R 400.1908 .Capacity (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.

I received an anonymous complaint stating that Ms. Giles cares for "at least" 10 children that are "dropped off at all times of the day and night." I conducted an unannounced on-site inspection on 04/18/2023 at 10:36am. When I arrived, Ms. Giles was present with three child care children. I informed Ms. Giles of the allegations, and she explained that she had some issues with her neighbors that she used to care for, and she felt they were calling in complaints. Ms. Giles explained that she has 24 grandchildren total, and she cares for eight of them at times during child care hours after school and she also cares for up to six of her grandchildren that will come later in the day and stay overnight at times. Ms. Giles is licensed to provide overnight care. There are five unrelated child care children enrolled with the child care home, however all of the children do not come five days a week or on regular schedules. Ms. Giles provides care for her eight grandchildren; three grandchildren are under the age of 6 and five grandchildren are over 6 years old. Ms. Giles reiterated that most of the time, her grandchildren do not come until after school, when most of her child care children have left the home. I reviewed the ratio and capacity rules pertaining to relative children over the age of six with Ms. Giles. On 04/18/2023, 05/01/2023 and 05/25/2023 I attempted to contact Child A and Child B's Mother as well as Child C's Mother. On 04/18/2023, I left a message for Child A and Child B's Mother. I was not able to leave a voicemail for Child C's Mother as the voicemail box was full on any attempted contact date. I did not receive a return call by the end of the investigation from Child A and Child B's Mother.

I There is not sufficient evidence that the child care home premises is not maintained in a clean, safe and comfortable condition. On 04/18/2023, when onsite, I observed no concerns.

(1) Prior to a child's initial attendance, a licensee shall obtain the following documents: (a) A completed child information card on a form provided by the department or a comparable substitute approved by the department.

On 04/18/2023, Ms. Giles did not have a completed child information card prior to children's attendance for all enrolled children.

R 400.1907 · R 400.1907 Child's records. (3) Dated daily attendance records of children in care must be maintained and include the child's first and last name and the time of arrival and departure. Electronic records may be used. If electronic records are used, they must be available to the department at the time of the inspection. If electronic attendance records are not available during an on-site inspection, the child care home is in violation of this rule.

Attendance records for children including first and last names were not kept. On 04/18/2023, Ms. Giles could not locate one week of attendance for children, and first and last name or arrival and departure times were not kept.
