On 8/31/2023 Child Care Staff Member 2 (CCSM) informed Michigan Department of Health and Human Services ( that she was changing diapers in the classroom with Child Care Staff Member 1 this morning when Child A began playing rough and pushing friends. CCSM1 was on the floor interacting with children when this occurred. CCSM2 witnessed CCSM1 grab Child A’s ponytail and pull him toward her. CCSM2 heard Child A say “Ow” and “Stop.” CCSM1 laughed it off and told him to stop his behavior. CCSM2 expressed concern regarding this interaction to Child Care Staff Member 7. CCSM7 checked on Child A a few hours later and reported that there was a red mark and the site was sore. Child A’s Mother was contacted and notified of the incident. According to CCSM2, Child Care Staff Member 5 has witnessed CCSM1 be rough with children in the past. CCSM2 witnessed two other incidents between CCSM1 and Child B and CCSM1 and Child E this morning as well. Child B put her arms around CCSM1’s neck and CCSM1 then put her arms around Child B’s neck. Child B was laughing during this interaction and did not appear scared. CCSM2 also witnessed CCSM1 bop Child E on the head with a plastic bottle when he wasn’t sharing. Child E flinched but did not appear upset. CCSM2 did not observe injury on either child. I made an onsite inspection at Sprout Early Care & Preschool with on 9/1/2023. Program Director Amanda Swager reported to us that CCSM2 came to her yesterday with concerns that CCSM1 pulled Child A’s ponytail in an attempt to redirect him. Amanda Swager spoke with CCSM1 and asked how the day was going. CCSM1 reported that that the day is going well and denied feeling frustrated. Amanda Swager then confronted CCSM1 about the allegation that she pulled Child A’s ponytail. CCSM1 reported that the act was not aggressive and she was just being playful with Child A. CCSM1 was sent home and placed on administrative leave pending the investigation. Amanda Swager contacted Child A’s Mother to notify her of the incident. Amanda Swager did not look for possible injury. According to Amanda Swager, CCSM1 is often on the floor, engaged with children. She has never had any concerns with CCSM1’s interaction with children. Amanda Swager did not have any knowledge regarding the incidents involving Child B or Child E. 5 spoke on the telephone with Child E’s Mother on 9/5/2023. Child E’s Mother did not have any concerns regarding care, discipline or child care staff at the child care center. Child E never mentioned the plastic bottle incident to his mother and he did not have injury as a result. Child E has always gone to CCSM1 with open arms. Redirection is the primary method of discipline used in the classroom. spoke on the telephone with Child F’s Mother on 9/5/2023. Child F’s Mother did not have any concerns regarding the care provided at the child care center or the child care staff. She did not have knowledge of discipline used in the classroom. I spoke on the telephone with CCSM1 on 9/6/2023. An interview was scheduled for 9/7/2023 at 11:30 a.m. at CCSM1’s residence. I made face to face contact with CCSM1 and on 9/7/2023. CCSM1 informed us that she has been working at Sprout Early Care & Preschool for approximately 1 year. She is very playful with children and admitted they gravitate toward her. She has never intentionally caused harm to any child in care. CCSM1 informed us that Child A was playing rough with his friends on 8/31/2023. She asked him several times to stop. CCSM1 lightly tugged Child A’s ponytail. She said she was being playful and did not intend to hurt Child A. According to CCSM1, Child A did not say “stop” or “ow”, however, he did go down to the floor, crying. CCSM1 checked on him after they went outside and did not see any redness on his scalp. CCSM1 informed us that Child A can play the victim and is quick to cry. CCSM1 described Child B as very lovable and explained that when she and Child B had their arms around each other’s necks that they were just

Child B and Child C’s Mother informed us on 9/5/2023 that Child C came home with a red mark on his face approximately two weeks ago. He told his mother that a female child care staff member hit him. Child B and Child C’s Mother confronted Child Care Staff Member 7 (CCSM7) the following day. CCSM7 informed her that she did not witness an incident, therefore did not write up an incident report. According to Child B and Child C’s Mother, Child C has a speech delay. CCSM7 went through all of the child care staff names and Child C said “yes” to her name. CCSM7 later contacted Child B and Child C’s Mother stating that she found out that another child had caused the bruise on Child C’s face. Child B and Child C’s Mother never took a picture of the injury. During the onsite inspection on 9/7/2023, licensee designee Julia Pratt-Buckham and program director Amanda Swager informed us that they had no knowledge of a red mark on Child C’s face until they received a phone call from his mother this morning. Child Care Staff Member 3 (CCSM3) informed us that CCSM7 notified her a few weeks ago that Child B and Child C’s Mother reported a red mark on Child C’s face. CCSM7 never witnessed how he was injured. Child C initially claimed that CCSM7 caused the injury and then later claimed Child G hit him. Child C and Child G have a history of not keeping their hands to themselves. Photos were not taken of the injury. CCSM3 did not have any concerns regarding CCSM7’s interaction with children and said that CCSM7 is good about reaching out for help if feeling overwhelmed. Parents and children like CCSM7 and she is one of their favorite child care staff members. CCSM7 observed a red mark on Child C’s cheekbone approximately two to three months ago. Child B and Child C’s Mother brought it to her attention but said that Child C won’t tell her how it happened. When questioned, Child C initially stated that CCSM7 did it. He later said that Child G hit him. Child C and Child G have a history of hitting each other. CCSM7 did not witness the incident and denied handling Child C in a manner that caused the red mark on his face. 9 scratch marks on Child C’s face and has witnessed a sibling scratch Child C’s face. According to Elan Bridges, Child C and his siblings are physically aggressive toward one another. She has also observed Child C hit himself as he throws self-injurious tantrums.

I spoke on the telephone with licensee designee Julia Pratt- Buckham on 9/8/2023. Child B and Child C’s Mother viewed CCSM7 restrain Child C on the center’s livestream on 9/7/2023. Child B and Child C’s Mother came to the facility and confronted CCSM7 on the playground. Child B and Child C’s Mother was cursing in front of the children and accused CCSM7 of physically abusing children. CCSM3 removed the children from the playground and law enforcement was contacted. On 9/7/2023 CCSM8 mentioned that CCSM7 has restrained children that are hitting and kicking others in an attempt to protect the child and others around them. CCSM8 said that this is only performed in response to aggressive behavior and CCSM7 never holds down a child to get them to nap. CCSM8 demonstrated her interpretation of CCSM7 restraining a child. CCSM7 sits on the floor with her legs crossed. She then places the child in her lap and gently places one leg over the child’s lap. Program director Amanda Swager and CCSM3 informed us on 9/7/2023 that they were not aware that CCSM7 has restrained children and have never observed this interaction. 11 Child B and Child C’s Mother informed on 9/11/2023 that she observed the interaction between Child C and CCSM7 while watching the livestream. Child B and Child C’s Mother initially saw Child C hit another child. She then observed Child C go into a time out where he sat down and put his head in his hands as if he was crying. Child B and Child C’s Mother then saw CCSM7 put Child C in her lap, place her leg over his legs and hug him. Child B and Child C’s Mother recorded the interaction on her phone and provided a copy to shared a copy of the video with me on 9/12/2023. In the video you can see Child C sitting on CCSM7’s lap for a few moments. He then gets up and sits down facing CCSM7. During the onsite inspection with on 9/12/2023, the video of the restraint involving Child C was showed to CCSM8. CCSM8 stated that it appeared to be the typical way she has observed CCSM7 restrain children in the past. Child Care Staff Member 10 (CCSM 10) was in the classroom relieving child care staff for breaks on 9/8/2023 at the time CCSM7 restrained Child C. CCSM10 did not observe anything of concern that day. She was shown the video but was unable to identify the staff member or child shown in the video. I spoke on the telephone with CCSM7 with on 9/12/2023. CCSM7 explained that Child C was hitting several children on 9/8/2023. She sat Child C down to talk with him about his behavior, however, he ran away from her and hit another child. CCSM7 then sat Child C in her lap and draped a leg over him. Child C was able to calm down and she discussed behavior expectations again with him. Child C played well the remainder of the day. CCSM7 informed us that she was previously trained on restraining children while employed at another child care center. CCSM7 provided a similar statement regarding the restraint to PSO from the Kalamazoo Public Services Department per the report submitted on 9/8/2023. Child G’s Mother informed on 9/12/2023 that she was aware that CCSM7 occasionally restrained children that posed a safety risk to themselves or others when she was the program director at the center. Child G’s Mother has never witnessed CCSM7 restrain children in a malicious manner. CCSM7 would use restraint to calm a child down and then talk with them. Child G’s Mother suggested to CCSM7 that she discuss this procedure with parents prior to restraining a child. 12

I made an unscheduled onsite inspection at Sprout Early Care & Preschool on 4/21/2023 and spoke with program directors Amanda Swager and Betsy Huckendubler, licensee designee Julia Pratt-Buckham and Child Care Staff Member 1 (CCSM1). Ms. Swager and Ms. Huckendubler denied any knowledge of CCSM1 striking a child. They informed me of an incident involving CCSM1 and Child A that occurred on 10/12/2022. I was provided written statements taken by staff during the internal investigation. A child care staff member reported to management that CCSM1 wound up her arm and hit Child A in the back, causing him to fall into the cubbies. Parents were informed of the allegation and an internal investigation was completed. Through the investigation, it was discovered by management that Child A was hitting another child with his coat. CCSM1 repeatedly asked Child A to stop. When he refused to stop, she grabbed the coat and took it from him. CCSM1 admitted to management that she pulled at the coat hard, causing Child A to bump into the cubbies. Ms. Huckendubler reported that Child A had bruising on his back and shin's. She concluded that the injuries were a result of rough play rather than the incident as she did not think they appeared suspicious. Ms. Swager and Ms. Huckendubler informed me that CCSM1 has been employed at the child care center for eight years. She is currently the lead teacher in the Pre-K classroom. CCSM1 is the only staff member that works in this classroom. Ms. Swager and Ms. Huckendubler have never had any concerns regarding CCSM1 and felt it should be noted that CCSM1 and the staff member that reported the incident had a poor working relationship. Licensee designee Julia Pratt-Buckham denied allegations that CCSM1 stuck Child A in the face. She does recall the incident that occurred on 10/12/2022 as there was an internal investigation. CCSM1 forcefully grabbed a coat away from Child A because she was worried that he was going to harm other children with the coat zipper. CCSM1 reported to me that Child A took off his coat and started hitting his friends with it on 10/12/2022. CCSM1 took the coat away from Child A, provided a verbal reminder not to hit and then gave him his coat back. He was upset immediately following the interaction, however she admitted, that Child A is often upset when redirected. CCSM1 stated that the interaction may have appeared forceful, but denied ever hitting Child A. I spoke on the telephone with Child A's Mother on 5/4/2023. Child A's Mother did not express any concerns about care and supervision provided and discipline techniques used in the classroom include positive reinforcement, redirection and quiet time. A staff member reported to Child A's Father in October 2022 that CCSM1 3 hit Child A. She was later informed by management that an internal investigation was completed, and it was determined that CCSM1 did not hit Child A. Child A denied anyone hurting him at the child care. He stated that he liked CCSM1 and was not afraid of her. Child A's Mother did not have any concerns about CCSM1 before or after that incident. Following the incident, Child A's Mother observed two small bruises that were very light in color located on Child A's back. She was not able to verify the cause of those bruises. I spoke on the telephone with Child B and Child C's Mother on 5/4/2023. Child B and Child C's Mother did not report any concerns regarding care and supervision and denied that physical discipline is used in the classroom. She would not describe CCSM1 as warm and fuzzy, however, is observed to be appropriate with children. Child B and Child C's Mother has heard CCSM1 raise her voice to get children's attention but does not yell. I spoke on the telephone with Child D's Mother on 5/4/2023. Child D is in the classroom with CCSM1. Child D's Mother does not have any concerns about the care and supervision provided and is very happy with the care Child D receives. I spoke on the telephone with Child A's Father on 2/7/2023. Child A has been attending Sprout Early Care & Preschool since August 2022. He provides labeled bottles for Child A daily. On 12/13/2022, Child A was accidentally fed breast milk that was intended for Child B. Staff discovered this mistake after records indicated that Child A consumed three bottles that day, however, only two of the bottles were empty. Child A's Father did not disclose any health complications after Child A consumed the breast milk. On 2/3/2023, staff reached out to him stating that they accidentally gave Child A's bottle to Child C. The center developed an improvement plan after the first incident; however, it has since happened again. Child A continues to attend the child care center. I made an unscheduled onsite inspection at Sprout Early Care & Preschool on 2/9/2023 and spoke with program director Elizabeth Huckendubler, lead caregiver Naomi Evans and child care staff member Alexa Klapp. Elizabeth Huckendubler informed me that the allegations regarding bottle feeding is correct. Parents label their child's bottles with name, contents and date. Staff have been trained to look at the label, make an announcement to other staff and show the bottle to another staff member for a visual check prior to feeding a child. In both instances, these procedures were not being followed. On 12/13/2022, staff did a visual check of the bottle but not the label. Child A and Child B's bottles were identical in appearance. On 2/3/2023, bottles were moved around in the refrigerator. Child C was newly attending the infant classroom and her bottles did not fit in the reserved space, therefore, the bottles had to be moved to another shelf. When it came time to feed Child C, staff accidentally grabbed the incorrect bottle. The incidents involved different staff members. The staff member that fed Child A the incorrect bottle on 12/13/2022 is no longer employed at the center. Child care staff member Alexa Klapp provided Child C the incorrect bottle on 2/3/2023. All involved staff members were provided additional training. All involved parents were informed of the incident. Child B's Mother never disclosed any health-related issues to staff. Child B no longer attends the child care center. Naomi Evans is the infant lead caregiver, however, was not present in the classroom at the time of the incidents. She reported that staff member Alexa Klapp may have been confused about which child she was feeding. 3 Child care staff member Alexa Klapp works in multiple classrooms at the center. On 2/3/2023, Child A and Child C were both crying and needed to be fed at the same time. Although Child C was new, Ms. Klapp was familiar with Child A and is certain that she mixed up the bottles rather than the children. During the onsite inspection, I went into the infant classroom to inspect the refrigerator containing bottles. I observed appropriately labeled bottles located on a shelf that was also labeled with the child's name. I attempted telephone contact with Child B's Mother on 2/17/2023. The telephone number was no longer in service. I spoke on the telephone with Child C's Mother on 2/17/2023. She acknowledged that Child C was accidentally fed an incorrect bottle on her second day of care. Although the bottle contained a different brand of formula, there had not been any negative side effects. Child C's Mother did not express any concerns regarding the care Child C receives. I spoke on the telephone with Child D's Mother on 2/17/2023. Child D's Mother is satisfied with the care provided by child care staff. Child D no longer takes bottles; however, she has never had any feeding concerns. On 2/15/2023 I received a detailed plan to prevent future bottle-feeding mistakes. I spoke on the telephone with licensee designee Julia Pratt- Buckham on 1/14/2021. Ms. Pratt-Buckham informed me that on 1/12/2021 preschoolers were in line to use the bathroom. Child B was on the floor and tickled Child A's legs. Child care staff member Saima Siddiqui witnessed the interaction and thought Child B may have unintentionally touched Child A's private area and reported to parents that Child B touched Child A's vagina. Law enforcement came to the child care center today to investigate the matter. I made an onsite inspection at Gilden Woods on 1/15/2021 to interview program director Amanda Swager and child care staff member Saima Siddiqui. According to Ms. Swager, on 1/12/2021 Ms. Siddiqui reported to management that it "looked like" Child B inappropriately touched Child A. Because Ms. Siddiqui's observation wasn't clear, Ms. Swager individually spoke with each child. Child B informed her that he tried making Child A laugh by tickling her leg. Child A denied that Child B touched her in any way. Child B has been attending Gilden Woods for approximately 4 1/2 years. He has no prior history of inappropriate touching. Ms. Siddiqui wrote up incident reports for both Child A and Child B's parents indicating that Child B touched Child A's "vagina." Saima Siddiqui informed me that Child A and Child B were lined up to use the bathroom. Child A was wearing a shirt and leggings and was standing with her legs apart. While Child B was sitting on the floor underneath Child A, he reached up and started tickling her private area. Ms. Siddiqui was standing right across from them and stopped it immediately. She then discussed appropriate touch with both children. According to Ms. Siddiqui, Child B has never touched a child inappropriately before. The interaction she observed between Child A and Child B appeared innocent. She attempted to explain this to Child A's Father on 1/12/2021 after he was provided the incident report, however, he was upset and immediately left with Child A. I spoke on the telephone with Child A's Mother on 1/28/2021. Child A's Mother informed me that Ms. Siddiqui was shadowing Child A due to some prior bullying concerns Child A was experiencing with another child. Ms. Siddiqui provided Child A's Father an incident report when he came to pick Child A up on 1/12/2021. He immediately removed Child A from the center. Once home, Child A stated that she had a bad day and that another child touched her vagina. Child A said that she told 3 the child care staff members that Child B touched her leg because she didn't want them asking a bunch of questions. Child A's Mother stated that she is appalled with how the center handled the situation. Child A is no longer attending the child care center. I spoke on the telephone with Child B's Mother on 1/28/2021. When she arrived to pick Child B up from the center on 1/12/2021, Ms. Siddiqui stated "This is serious. This is very bad. I saw your son touch another friend's vagina." Ms. Siddiqui did not provide Child B's Mother any other details regarding this incident. Child B told his mother that he was tickling Child A's leg and licensee designee Julia Pratt-Buckham confirmed this version of the story. Child B's Mother believes that everything was blown out of proportion and poorly handled by Ms. Siddiqui. Child B's Mother stated Gilden Woods is a wonderful place and did not express any concerns regarding the care and supervision they provide. I spoke on the telephone with Child C's Mother on 1/28/2021. Child C has had a wonderful experience at Gilden Woods. She has discussed past concerns with child care staff and the results were satisfactory. I spoke on the telephone with Child D's Mother on 2/1/2021. Child D has expressed fear about attending Gilden Woods over the last few months. Child D's Mother has discussed this concern with program director Amanda Swager and Ms. Swager reports back that Child D appears to be fine while in their care. Gilden Woods has cameras set up in ea
