On 4/19/23, 1 received an email from the licensee designee, Ms. Hall-Elzy, who stated that during a conversation with the staff members at the center, she was informed that Ms. Moore may have dropped Child B resulting Ms. Moore said that she did not drop Child B, but she was squatting on thineM floooorr en Child B ■forward and . There was no mention of a date, time or location of the incident. On 4120123, the department received a complaint stating that on 4/11/23, CCSM 8 had dropped Child B causing _. CCSM 8 lied on the incident report to Child B's parents. On 4121123, 1 interviewed the complainant who said she had not witnessed the incident but there were other staff members including CCSM 3, and Ex-employee 1 that were aware of the details of the incident. The complainant stated that it was not CCSM 8 tha Child B, but it was Ms. Moore. The complainant said that she got the names mixed up. The complainant was not sure about the date this occurred. On 4121123, 1 interviewed Ms. Moore who said that she was in the infant 1 classroom when the incident with Child B happened. She was relieving a staff member for lunch, and she saw this incident. CCSM 8 had a sandwich in her right hand, and she bent down to put Child B on the floor with her left hand. At this time, Child B on the Child B on the C I cried u was consolable. Ms. Moore said that she wrote an incident report and called the parents the same day. The parents seemed to be fine about the situation. On 4/20/23, the department received a complaint stating that most of the classrooms are out of ratio due to staff shortages. There were no further details on the dates or times. The ratio issues are mainly in the mornings when the rooms are combined at drop off times. On 4/21/23, I interviewed the complainant who witnessed the classrooms being out of ratio many times. The complainant said that it is especially true of the combined classrooms in the morning between 7:30 a.m. and 8:30 a.m. when it gets very busy. The infant/toddler rooms and discovery preschool (DPS)/preschool (PS) combined rooms are typically out of ratio at this time. The complainant did not have any details of the times or dates but stated that this was a very common issue as recent as last week. On 4/21/23, I conducted an unannounced, onsite inspection at the center. There were five rooms operating, and all the rooms were in ratio. I observed the following: Infant 1 room: 8 children with 2 staff members. Toddler 2 room: 8 children with 2 staff members. Infant room 2: 4 children with 1 staff member. Discovery preschool room: 8 children with 1 staff member. Pre-k classroom: 9 children with 1 staff member. The toddler 1 classroom and the preschool room were closed for the day. On 4/21/23, I interviewed Ms. Moore who said that they are not able to maintain ratios in the mornings, especially in the last two weeks due to staff shortages. Ms. Moore said that the staff members that are currently employed do not follow the staff schedules and don't come into work at the time they are supposed to be in the classroom. This makes it hard to maintain ratios. She said that this is a typical problem in the infant/toddler combined group in the morning but is also a problem sometimes in the other combined group of preschool and Pre-k. They combine infants/toddlers and preschool/pre-k classrooms in the morning until about 8:30 a.m. and after 4 p.m. in the evening. Ms. Moore said that management is trying to hire more people, but the staff turnover is very high at this center. Ms. Moore said that if all the children are sleeping, the staff members break each other during lunch time. On 4/21/23, I interviewed CCSM 1 who said that she always works in the mornings, and they have been out of ratio on and off several times a week. CCSM 1 said that there have been mornings when they had fifteen children with just two staff members, and nine toddlers by herself. CCSM 1 said that when they separate into their classrooms, they seem to be fine. CCSM 1 said that during nap times, if all the children are sleeping, they break each other. When the staff members go on breaks, they take more than a half hour to come back. Even if one child is awake, a staff member relieves them for breaks. On 4/21/23, I interviewed CCSM 2 who said that ratio has been an issue since many staff members quit in the last two weeks. CCSM 2 said that during nap time she had eight children by herself, but all the children were sleeping. Usually, all children sleep during nap time and the staff members break each other. CCSM 2 said that there was a day in the toddler room when they had nine children with two staff members all day. CCSM 2 did not know the date of the incident. On 4/21/23, I interviewed CCSM 3 who said that the staff shortage has created issues for ratio, especially with the combined infant/toddler group in the morning from 7:30 am to 8:30 am. The previous week was very hectic. One of the days they had over twelve children with two staff members. CCSM 3 was not sure about the combined group of preschool and pre-k rooms in the morning. On 4/21/23, I interviewed CCSM 4 who said that they are out of ratio at least a couple of times in a week.

On 4/20/23, the department received a complaint stating that most of the staff members did not assure that children washed hands with soap and water after diapering, and before or after mealtimes. There was no information on the names of staff members, specific classrooms, or dates. On 4/21/23, I interviewed the complainant who said that most of the staff members working in the infant/toddler rooms and discovery preschool rooms were not washing children's hands or their hands with soap and water. The complainant said that the staff members used either baby wipes to clean children's hands or they did not wash them at all. The complainant said that toddler 2 and older classrooms were washing hands for both children and staff after diapering, before and after meals. On 4/21/23, I interviewed Ms. Moore who said that she was retraining several staff members on using soap and water for hand washing instead of baby wipes, especially in the infant room. Ms. Moore said that this has been going on for four months that staff members do not listen to instructions. She said that the infant 2 room staff members and toddler room staff members are not ensuring that children wash hands after diapering or before/after meals. Ms. Moore said that staff members know the rules, but they don't want to follow them. On 4/21/23, I interviewed CCSM 1 who said that she was not aware that she had to wash children's hands with soap and water after diapering, and before and after meals. CCSM 1 said that she has always used baby wipes for everything in the infant rooms. On 4/21/23, I interviewed CCSM 3 who said that she knows to wash hands with soap and water, and she had followed the same with the infants. However, she had seen that some staff members (not sure about the names) did not use soap and water to wash children's hands after diapering, and before and after meals. On 4/21/23, I interviewed CCSM 4 who said that she did not know that infants had to use soap and water to clean hands after diapering and before/after meals. She said that she was hearing about it for the first time. CCSM 4 said that she washed her hands with soap and water after diapering, and before serving meals. On 4/21/23, I interviewed CCSM 5 who said that she had always washed children's hands with soap and water after toileting and before/after meals in the discovery preschool room. She had not seen anybody use wipes in the discovery preschool classroom. CCSM 5 said that she always uses soap and water to wash her hands after diapering and before serving meals. On 4/20/23, the department received a complaint stating that most of the lead caregivers at the center are not qualified. On 4/21/23, I interviewed the complainant who said most of the lead caregivers are not qualified. On 4/21/23, I reviewed the educational qualifications for the lead caregivers. There are seven rooms operating at the center. Out of the seven rooms, three rooms (preschool, pre-k and infant room 1) have a qualified lead caregiver and the other four rooms (infant room 2, toddler 1, toddler 2, infant 2 and discovery preschool rooms) do not have qualified lead caregivers. The lead caregiver in the pre-k room has a CDA, the lead caregiver in the infant 1 classroom has 12 semester hours in early childhood education courses and the preschool lead caregiver has an approved variance from the department. On 4/21/23, Ms. Moore said that they were struggling to hire qualified staff members and she was trying to do her best with enrolling the staff members into courses to get their ceu's so that they can be qualified. Ms. Moore said that even before they complete the requirements, they quit their jobs. On 6/12/23, Ms. Hall-Elzy said that she was aware of the lack of qualified lead caregivers in the classrooms. She said that they were working on hiring and retaining the qualified staff members. On 4/20/21, the department received a complaint stating that the trash was not taken out of the center daily. There was no mention of specific dates. On 4/21/23, I interviewed the complainant who said that there are many times when the staff members do not take out the trash when they close for the evening. This is an issue that is not dealt with by management. The staff members are not held accountable for the same. On 4/21/23, I interviewed Ms. Moore who said that it was a clear expectation for all the staff members to clear the garbage every day. The closers are expected to take the garbage out if it is not cleared by the afternoon staff. All staff members work on these procedures. Ms. Moore said that as far as she is aware, all garbage is removed from the center daily. On 4/21/23, I interviewed CCSM 1 who said that she mostly works in the mornings with the infant/toddler classrooms. CCSM 1 said that she is aware that trash needs to be removed every day, and she takes care of it when she is required to do so. However, there are many mornings when she comes into the classroom in the morning and the trash is left in the trash can and is not disposed the previous day. CCSM 2 said that she takes the trash out when she closes for the day, and she has never seen it left behind from the previous day. On 4/21/23, I interviewed CCSM 3 who said that it has happened at least two times a week that trash is left in the classroom from the previous day. Many times, she has seen the trash bags tied and left outside the classroom but not disposed of in the dumpster. Sometimes she has seen staff members leaving the snack bags and water bottles outside near the playground without disposing of them into the trash bags. On 4/21/23, I interviewed CCSM 4 who said that there have been days when she has seen trash left in the infant 1 classroom without being disposed. CCSM 4 said that she has seen water bottles and snack bags being left outside in the outdoor play area by staff members. The trash is not cleared from there on a day-to-day basis. On 4/21/23, I conducted an inspection onsite. I did not observe any trash left outside on the playground. On 4/21/23, I received a video from the complainant which showed used paper towels, a water spray bottle, and used paper cups left outside near the playground, but children had no access to the trash, since it is in the fenced area on the premises. On 4/21/23, I interviewed CCSM 5 who said that the trash in the discovery preschool classroom does not get taken out daily if she is not present in the classroom. CCSM 5 said that not all staff members clear the trash daily. On 4/21/23, I interviewed CCSM 6 who said that if she was not working in the discovery preschool classroom, the trash was not taken out that day. CCSM 6 said that this happens at least three times a week. CCSM 6 said that not all staff members/closers know that they have to clear trash from their classroom on a daily basis. On 4/21/23, I interviewed CCSM 7 who said that the trash is picked up from the pre-k room daily. CCSM 7 said that she has not had problems with trash being left in the classroom. On 4/21/23, I interviewed CCSM 9 who said that trash is always taken out of the classroom and put into the dumpster daily. She has not had that problem in the toddler 2 classroom. On 5/12//23, I interviewed CCSM 8 who said that she has not had a problem with trash being cleared from her classroom on a day-to-day basis; however, she has seen used baby wipes and water bottles on the grass area close to the playground many times. On 10/29/2021 Child A's Mother stated that Ms. Martinez informed her that she had held Child A down when he was upset. Child A is Autistic. She was not sure of the 2 date that this occurred, but it was roughly two weeks ago. The second incident occurred on 10/25/2021 when Child A had a handprint on his bottom fingerprints or his left hip that looked like someone had squeezed him, and a scratch mark that looked like a rug burn. Child A's Mother did not speak to anyone at the center about the marks on Child A. Child A's Mother took pictures of the marks. I viewed the pictures, and they looked like scratches; they did not appear to be fingerprints. Child A's Mother did not take Child A to a doctor; she did not talk to Ms. Martinez or anyone else at the center about what Child A stated or his injuries. Child A has an applied behavior analysis (ABA) therapist that works with him from 8:00 am- 12:00 pm. Child A attended the center Monday through Friday at various hours between 6:50 am to 3:00 pm. Child A's last day was , and acco"rdinWg to his .m other, she did not inform the center that she was disenrolling him until She did not tell anyone why she was disenrolling him from the center. On 11/01/2021 Ms. Martinez stated that Child A is Autistic, and he would scratch and hit her when he was upset. He would run to the corner sometimes and she would ask him once he calmed down if he wanted to sit in her lap and she would hold him and sing to him to help him to calm down. She never grabbed or held him tight, and when he was in her lap, she did not touch his legs or hips. Ms. Martinez stated that she was not aware of the allegation; Child A's Mother did not say anything to her. On 11/01/2021 At 12:45 pm I observed fifteen preschool children alone with Ms. Martinez. The children were on cots that were not placed 18 inches apart, and there were at least four children that were awake on their cots. The name-to-face sheets were separate for the preschool and young preschool classrooms. Ms. Martinez and Ms. Pagel did not combine the children on one name-to-face sheet, so they did not accurately document that Ms. Martinez was alone with fifteen children. Ms. Martinez stated that the lead caregiver left the center in May of 2020, and she is the substitute lead caregiver. She is working on her CDA and currently completing the last module of the program. She stated the Ms. Pagel had brought the young preschool children to her classroom during naptime. The center had been short staffed, but they were closing classrooms and that was helping. She had seven children until Ms. Pagel left her eight children with her at noon. Ms. Pagel left to cover breaks at 12:45 pm. She knew that she was out of ratio with the extra children but that was the only way that the staff would receive their lunch breaks. Ms. Martinez stated that the name-to-face sheets were separate because they were separate classrooms. Ms. Pagel stated that she had combined her eight children with Ms. Martinez in the preschool classroom at noon and she started breaking the other caregivers at 12:45 pm and she was starting her lunch at 1:48 pm and at 2:45 pm she would return to the preschool classroom with Ms. Martinez. She knew that leaving the classroom left Ms. Martinez out of ratio with the extra children but that was the only way that the staff would receive their lunch breaks. ..... .........................................................................................................................................................
