(1) Except as provided in section 5n(14) and (15), a child care center, group child care home, or family child care home shall not allow an individual to be a child care staff member without requesting a criminal history check as required by section 5n.
I completed an unannounced, on-site inspection on 04/01/2022. When I arrived at the center at 4:10, there were two child care staff members present, Julie Atkins, and Michelle Bousseloub. The approved program director, Dennis Metty, was not present. I first spoke with Julie Atkins who provided the following names of the child care staff members who work at the center and in the after-school program: Michelle Bousseloub, John Lewandowski, Nicole Omara. There are two child care staff members, Britini Sterling and Paula McCarthy who only work in the preschool program. On 04/01/2022, I then spoke with child care staff member, Michelle Bousseloub, who reported that the child care staff members include herself, Julie Atkins, Nicole Omara, and occasionally John Lewandowski. Mr. Lewandowski is a cook for the school, however, will sub in the after-school program on occasion. On 04/04/2022, I spoke with Licensee Designee and School Age Program Director, Dennis Metty. Mr. Metty confirmed the child care staff members for the center to be the same named individuals as provided by Ms. Atkins and Ms. Bousseloub. Mr. Metty identified the main child care staff members to be Julie Atkins, Nicole Omara, and Michelle Bousseloub. John Lewandowski will fill in as a sub as needed. Mr. Metty reported that all individuals have completed the required criminal history background checks as required by child care licensing. I then reviewed the department's child care background system and found that all individuals named as child care staff members have completed the required fingerprints. Additionally, all individuals have been found eligible to work in child care and are properly connected to the center's license.
The requirement that a child care center shall not allow an individual to be a child care staff member without requesting a criminal history check is not being followed. The School-Age Program Director, Dennis Metty, is not on site after 3:30 PM. A review of the preschool and after school required documents of the child care staff members will show that regulations are not being followed.

I completed an unannounced, on-site inspection on 04/01/2022. When I arrived at the center at 4:10, the approved program director, Dennis Metty, was not present. I spoke with Mr. Metty on 04/04/2022 regarding the allegation. The school age program operates from 3:05 PM to 6:00 PM, or until the last child is picked up. Mr. Metty indicated that his work hours begin at 7:00 AM and that he is usually present until a timeframe between 4:00 PM to 6:00 PM. It depends on the day and what is going on with regards to how long he stays. Mr. Metty reported that he left early on 04/01/2022 because he was not feeling well. Mr. Metty admitted that he is not always present at the center until the last child leave the aftercare program. He is aware that the requirement of him as the program director is that he is there until 6:00, or until the last child leaves.

A center shall keep on file at the center evidence to verify that each child care staff member and each volunteer who has contact with children at least 4 hours per week for more than 2 consecutive weeks is free from communicable tuberculosis (TB). The complaint source was anonymous; therefore, I was unable to obtain additional information to determine which records are to be reviewed. I reviewed the required MiRegistry and CPR/First Aid records of the seven child care staff members who work the preschool and after school program. 4 On 04/04/202, I spoke with Mr. Metty regarding the allegation. I informed Mr. Metty that my review of the MiRegistry system did not show that the child care staff members had completed the health and safety trainings. Mr. Metty indicated that the current child care staff members, in the aftercare program, have been temporary and he doubted they had completed the training. Mr. Metty did indicate that he was unaware of the need for child care staff members to be connected to the center's license in MiRegistry. Technical assistance was provided to Mr. Metty, along with contact information to MiRegistry, for the issue of connecting child care staff members. I requested that Mr. Metty forward me verification of TB, CPR/First Aide, and any completed MiRegistry health and safety trainings for himself, Julie Atkins, Nicole Omara, Michelle Bousseloub, John Lewandowski, Paula McCarthy, and Britni Sterling. On 04/12/2022, Mr. Metty emailed me verification of TB for himself, Julie Atkins, Nicole Omara, Michelle Bousseloub, John Lewandowski, Paula McCarthy, and Britni Sterling. On 04/12/2022, Mr. Metty emailed me current CPR/First Aid certification verification for himself, Britini Sterling, and Paula McCarthy. In regard to Julie Atkins, the document received from Mr. Metty shows that she had completed Adult First Aid/CPR/AED training on line only on 08/12/2020. There was no documentation on behalf of Michelle Bousseloub. It was Ms. Atkins and Ms. Bousseloub who were the two child care staff members present during the 04/01/2022 on-site inspection. On 04/12/2022, Mr. Metty emailed me verification of MiRegistry Health and Safety Course 1 and 2 for Julie Atkins, Paula McCarthy, and Britini Sterling. The remaining child care staff members, Dennis Metty, Nicole Omara, and Michelle Bousseloub had not completed the Health and Safety training on MiRegistry within 90 days of hire. Although child care staff member, John Lewandowski, had not yet completed the required training, he was still within his 90 days of hire.

R 400.8131 · R 400.8131 Professional development requirements. (10) All child care staff members who work directly which children are required to be trained in first aid and pediatric, child, and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center, and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child, and adult CPR. Each of these child care staff member's first aid and CPR certificates must be valid and retained on file in the center.
During the 04/01/2022 on-site inspection there were two child care staff members present, Julie Atkins, and Michelle Bousseloub. Ms. Atkins completed CPR and First aid training on 08/12/2020, however was not certified. Ms. Bousseloub did not have CPR or First Aid training or certification. There were no other child care staff members on-site at the time who were I certified in CPR and First Aid.

I reviewed all seven child care staff member's files and three child care staff members (Dennis Metty, Nicole Omara, and Michelle Bousseloub) had not completed the required health I and safety training through MiRe0istry within 90 days of hire.
