Child Care Staff Member (CSSM) 1 Child A's Child A complained of irritation During a physical exam general irritation was observed. Child AChild A's mother reported that she works at the facility as a child care staff member and Child A attends the facility, but she does not work in the same room. She works from 8:00am to 12:30pm and leaves Child A at the facility in the afternoon. Child care staff member (CCSM) 1 is the lead teacher in Child A's classroom and he started at the facility in October of 2022. She believes he worked there before, but just came back. Child A's mother said in November 2022 Child A started coming home She assumed she was not but didn't physically oo at the area. She started using and it helped for a while and then came back. On December 4 2022, Child came home from the center and said CCSM 1 Child A's mother talked with Child A about only allowing momdad,or grandma to Child A complained about and Child 's mother assumed CCSM s Wmoerreported not feeling comfortable reporting her concerns to program director, Tim Sheldon because he is friends with CCSM 1. Child A's mother reported that on December 18. 2022 Child A was picked u b her father. At pick up CCSM I told him Child A ,so they her. When she got home, she was that were not hers. She reached out to CCSM 4; 3 because she was working in Child A's room that day, to see if Child A had an accident that day. Mr. Sheldon told her CCSM 1 was not there because he was at a training, but in his heart, he doesn't think CCSM 1 would do what he is being accused of. She has not been back to work since that day and said she needs some time. Child A has also not been back to the center. Child A's mother also reported that over Christmas break Child A went to Kid Zone, which is the daycare in the YMCA that kids can go to if the parent are still in the building working or working out. She did not have any issues with during that time. Child A's father reported in December Child A was complaining of othou ht it was an issue of her ,so they ed with . On October 10, 2022, I received a telephone call from Licensee Designee, Bobby Ludwick. She informed me that Program Director, Tim Sheldon was also on the line. They reported that a child had been left on the playground that 2 day for approximately ten minutes. They believe when the 3's classroom was transitioning inside from the playground the child got out of line and returned to the playground. The child was not injured or upset when he was found, and the parents have been notified. Mr. Sheldon agreed to send the incident report with further details. On October 13, 2022, I completed an unannounced onsite inspection and interviewed Mr. Sheldon and Child Care Staff Member, Sarah Lozeau. Mr. Sheldon was having a parent event that day called Lunch and Learn, and he was preparing for parents to arrive. Around 11:45am he went to the door to let in a parent, Child B and C's mother, and she asked, "Why is there a kid on the playground alone?" Mr. Sheldon went to the playground and found Child A. He was not upset or hurt. As Mr. Sheldon was walking Child A inside Child Care Staff Member, Cassie Haimann, was coming out to retrieve Child A. Mr. Sheldon said the lead caregiver in the 3's room is Ms. Haimann and the assistant caregiver is Sarah Lozeau. After his event Mr. Sheldon spoke with Ms. Haimann and Ms. Lozeau. Ms. Haimann reported that she counted the children as they lined up to leave the playground and had the correct number of children. She admitted she did not count the children again when they reached the classroom, which is a center policy. Ms. Lozeau told Mr. Sheldon she is normally in the back of the line when they go inside from the playground and Child A is normally with her. That day, she was leading the class in, and Ms. Haimann was in the back of the line. She was unsure when Child A went back to the playground. Mr. Sheldon reported that Ms. Haimann has been terminated due to the incident and Ms. Lozeau was written up. Ms. Lozeau reported that when the group was lined up to head inside from the playground she was at the front of the line and Ms. Haimann was at the back of the line. Child A was holding the door for the group as they lined up. Ms. Haimann counted the children and then they headed inside. They did not count the children again when they got back into the classroom because it was a very busy day, and the kids were excited about their parents coming for the event. Ms. Lozeau did not realize they were missing Child A until Ms. Haimann looked out the window and saw Mr. Sheldon on the playground with Child A. Ms. Haimann went to get Child A and return him to the classroom. Child A was quiet because he thought he was in trouble, but he was not injured or upset. She believes that after he held the door for the class to enter, he went back to the playground. Child A does have trouble with transitions and often does not want to stop playing. Ms. Lozeau said they have started holding Child A's hand when going in and out from the playground, counting in line, and once they return to the classroom. While onsite I observed the playground. It is at the entrance to the center and is fully fenced. There are no water hazards present, but there is a street approximately 50 yards from the playground. The playground is only 6-8 feet from the entrance to the center. 3 On October 13, 2022, I made telephone contact with Child A's mother. She reported that on the day of the incident she received a telephone call from Ms. Ludwick and Mr. Sheldon informing her that Child A had been left outside on the playground unsupervised for around ten minutes. Child A's mother was upset about the incident, but she is aware her son is not a great listener and does tend to wander off. She was upset to hear that Ms. Haimann was let go for the incident because Child A really liked her. She plans to remain at the center and has no ongoing concerns with supervision. She believes they handled the incident well and are taking measures to ensure it

On December 16, 2021, 1 made telephone contact with Child A's mother. She reported that during bath time Child A said that her private parts were 2 sore. She told her mother that she was sore because while at school she needed help wiping and could not find a "teacher'. She reported that Child B used his bare hand to wipe her, and it hurt. Child A told her mother that Ms. Cassie walked in and said, "oh my goodness." Child A's mother reported being upset that she was not told about the incident. She said that when she confronted the staff about the incident, they denied knowing anything about it, so she removed her child from the center. She reported not having any previous issues with the facility. On December 16, 2021, I completed an unannounced onsite inspection and interviewed Program Director, Tim Sheldon. He reported that the preschool room was not operating today due to a covid exposure. Mr. Sheldon reported that he became aware of the incident between Child A and Child B when Child A's mother sent a message to Child Care Staff Member, Cassie Haimann through their app, Bloom. Ms. Haimann notified Mr. Sheldon through text message early in the morning and he stated he would address it when he arrived at the facility. Mr. Sheldon spoke with Ms. Haimann and Child Care Staff Member, Sarah Lozeau, who work in the preschool room and neither of them witnessed Child A and Child B in the bathroom together. They told Mr. Sheldon they follow the center's policy of one child in the bathroom at a time and a staff member stays near the door in case they need help. Mr. Sheldon stated that Child A's mother was very upset about not being notified about the incident, but his staff report they had no knowledge of any incident happening. He stated they certainly would have completed an incident report and notified parents if they knew anything like that happened. On January 18, 2022, I made telephone contact with Ms. Haimann and Ms. Lozeau. Ms. Haimann stated that she received a message from Child A's mother through the Bloom app at 1:21a m on December 13, 2021, stating what Child A told her. She reported having no knowledge of the incident. Ms. Haimann stated the incident reportedly occurred on December 9, 2021, and she only worked in the classroom for the morning on that day. She never saw Child A and Child B in the bathroom together and Child A never told her anything happened. Ms. Haimann said that Child A had issues with Child B, and she never wanted to be by him, but she was not aware of any incident between the two children. Ms. Lozeau reported that they monitor the bathroom at all times, and they only allow one child in the bathroom at a time. She stated the children often need help in the bathroom, so an adult always stands outside the door in case they are needed. Ms. Lozeau reported that Child A tends to tattle a lot and she told on Child B often. She reported a few times Child A would come tell her that Child B hit her, but they were on opposite sides of the room, and it was not possible. Ms. Lozeau said she believes Child A would have told her if an incident happened in the bathroom with Child B. On January 18, 2022, I made telephone contact with Child C's father and Child D's mother. Child C's father reported that he has had no concerns with supervision, and he believes that the center always has a staff member stand outside of the bathroom door because his son requests that he or his wife stand outside the door every time 3 he uses the bathroom at home. Child C's father stated that the facility is good about notifying the families regarding any injuries or incidents. They usually send a message through the app, Bloom. Child D's mother stated that her son does complain about biting sometimes, but that has been her only complaint about supervision, and she understands that it does happen with this age group. She stated she is notified when anything happens with her child, and she has no concerns with the facility. On January 20,

On March 22, 2021, Licensee Designee, Bobby Ludwick, contacted the department by email to report an allegation of child-on-child inappropriate touching. She included the Incident Report (BCAL-4605) with her email message. The incident report stated that Program Director, Timothy Sheldon, received a phone call from Child A's Mother to say that Child A (female, age 4) reported to her mother that Child B (male, age 5) had touched his vagina to her vagina. Child A's Mother asked Child A to describe Child B's vagina and she described a penis. Child A also told her mother that Child Care Staff Member, Kiara Thurman, and Child C (male, age 5) were in the bathroom at the time of the alleged incident. Mr. Sheldon spoke with Ms. Thurman who said that while Child A was in the bathroom, she noticed Child B had left the play area without permission and she ran to the bathroom to look for him. When Ms. Thurman walked into the bathroom, Child B ran into a stall. While in the bathroom, Child B had to be reminded several times to stop looking into Child A's stall. Child A's stall door was open, so Ms. Thurman said she reminded Child A to close the door when she's using the bathroom and she closed it for her. Child A had a toileting accident, so Ms. Thurman asked Child B to leave, and she went and got Child A another set of clothing. On March 22, 2021, I spoke to Ms. Ludwick and Child A's Mother by telephone. Ms. Ludwick said she had not spoken to Child A's Mother. She stated that Mr. Sheldon had handled the incident. Child A's Mother said that on March 19, 2021, Child A told her that Child B and Child C followed her into the bathroom and Child B touched his vagina to her vagina in the bathroom. She asked Child A to describe Child B's vagina and she said it did not look like hers and described a penis. Child A's Mother explained that Child A lives in a household of women, so she does not know what a penis is. She said that Child A told her that Ms. Thurman and Child C were also in the bathroom, but they did not see what happened. Child A indicated that her clothing was off when Child B touched her because she had wet her pants. Child A's Mother said she felt Mr. Sheldon was responding appropriately to her concerns and she sent Child A back to the center. Mr. Sheldon assured her they were taking precautions to make sure it did not happen again and that they were implementing a new procedure when children needed to use the bathroom, so children are never unattended. Child A's Mother did not have any other concerns about the center. 3 On March 22, 2021, I made an onsite inspection to the child care center and spoke to Mr. Sheldon, and Ms. Thurman. Mr. Sheldon said that Child A's Mother contacted him about 10:00 PM on March 19, 2021 and stated that Child A said she was using the bathroom and Child B touched his vagina to her vagina and Child A proceeded to describe a penis. On March 20, 2021, Mr. Sheldon said he contacted Ms. Thurman who stated that Child A had been given permission to use the bathroom and a few moments later they realized Child B was not in the classroom. Ms. Thurman ran to the bathroom because they only allow one child in there at a time unsupervised, and Child A, Child B, and Child C were in the bathroom. When she walked in, Child B was in Child A's stall, but he had his pants up. She told Child B to go to the bathroom, but he kept peeking under Child A's stall, and Ms. Thurman kept having to tell him to stop. Ms. Thurman sent Child B back to the classroom and she went and got dry clothing for Child A. She returned and helped Child A change her clothing and then Child A's Mother arrived to pick her up. Mr. Sheldon said he contacted Child B's Father over the weekend, but he did not have much to say about the incident. He seemed more concerned about some of the wording in the incident report that Mr. Sheldon had sent him. Child B returned to the center on Monday morning.
