    On 11/02/2022, I spoke with Child A's Mother about the allegations. Child A's Mother explained that she felt like the center was singling out and targeting Child A. Child A has been attending the center since September 2022. Child A's Mother said that the center sent Child A home multiple times when he had behavior concerns. The center director Kelly Ashley had Child A's Father signed a probation plan on 10/13/2022 without consulting her or discussing it with her. Child A's Mother did not agree to the plan. Child A's Mother and Child A's Father had a meeting with Ms. Ashley on 10/26/2022 to discuss the situation. Child A's Mother questioned why the plan that Child A's Father signed was only about how he was 3 going to be sent home and excluded from care for his behavior instead of a plan to help Child A in the classroom. Child A's Mother said that there was no behavior plan in place for Child A. The center was reporting that Child A was being physically aggressive towards other children and the CCSMs but she had not seen that behavior from him at home, so she was wondering what was happening in the classroom to cause him to behave in that way. She did not feel the center provided them with adequate documentation of the behavior issues and they did not show her any video footage of the incidents. Due to having concerns about why the center was reporting behavior that they had not seen at home, Child A's Mother took the day off work so she could observe Child A in the classroom. On 10/27/2022, she arrived in the morning and stayed with Child A. She explained that she sat in the corner and took notes on her laptop of what she was observing. She reported that Ms. Ashley did not want her to observe the classroom. CCSM 4 came into the classroom and told her that Ms. Ashley wanted her to observe the video feed instead of being in the classroom and that Child A might act differently than if she remained in the room. Child A's Mother said she declined to do that because the video feed would not have audio and she wanted to hear what was being said and because Ms. Ashley was not there yet. Later Ms. Ashley came in the classroom and told her that she could view the video feed and when she declined, Ms. Ashley told her that she needed to have a background check. Child A's Mother agreed to fill out the form, but Ms. Ashley told her that she could not stay more than four hours. When the classroom transitioned to another room for Bible class, Child A's Mother saw CCSM 1 grab Child A by his arms, lift him up and sit him down aggressively. Child A did not cry or appear upset. Child A's Mother said that she did not think it was an appropriate way to interact with her child. A few minutes later, she observed CCSM 2 grab Child A's head in an aggressive manner to turn him around. After Bible class was done and the classroom returned to their own room, Ms. Ashley came in and started talking to her about the tuition balance that she owed. Child A's Mother told her that it was unprofessional to have that discussion in the classroom in front of children and went into the Bible classroom as it was empty. Ms. Ashley followed her, was escalating, started talking louder and continued to talk about the matter in the hallway and refused to go in the Bible room. Child A's Mother asked if they could go to her office instead, but Ms. Ashley continued to talk. Child A's Mother had to leave the Bible classroom as another group of children came in and Ms. Ashley came back to Child A's classroom with Witness 1. They then talked in the office and Witness 1 asked Child A's Mother to leave. Child A's Mother told them that she had planned on staying to observe her child and was told that they would need a background check on her in order for her stay the whole day. Child A's Mother said that she took Child A and left. Later that evening she received an email from Ms. Ashley informing her that Child A was being dismissed from the center. (1) Pursuant to section 5n of the act, MCL 722.115n, before an individual has unsupervised contact with children, the department shall determine the individual's eligibility to be any of the following: (e) An unsupervised volunteer.

    On 07/15/2022 I completed an unannounced visit to the child care center with Child Care Licensing Consultant Sara Schalk. I interviewed staff member Holly Engelberg. Ms. Engelberg stated the school age program went on a field trip to see the West Michigan White Caps baseball team on 7/13/2022. Because of a large response from parents interested in joining, three parents were 2 asked to drive their own cars. These three parents drove their own vehicles with their own children and other children from the classroom. Ms. Engelberg stated the three parents who drove their vehicles were not fingerprinted prior to the field trip. The three parents were in their vehicles alone with the children and not with any other staff members. Ms. Engelberg stated they did not expect such a large turnout of individuals interested in going. I explained that any parents who take children that are not their own and who are not in the presence of a staff member would be considered unsupervised volunteers and would need to be fingerprinted. Ms. Engelberg stated she understands, and they would have anyone who is an unsupervised volunteer with children be fingerprinted moving forward. Ms. Engelberg stated they will not be having such large events moving forward. On 08/03/2022 I contacted Program Director and Licensee Designee Kelly Ashley. Ms. Ashley stated she spoke with Ms. Engelberg and understood the field trip to the baseball game on 7/13/2022 was not done correctly with the three parents who drove. She is now aware that anyone who is unsupervised with children who are not their own are considered unsupervised volunteers. The volunteers are required to meet all rules before working with children unsupervised. This includes trainings and being determined eligible to have unsupervised contact with children. She will make sure anyone who is unsupervised will be determined eligible before they are with children. Ms. Ashley stated they had such a large response regarding this baseball game. She stated moving forward, they will not have such large events and will just use their normal staff and busses for field trips. Ms. Ashley stated they asked for volunteers for the field trip but did not review the center administrative rules for volunteer transportation, therefore did not meet transportation criteria.

    On 03/16/2021, I completed an unannounced on-site inspection and spoke with center director Kelly Ashley. Ms. Ashley explained that she had a video of the child falling off the slide, had provided it to Child A's Father and would email a copy of it to me. Ms. Ashley explained that Child A is enrolled in kindergarten and attends class virtually while at the center. Child A was injured while on the playground with child care staff member Hannah Waller. Ms. Ashley said that Ms. Waller was providing appropriate supervision and was sitting on a bench that faces that playground with her back to the parking lot. 2 I interviewed Ms. Waller who explained that she works with school age children at the center. On the day that Child A was injured, she had taken Child A and another 4th school age child who is in grade outside to play on the playground. She explained that they walked outside, and the two children were playing a game. She sat down on the bench and could not see the slide from there. Ms. Waller explained that she heard Child A cry, but she initially thought he was pretending because he has pretend cried while playing in the past. As he continued to cry, she realized that he was hurt. She went over to him, looked him over but he would not let her lift his pant leg so she could not really see anything. He stood up but would not put any weight on his leg. She carried him to the bench, and he kept screaming. She then carried him inside and took him to the office where they got him some ice and his parents were contacted. Ms. Waller reported that she asked Child A what happened to him when they were in the office. She said that he told her that he was crawling and fell off. Ms. Waller said that she did not see him fall but she was facing the playground, watching the children while sitting on the bench. She said that she was not on her phone and had left it at home that day. I walked around the playground and viewed the play structure that Child A fell off. The slide is on the far side of the play structure from the bench and there is not a clear view of it from the bench. I reviewed the playground inspection report dated 07/28/2015 while on-site. The report states that the composite play structure is "intended for use by 2-12 years old." Ms. Ashley emailed a copy of the video of Child A falling off the slide. I viewed the video and observed Child A throw a ball at the other child and then run up and go on the play structure while the other child is retrieving the ball. The video shows Ms. Waller sitting on the bench facing the playground. Child A goes onto the slide. The video is not clear enough to see if Child A was standing or kneeling, but he was not sitting down as he began going down the slide. Child A appears to be leaning to his left and falls forward and goes over the edge while on his knees. Child A then falls to the ground. Ms. Waller was at Child A's side within ten seconds. On 04/13/2021, I spoke with Child A's Mother about incident. Child A's Mother reported that she initially had a concern about staff not being close enough to her son. I shared with her that my assessment of the incident was that appropriate care and supervision had been provided to her son. She had no other concerns about the care provided to Child A and he has returned to the center for care. 3
