    R 400.1913 · R 400.1913 Discipline; child handling. (3) Personnel shall not do any of the following: (a) Hit, spank, shake, bite, pinch, or inflict other forms of corporal punishment.

    On 11/12/2020 I spoke to the Reporting Person regarding the allegations. The Reporting Person stated that on 11/11/2020 she spoke with Child A 2 who disclosed that when the child care licensee, Ms. Ashley Shellenbarger gets upset, she'll "smack" the children on their sides. The Reporting Person also stated that Child A had reported being "smacked" on the arm, and that Ms. Shellenbarger had also recently spanked a child care kid by the name of _ The Reporting Person denied ever observing any marks or injuries on Child A, but noted having concerns as she reported believing that Child A's Guardian would not address these matters out of fear of losing child care for Child A. On 11/12/2020 I made an onsite inspection at the home of Ms. Ashley Shellenbarger. During the inspection, I interviewed Ms. Shellenbarger and the child care staff member, Ms. Cierra Ackley. Upon discussing the allegations with Ms. Shellenbarger she denied using physical discipline on Child A, and stated that she's never used any physical methods of discipline on the child care children. Ms. Shellenbarger stated that her primary method of redirection was placing children in timeout; however, with the older children, she will take away privileges or an activity. Ms. Shellenbarger informed me that there was only one time that she ever recalled making physical contact with a child, and that was to prevent them from running out into the street. Ms. Shellenbarger stated that she has had Child A in her care for over seven years. She stated that Child A was a good child but has had a "difficult life." Ms. Shellenbarger stated that Child A was typically a well-behaved child but over the past few months her behavior has been "rough." Ms. Shellenbarger stated that recently Child A has not been listening too well and that she has been "overly emotional." A request was made for Ms. Shellenbarger's current and closed Child Information Cards. After reviewing the cards, I was not able to locate a child named _ When asked if Ms. Shellenbarger had an enrolled child named she said she did not, and noted that she has never had a child by that name. I then informed Shellenbarger that Child A also made the disclosure that a child identified as had recently been spanked. Ms. Shellenbarger appeared confused at this, and again stated thpt sh does not have any currently enrolled or former child care children named Ms. Cierra Ackley informed me that she has been working as Ms. Shellenbarger's child care staff member regularly since September of 2019, but acknowledged that she has also worked as her child care staff member, "off and on" for the years prior to September, 2019. Ms. Ackley stated that in the time she has worked for Ms. Shellenbarger she has never witnessed her used any methods of physical discipline. When specifically asked about Child A, Ms. Ackley noted that her punishments include either being placed in timeout or having privileges taken away. Ms. Ackley identified Child A as "sassy but good," and denied ever witnessing any interaction between Child A and Ms. Shellenbarger that could even be misinterpreted as physical discipline or redirection. 3 I then asked Ms. Ackley about a child named - Ms. Ackley denied that there were any current child care children named Wyatt, and noted that she does not recall there ever been a child named =that attended the child care facility during periods of time when she worked for Ms. Shellenbarger. On 12/3/2020 I spoke to Child A's Guardian, Child B and Child C's Mother, and Child D and Child E's Mother. Child A's Guardian stated that Child A has been attending Ms. Shellenbarger's child care home since 2014. During this time, Child A's Guardian denied having any concerns regarding Ms. Shellenbarger or the care that Child A has received. Child A's Guardian informed me that she had spoken with the Reporting Person shortly after the allegations were made, and Child A's Guardian informed the Reporting Person that she's never had any concerns
