722.115n(3) Application for or renewal of license to operate child care center, group child care home, or family child care home; household member or child care staff member; criminal history check; requirements; duties of department. Each individual listed in subsection (1) shall give written consent at the time of the license application and before a group child care home or family child care home allows an individual to be a member of the household, or before becoming a child care staff member to allow the department of state police to conduct the criminal history check required under subsection (1). The department shall require the individual to submit his or her fingerprints to the department of state police and the Federal Bureau of Investigation for the criminal history check as required in subsection (1).

Child A and Child B were dropped off at Ms. Liggins child care at 8:45am in fresh diapers and were picked up at 4:00pm. Child A was wearing the same diaper and it was soaked with urine and leaking onto his pants. Child A's diaper was not changed all day.

On October 10, 2022, I completed an unannounced onsite inspection at the child care home and interviewed Licensee, Ruby Liggins and Child Care Staff Member, James Liggins. Ms. Liggins reported that Child A and Child B are twins. They were picked up on the day in question by their father. A few hours later Ms. Liggins received a call from Child A and Child B's father saying the mother was concerned that Child A had not been changed all day. Ms. Liggins informed Child A and Child B's father that shortly before pick-up Child B had diarrhea and both twins were changed at that time. Ms. Liggins asked Child A and Child B's father if Child A had been changed since being home. He did not know if the diaper had been changed. Ms. Liggins stated that Child A's mother felt Child A had not been changed because he came home in the same brand of diaper (Meijer) he was sent to care in, but a different brand (Huggies) is sent to the child care for Child A. Ms. Liggins noted that they do have some Meijer brand diapers as well as other brands. 2 She likely just grabbed a Meijer brand diaper instead of a Huggies diaper when she changed Child A. Ms. Liggins reported that the children are changed multiple times throughout the day, but she does not keep a log of diaper changes. She said Child A and Child B's mother requested she start doing a log of diaper changes, but all their children are in diapers, and she does not have time for that. She stated that she recently charged Child A and Child B's parents a late fee for not paying for child care on time and she believes this complaint may be a result of that. Mr. Liggins reported that they change all the children's diapers before lunch and after nap at a minimum and change them as needed. He reported that he was not the one to change Child A and Child B that afternoon, but said it was done by Ms. Liggins. Mr. Liggins reported that they have never had a complaint from parents before regarding diaper changes. On November 9, 2022, I made telephone contact with Child A and Child B's mother, Child C's mother, Child D's mother, and Child E and Child F's mother. Child A and Child B's mother reported she did not notice how full Child A's diaper was until after they were home for a bit. She doesn't remember how long, but it was so wet it was starting to leak through to his pants. She said he went to child care with a Meijer brand diaper on and came home with a Meijer brand diaper on, but they send Huggies diapers to child care. She believes he was not changed all day. Child A and Child B's mother reported that she asked Ms. Liggins to start doing a log for diaper changes and she said she did not have time for that. Child A and Child B's mother said this is the only time she has had an issue with diaper changes. Child C's mother reported her child has been in care 18 months and she has never had any issues with diaper changes. Child D's mother said her child has attended the child care for two years and she has never had any concerns with diapering. Child E and Child F's mother said her family has used the child care for over eight years for three different children and she has never had any issues with diaper changes.
