On 03/25/2022 I emailed CCSM 1. 1 explained to her that I was investigating allegations that Child A found an eyebrow razor on the gym floor and scratched his face with it. CCSM 1 emailed me back that same day stating that she understood and would cooperate with the investigation. I attempted to contact Child A's Mother on 04/13/2022 and 04/19/2022. 1 left voice messages requesting a return phone call. I have not heard from her to date. 3 I conducted an on-site inspection on 04/22/2022 at approximately 11:05 AM. I I interviewed CCSM 1 and CCSM 2. Both confirmed Child A year old male) found an eyebrow razor on the floor in the gym. Child A picked the eyebrow razor up and scratched his face with it. Both stated Child A did not scratch himself deep enough to cause bleeding. Child A's Mother took Child A to the doctor. The doctor would not treat Child A's injury, as it was not severe enough for medical treatment. Since the incident, the facility has put policy in place that staff are to inspect the gym before and after the children in care use it. During the on-site inspection, I observed the gym where Child A found the eyebrow razor. There were toys that were pushed against the wall. The gym was mainly an open space. There were cameras that had been installed since the incident with Child A. The space appeared to be safe and appropriate for the children in care to use. On 04/28/2022 at approximately 10:00 AM I conducted an unannounced on-site inspection. I interviewed Child Care Staff Members, CCSM 3 and CCSM 4. CCSM 3 explained that she was not present when Child A scratched his face with the eyebrow razor, nor did she have any firsthand knowledge. CCSM 3 stated she was aware of the incident, as CCSM 4 told her about it. CCSM 4 explained she is the Lead Teacher in Child A's classroom. CCSM 4 took the children in care to the gym. CCSM 4 noticed Child A with an eyebrow razor. Child A did not appear to be doing anything with the razor, he just had it in his hand. CCSM 4 wasn't sure how long Child A had the eyebrow razor before she took it away from him. Child A was observed to have a long scratch on the right side of his face. The scratch started at Child A's eyebrow and ended at the top of his cheek. Child A was not crying, and the scratch was not bleeding. CCSM 4 reported the incident to CCSM 1. CCSM 1 informed CCSM 8. CCSM 8, contacted Child A's Mother. I conducted an unannounced on-site inspection on 05/10/2022 at approximately, 9:50 AM. I interviewed Administrator, CCSM 8. CCSM 8 stated CCSM 4 brought Child A to her. Child A only had superficial scratches on his face. CCSM 8 contacted Child A's Mother. CCSM 8 stated the center has since put in new policy that the gym and the playground must be scanned before the children in care are allowed to play. A camera has since been installed in the gym. CCSM 8 explained that the razor may have been left by another patron that was in the building. It should be noted that an eyebrow razor is a utensil that has a handle with a razor like blade at the end, used to shave eyebrows. The razor is not as thin or sharp as a regular razor and would not cause as severe damage. 4

I conducted an unannounced on-site inspection on 04/28/2022 at approximately 10:00 AM. I interviewed Child Care Staff Members, CCSM 3, CCSM 4, CCSM 9, CCSM 10, CCSM 6 and CCSM 8. CCSM 3 stated that she is support staff in the infant room. CCSM 3 stated she did not have any firsthand knowledge of the incident but was aware, as Child B's Mother (CCSM 4) informed her. CCSM 4 is Child B's Mother. CCSM 4 was on her planning time which is from 2:30 PM to 3:00PM on 04/18/2022. The toddler 1 room was transitioning from the classroom to the gym. CCSM 4 stated she saw the children from toddler 1 room waking to the gym as she was going to the bathroom in the hallway by the gym. Child B did see her, but she assumed that Child B stayed with her class that went into the gym. CCSM 4 stated she was in the bathroom for approximately two to three minutes. When she came out of the bathroom, she observed Child B wandering around unsupervised in the hallway. She brought Child B to the gym and the child care staff members stated they assumed Child B was with her. CCSM 4 stated that it was concerning that Child B was unsupervised in the hallway, as the doors to the main entrance are open during the day and anyone could have come in. CCSM 4 stated she was satisfied with how management at the facility was handling the situation and she believed it would not happen again. CCSM 9 stated she was support staff for the toddler 1 room. She explained that there were eight toddlers in the toddler 1 room on 04/18/2022. CCSM 9 is the primary caregiver for four of the children in the toddler 1 room. CCSM 11 was the lead caregiver in the toddler 1 room and is the primary caregiver for the other four children that were in toddler 1 room on 04/18/2022. CCSM 9 explained that she took her four children the gym. CCSM 11 is the Primary Caregiver for Child B as well as three other toddlers in the toddler 1 room. CCSM 11 was walking with her children 5 and child care staff member, CCSM 12 was walking with the children from preschool prep room to the gym. Child B's Mother happened to be in the hallway heading to the bathroom at the same time as CCSM 11 and CCSM 12 were taking their children to the gym. Child B was with CCSM 11 and at some point, while CCSM 11 was walking with the children, Child B left the group to follow her mother. CCSM 9 stated that when CCSM 12 arrived with the preschool prep classroom and CCSM 11 arrived with her children the child to child care staff member ratio became too many. CCSM 9 told CCSM 12 that he needed to take the preschool prep class back to the classroom because they were out of ratio with both classes being in the gym. Before CCSM 12 left the gym, Child B's Mother came into the gym with Child B. Both Ms. CCSM 11 and CCSM 12 told Child B's Mother that they thought she knew that Child B was with her. CCSM 9 stated she did not know how long Child B was unsupervised in the hallway. CCSM 10 is the Lead Caregiver in the toddler 2 room. CCSM 10 stated that Child B is in the toddler 1 room. She had no director knowledge of the incident as she was not present. CCSM 6 stated that she saw Child B in the hallway unsupervised when Child B's Mother found her. CCSM 6 stated she did not know how long Child B was left unsupervised in the hallway. CCSM 8 is the program coordinator for the facility. CCSM 8 stated that she observed video footage showing Child B wandering the hallway unsupervised for approximately 2 minutes before Child B's Mother found her. CCSM 8 stated Lead '/2 Caregiver for the toddler 1 room, CCSM 11 did not count the children and therefore did not realize that Child B was missing from the group. It should be noted that CCSM 11 is no longer a child care staff member for the center.

I made an unannounced on-site inspection on 05/10/2022 at approximately 9:50 AM. I interviewed CCSM 1, CCSM 2, Child Care Staff Members CCSM 5, CCSM 6, CCSM 7 and Program Coordinator, CCSM 8. CCSM 1 and CCSM 2 stated CCSM 13, was the only child care staff member in her classroom on 04/18/2022. Ms. CCSM 13 walked from her classroom, through the Great Start Readiness Program (GSRP) Room (which was adjacent to CCSM 13's classroom) to the kitchenette to get a vacuum for her classroom. CCSM 13 left the children in the classroom alone for approximately 2 minutes while she went to get '/2 the vacuum. CCSM 5, CCSM 6 and CCSM 7 stated that on 04/18/2022 at approximately 3:00 to 3:15 GSRP 1 Room and GSRP 2 Room combined. There are doors on both sides of the classroom and to get to the kitchenette CCSM 13 had to walk through the classroom. CCSM 13 announced that "she just loves leaving her kids in the classroom alone". CCSM 13 walked through the classroom and went to the kitchenette to get the vacuum. She used the vacuum in her classroom and then left her children alone again to return the vacuum to the kitchenette. They were not sure how many children she had in her classroom at that time. All the Child Care Staff Members believed that she was gone from her classroom for approximately 2 minutes. CCSM 8 stated that she was in the meeting with CCSM 13. CCSM 8 stated that Ms. CCSM 13 was terminated and no longer works at the center.

An on-site inspection was conducted on 04/22/2022 at approximately 11:05 AM ■ Interviews were conducted "1411 roaram Director, CCSM 1 and and M 14. CCSM 1 explained the child care center previously had cameras in other parts of the facility but just got the cameras in the gym over the weekend prior to the incident. The incident occurred on the Monday, 04118/2022 after the cameras were installed so they were new to the facility and Child Care Staff may not have been aware that the cameras were in operation. Child C told Child Care Staff Member, CCSM 7 on Monday. 04/18/2022 around 2PM or 3PM that CCSM 12 hurt her in the gym. CCSM 1 indicated this was when she and CCSM 7 observed the marks on Child C's arm. CCSM 1 stated she requested footage of the gym that day. She did not receive the footage until Tuesday, 04/19/2022. She stated CCSM 12 was off on Wednesday, 04/20/2022. 00nThursday,04/21/2022 CCSM 1 instructed CCSM 12 to go to Human Resources. CCSM 1 stated there was a red mark on Child pper arm and a bruise by her elbow. She stated that Child C said it was from CCSM 12 but then also stated that her grandmother grabbed her arm. Child C then told a third story, that she fell at her father's house and was bruised. CCSM 1 stated she did not know which story to believe at the time. The footage covers most of the gym except to the right and under the camera. There were four child care staff members in the gym at that time. Child Care Staff Member, CCSM 12 was seen sitting on a ledge across the gym by a window. There was a Child Care Staff Member in front and to the right side of CCSM 12. The Child Care Staff Member was identified as CCSM 14. CCSM 14 was playing on her cellular phone during the entire video footage and did not observe the incident between CCSM 12 and Child C. At 11:30 AM, CCSM 12 made Child C come sit by him. Child C was made to sit on the floor in between CCSM 12's legs. It is unknown what Child C may have done to cause disciplinary action. At approximately 11:36am, Child C tried to stand up and CCSM 12 grabbed Child C by her arm. There appeared to be a struggle between CCSM 12 and Child C. CCSM 12 grabbed Child C's wrists and her arms by her elbows. Child C appeared to drop her weight and it looked as though CCSM 12 was trying to restrain her. Child C then sat back down. At 11:42AM Child Care Staff Member, CCSM 6 took some of the children in care to the bathroom. At 11:45am CCSM 12 was still tossing a ball back and forth to another child in care. Child C was sitting on the floor directly in front and in between CCSM 12's legs. Child C and CCSM 12 were sitting face forward. Child C swatted up backward in what appeared to be a playful manner. Child C did not use any force and the swat would not have hurt CCSM 12. CCSM 12 looked down at Child C and smacked her on the forehead with an open palm. He then took the ball and bounced it off Child C's head. CCSM 12 then smacked her in the head again. CCSM 12 then grabbed Child C's arms. Child C dropped her weight. CCSM 12 was lifting Child C's arms up when she dropped her weight. Child C began to twist and turn. CCSM 12 then grabbed Child C's upper arms and wrists again. Child Care Staff Member, CCSM 7 was then observed going over to Child C and CCSM 12. CCMS 7 then took Child C away from CCSM 12. CCSM 14 stated that she has worked in the Preschool Prep Class with CCSM 12. She has seen CCSM 12 restrain and be rough with Child C. Ms. CCSM 14 explained that Child C has some behavioral issues and CCSM 12 often feels the need to restrain her. She has never told administration about CCSM 12's behavior, nor has she ever seen injuries on Child C. An unannounced on-site inspection was conducted on 05/10/2022 at approximately . We interviewed i Care Staff Members, CCSM 6, CCSM 7 and CCSM 8. CCSM 6 stated that she was in the gym with CCSM 12 and Child C on the day of the incident. Ms. CCSM 14 did not provide appropriate care and supervision of Child C when she was observed playing on her cell phone instead of supervising the children in the gym. CCSM 14 could have intervened if she would have seen CCSM 12 mistreat Child C. Although CCSM 14 was right next to CCSM 12 and Child C, she did not witness anything because she was on her cell phone. CCSM 14 also stated during her interview that she has witnessed CCSM 12 restrain and mishandle Child C on other occasions. CCSM 14 stated she did not report CCSM 12's mistreatment of Child C that she witnessed on other occasions. CCSM 14 did not provide appropriate care of Child C when she decided not to report the inappropriate behavior that she witnessed.

I received an incident report from Director of Early Education and Children Services, Patricia Ryan on 12/09/2020. The incident report stated that on 12/07/2020 Child A was mistakenly given Child B's bottle. Once this was discovered, Lead Teacher, April Schmidt contacted Program Manager, Lauren Lavender, and reported the incident. Ms. Lavender contacted Child A's Mother and Child B's Mother to report that Child A had received Child B's breast milk. Ms. Lavender then reported the incident to Patricia Ryan. Both Child A's Mother and Child B's Mother has been contacted multiple times to ensure they were satisfied with how the center 2 handled the incident. There has also been an internal corrective action plan created to make sure an incident like this will not happen in the future. I contacted Director of Early Education and Children Services, Patricia Ryan, on that same day. I told Ms. Ryan that a special investigation was going to be opened regarding Child A receiving breast milk that was supposed to be given to Child B. I made an on-site inspection on 12/17/2020. I interviewed Director of Early Education and Children Services, Patricia Ryan, Program Director, Nina Smith, Infant Lead Teacher, April Schmidt, Child Care Staff Member, Massoudah Apoushtewat and Program Manager, Lauren Lavender. Infant Lead Teacher, April Schmidt, explained that on 12/07/2020, she and Child Care Staff Member, Massoudah Apoushtewat were in the Infant Room. There are six children enrolled in the Infant Room and five were present on that day. Ms. Schmidt left the room for approximately ten minutes. She took one of the infants with her, so the room was not out of ratio. Ms. Schmidt stated Ms. Apoushtewat had warmed the bottle and was feeding Child A when she returned to the classroom. Ms. Apoushtewat asked Ms. Schmidt to record the bottle feeding for Child A on Tadpoles. Ms. Schmidt explained that Tadpoles is the system the center utilizes to record information such as feeing, diaper changes, napping schedule and etc. Ms. Apoushtewat told Ms. Schmidt that the bottle contained breast milk. Ms. Schmidt stated she knew Child A did not get breast milk. She believed the reason for the mix up was because Child A and Child B have the same kind of bottle. Ms. Schmidt stated once she realized the mistake had been made, she reported the incident to Program Manager, Lauren Lavender. Ms. Lavender then contacted Child A's and Child B's parents to report the incident to them. Neither Child A nor Child B's parents were angry because of the incident. Ms. Schmidt stated that she did speak with Child A's Mother later that day, as she called to make sure Child A did not have any adverse reactions to the breast milk. Child Care Staff Member, Massoudah Apoushtewat, stated that on 12/07/2020 she and Infant Lead Teacher, April Schmidt were in the infant room. There were five infants in attendance that day. Ms. Schmidt left the room between 10:30 AM and 11:00 AM for approximately ten minutes. Ms. Schmidt took one of the infants with her so the room would not be out of ratio. Ms. Apoushtewat explained that both Child A and Child B were both crying. She put both Child A's and Child B's bottles in the bottle warmer. Ms. Apoushtewat stated that Child A and Child B have the same brand of bottle and they look identical. Ms. Apoushtewat stated that when Ms. Schmidt returned to the classroom they discovered that Child A had been given Child B's bottle. Ms. Schmidt reported the incident to Program Manager, Lauren Lavender. Ms. Lavender contacted Child A's Mother and Child B's Mother. Ms. Apoushtewat stated that Program Director, Nina Smith, interviewed her and Ms. Schmidt when she returned to the center the next day. Ms. Apoushtewat stated that the corrective action plan developed by the center is to have the bottle checked by 3 both Infant Lead Teacher, April Schmidt and herself to ensure the correct bottle is given to the intended infant.
