" On 9/22/2022 1 completed an unannounced on-site inspection at the center. I interviewed education manager . She stated that she was filling in C1 for program director Lacey Latsko on 911912022. While she was checking in on the classrooms, child care staff member , who is the in the pre-k room, told her that she wanted her to know that Child A's Mother ha s opped her this morningto share that Child H Child C had Child A. Child other had told that she was not sure where it took place or if it took place at the center. Child 's Mother was unsure if the children even attended the stated they found out later that those children do attend the center, also shared with her at that time that Child A was putting cemntuAltilpplee i dren that day (9/19/2022). On 09/08/2022 the Bureau received a complaint which stated that on 09/06/2022 Child A was dropped off at the center between 8:30 and 8:45am and was picked up at 3:45pm. When he was picked up, he was wearing the same pull-up he had been dropped off in that morning, which was wet and had soaked through his pants. He had not been changed in approximately 7 hours. The complaint also stated that Child A's Father reached out to Ms. Latsko with his concerns, and she said she would look into it and get back to him, however she never did. On 09/12/2022 I completed an unannounced on-site inspection at the center. I interviewed Program Director Larissa (Lacey) Latsko. She stated that on 09/06/2022 Child A's Father called her and said Child A had the same pull-up on when he got home as he did when he was sent in that morning, and that it was soaking wet, having soaked through his pants and his car seat. I told him I'd look into it and get back to him. Child A was in the Preschool room on 09/06/2022, and Ms. Latsko said she immediately went to talk to the child care staff member in the room that day, Paige Bergman. Ms. Bergman is a floater at the center who was filling in in the Preschool room on the day of the incident. "She said he'd been going to the bathroom all day. She would ask him if he went, and he'd say `yes,' she'd ask him if his pull-up was dry, and he'd say `yes." Ms. Latsko said she asked Ms. Bergman if she had checked Child A's pull-up and she told her "she had not physically checked his pull-up all day." Ms. Latsko said she reviewed the diapering policy verbally with the staff member and told her that she needed to physically check the diapers herself. "I told her she needs to stand right there when a child is going to the bathroom, and if she needs to physically check the diaper, she needs to." I asked if Ms. Bergman had entered diaper changes on a daily sheet that day and Ms. Latsko replied, "She said she didn't enter diapering into the IPAD that day. Normally, the teacher would have because Child A is still in a pull-up, so we would still enter that information." I asked Ms. Latsko if she had followed up with Child A's Father, as she said she would. She replied, "I sent a follow up email explaining what had happened and apologized. His parents never emailed me back." I asked for a copy of the email she sent, and she said she thinks she deleted it. She looked for the email during our interview and said she couldn't find it. She expressed that she recently deleted a lot of emails, and I expressed that it might be unusual to delete emails from your sent folder, rather than your inbox. She said it is possible she didn't send it. "I sent it from home, so it's possible it never sent." On 09/29/022 I spoke with Child A's Mother. She said that when children turn 2, the center starts helping the parents with potty training by working on it while children are in care. "I've seen them in the bathroom with the kids at pick up. He's not really interested in it at all, but I do see them attempt to have him go to the bathroom." She 3 said on 09/06/2022 she picked Child A up from the center and his diaper had soaked through his pants. "I picked him up and immediately my arm was wet. I looked at his pants, and you could see that the pants were wet, there were two wet rings on his clothes." She checked Child A's pull-up and saw that it was the same pull — up he had on when she had dropped him off that morning. She dropped him off around 8:30am and picked him up around 3:45pm, which means his diaper had not been changed in approximately 7 hours. Her husband called Ms. Latsko that evening, and she said she would look into it and call us back. "We never heard back from her." Child A's Mother stated that lately they have had a hard time with the center overall. She stated that the teaching staff is constantly changing, "It's like a revolving door. The teachers are never there." She said that over the past six years they have attended the cent

On 08/23/2022 Program Director Larissa Latsko left a voicemail saying that on the evening of 08/22/2022 an incident had occurred, and she wasn't sure if she needed to report it. I called her back and spoke with her on the phone. She said that the previous evening, child care staff member Mace Gates had been working in a classroom with a group of children when Child A fell asleep. She left the room to bring the other children to another classroom and unknowingly left Child A. She then briefly came back in the room, but then left again. "About a minute later," child care staff member Luis Canales entered the room where Child A was sleeping and found him. I instructed Ms. Latsko that this was indeed something she needed to report, as all incidents of children being left unsupervised for any amount of time must be 2 reported to the Bureau. Additionally, I asked her to send an incident report, which she did. On 08/30/2022 I completed an unannounced on-site inspection and interviewed Ms. Latsko. She stated that at the time of the incident she was not present in the center, and child care staff member Cindy Timm was working as the "Team Lead" in charge that night. "I heard it second hand from her. It sounds like Ms. Gates was moving kids from the Preschool room to the Early Preschool room to combine at the end of the night. Child A was asleep because he didn't feel well. Ms. Gates didn't know he was asleep and moved the remaining kids to Early Preschool and signed them all in, including Child A. She then went back to get her water bottle from the Preschool Room where Child A was, and then went back to Early Preschool." A little while later, Mr. Canales entered the Preschool Room and found Child A. Ms. Gates said, "she wasn't used to children being asleep at that time." When asked if Ms. Gates knew Child A was sleeping in the classroom, Ms. Latsko replied, "She didn't leave him there on purpose. She didn't know he wasn't with her." Ms. Latsko said she saw video footage of the incident and that the whole incident "was about five minutes total" and that Ms. Gates did walk back into the classroom one time "for about a minute." She tried to call Child A's Father about the incident, but he was not interested in talking about it, and asked Child A's Grandpa to talk to them. "His Grandpa said he didn't think much of it." I asked Ms. Latsko what procedural steps were in place following an incident like this at the center, and she sat quietly for a minute. I asked if Ms. Gates was written up or placed on administrative leave and she said that she was not on administrative leave, and they had not yet written her up. "I did a name to face training that Tuesday, after it happened. And since the training, Amelia [Cegielski] and I have been going into the rooms every day to double check the name to face sheets and coach them on any mistakes we find." School education manager Amelia Cegielski said she was also not present in the center at the time of the incident, and that Ms. Timm was in charge of closing that day. At the time of the incident, Ms. Timm called Ms. Cegielski to let her know what happened. "She said a child was left alone sleeping in the Preschool room." Ms. Timm said that Ms. Gates told her the child was left alone for "around 30 seconds" but that Ms. Timm thought it was longer. Mr. Canales, who was the staff member in the Early Preschool room at the time the classrooms combined, and the one who then went back to the Preschool room to clean and found Child A, thought it was closer to five minutes. I asked Ms. Cegielski if she knew if there were any disciplinary actions for staff following an incident like this and she said she was "not sure." Cindy Timm is a lead caregiver at the center and fills in as a "Team Lead." At the time of the incident, she was "closing as the manager in charge." She asked Ms. Gates to move her children to the Early Preschool room to combine. "She moved the 3 kids over, and about 10 minutes later, Child A's

On 06/30/2022 I received an email from the Program Director at the center, Larissa Latsko, stating that on 06/29/2022 there was an incident that occurred between two school aged children that she wanted to speak with me about. I called and spoke to her and the School's Education Manager, Amelia Cegielski, on speakerphone. Ms. Latsko reported that in the afternoon on 06/29/2022 the school age staff member, Brandy Ramsey, called Ms. Cegielski down to her classroom, saying that something had happened and one of her students was "very upset." Ms. Cegielski reported that when she entered the room she saw that Child A was "visibly shaken and upset." Child A's Father was picking Child A up at the same time that Ms. Cegielski took 2 Child A out of the room, so the 3 of them sat down together in the office. Child A "shared that the children were making a fort, and another child used her hand to touch Child A's private area. The child was visibly shaken, in tears. She said she knew it wasn't right, so she moved away." Ms. Cegielski said she attempted to speak to the other child, Child B about it, but she "didn't get a lot of information." There was one staff member in the classroom, but Ms. Latsko and Ms. Cegielski did not know what her location was in the room at the time of the incident. "As soon as it happened, she called me down to her room." On 06/30/2022 Ms. Latsko sent a copy of the incident report over email, which reiterated what she and Ms. Cegielski had told me over the phone. On 07/06/2022 I completed an unannounced on-site inspection at the center. Ms. Latsko reported that the staff member found out about the incident on 06/29/2022 after a third child came to her and said she saw it happen. "She said the two kids were in the fort, and one was on top of the other and forced her to open her legs, and that now one was crying." After the child reported it, the staff member called Ms. Cegielski, and she came down to the room to try to figure out what happened. She took Child A out of the room because she was upset, and then spoke to Child A and her Father. Ms. Cegielski also spoke to Child B's Mother at pick-up. She asked her to speak with Child B and follow up with her later, but she has not heard back from Child B's Mother. I asked Ms. Latsko if she had any previous concerns with Child B acting out inappropriately with other children and she said there were no other concerns. She also reported no previous concerns for Child A. Ms. Latsko confirmed that there was only one staff member in the room at the time of the incident. Amelia Cegielski stated she has worked at the center since She reported no previous concerns for Child A or Child B. She was on-site at the time of the incident, which occurred between 4:30 and 5:30 pm on 06/29/2022. "The school age teacher called and asked me to come down to the room. She said she didn't know what had happened but mentioned Child A, and that she was in tears. I pulled her out to speak with her, and when we got up to the office, her dad had arrived to pick her up. We went into the office to talk, and she burst into tears, said something uncomfortable had happened that she knew wasn't right. Her dad asked what exactly happened and she said she was in the fort when Child B used her hands to touch her private parts. Her dad asked if she had her clothes on at the time and she said she did." Ms. Cegielski stated she spoke to Child B's Mother at pick-up, and she sent her an incident report to sign. "She didn't follow up with me after." "I tried to follow up with Child B, just asked her a really general question like "did something happen with you and Child A in the fort?" and she just looked at me with a kind of confused look and said they were playing Pokemon go." Since the incident, the forts in the classroom have been removed and the management team is working with the 3 staff on active supervision techniques and what they can do at the center to improve supervision. On 05/05/2022 I received a phone call from Program Director Lyndsey Deters stating that on 05/04/2022, childcare staff member Lauren Guyton dropped a 7 month old infant. Ms. Guyton was standing up and holding Child A when he "flung back out of her arms." The child fell backward to the ground from her standing position. Ms. Deters said that they called Child A's Mother to let her know what had happened, and that night Child A's parents took him to get checked out by a physician. "She said everything checked out and there were no concerns." On 05/05/2022 Ms. Deters emailed me a copy of an incident report, which stated, "Lauren went into the Infant 2 room to move Child A to Infant 1. When Lauren picked Child A up from the floor, he leaned back falling from the teacher's arms." On 05/16/2022 I completed an unannounced on-site inspection at the site. I spoke to Ms. Deters, who explained that Lauren Guyton no longer works at the center. She had given her two weeks prior to the incident. School Education Manager Amelia Cegielski said that she was present at the time of the incident. "I had asked Lauren to move the child from Infant 2 to Infant 1, and when she picked him up, he fell. She said he was reaching for her earring or something, and then he tipped back." Ms. Cegielski said that at the time of the incident, they called Child A's Mother who came to the center and "did a triage over the phone with their primary care provider." Ms. Cegielski was present with mom at that time and watched her complete the assessment. Child A's Mother left him at the center, since there were no obvious signs of distress and the physician said it should be ok. "When I checked the child, I didn't see anything. He was moving fine, and there were no signs of injury or concussion. The teachers did watch him closely the rest of the day and did extra nap checks for him." That night Child A's Mother took him to the doctor to get checked out, and everything seemed ok. There were no previous concerns for Ms. Guyton's care of children before. It seemed like it was just an accident. Child care staff member Christie Mulder stated she was in the Infant room at the time of the incident, but didn't see it happen. "I was doing something over at the counter. I had seen her pick him up, but by the time I heard him cry, he had fallen and she had already picked him right back up. When I turned around, she was holding him again and he was crying. She said he was reaching for her earring and then he fell." Ms. Mulder said Child A "is an archer, he likes to arch his back if he doesn't like something. She (Ms. Guyton) is usually a cook and she just comes in to help sometimes, she probably didn't know that about him." Ms. Mulder said Child A calmed down quickly and she didn't notice any bumps or other injuries. She had no previous concerns regarding how Ms. Guyton interacts with children. Sylvia Torrez stated she was also in the room at the time of the incident, but also did not see it occur. She was changing a child's diaper. "I heard a loud bump and the baby was on the ground, and by the time I turned to look she was holding him again. I didn't see very much." Ms. Torrez said that Child A "seemed ok" and she didn't 4 notice any injuries or abnormal behavior from him. She doesn't have any concerns for Ms. Guyton, "she's nice, and it was just an accident." On 06/01/2022 I attempted to call Lauren Guyton but was unable to reach her. She has not yet returned my call, and she no longer works at the center. On 06/01/2022 I spoke with Child A's Mother. She said the center called to notify her of the incident shortly after it happened. "They explained what happened and were very apologetic and empathetic." They explained that one of the child care staff members in the Infant 2 classroom was holding Child A when he reached for one of her earrings. I conducted an unannounced onsite inspection on 2/7/2022. I interviewed Lyndsey Deters, acting program director, regarding the allegation. I explained that the department received allegations that the center is not regularly cleaned and there is mold growth present in the carpet. Ms. Deters stated that the center is cleaned and sanitized daily. She acknowledged being aware of mold in an area of carpet, and a work order had been placed for carpet replacement. Ms. Deters stated that the carpet mold was present in the Toddler 1 classroom, and she accompanied me to observe this room. I observed the Toddler 1 classroom with Ms. Deters and found a large stain in the carpet. I interviewed Kim Pell (lead caregiver) regarding the stain. Ms. Pell stated that she first observed that stain in March of 2021 when she worked in the room as a substitute Child Care Staff Member. Ms. Pell reported the stain to a member of the management team, but she couldn't recall exactly who she spoke to. A carpet installer came to the facility to assess the carpet in December of 2021, and Ms. Pell stated that the carpet installer informed her that the stain appeared to be mold, but he couldn't be certain about this without removing the carpet. 2 While observing the Toddler 1 classroom, Ms. Deter stated that she initially observed the stain in December of 2021 when she was notified of it by Child Care Staff Members. She initiated a work order to have the carpet cleaned or removed if necessary. I identified chipped/peeling paint on the walls in the Toddler 1 classroom. I explained to Ms. Deter that chipped or flaking paint could not be present on interior or exterior surfaces at the center. I asked Ms. Deters to escort me through the facility to assess the cleanliness of other space approved for use by children. In addition to the Toddler 1 classroom, I also observed the Infant 3, Toddler 2, Early Preschool, and Preschool classrooms. Visible dirt and dust were present along the baseboards of all classrooms. Some of the baseboards were coated with old food in some areas, and other baseboard were damaged and in need of replacement. Chipped paint was also present on the walls of the Infant 3 classroom. I also observed trash and old food below a cupboard in a classroom. I identified these areas to Ms. Deters and recommended that the facility develop a schedule for deep cleaning that would include areas such as baseboards and carpets. It appeared that these larger areas were not being regularly cleaned though surface cleaning occurs daily. I also explained the importance of regular cleaning for health and safety reasons. All of the soiled areas were in child use spaces and small children such as infants and toddlers regularly use the floor space for play and development. Old food on floors presents a hazard as small children could place these items in their mouths and choke, and floor areas that are not clean presents health risks for young children. Ms. Deters agreed and stated that she would initiate a plan to have all of the identified cleaning issues addressed. I conducted a second unannounced inspection on 3/29/2022. I observed the Toddler 1 classroom again. The room was clean, and all baseboards had been thoroughly cleaned and sanitized. The stain in the carpet was still present, but the carpet was cleaned on 2/26/2022, 3/4/2022, and 3/13/2022. The Toddler 1 classroom is scheduled to be painted and all carpet will be replaced. Ms. Deters explained that until the new flooring is installed, the carpet will be regularly cleaned to help ensure the health and safety of children. I walked through the facility and observed several classrooms during the onsite inspection. Most of the classrooms observed were newly painted and no chipped or flaking paint was present. All baseboards were cleaned and no heavy dust or soilage was observed.

On 8/31/2021 a phone call made to speak with to Child A's Father. He stated that Child A had been attending the center since he was an infant. Child A's Father stated the last 6 months he has been given incident reports that Child A had been getting bitten by Child B weekly. Child A's Father stated that it started out as once a 04 month, and then three months ago it increased to about twice a week. He stated that Child A was sick for a week, and did not attend the child care. Once he returned, Child A was bitten by Child B about four times in a week. He added that he was bit at least 1% times in the past month, Child A's Father stated that he met with the director to discuss the issues and was told that Child B was put on a behavioral plan, and they would be monitoring the situation. Child A's Father stated that during the behavioral plan period, Child A was still bitten by Child B. He explained that he would get an incident report each time Child A was bitten, Child .A's Father stated that Child B is no longer able to attend the center because the behavior plan did not seem to work. He stated that he pulled Child A from care a week ago. Father A added the day before he stopped attending, Ms. Tranquilla had a pen in her pocket, without a cap, and went to sit Child A down and the pen rubbed his leg and left a red mark on his leg, which he received an incident report for. During our onsite inspection we interviewed program director, Megan Dillingham. She stated that Zoie Tranquilla is the lead caregiver in the classroom, and she is typically in the classroom alone because there is low enrollment in the room. Felicity Koets will help assist Ms. Zoie Tranquilla if there are more than 4 children in care in that room. Ms. Dillingham stated she was aware of that Child B often bites Child A. She reported that their school education manager, Amelia Cegielski, created a behavior plan for Child B due to his biting. Ms. Dillingham explained Ms. Cegielski role is to support the children, employees, and parents and wor ks with the children in the facility. She explained that Child A's parents were upset and came in to speak with her due to him getting bitten numerous times within a short time period. On 6/18/2021, Ms. Dillingham and Ms. Cegielski met with Child B's parents to discuss the behavior plan. The behavior plan that they put into place for Child 8 was intended to eliminate the biting. Staff members would work on his communication skills by modeling those skills. Staff members would also teach him acceptable behaviors for affection. Ms. Dillingham reported that the behavior plan in place and were monitoring Child B for 21 days. Ms. Dillingham stated that after the behavioral plan was put in place, Child B's behaviors got better but started to regress in the last month. Ms. Dililngham stated Ms. Cegielski met with Child B's Father again on 8/20/2021, to put a plan in place that the child would get a warning then would have to stay home. Instead of implementing the new plan, Child B's parents withdrew Child B from the child care. Child A's parents also withdrew him on the same day. Ms. Dillingham provided Child A's file, from 6f1112021-8120/21 there were 16 incident reports, 13 of those were from being bit by Child S. Most of the incidents were in the morning. Ms. Dillingham stated that diaper/transition time is 9 9:30am and 11-11:30am when most of the incidents occurred. lbs. Dillingham also provided a copy of Child behavior plan. ire's During my onsite inspection, interviewed the school education manager, Amelia Cegielsk heqsaed that works with every classroom, and supports families and staff members. She also helps build the curriculum and helps with behaviors. On 04/26/21 1 spoke with Child A's Mother by telephone. She explained she received an incident report on 4/22/21 from the child care facility stating Child A had a large bruise on • inner thigh. She took• in for Child A's Mother said she had noticed a similar bruise to inner thigh a few weeks prior. She did not have any concerns the bruises were a ing place at the child care facility. She had no concerns about Child A's care or supervision while in care. On 04/26/21 and I conducted an unannounced on-site inspection to the facility regarding allegations that Child A, age,, had extensive bruising to inner thighs.. These allegations were investigated separately from another investigation we were conducting at the facility under 2021D 1078008 regarding bruises to a child in the same classroom. and I met with Ms. Leep and she continued to deny any knowledge of how bruising was occurring on children in the classroom. She provided us with a copy of the incident report that was completed for Child A. and I then interviewed Kendra Carpenter, child care staff member, outside the presence of others. Ms. Carpenter is the , in the classroom. She said on 04/22/21 she was changing Child 's diaper and noticed the bruising to inner thigh. She said "nothing happened" with ■ while II was in care. She so she was not aware if there were any accidents or incidents with im in the classroom on that day. Zoie Tranquilla, CCSM, was then interviewed outside the presence of others. She works as an assistant in the classroom. She saw, "a big looking bruise that didn't look full formed", on Child A's inner thigh. She saw this when Ms. Carpenter was changing and she called her over to see the bruise. She did not recall 3 anything happening to Child A while in care on 4121121 or seeing had any thati type of accident. On 04/26/21 I spoke with Child B's Mother by telephone. She has had no direct contact with the caregivers in the = classroom due to COVID-19 protocols that do not allow parents into the building. She said last week she noticed a small bruise on Child B's, age', buttock where, "he appeared to have sat on something like a small lego." She was aware of the bikes used by the = classroom and said Child B uses them frequently. She did not have any concerns about Child B's care at the center. I then spoke with Child C's Mother by telephone. She has not had any concerns with unexplained injuries or bruises to her child. She was aware of the riding toys on the playground and said Child C always pushes them rather than rides them. I left a telephone message for Child D's Mother on this date. I have not received a return telephone call from her. I then spoke with Child Es Mother by telephone. She had concerns as approximately a month ago Child E, age', nose was bleeding and had a scab in another area when she picked up from care. She was told no one knew what happened to Child E. She spoke w h Ms. Leep about her concerns and was told she was not able to view any video of Child E's day. She then spoke with Ms. Conroy and was told she would follow-up with her and she did not receive any additional follow-up from her. She had no concerns about Ms. Carpenter or her care for children in the classroom. Child E remains in care at the facility. On 05/03121= provided me with the following information pertaining to On 05/06/21 contacted Child F's Mother. Child F's Mother stated she observed a bruise on Child F's inner thigh and one on ■ buttocks. The bruises are the size of a thumb print and she did not think anything of it. She stated she did not get an incident report and was not notified of the bruising. She stated Child F is very nI "reactive" to getting hurt and would have told someone immediately if was hurt. She stated that earlier this week Child F had a bruised goose egg on forehead and reported that hit■ head on the house. She stated that she does not know what this means because she cannot see the classroom due to COVID restrictions. She stated that she d

Child A was There were two prior incidents ruises that were believed to have occurred while in child care. On 04/19/21 1 contacted Rachel Arens, Child Care Licensing Consultant, to inquire whether she was informed of any incidents with Child A having bruising while in care. Ms. Arens is the assigned consultant for the facility. She had not received any past or current incident reports about Child A receiving for bruises sustained at the child care facility. On 04/20/21 1 spoke with Child A's Mother by telephone. She recounted three separate incidents where Child A had bruises when in care. The first incident was 12101/20, the second was 04/07/21, and then this current incident. She was told each time that it was unknown how the bruises happened. She had brought her concerns to Kristen Leep, program director, however she does not feel there was a satisfactory response to the concerns. She did not have any concerns about staff as she has had little to no interaction with them as she is not allowed into the center due to COVID-19 protocols that are in place. She said Child A■_." the child care. On 04/20/21 ,and I conducted an unannounced on-site inspection to the facility. We interviewed Kristen Leep, program director, about the reported concerns. Ms. Leep said she was aware of the current bruises Child A has on ■ inner thigh. She had no idea how they occurred and denied any incident took place with Child A while in care to cause the bruising. She was aware of the previous concerns of Child A having bruising, which, she again said she never saw any bruises on Child A. She denied having any performance or behavioral issues with staff in the classroom. The lead caregiver and assistant have been in the classroom for quite some time. She denied any parents have brought any concerns to her about staff in the classroom. I viewed Child A's file and there were no incident reports for the days where bruising was reported by Child A's Mother. 3 We then interviewed Kendra Carpenter, chi ld care staff member, CSM1. outside othne presence of others. lbs. Carpenter explained she is in the ad classroom. She was aware of the reported concetrnhse tMhati Child bruising inner thigh. She denied knowing how they may have happened or that she saw any bruising on Child A while in care. She was informed of the bruises by Ms. Leep. She said the bruises may have come from the outdoor riding toys Child A uses. She had no other explanation or idea how the injury took place. Kennedi Mealoy, LGSM was then interviewed outside the presence of others. Ms. Mealoy said she is and worked in the classroom on 04/15/21, the day the bruising was found on Child A. She said Child A told her, "I have a bruise" and pointed t leg, Ms. Carpenter was in the classroom when this took place. Ms. Mealoy as e Child A about the bruise, but did not say anything more. She did not see the bruise on Child A's leg. She thoug t Ms. Carpenter knew about it and had seen it. She felt Ms. Carpenter was great with the children in the classroom and she was, "sweet, caring, and gets along with other teachers." Paige Bergman was then interviewed as she is the in the classroom. Child A had been in her classroom in December 2020 and was Child A's primary caregiver. On 12101/20 she noticed bruises on the inside of Child A's leg. She called Kristen Leep and recalled she looked at the bruises on the inside of Child A's leg. She did not recall if an incident report was done or additional follow-up any took place. She did not recall any explanation for how the bruising may have happened. On 01/20/2021 I received a phone call from Program Director Kristen Leep, who stated that the parent of a child in care said that child care staff member Jashon Long used unnecessary force with Child A and he feel out of his chair. The incident was viewed on live video footage, which parents have access to when off-site. Ms. Leep stated that she did not speak to the parent herself, but that she saw messages that had been sent through their communication app, Bright Wheel. "She had messaged regarding what she saw on the video and then she said "I don't need him getting hurt because someone's frustrated." She informed the center that she was coming to get her child, which she then did. Ms. Leep said that when she asked Mr. Long about the incident, he said he just moved the child's chair and the child fell out. Ms. Leep then sent me the required incident report, which stated that during lunch Mr. Long heard a child yell "stop it' to Child A. He walked over to Child A and "grabbed the back of his chair sliding him backwards and as he was sliding him backwards, Child A fell out of the chair on the floor by throwing a tantrum. Once Mr. Long saw that Child A fell, he quickly grabbed him to check for any bumps or bruises. Mr. Long did not see any on Child A." Ms. Leep also sent a screen shot of the messenger app that is used to communicate with parents, which showed a conversation between Child A's Mother and Mr. Long. Child A's Mother asked, "Is there a reason Child A is put to the side of the children?" Mr. Long replied, "We had to separate him from another student while passing out lunch he is back to the table eating lunch." One minute later Child A's Mother replied, "I think there was unnecessary force, he fell out of the chair." Mr. Long stated, "Child A likes to throw himself to the ground when he has to be separated or when he's upset. There wasn't any force with removing him from the table. If you can have a conversation with him about being physical with friends that would be appreciated. There wasn't any frustration with him. Once he fell out of the chair, I picked him up to make sure he was okay. I'll let you know if he has anymore misbehaving issues." Child A's Mother then sent an email which stated, "Please remove Child A from the room, I am coming to pick him up." She then came to pick him up directly. The mother also asked for video footage of the incident and stated, "I think Child A is afraid of (Mr. Long)." On 01/21/2021 I completed an unannounced on-site inspection at the center. I spoke with Ms. Leep, who stated that Child A's Mother removed the child directly following the incident and has not brought him back. Ms. Leep explained she was in a 3 classroom at the time of the incident and did not learn about it until later. The school's Education Manager, Amelia Cegielski, is the one who had contact with Child A's Mother about the incident. Ms. Leep explained she spoke to Mr. Long. He said that Child A grabbed another child's face, and Mr. Long went to move his chair when the child `'threw himself out of the chair." Mr. Long checked on him, made sure he was ok, and the child finished eating and "seemed ok." Mr. Long is the lead in the Early Preschool, where Child A has been for a few months. He has been working at the center for around 8 months, and she has had no previous concerns regarding his interactions with children. "He's always very gentle. We'll have to see the video footage, but the kids love him." She reported that no staff have reported concerns with him either. Amelia Cegielski is the school's Education Manager. She said she was present in the center at the time of the incident, and she spoke with Child A's Mother when she came to pick him up on the day of the incident. "Child A's Mother called, and she was very upset. She asked me to remove him right away. I didn't know what was really going on, but I had seen the messages come through on Bright Wheel. On 11/20/2020 I spoke with the complainant. The complainant explained she did not witness the incident, but this was reported to her. She said it was told her that Ms. Bergman grabbed Child A in an aggressive manner and it looked concerning. On 11/23/2020 I spoke with Makayla Goldsmith, Child A's elementary school teacher. She explained she was doing a zoom meeting with her students, which included Child A. During this zoom meeting, shortly after 9:00am, Ms. Goldsmith observed one of Child A's caregivers at the center, unknown name, use both of her hands to grab both of Child A's wrists and "forcefully" put him down in his chair. She said Child A appeared "normal" after the incident and did not appear to be upset. She explained Child A wondered from his seat a few other times. Ms. Goldsmith stated the staff member came onto zoom with Child A's headphones and Ms. Goldsmith asked this staff member if she could hear her and the staff member responded yes, but Child A "is choosing not to come, he always does this" and she sounded frustrated. Ms. Goldsmith could not hear audio during the altercation, and she stated she did not observe any other incidents. She stated she spoke with the school principal and Child A's Mother regarding what she witnessed and since this incident, she has not seen Child A attend the center. On 11/23/2020 I made an unannounced visit to the center. I spoke with program director, Kristen Leep. Ms. Leep explained in the morning of 11/18/2020, Child A was having difficulties and staff member, Paige Bergman had called her for assistance. She stated Child A was running around the classroom, hitting other child care children and distracting others from getting their work done. She stated she tried to help Child A stay in his zoom class, but this was difficult. She explained she called Child A's Mother on 11/17/2020 to inform her about Child A's behaviors. Ms. Leep stated the next day, Child A was behaving in the same manner and Ms. Bergman called her for help as Child A was not completing his work and was hitting other children. Ms. Leep explained she was unable to come to Ms. Bergman's classroom to help because she was getting ready to help in another classroom. She said Ms. Bergman was clearly becoming frustrated with Child A's behaviors, so to prevent anything from escalating, she contacted Child A's Mother and left a voicemail requesting Child A to be picked up from the center. She stated Child A's Mother called back and advised Child A's Grandmother would be picking him up. While on the phone, Child A's Mother said Child A's Elementary School teacher witnessed through zoom his classroom caregiver grab him and the schoolteacher expressed concern with how she saw Child A being grabbed. Ms. Leep stated Kathleen Conroy, district manager, was made aware of the allegations. On Thursday 11/19/2020, Ms. Conroy reviewed the classrooms video footage and did not see any concerning actions from Ms. Bergman, although there were times Ms. Bergman and Child A were out of the cameras view. Ms. Leep stated 3 she spoke with Ms. Bergman and told her to be mindful with handling the child care children and to take a break, if needed. She stated Ms. Bergman did not provide an explanation of what happened. Ms. Leep said Ms. Bergman was not written up because nothing was seen in the video footage. She stated there was no documentation made for the alleged incident. Ms. Bergman was the only staff member in the classroom, therefore there are no other additional witnesses that would have observed the alleged incident. Ms. Leep stated Ms. Bergman has one write up for being tardy and no one has made complaints about her. I spoke with Paige Bergman, child care staff member. She stated around 9:30am on 11/18/2020, Child A was being disruptive during his online zoom meeting and she had other school aged students completing online schoolwork. She explained Child A was refusing to do his work, yelling at her, taking toys and hitting other c
