R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On 09/29/2021 I received an incident report from Lake Orion Early Childhood Center. The report stated that child care staff member Penni Robertson tossed Child A onto a crash pad (large foam mat) three times while playing an "airplane" game. On the third time, Child A landed on his elbow. Child A cried and grabbed his left elbow. Ms. Robertson had Child A move his arm around (to see if he could move his arm), applied an ice pack and comforted him with hugs. Within a few minutes of the incident Child A and B's Mother arrived at the center. Ms. Robertson explained what occurred and Child A and B's Mother took Child A and B home. I did not receive a phone call to report this incident. On 10/13/2021 I spoke to Child A and B's Mother. She recalled that she picked up Child A and B around 6pm on 09/27/2021. When she walked into the gross motor room, she observed Child A sobbing heavily. Ms. Robertson explained that she tossed Child A on the crash pad as part of an "airplane" game. Ms. Robertson said he fell on his left arm and cried instantly. Ms. Robertson told Child A and B's Mother that she checked Child A's left arm for injuries, asked him to move his arm around, and applied an ice pack. Child A, Child B, and Child A and B's Mother walked out of the building. While they walked to the parking lot, Child A and B's Mother observed Child A holding his left arm as he continued to cry. Once Child A was placed in the vehicle, Child A and B's Mother noticed he could not move his left arm. At this time, she grew concerned and she took Child A to the Emergency Room. Child A was diagnosed with a radial head subluxation or "nursemaid's elbow" to his left arm. Once his elbow was relocated into place, the pain ceased. Child A and B's Mother called Program Director, Kim McLean to gather more information about the incident. She received a call back the following day. Ms. McLean told her she would follow up with the incident and get back in touch with her. Child A and B's Mother was concerned that Ms. Robertson hurt Child A and is frustrated that she did not receive written notification detailing the events that led up to Child A's injury in a timely manner. She stated she did not receive written information about the incident for nearly two weeks after the incident. Child A and B's Mother is concerned about the care and supervision of children in the afterschool program. Child A and B's Mother attend care two days a week, usually Monday's and Friday's. On 10/26/2021 I conducted an unannounced inspection at Lake Orion Early Childhood Center. I interviewed Program Director Kim McLean and child care staff member Makayla Haynes. Ms. McLean informed me she had left work for the day, prior to the incident that occurred on 09/27/2021. She did not receive notification of the incident from child care staff members that evening, however, she received a call from Child A and B's Mother the following day. Child A and B's Mother asked why she was not informed of the incident and to express her concern about the nature of the injury. Child A and B's Mother told her that Child B observed Ms. Robertson throw Child A into the crash pad and Child A cry right after the incident. Ms. McLean informed Child A and B's Mother that this game is not an appropriate activity, and she will follow up with Ms. 3 Robertson to understand what happened. Ms. McLean told Child A and B's Mother she will receive an incident report once all the facts are collected. Ms. McLean stated that when an accident or injury occurs in the before or after school program, child care staff will communicate the incident face-to-face, when parents pick up. Staff will call parents on the phone if a major incident occurs. During the school day, staff communicate accidents and injuries using the ProCare App. An incident report is completed and submitted to the school district and the department, if needed. Ms. McLean placed the incident report in Child A's backpack on 10/04/2021. Ms. McLean stated the
