On 0411312021 Child A M -year-old _) went home from child care with a bruise on ~- On 04/16/2021 and I conducted a face-to-face interview with Child A's Mother. She stated a on the afternoon of 04/13/2021, she received a phone call from the school asking her to pick Child A up because supposedly had diarrhea. When she was cleaning Child A's bottom around 4:00 , she noticed bruising on Child A's-. Child A said, "My hurts." She knew the bruise did not happen at home because she saw Child A's when she changed E that morning around 7:OOAM and everything looked normal. Child A's Mother ex ed program director Ms. Jenasie Schopieray and requested a meeting for the next morning. When she told Ms. Schopieray about Child A's injury, she did not seem shocked by it. She explained that Child A fell on the playground, cried for a second, then went back to playing. She also mentioned that the playground e ui ment Child A was playing on has holes in it. Staff did not check Child A after fell because seemed ok. Child A's Mother described Child A as a klutzy c tld who often pays rough, but m has never fallen and injured Rise!Rbefore. After learning of Child A's injury, Ms. Schopieray said that she e had checked Child A. Child A's Mother also spoke with CCSM 2, asked if Child A fell on something, and was told "no." She expressed concern that the stories about Child A's injury were not consistent. She also wondered why it was not reported to her immediately after it happened. center. Child A is mostly potty trained at home and hardly has any accidents. Child 3 A's Mother then stated that Child A wears a pull up most of the time at home but when ■ is at the center, they change into underwear. She and center staff ■ have been working on potty training, but when Child A is at the center, had frequent toileting accidents. Child A's Mother has a feeling that staff are rustrated with Child A's toileting accidents. She worries that Child A's injury might have been from a due to someone's frustration over her toileting accident on the Dlavaround because it looks like a . Child A's Mother takes Child A to a On 04116,2021, and I conducted an unannounced onsite inspection and interviewed Ms. Schopieray. She stated that Child A has frequent toileting accidents even though ■ is given many opportunities to use the bathroom throughout the day. Children in Child A's preschool classroom must be potty trained in order to attend so Ms. Schopieray gave Child A's Mother a timeframe for Child A to be completely potty trained by 04/26/2021. Ms. Schopieray and the other child care staff members have been working with Child A on toileting and have tried many different strategies. They have all expressed frustration about potty-training accidents because they seem purposeful. Child A arrives at the center in pull-ups and is changednto underwear soon after arriving. Ms. Schopieray knew Child A was because Child A's Mother often asked staff to put in aulwlluapy*a e of the day because the She never said why Child A was nor did she give an medical explanation why Child A had difficulty with toileting. Child A is the Ms. Schopieray thinks 1 toileting accidents are behavioral because will sit on the toilet and not go, then urinate or defecate in pants immediate y a erwards. Because of this, they have implemented a five-m nu e break as a consequence for Child A's seemingly purposeful toileting accidents. They do not call the break a time out because they are asking to think about■ choices and hopefully make a different decision next time. Center staff always take children to the bathroom before and after going outside. Once they are out, they try to avoid running children back and forth to the bathroom. On 04/13/2021, Child A had a loose stool bowel movement in. pants while playing outside on the playground even though had just used the ■ bathroom. CCSM 2 took inside to help get cleaned up. When they came back outside, Child A sat at the picnic table to think about what happened

On 03/03/2021, during the on-site inspection, time cards were present for two child care staff members who were not connected to the facility in the child care background check system. On 03/04/2021 I informed Ms. Schopieray that CCSM 5 and CCSM 6 were not connected to her facility in the background check system. Ms. Schopieray stated that she had eligibility letters for the child care staff members from another center and she thought that was enough to be compliant, but she would connect the staff members to her facility immediately. As of the date of this report, CCSM 5 and CCSM 6 are connected to the facility in the Child Care Background Check system.

On 02/04/2021, The complainant stated that sometimes there is one child care staff member with 12 or 13 preschool age children and that group sometimes combines with the Infant/Toddler classroom. The following statement is included in the 09/10/2020 Addendum to the Original Licensing Study Report: "It is acceptable for children older than 36 months to be cared for in the infant/toddler room at the beginning and end of the day. Ms. Schopieray understands that all children must be provided with appropriate programming at all times and the ratio of child care staff members to children is determined by the youngest child in the room." 4 On 02/08/2021, I attempted an on-site inspection. When I arrived at the center, I was informed by the St. Mary of Hannah building principal, Ms. Lisa Swartz-Medina, that Kingsley Children's Center was not operating due to a COVID-19 exposure. I received an email from licensee and program director Ms. Jenasie Schopieray later that day stating that the center was not operating due to COVID-19 and would resume operations on 02/15/2021. On 02/09/2021, I received an additional allegation regarding the ratio of child care staff members to children the mornings in the Infant/Toddler Room. The complaint indicates that too many children are combined with babies in the Infant/Toddler Room. On 02/18/2021, I completed an on-site inspection. There were 11 preschool age children present in the Preschool Classroom with two child care staff members and 8 infants and toddlers in the Infant/Toddler Room with two child care staff members. Therefore, the center was in compliance regarding the ratio of child care staff members to children and group size during the inspection. I spoke with Ms. Schopieray and informed her of the allegations. She stated that it was possible that a few times in the mornings, the center had been out of compliance regarding the ratio of child care staff members to children and group size when a few children had arrived early and all child care staff members had not yet arrived. Ms. Schopieray indicated that she understood the Licensing Rules for Child Care Centers regarding ratio and group size. Ms. Schopieray stated that she was not aware that an accurate record detailing the daily arrival and departure times for each child care staff member is now a required rule. On 02/19/2021, I spoke with Ms. Schopieray and explained that I had not completed a full review of the attendance information I had gathered during the inspection the previous day; however, I was concerned because I could already see that the center had not been in compliance regarding the ratio of child care staff members to children at least on the morning of 02/17/2021. Ms. Schopieray explained at that time that the general practice in the morning is for the children who arrive early to be cared for in the Infant/Toddler Room, even if they are signed in on the preschool attendance record, until there are too many children to be in compliance in the Infant/Toddler Room or additional child care staff arrive. Some children are also moved from the Infant/Toddler room into the Preschool Room and back to the Infant/Toddler Room if they are old enough. Ms. Schopieray knew that there had been times when the center may have been out of compliance regarding child care staff members to children and too many children may have been in the Infant/Toddler Room. Ms. Schopieray had let a staff member go the previous week and that had been part of the problem, but that should now be resolved. She understands that she needed to make sure the center was in compliance regarding the ratio of child car There are always movies on in the infant/toddler room. On 02/09/2021, I received information that indicated that there are always movies on in the Infant/Toddler Room. On 02/18/2021 and 03/03/2021 I did not observe media used in the Infant/Toddler Room. On 02/18/2021, Ms. Schopieray stated that sometimes a "Mickey" show was on in the Infant/Toddler Room at drop-off time due to a parent request. This was in effort to make the drop-off transition easier for a particular child. Ms. Schopieray stated that they really just play it for the music and the children are not expected to watch the show. We discussed that sometimes videos that the children dance to are played on the computer screen, but these felt appropriate and were not used very much. On 03/02/2021, CCSM 2 stated that she does not believe that movies are played a lot in the Infant/Toddler Room, but it is hard to say. On 03/16/2021, CCSM 3 and CCSM 4 stated that there is no passive media or movies played in the Infant/Toddler Room. Sometimes interactive media played is where children dance and sing, but that is short and appropriate to their age and development. 03/18/2021, I spoke with Complainant 1. He/she stated that he/she has witnessed computer screens and phones being used in the Infant/Toddler room regarding media. 11 On 03/18/2021, CCSM 1 stated that she really did not have information about media in the Infant/Toddler room. On 03/18/2021, Ms. Schopieray and I discussed media used in the Infant/Toddler Room. We discussed that at times they have played music videos where the children would dance with the videos. We discussed that interactive media can be developmentally appropriate at times. Ms. Schopieray stated that they do not and have not used passive media at all in the Infant/Toddler Room. Ms. Schopieray stated that there is a television in the classroom, but it is never used, and any media played was shown on a computer screen. I informed Ms. Schopieray that upon review of all rules, all media is prohibited for children under two years old. We discussed that since the Infant/Toddler Room is approved for children under two years, as well as children older than two years old, the use of any media, including interactive media, is not allowed when children under two years old are present. Ms. Schopieray stated that she understood and would let her staff know. She explained that they really did not have much screen time anyway and they would switch to providing music only without screen use involved. APPLICA .....B .....L .....E ... RULE R 400.8179(9) Program. (9) Use of media is prohibited for children under 2 years of age. ANALYSIS: Ms. Schopieray did not ensure children under two years old were not exposed to media. At times, interactive dance videos were played in the Infant/Toddler Classroom. CONCLUSION: VIOLATION NOT ESTABLISHED The licensee and program director, Ms. Jenasie Schopieray, is not at the center at least six hours per day. On 02/09/2021, I received information that indicated that Ms. Schopieray is "never there," regarding her presence at the center. Note: As program director, Ms. Schopieray is required to be present in the center for at least six hours per day on a regular basis. Program directors are allowed sick days, may attend trainings, and leave the center during the hours of operations. However, a program director must be regularly scheduled and present a total of six hours per day on a consistent basis. On 02/18/2021, I informed Ms. Schopieray of the allegation and she stated that she is regularly at the center for at least six hours during hours of operation. On 03/02/2021, CCSM 2 stated that Ms. Schopieray had been gone a lot and before December 2020, she was not present at least six hours per day. On 03/16/2021, CCSM 3 stated that she knows that Ms. Schopieray has been at the center on a regular basis at least 6 hours per day since November 2020. She may have been occasionally gone for appointments. On 03/16/2021, CCSM 4 stated that she knows that Ms. Schopieray has been at the center on a regular basis, at least 6 hours per day, since October 2020. She may have been occasionally gone for appointments. On 03/18/2021, CCSM 1 stated that she does not know exactly how many hours per day Ms. Schopieray is at the center, but she sees her every day at the center. On 03/18/2021, the complainant stated that he/she believes Ms. Schopieray has been at the center at least six hours per day recently, but she was not present at least six hours per day before the time of this investigation. On 03/18/2021, Ms. Schopieray and I discussed that I had received conflicting reports of the amount of time she has been present in the center. Ms. Schopieray stated that she has always been present at least six hours during center operations unless she had an appointment. She has worked a lot in the classrooms this school year. She sometimes worked at the center, then left, and returned to the center later in the day to work in the classrooms again. I asked why anyone would indicate that she was not present enough. Ms. Schopieray expressed that she could only think 13 that possibly her occasional practice of working a split shift may have given this impression, but she has indeed always been present at least six hours per day during center operations. We also discussed that since Ms. Schopieray is now keeping track of her arrival and departure times, her record of attendance should no longer be an issue. APPLICABLE RULE R 400.8113 Program director qualifications; responsibilities.
