Teacher 1 did not provide appropriate care and supervision for Child A when she turned away from him during a diaper change and he fell off the table hitting his head. Teachers also did not provide appropriate supervision when they fed Child A a muffin that contained dairy knowing he is allergic to dairy.

On 08/11/2023 the center sent an incident report stating that earlier that morning Child A (male, 18 months) had been left unattended on a playground. The report said that Child A’s class was transitioning back into the classroom around 10:09am, and the child was found on the playground by another teacher at 10:13am. On 08/16/2023 I completed an unannounced on-site inspection at the center. I spoke with Program Director Dani Parent and child care staff member CCSM1. Dani Parent was not in the building at the time of the incident but did state that she is in the process of doing formal write-ups for the staff who were involved in this incident, 2 CCSM2 and CCSM3. Both child care staff members were just out of their 90 day probationary timeframe, as they are relatively new hires. CCSM1 was in the PreK room at the time of the incident, helping to give a staff member a break. She heard a preschool room child care staff member yelling into the building that someone needed to come get Child A. The staff member had seen him on the toddler playground alone, from an adjacent playground where she was with her class. CCSM1 said she believes Child A was outside alone for “about three minutes.” She does not believe that CCSM2 and CCSM3 knew that Child A was not with them until he was brought back to their room. When asked about the transition processes at the center, CCSM1 said that the child care staff members count children, use doughnut ropes (that children hold on to in a line), and use face to name sheets all during transitions. The staff should have counted before they came into the room and then as they entered as well, to make sure everyone was accounted for. She did not believe they were following protocol at the time of the incident. Child care staff member CCSM2 is an assistant child care staff member in the toddler room. She stated she has worked at the center since late May. On the day of the incident, it was “a little chaotic” at the center. They were short staffed that day, so they were moving staff around. CCSM2 stated she was outside with the toddler classroom when there was a staffing change in her room. Her second staff member left and CCSM3 took their place. “About 15-30 minutes later, we went inside because we had a few kids with dirty diapers.” She said that the normal protocol for transitioning in from outside is to line the children up, count them and do the face to name. CCSM2 remembers counting to herself but not out loud. “I did count, but I must have counted wrong.” They did not line the children up and they did not do the face to name at the time of the incident. “We usually line up, but we didn’t that day. Instead, we just called the kids over.” They were standing in a group, and Child A and another child were still out on the playground. CCSM2 noticed the two children on the playground, so she asked CCSM3 to get them. “They both favor CCSM3, so I asked her to get them. She must have thought I told her only one was out there, because she got one but didn’t get Child A. He was hiding in the plastic treehouse.” As they were transitioning inside, a child was picked up by their mother from the room. As she left, she left the door to the hallway open, so as the children entered from the playground, they were running across the room and trying to leave into the hallway. “CCSM3 was in the classroom, and I was in the doorway to outside.” “There was a lot of chaos.” The child care staff closed the door to outside and CCSM3 began to change diapers while CCSM2 got kids settled on the rug. “I know I should have done it sooner, but I was going to do the face to name once they were sitting down. We were in the process of sitting down when Child A was brought back.” “We didn’t know he was missing until he was brought back.” CCSM2 thinks Child A was outside alone for about 2 minutes. CCSM3 was on vacation during my on-site inspection. I spoke with her on the phone on 08/17/2023. She has worked at the center for about three mo

On 12/14/2021, I completed an unannounced on-site inspection and informed program director Jayne Johnson about the allegation. I walked through the center to verify staff to child ratio compliance in the classrooms. I interviewed child care staff member (CCSM) Amanda Cebelak who reported that she was working in the 2-year-old classroom by herself with more than four children last week. Ms. Cebelak reported that on 12/08/21, she had eight children ages 2 and half and under by herself in the classroom. She explained that Ms. Johnson moved a child to another classroom when she reached five children but then three more children were dropped off. Ms. Johnson came back to the classroom and stood in the doorway for a few minutes. She then told Ms. Johnson that she needed breakfast for a child that Ms. Krolik had brought to the classroom at 9:00 AM. Ms. Cebelak said that she then asked Ms. Johnson if she could swap out children so that she could have children that were easier to care for by herself. Ms. Cebelak said that Ms. Johnson began yelling, raising her voice and talking about how she was so sick of people not coming in, now showing up and not doing their job. Ms. Krolik then came over and told her that there was a "situation happening" and she just needed to deal with the children she had. Ms. Cebelak said that she tried to explain that she had children playing in the sensory table, one eating and there were diapers that needed to be changed. She said that Ms. Johnson took four children out of the classroom, and she later saw them in the Pre-K classroom with Ms. Krolik, another CCSM and five or six Pre-K children. The children being moved to the Pre-K classroom made that classroom out of ratio then because they had more than eight children with two caregivers. Ms. Cebelak reported that she was over ratio for about an hour and a half that day. Ms. Cebelak reported that Child A (male, 2 years old) was dropped off during the time that she was over ratio and Child A's Mother said something to Ms. Johnson about how many children were in the classroom. Ms. Cebelak reported that she has been out of ratio occasionally in the past, but it was fixed right away when she notified the office. She is not aware of any other classrooms being out of ratio. Ms. Cebelak reported that on 12/09/21, she was told that the other CCSM had called in sick, but she does not think there was anyone scheduled to work. She had seven children by herself that were under 2 and half years old. She spoke with Ms. Johnson and CCSM Pam Krolik about being out of the required staff to child ratio. Ms. Krolik advised her to move children to the toddler room, but she was not able to because the toddler classroom already had seven children. I interviewed director Jayne Johnson who was aware that the classroom had not maintained the required staff to child ratio. She explained that on 12/8/21, she had a 3 schedule mix up and a CCSM called in sick and that was why the 2-year-old classroom was over ratio at that time. Ms. Johnson reported that she did not recall yelling, but her voice may have been raised. She acknowledged that she told Ms. Cebelak that she was sick of people not coming in, now showing up and not doing their job. She did not want Ms. Cebelak to move a child to another room and Ms. Cebelak is sometime late for work; her statement was about that because she was frustrated. I interviewed Ms. Krolik who said that she did not remember what Ms. Johnson was saying while standing in the doorway but recalled that Ms. Cebelak wanted to switch children so she could have an easier toddler to care for. She did not think Ms. Johnson was yelling that loud just that it was louder than she normally talks. She said that Ms. Johnson was just frustrated about the center being out of ratio. Ms. Krolik said that she has been working in classrooms because of the center being short staffed so she would not know if the 2's classroom was out of ratio. She recalled the time when Ms.

Ms. Johnson did not maintain the required staff member to child ratio. On 12/8/21, the Pre-K classroom contained 11 children with 2 child care staff members. The youngest child was 2 years old which determined that the classroom had to follow a 1 staff member to 4 children ratio.
