    On 6/7/2022, I completed an unannounced inspection at e facility. During our onstte ■ inspection we interviewed Megan Jones, School Education Manager. She stated that she was aware of an incident that took place on 6/1/2020 with Child A and Child Care Staff Member, Peyton Barbrick. Ms. Jones stated that she was not there when the incident occurred but staff member, Haley Newenhouse witnessed the incident. Ms. Jones stated staff member Peyton Barbrick and Child A were on the playground playing and laughing, Child A scratched Ms. Barbrick. Ms. Barbrick said `ouch that hurts. Don't do that," and scratched Child A. Ms. Jones reported there was a red mark on Child A's arm that faded away before they came inside. Ms. Jones explained that Ms. Barbrick babysits Child A outside of the facility and they have a special relationship. When Child A's Mother was informed, she responded that it sounds like a misunderstanding and hoed no one was in trouble. Ms. Barbrick was Child A Mother's attempted to advocate or Ms. Barbrick not a be terminated. Ms. Jones stated she does not think the scratching was done maliciously and feels Ms. Barbrick was too comfortable and did this without thinking. Ms. Jones reoorted no write ups or During our onsite I interviewed staff member Katie Arnson. Ms. Arnson stated these has been working at the facility '. She has been working with Ms. Barbrick. Ms. Barbrick is pafssoiorn"aot u, oing, and loud with a lot of energy. She has not seen any concerning interactions with Ms. Barbrick and children in care. There may have been times that Ms. Barbrick became frustrated and was a little loud but stated Ms. Barbrick's voice is naturally loud. Ms. Arnson reported she was outside when the incident occurred but did not see the scratching between Child A and Ms. Barbrick. Ms. Arnson stated she heard Ms. Newenhouse say, "Peyton [Barbrick[ why would you do that". Ms. Barbrick stated, "she is fine; it is not a big deal." Ms. Newenhouse responded that Child A is a child and Ms. Barbrick is an adult, that it is not okay to do that. Ms. Barbrick continued to say it was not a big deal. Ms. Arnson explained that Ms. Barbrick was "playing it off as if it was not an issue". Ms. Barbrick seemed embarrassed and had a look of regret on her face. Ms. Arnson reported she thinks Ms. Barbrick got caned away and ii that this scratch was not malicious. She added that Ms. Barbrick does not have good boundaries with children in care. Ms. Barbrick would do things like talk with children during nap instead of letting them go to sleep. Child A is a child Ms. Barbrick has boundary issues with as Ms. Barbrick is close to Child A's family, and she spends time with Child A outside of the class. Ms. Arnson stated she saw a red mark on Child A's right forearm. It looked as if it would when you scratch your arm and have red nail marks and it faded in ten minutes or less. Child A did not cry, and she did not hear Child A respond or react to being scratched. Ms. Arnson stated she has never seen Ms. Barbrick scratch any other children in care. Ms. Barbrick has never been seen to harm any child. I interviewed lead, Sonya Martinez. She has been the lead staff member tote class for over almost six years and has worked at the facility for. " Ms. Martinez reported that Ms. Barbrick can get flustered and yell. Ms. ar ck is very blunt and would speak to children as if they are an adult. Ms. Martinez stated that she would step in and assist. Ms. Barbrick had issues setting boundaries with children. Ms. Barbrick would tickle children, play with their hair, hold them, hug them, and play hit them. Ms. Barbrick would only do this with certain children and yell at other children when they tried to join in. Ms. Martinez stated she told management she didn't not think this class was a good fit for Ms. Barbrick and school aged children would be a better fit for her. Ms. Marinez reported that Ms. Barbrick started working more in other classes. Ms. Barbrick was friends with

    R 400.8380 · R 400.8380 Maintenance of premises. (1) The premises must be maintained in a clean and safe condition and must not pose a threat to health or safety.

    On 2/25/2021, I completed an unannounced inspection at the facility. During my onsite inspection, I interviewed program director, Kathryn Urquhart. She admitted that they were experiencing some leaking issues in multiple classrooms in the facility. Ms. Urquhart explained that in the summer of 2019 they had a new roof installed and the roofers did not install the ice shields correctly. With all the recent snow and ice melting, the water had nowhere to go, but inside the facility. Ms. Urquhart stated that on Friday 2/19/2021, they noticed the roof leaking in multiple areas in the facility, particularly the eastside of the building. They put buckets down to catch the water from the ceiling and she immediately put in a work order to have the leaks fixed. Tutor Time's maintenance man, Michael Cleveland and a roofing company came out and removed all the snow and ice from the roof. Ms. Urquhart escorted me to the preschool classroom. This classroom had significant water damage. I observed 6 ceiling tiles missing from the ceiling that was located on the southeast side of the classroom. The materials from the falling ceiling tiles were still on the floor and there was also insulation covering the floor. There were three large trash containers that had water in them. The materials that were on the floor were contained and blocked off by bookshelves, keeping children away from the materials and the wet carpet. This limited the square-footage space the children had access to. There were 23 children in the classroom. I asked Ms. Urquhart if she had contacted parents to inform them of the water damage in the building since parents are not allowed in the building due to the COVID pandemic. She stated that she had contacted parents and that parents are able to see in the building through the windows. On 2/25/2021, I interviewed Child Care Staff Member, Julie Beke-Dreyer. Ms. Beke- Dreyer reported that the roof started leaking on Friday 2/19/21. Buckets were placed around the facility to catch the water from the leaking ceiling. Before nap, one ceiling tile fell from the ceiling crashing to the ground. Staff members blocked off the area where the ceiling tile fell with bookshelves to contain the mess and the possibility of other ceiling tiles falling. Ms. Beke-Dreyer reported that the leaking got worse and there was more water saturated on the floor, walls, and ceiling. On Monday 2/22/21, five more ceiling tiles fell while children were in the classroom. That day roofers came out and removed all the ice and snow from the roof to prevent any more water coming into the building. The roofers came back out on 2/23/2021, to ensure the leaking had stopped. On that same day, dry wall from the ceiling fell in the same corner where the six ceiling tiles had fallen. Ms. Beke-Dreyer stated she felt the building was safe and that no more ceiling tiles would be falling. Ms. Beke-Dreyer stated that things were being done to fix the problem. On 2/25/2021, I spoke to CCSM Alyssa Ensley. Ms. Ensley stated that she works in the infant room. On Friday 2/19/21, leaking started in building. She reported that the whole side of the infant classroom was leaking and got worse during the day, while children were in the classroom. On Monday 2/22/2021, a ceiling tile fell in the infant classroom, thankfully no children were near that ceiling tile and no one was hurt. Ms. Ensley stated that multiple ceiling tiles were very wet, brown, cracked, and she is 4 concerned that they will fall while the children are in the room. I observed the ceiling tile that fell, which was still on the floor; there was a camera that was attached to that ceiling tile that was dangling from the ceiling. I also observed multiple ceiling tiles that were brown and saturated. The carpet in the infant room was also saturated. The walls had bubbled where there was substantial leaking.     On 2/25/2021, I observed the preschool classroom. The preschool classroom was operating with 23 students with 24 students being the maximum capacity in the classroom based on the available square footage of the room. The classroom is 850 square feet. Each child is required to have 35 useable square feet. There was a large section of the classroom that was not accessible to children in care. There were bookshelves blocking off the area where 6 ceiling tiles, drywall from the ceiling, and insulation had fallen. Each ceiling is 2 ft by 4 ft for a total of 8 square feet. The facility blocked off an area of 12 ceiling tiles, accounting for 420 feet. The capacity of the classroom, based on usable square footage, would be 12 children.

    Carpets throughout the facility were saturated with water that had leaked from the ceiling. The paint on the walls had bubbled from the water damage. Multiple ceiling tiles throughout the facility had fallen or were brown and cracked from the weight of the water. The center remained open and continued to care for children in these classrooms with water damage.

    On 11/25/20, I conducted an unannounced on-site inspection. I spoke with child care staff care member Autumn Deer regarding the complaint. After reviewing the complaint with Ms. Deer, she stated that there was not a child left alone in the school age classroom. She stated that she has been in the school-age classroom all day. However, she and the children left the room around 9:00am to grab materials for the day from the resource room in the back of her classroom and from the 2's classroom 2 but she stated she took all the children with her. She stated she had seven children total and she took all of them to get the resources. When they returned, they were in the classroom making turkeys and she was in the room with them the entire time. Ms. Deer also stated that they do not have a computer in the classroom, but she has an iPad for her classroom. She stated she allowed one of the children to use to iPad to check-in another child. She said sometimes they allow the children to do that because they think it is fun and they like pretending to be the teacher. Ms. Deer stated that she is not sure why someone would say that a child was alone in the classroom. The only thing she can think of is that she was standing in an area of the room where someone couldn't see her and assumed that the child was in the room alone. On 01/5/2021, I spoke with Child A and B's Mother regarding the complaint. She stated that she did not see a child left alone in the school age classroom on 11/25/2020 or any other day. She stated that she would be the first to make a complaint if she did. She stated that her children have been attending the child care center since March 2017 and she has had no issues or concerns with the facility. I spoke with Child C and D's Mother regarding the complaint that a child on a computer was seen left alone in the school age classroom. She stated she has never seen a child left alone in the school age classroom. She stated her youngest child has been attending the center since she was 12 weeks old and she has never had any issues or concerns with the center. Child E's Mother said she did not see any child left alone in the school age classroom on 11/25/2020 or any other day. She stated she has nothing but great things to say about the center. Child F and G's Father stated he did not see any child left alone in the school age classroom or any other classroom. On 01/05/2021, I spoke with program director Katy Urguhart regarding the complaint. Ms. Urquhart stated that she knows that the complaint was not true because she had her district manager review the tape and at no point was there a child left alone. Also, there would not have been a child on a computer that day because they do not allow children on technology between the hours of 9am-5pm unless it is for virtual learning and it wasn't a virtual learning day.

    On 10/08/2020 I completed an unannounced inspection to the child care facility. I met with Program Director Kathryn (Kate) Urquhart. Mrs. Urquhart stated there was a toilet in the preschool room that was leaking, but it was leaking water and not sewage. She stated the toilet was leaking and maintenance came to fix the issue. It looked as if they fixed it and staff left for the weekend. When staff returned after the weekend, they noticed the toilet was not fixed and it had leaked the entire weekend. Maintenance was again called out and it was noted that the water line from the wall to the tank was broken. This water line was completely replaced. The carpet was then wet and needed to be cleaned. A carpet cleaning crew cleaned the carpet and were in the process of drying it. Mrs. Urquhart stated there was never any raw sewage leaking onto the ground. The classroom did smell because of the wet carpet, but it was not a health risk. Mrs. Urquhart provided me with the internal maintenance company that assists with fixing any repairs. I interviewed staff member Katelyn Bleau. Ms. Bleau stated the toilet in the preschool room was leaking. They believed it got fixed but then it turned out it leaked the whole weekend. The carpet was wet and needed to be cleaned. Mrs. Bleau stated the carpet was cleaned and they were not to use the wet area. She stated she never heard that there was raw sewage, or the carpet needed to be replaced. I interviewed staff member Janelle Gonyon. Ms. Gonyon stated the toilet was leaking and it leaked over the weekend. She stated the carpet was soaking wet when they came in on Monday. Ms. Gonyon stated the carpet did smell but management were working on getting the smell out. She stated she never heard there were feces and urine that spilled. I interviewed Assistant Director Pam Noble. Mrs. Noble stated the toilet did leak and they had to clean the carpet. She stated there was never any indication the water was raw sewage or a threat to anyone's health. I viewed the room and the toilet that was leaking. I noticed the carpet that was being dried. I noticed the toilet part that was replaced and was no longer leaking. The room did have a wet carpet smell, but that was being addressed with fans. On 10/08/2020 I contacted Randy Blauw from Emcor Property Maintenance. Mr. Blauw stated a washer was replaced on the toilet and they believed that fixed the 611 W. OTTAWA. P.O. BOX 30664. LANSING, MICHIGAN 48909 www.michigan.gov/lara . 517-335-1980 issue. On Monday when staff returned, the carpet was wet from the toilet leaking. Mr. Blauw stated the water line from the wall to the back of the toilet needed to be replaced and that was the issue. The water coming from the wall to the toilet is clean and there is no sewage in it. There was never any raw sewage leaking on the carpet at any time. The carpet being wet did smell, but they were drying it. There was never an issue with the health of staff or children in care at any time. On 10/08/20201 completed a telephone exit conference with Licensee Designee Kathleen Conroy.
