R 400.1904a · R 400.1904a Child care staff member; employment requirements. (4) A child care staff member shall conduct himself or herself in a manner that is conducive to the welfare of children and be able to meet the needs of children and provide for their care, su ervision, and protection.
At the onsite inspection on 3/27/2023 I met with licensee, Sabrina Nuffer. I reviewed attendance records for staff and children and her child care staff member's employee file. Mrs. Nuffer does have her mother-in-law, Terri Nuffer, assist her with child care. Ms. Nuffer has six children of her own, two under the age of six years. Terri Nuffer is there to help her. I reviewed Terri Nuffer's child care staff person's assistant certifications signed on 07/01/2022. The employee file contained all the required records. A medical clearance signed on 07/07/2022 indicates that Terri Nuffer does not have any physical or mental condition or a health problem which would affect the ability to provide independent care of children age birth to seventeen years in a child care setting, with or without reasonable accommodations. On 04/28/2023 I interviewed child care staff member Terri Nuffer by telephone. Terri Nuffer spends time with the children playing. She cooks, she helps clean up, and she changes diapers. Terri denied sitting around doing nothing and verified that she can meet her job requirements. 3 I interviewed Child D and Child E's, and Child F's, parents who did not express concerns about the ability of Terri Nuffer to provide care to dependent children. Child C's and Child G's parents did not respond.
The child care staff member is disabled and doesn't do anything. There are not enough caregivers for the number of children present. Child C (male, 2 years, 4 months/1 year, 9 months at the time of the incident) was lost in a cornfield for two hours and it was never reported to the department. There is an unreported pool on the property. Child A (male, 3 years, 9 months) and Child B (female, 2 years, 9 months) are hungry and thirsty at pick up and have not been fed their snacks or given their drinks.

The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.
On 03/27/2023 Sabrina Nuffer was caring for six unrelated children and four related children under the age of six years and had one child care staff member present. Sabrina Nuffer's children are five year old twins, a six year old, a seven year old and a thirteen year old. There were two adults to the ten children present. There were six unrelated children and six related children, two of whom are over the age of seven. I reviewed Mrs. Nuffer's attendance records. Mrs. Nuffer has her mother-in-law assist her with child care. Mrs. Nuffer has six children of her own and Terri Nuffer helps with them. Records reflect that Mrs. Nuffer has maintained ratio. I interviewed Child D and Child E's and Child F's parents mother by telephone. She does not have any concerns about the ratio of adults to children. Child F's mother is completely comfortable with the number of kids and adults present during child care. Child F's father has no concerns but commented that it does seem like a lot of kids for one person to take care of. He did not have anything further to share. 4

Child A and Child B's mother spoke about Child C (male, 2 years, 4 months) being lost in a cornfield for hours, she thinks it was in August. The farmers were cutting down corn because Ms. Nuffer had to call the farmers and ask them to stop cutting the corn until he was found. The police and fire department were involved. Child C's mother allegedly does not want to be involved because she still needs Child C to attend child care with Ms. Nuffer because she does not have anybody else. Mrs. Nuffer clearly remembers the day Child C ran off into the cornfield. She had mulch delivered and the kids wanted to play on the mulch pile. Child C (male/1 year 9 months at the time of the incident) went behind the mulch pile and ran into the corn field. He was gone for a "good 45 minutes." She did call the police and the surrounding farmers to help look for Child C. Kawkawlin Township sent a fire truck; an ambulance was on hand in case Child C needed medical attention. She notified Child C's parents right away and they also came and helped look for him. Child C has run away from his parents three times before that she is aware of. A police officer found Child C and Child C thought it was a funny game of chase and kept on running away from the officer until 5 he was caught. Mrs. Nuffer thought it was around Halloween time 2022 when it happened. She has a camera pointed at her backyard and her camera showed Child C running off and there was nothing she could do as she could not leave all the other children outside unsupervised or leave her child care staff member assistant out of ratio. On 04/06/2023 I contacted Olivia Rivera, a records clerk from the Bay County Sheriff's Department. She verified that on 10/25/2022 there was a call to the Sheriff's Department in reference to a child lost in a corn field at the address of Sabrina Nuffer. I attempted to interview Child C's mother by phone, A voicemail message was left asking for a return phone call. Terri Nuffer confirmed that Child C did get into the cornfield last fall. He was there one minute and gone the next. She followed the emergency plan, stayed with the other children, and kept them calm while Sabrina Nuffer was dealing with the authorities. Child C's parents were notified, and his father was helping with the search. Ms. Nuffer denied being aware of the requirement that she report a missing child to her licensing consultant. It was her misunderstanding that if there were no injuries to the child an incident report would not be necessary, and Child C was fine. I received notice from the assigned consultant that Ms. Nuffer had sent her a text message reporting the missing child on 03/27/2023 and apologizing for not reporting it at the time it happened. On 04/06/2023 I attempted to interview Child C's mother by phone, A voicemail message was left asking for a return phone call. Another message was left on 4/28/2023 and no response has been received to date. Child D and Child E's mother is not aware of a child being lost in a corn field. Child F's parents were aware that a child was lost in the corn field last year, although they had no details. Terri Nuffer was not aware of the lost child being reported or not. Child C's parents were notified when it happened.

On 03/24/2023 1 reviewed the 2022 Renewal Inspection for Sabrina Nuffer to verify whether a swimming pool was included. I consulted with the assigned licensing consultant regarding Mrs. Nuffer, and she is aware that there is an above ground pool on the property. The renewal report references an above ground pool. Child A and Child B's mother is concerned that there is a swimming pool that is not currently listed on the Great Start website. I told Child A and Child B's mother that the swimming pool has been reported and is included in the last renewal which is available to her online. Child A and Child B's mother had signed a water activity permission slip for both of her children. Terri Nuffer does know that there is an above ground pool on the property. She does not know how long it has been there, but kids don't go near it and the ladder is taken out every time the pool is used.

R 400.1921 · R 400.1921 Water hazards; water activities. (1) A licensee shall ensure that barriers exist to prevent children from gaining access to any swimming pool, drainage ditch, well, natural or constructed pond, or other body of open water located on or adjacent to the property where the child care home is located. These barriers must be a minimum of 4 feet in height and appropriately secured to prevent children from gaining access to such areas. 7
When I interviewed Child A (male, 3 years, 10 months) and B's (female, 2 years, 9 months) mother by telephone. She is concerned because when she picks Child A and Child B up, they are thirsty and hungry and gobble down their snacks and drink cups that are still full and have not been touched since the children were dropped off. Child A and Child B's mother is aware that Mrs. Nuffer participates in the food program and acknowledged that she signed a child in care statement for Child A and Child B indicating Mrs. Nuffer would provide their food and milk. Mrs. Nuffer provides her with a calendar of what she feeds them. Ms. Nuffer said Child A and Child B would come to care with little donuts, pop tarts, and other various junk food that after arriving Child A and Child B did not want. She would leave the items in the entryway in their bins to go home with them at the end of the day. Ms. Nuffer is not allowed to give them sugary snacks because she participates in the food program and will not serve those types of snacks. On 03/31/2023 I sent a follow up email to Child A and Child B's mother asking what kinds of snacks and drinks she was sending with Child A and Child B. She sent Child A and Child B with Gatorade in their cups. She denied bringing Child A or Child B Little Debbie snack cakes as they were dropped off at 7:30 AM. She did acknowledge that she sent pop tarts here and there, but says it was not even a once-a-month thing. Child D and Child E's mother feels good about the care they receive from Mrs. Nuffer. I interviewed Child F's parents who have no concerns for the quality-of-care Child F receives. They have never had issues with drinks or snacks. Terri Nuffer feeds children in care two snacks and their lunch; she cooks the meals, and all the snacks and meals are served with milk. Terri Nuffer denied that any children were hungry or thirsty while in child care.

he licensee does have written agreements with parents and is responsible for providing adequate food. The licensee participates in the food program, has dated menus, and parents confirmed that their children are fed, and they have no concerns about children in care being hungry or thirsty. The daily menu and schedule references breakfast, an AM snack, lunch, and a PM snack. The menu appears to be adequate to meet the needs of the children in care and includes fruits, vegetables, whole rains, and fluid milk.
