On 06/02/2023, I received a phone call from the complainant expressing concerns that child care staff members at the child care center were not acting within their requirements as mandated reporters or being encouraged by Program Director Taylor Brown or Kindercare administration to contact Department of Health and Human Services (DHHS) with suspected child abuse and neglect. The complainant explained that during conversations with child care staff members she became aware of two incidents she felt were concerning and that staff should have reported. Child Care Staff Member (CCSM) 1, CCSM 2 and CCSM 3 reported to the complainant that Child A had Child D when he was observed telling Child D t In addition there had been instances where Child A had other CCSM 1 CCSM 2 and CCSM 3 also RepoRethat there had een aggressive ant between Child B and Child C who are siblings. One day during circle time Child C was trying to and Child B was "aggressively" . Child B also will watch Child C once he air across the floor and centl Child B an emotional rabbit that was at their home and displayed ■ i CCSM 1; CCSM 2 and CCSM 3 told the complainant that they had not reported the incidents to DHHS. The complainant encouraged the staff members to report the incidents, and emailed Program Director Taylor Brown to explain what she had been told as well as her concerns with staff members not reporting to DHHS. The complainant sent me the email response from Program Director Taylor Brown which stated that staff members had "not been able to talk with me (Taylor Brown) about 3 the incident" and that she was "frustrated to receive that call from the center regarding an issue that I (Taylor Brown) had not even been made aware of yet." The email stated that Taylor Brown and the Kindercare Area Manager had developed plans to observe behavior and described the behaviors as new. The complainant explained that she felt concerned that the child care staff members were not encouraged by administration to be mandated reporters and to report things that they felt concerning and instead felt they had to "run things by" their administration. On 06/0612023, I conducted an unannounced onsite inspection and interviewed Program Director Taylor Brown, CCSM 2 and CCSM 3. Taylor Brown re orted that on approximately 06102/2023 she received a visit from _____________________ regarding Child B an stated that e did not feel ere were any supervision issues or anything for him to review farther. Regarding Child A, Program Director Taylor Brown reported that CCSM 2 was present for the incident in the restroom with Child A and Child D and repoorrtteedd that Child A and Child D were like boys do" and . CCSM 2 witnessed the behavior, stopped them, and spoke with em both about their behaviors. CCSM 2 did not "seem concerned." Child A has been "acting out" with a variety of behaviors such as swatting at staff members, biting, or pushing others. Child A's Mother is aware of behaviors as they are seeing them at home as well. Child care staff members had been increasing their monitoring of Child A, only allowing him in the bathroom when no other children are in there, tracking these incidents as well as communicating with Child A's Mother. Taylor Brown was not aware of these behaviors being recurring and stated that these are the first behaviors that she has seen from Child A since being at the center as of 12/2021. Program Director Taylor Brown reported that she had been made aware of the incidents with Child B Child C's Child C by the hair when CCSM 1 resigned from employment. Taylor Brown explained that CCSM 3 had told her at one point that Child B will "flip off" Child C and uses "aggressive language" toward her, but nothing more. Child care staff members would watch Child B closely, have conversations regarding being safe, kind words and keeping hands to self as well as have conversations with Child B and Child C's Father. On 01/05/2023, Program Director Taylor Brown called and notified me that she witnessed child care staff member Amber Harris pull Child A by the legs to get him to lay down on his cot. Ms. Brown sent the required incident report to the department that afternoon. On 1/9/2023, I conducted an unannounced onsite inspection and interviewed Program Director Taylor Brown and child care staff members Chayanne Rose Blakenburg, Marsha Mauer, and Kristen Launius. Ms. Brown reported that she was giving a tour to a prospective family and as she walked by the toddler room, she observed Ms. Harris trying to get Child A to lay on his cot. While interacting with Child A, Ms. Harris grabbed Child A's legs and "aggressively pulled" him by the legs down to the cot. Ms. Brown was uncomfortable with the interaction and felt that it was extremely inappropriate. Following the tour, Ms. Brown had a conversation with Ms. Harris, who understood the interaction was inappropriate but stated that she" couldn't help it." Ms. Brown discussed the mandated reporting training staff had just completed on 11/30/2022, and what appropriate care and interactions with children looks like. After speaking with regional managers, Ms. Harris' employment was terminated that day. Child care staff member Chayanne Rose Blakenburg reported that she only goes into the toddler room to provide breaks for staff. She has had concerns regarding the way Ms. Harris provides redirection to the children and described it as "harsh." Ms. Blakenburg did not take her concerns to management. Ms. Mauer is the lead teacher in the toddler room and has worked with Ms. Harris regularly. Ms. Mauer reported that she did not really have any concerns with Ms. Harris and stated that she would handle the discipline and redirection in the room when working with Ms. Harris. Ms. Launius works primarily in the infant room, next door to the toddler room. Ms. Launius has witnessed Ms. Harris "pull a child up by the hand and wrist" to redirect the child. When Ms. Launius saw this, she immediately told Ms. Harris that the children should not be picked up that way. Ms. Launius did not see any concerning interactions with children following this interaction. I interviewed Child A's Mother on 1/24/2023, who reported that Child A still attends the center adding that she was made aware of the incident and appreciated that Ms. Brown handled the situation promptly. Child A's Mother has had other concerns with Ms. Harris in the past, and how she would "fold children's legs" when doing a diaper change. These concerns were reported to Ms. Brown, and she did not witness it again after. I contacted Child B's Mother, Child C's Mother and Child D's Mother for an interview on 1/24/2023. All parents reported that they had no concerns with care and supervision in the toddler room. Child D's Mother added that she really doesn't stay 3 in the rooms long enough to see a lot of interaction between the staff and the children so it's hard to say if there is anything concerning. On 1/09/2023 and 1/24/2023 I attempted to contact child care staff member Amber Harris. Ms. Harris had a full voicemail and there was no way to leave a message or reach her.

MCL 722115m Child care center, group child care home, or family child care home: requirements for licensure. (14a) As used in this section: (a) "Completed application" means an application complete on its face and submitted with any applicable fees as well as any other information, records, approval, security, or similar item required by law or rule from a local unit of government, a federal agency, a state department or agency of another state, or a private entity but not from another department or agency of this state. A completed application does not include a health inspection performed by a local health department. (b) "Conducive to the welfare of the children" means: (i) The service and facility comply with this act and the administrative rules promulgated under this act. On 11/18/2022, 1 received an email from Program Director Taylor Brown informing me that there had been an incident at the child care center. Ms. Brown had attached an incident report to the email; however, it was the incorrect report. Additionally, she left a voicemail reporting the incident but stated that she wanted to talk with me in detail regarding the incident. On 11/2112022, I requested the correct incident report, however due to the holiday and Ms. Brown being out of the child care center. I did not receive the completed incident report until 11/28/2022. On 11/28/2022, 1 contacted Child A's Mother who reported that she had been informed that on 11/18/2022, Child A fell and bit her lip. On the evening of 11/18/2022 and over the following days, she noticed in the middle of her lip near her cupid's bow was swollen and Child A was bothered by the injury. Child care staff had not made Child A's Mother aware that there had been allegations of inappropriate discipline and interactions which led to Child A's injury. She had no previous concerns with care and supervision or the discipline at the child care center. I contacted Program Director Taylor Brown following my conversation with Child A's Mother. I informed Ms. Brown that Child A's Mother was not aware of the allegations. Ms. Brown explained that when Child A's Father picked up Child A on 11/1812022, the injury was discussed with him per their incident reporting policy. However, Ms. Brown had not spoken to her manager, or interviewed any staff regarding the allegation with She did not feel she had to whole story at the time to discuss the allegation with hild A's Father. That evening, she contacted her 3 managers, and discussed with them. She followed back up with on 11/21/2022, when she terminated employment. I provided technical assistance and explained to Ms. Brown at- p er r ule 400.8155(1) an incident is described as, "including but not limited to physical discipline of a child by a staff member." Ms. Brown acknowledged that she should have contacted Child A's Mother regarding the allegation. on 11/29/2022 at 1:00PM. I conducted an unannounced onsite inspection with and interviewed rogram Director Taylor Brawn, Assistant Director Chris Kubiak and child care staff members Moter Ms. Brown reported thatshe had spoken with i A's following conversation. When she originally spoke to her district manager she had been instructed to "wait for guidance," which was why she did not originally speak with Child A's parents regarding the allegations made regarding Ms. Brown apologized again and reiterated that she would ensure paren s are promptly notified in the future of similar incidents. Ms. Brown recalled on the day of the incident child care staff member asked her to sign a blank incident report. Ms. Brown immediately asked to complete the form and asked what happened. reported that Child slipped on the hard floor and hit her lip. The completed incident report from 11/18/2022 was reviewed which stated, "she (Child A) was turning around and slipped." left for the day following he completion of the incident report, and shortly after child care staff member reported to Ms. Brown that she witnessed , push Child A the way, shoving her causing Child A to fall and hit her face on the tile floor. Child A returned to the center on Monday 11/21/2022, and Ms. Brown did not recall seeing an injury on her face. Ms. Brown reported that she has never witnessed anything concerning with care or discipline, however staff have reported concerns with hen! very up and own and "brings personal things into work" which regularly affects her tone and manner in the center. She reported that there were times that she was in the infant room when was not aware, and could be overheard getting loud with her tone of voice," and Ms. Brown could sense that she was overwhelmed. MCL 722.115m Child care center, group child care home, or family child care home, requirements for licensure. (2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization shall not establish or maintain a child care center, group child care home, or family child care home unless licensed by the department. Application for a child care center, group child care home, or family child care home license shall be made on forms provided, and in the manner prescribed, by the department, including the fees required under subsection (10). I made an unscheduled onsite inspection at KinderCare Learning Center on 6/13/2022 and spoke with program director Taylor Brown, child care staff member Chris Kubiak and lead caregiver Audrey Berris. According to Taylor Brown and Chris Kubiak, child care staff member Anna Patten worked in the preschool classroom from 9:00 a.m. until 5:32 p.m. on 6/8/2022. Ms. Brown was attending a district meeting in Rockford for most of the day. Chris Kubiak is an assistant to the director and was present in the center from 6:30 a.m. until 2:55 p.m. When Ms. Brown returned to the center around 5:30 p.m., staff informed her that they caught Ms. Patten smoking marijuana in the preschool closet. Ms. Patten had already left for the day, however, Ms. Taylor confronted her the following morning. Ms. Patten denied smoking marijuana but provided no further explanation. Ms. Patten was placed on administrative leave pending investigation. Anna Patten began employment at the center on 5/3/2022. Ms. Brown and Ms. Kubiak did not express any prior concerns about Ms. Patten or her ability to care for children. Staff never approached them with any concerns. Both Ms. Brown and Ms. Kubiak have previously smelled marijuana on children's belongings before, but the odor was never specific to staff or the child care center. Taylor Brown provided me written statements from child care staff members Rose Soma and Tia Bonnau on 6/13/2022. Ms. Soma's indicated that she smelled marijuana in the preschool closet during the week of June 2nd. Ms. Bonnau disclosed that a staff member brought it to her attention that the preschool closet smelled of marijuana. Ms. Bonnau opened the closet door and detected the smell of marijuana as well. Audrey Berris is the lead caregiver in the preschool classroom and was working with Ms. Patten on 6/8/2022. Ms. Berris informed me that she smelled marijuana in the preschool closet earlier that day. She later noticed Ms. Patten go into the closet and shut the door. Ms. Berris was suspicious after smelling marijuana previously that day, therefore, opened the closet door. Ms. Patten had her back to Ms. Berris, however, Ms. Berris saw Ms. Patten throw something pen-shaped into her purse and walk out of the closet. According to Ms. Berris there was smoke in the closet and a strong marijuana odor. Words were not exchanged between either staff member. Ms. Brown was informed of the incident when she returned to the center later that day. Ms. Berris stated that she smelled marijuana at the center a week prior however, she is uncertain if the odor came from staff or the children's belongings. Ms. Berris did not express any concerns regarding Ms. Patten as a child care provider. Although Ms. Patten had to be reminded of duties, appropriate care was provided at all times. 611 W. OTTAWA. The door to the closet remains shut when children are present in the center, therefore, the contents inside the purses are not accessible to children. I spoke on the telephone with Child A's Mother on 7/12/2022. Child A's Mother did not express any concerns regarding staff or the care and supervision provided at the child care center. She has never witnessed staff or parents smoke/vape on the premises. I spoke on the telephone with Child B and Child C's Mother on 7/12/2022. Child B and Child C's Mother did not express any current concerns regarding staff or the care and supervision provided at the child care center. Prior complaints were brought to the attention of the director and remedied quickly. She has witnessed parents pull up to the center smoking/vaping but has never seen them do this outside of their vehicle. Ms. Brown believes the allegations were made by a disgruntled employee that walked out of the center in the middle of her shift last week. Ms. Brown has spent time observing classrooms and has never heard staff screaming at children nor has she witnessed staff handle children in an aggressive manner. Jessica Damer is a lead caregiver in the infant room. Ms. Damer has heard staff speak in a stern tone to children but has never heard staff yell at children or witnessed staff lift children up by their arms. I spoke on the telephone with Kristin Launius on 6/24/2022. Ms. Launius is a co- lead in the infant classroom. Staff redirect infants. She has never heard staff yell or handle children aggressively. I spoke on the telephone with Child A's Mother on 6/16/2022. Child A's Mother has overheard staff raise their voice to get children's attention, but they are not yelling at children in an attempt to intimidate. She has never observed staff handle children aggressively. I spoke on the telephone with Child B's Mother on 6/16/2022 and Child C's Mother on 6/27/2022. Taylor Brown stated she is an advocate of breastfeeding. She informed me that the only individual that has breastfed at the child care center since she began employment there in December 2021 was former child care staff member Ashante Waters. Ms. Waters worked in the infant room and was the primary caregiver for other infants. Ms. Waters occasionally breastfed, however, also brought bottles for her infant and would pump during breaks. Ms. Waters had the tendency to focus all her attention on her own child and was not fulfilling the needs of the other children she was responsible for. Ms. Brown informed me that parents can breastfeed in the classroom or the staff bathroom. While in the infant classroom, I noticed a sign posted stating "breastfeeding welcome." Jessica Damer informed me that breastfeeding is welcome at the child care center and breastfeeding positivity is incorporated in the training. According to Jessica, former child care staff member Ashante Waters breastfed her child a few times at the center, however, no other parents chose to breastfeed at the center. Kristin Launius stated that she has only witnessed one staff member/parent breastfeed at the center since she started working there in October 2021. Ms. Launius stated that the center supports breastfeeding and they have never turned anyone away. Child A's Mother did not enter the facility when her child was an infant. She does not know if breastfeeding was supported by center staff. Child B's Mother stated that Child B was not enrolled at KinderCare until he was one years old. Child B's Mother did not breastfeed or send bottles to the center. Child C's Mother never breastfed at the center. Taylor Brown informed me that bottles are premade and labeled. This expectation has been explained to both parents and staff. She has no knowledge of staff mixing formula and does not think formula is stored in the infant room. Jessica Damer stated that parents typically bring in ready to feed bottles, however, staff have prepared bottles with formula provided by the parent or found in the infant classroom. One parent used to only bring in one prepared bottle and staff would have to clean the bottle and prepare additional bottles when the child was hungry. According to Ms. Damer staff would follow the directions printed on the formula can to make sure they were preparing it correctly. Kristin Launius said that parents make bottles and bring them to the center, however, there was one parent that occasionally did not bring enough. Staff found an unopened can of formula in the classroom and would occasionally prepare bottles for the child. This is no longer an issue as the child is now eating solid foods. Child A's Mother informed me that parents mix the formula at home and bring ready to feed bottles to the child care center. Staff were changing Child A's diapers frequently and cleaning the affected areas. Child A's Mother did not instruct the center to discontinue using wipes until 5/9/2022. At that time, staff used wet cloth or paper towel to clean the area. Diaper rash cream and Aquaphor were applied frequently to the affected areas. Child A's Mother never provided the center with Neosporin.

On 11/16/2021, 1 received an email from Program Director Lauren Rybak to follow up on an incident that she contacted me about on 11/12/2021. Ms. Rybak had reported that child care staff member Adelle Deakin noticed a bruised area on the side of Child A's head along with some swelling. Staff notified Child A's Mother immediately Staff members looked pictures on the Brightwheel "ppand noticed on 11/10/2021, a small amount of swelling on the side of Child A's face but no bruisina. 7 However child care staff • occurred while Child A was in care. I interviewed Child A's Mother on 11/17/2021. Child A's Mother reported that she was notified on 11/ 1212021, by the child care center that they noticed an abnormal bruise and swelling on Child A's head. The center sent a video to her via the happened at the home, and that Child A was just starting to crawl. Additionally, Child A's Mother reported that she believed the center handled everything appropriately and described them as "fantastic." Child A's Mother reported that she has no concerns with the care and supervision provided. Adelle Deakin, Jessica Darner, Makayla Berry, and Rachel Stenson. Program Director Lauren Rybak reported that on the week leading up to 11/12/2021, no one reported noticing any temperamental changes in Child A, or abnormal crying. Ms. Rybak stated that Child A just began crawling and pulling up he furniture and described her as "fiery" and wanting to "just move." asked if the recordings of Child A's napping and eating appeared reviewin the week of 11/08/2021, it appeared that all meals, and nap times were nominal. also asked if there were any concerns with the any staff in the infan room and Ms. Rybak reported no concerns from staff or parents. Child care staff member Chris Kubiak reported that she was in another room when child care staff member Adelle Deakin brought Child A to her to show her the swelling and bruising on Child A's head. Ms. Kubiak instructed Ms. Deakin to contact Child A's Mother by sending her a message on Brightwheel, then after Ms. Rybak arrived and observed Child A's head, she had Ms. Deakin contact Child A's Mother via phone. Child A's Mother called back immediately and was already on her way to come pick up Child A to take her to the doctor. I interviewed child care staff member Adelle Deakin, who is the Reacaregiver in the infant room and typically Child A's primary caregiver. Ms. Deakin reported that prior to finding the injury, she did not recall anything abnormal with Child A, her temperament or her behavior. Ms. Deakin said that she was rocking 3 Child A to put her down for a nap and as she was stroking her head, she noticed a "squishy" area on the left side of her head. Ms. Deakin immediately had the other child care staff members in the infant room, and toddler room look at Child A's head and ask if they had noticed anything. All staff members reported that they had not seen anything happen to Child A that may cause the injury. Ms. Deakin then took Child A to Ms. Kubiak and then contacted Child A's Mother who immediately wanted to come get Child A. Ms. Forward asked Ms. Deakin if there was anything else concerning that happened with Child A leading up to 11/12/2021, and Ms. Deakin reported that Child A had a nosebleed "a few days prior." There was an incident report completed for the nosebleed. Ms. Deakin reported that "a few other times, Child A had some "bloody ers", but no other nosebleeds and the incidents were not close together. asked Ms. Deakin if she had any concerns with the care of children by any to which she reported that she did not. Child care staff member Jessica Darner stated that she arrived to the center after the incident happened on 11/12/2021 so she was not aware of the incident. However, Ms. Darner had worked with Child A on 11/10/2021, and was present the day of the bloody nose. There was not anything that lead to the injury and Ms. Darner stated that she thought it may be just the dry air but wanted to stil
