8110 1 Applicant; licensee; licensee designee; requirements. (8) A child shall be released to either parent or the child's guardian, unless a court order prohibits release to a particular parent. A copy of the order prohibiting release must be kept on file at the center.

    On December 9, 2021, 1 interviewed Tiffany Floate, program director and licensee designee, regarding the allegation that she did not allow Child A, B and C's Mother to leave the child care center with her children. Tiffany Floate explained that Child A, B, and C's Mother became upset with her on December 3, 2021. The family arrived at the child care at approximately 8:00a.m. Ms. Floate explained to Child A, B, and C's Mother that the children could not remain at the center at that time because there were not enough child care staff to maintain 2 ratio. Child A, B, and C's Mother had signed up for care to begin at 8:30a.m. and there would be adequate child care staff at that time. Child A. B, and C's Mother left with her children. On December 6, 2022, Child A, B, and C's Mother brought the girls to child care. Ms. Floate was walking down the hall when Child A, B, and C's Mother asked if they could talk in her office. As soon as they were in the office Child A, B, and C's Mother started yelling at her about not being able to leave the children at 8:00a.m. on December 3, 2021. She was "screaming". Ms. Floate gave Child A, B and C's Mother a copy of the schedule she completed for that week. She claimed she did not make that schedule. She continued to yell and called Ms. Floate a racist. Ms. Floate tried to calm her, and Child A, B, and C's Mother told her she could not speak until she was told she could speak. At that point, Ms. Floate said, "I am done" and she got up to go get the children. Child A, B, and C's Mother told Ms. Floate she could not touch her girls. Child A, B, and C's Mother was yelling in the hallway. Ms. Floate asked the other child care staff members to close their classroom doors because she did not want the yelling to frighten the children. Child A, B, and C's Mother then accused Ms. Floate of withholding her children. The child care staff got the children ready to leave with their mother, but she left the building. Ms. Floate then called the police. She wanted them to know what happened. A few minutes later a police car pulled into the child care parking lot and right behind it was Child A, B, and C's Mother's car. Ms. Floate reported that an officer came into the center and stated that Child A, B, and C's Mother was claiming Ms. Floate was withholding her children. Ms. Floate denied it and the officer asked if he could bring Child A, B, and C's Mother in to get the children. Ms. Floate said yes and that the children were ready. Child A, B and C's Mother entered the building yelling, "Give me my kids. Don't touch them." She took her children and left the building. They have not returned. During my telephone interview with Child A, B, and C's Mother, she stated that Ms. Floate would not let the children stay because it was too early. I asked if that happened a few days before the incident with the police and she said no. It happened that day. Child A, B, and C's Mother went from sounding irritated to very calm. She said the problem was Ms. Floate followed her down the hall and said she would call Children's Protective Services on her. Then Ms. Floate told the child care staff to "lock it down". Child A, B, and C's Mother became calm and said, "Neither of us used good judgement. I am over it. It is not an issue for me." She thanked me for looking into the situation and hung up. Jennifer Phillips, child care staff member, stated she was in the kitchen when Child A, B, and C's Mother started yelling in the hallway. Ms. Phillips propped open the kitchen door so she could hear. She said the purpose was to assure that Ms. Floate was okay. Child A, B and C's Mother was yelling at Ms. Floate and started coming down the hall towards her. Due to COVID-19, parents have not been allowed past a certain point in the hallway. Ms. Phillips heard Ms. Floate ask Child A, B and C's 3 Mother to stop. She did not stop, and she continued yelling. Ms. Floate then asked all the child care staff members to shut their doors. Child A, B
