722.115m Child care center; group child care home, or family child care home; requirements for licensure. Sec. 5m (2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization shall not establish or maintain a child care center, group child car home, or family child care home unless licensed by the department.... If the department determines that a service, facility, applicant, licensee, child care staff member, or member of the household is not conducive to the welfare of the children, the department shall deny the application or revoke the licensee's license according to section 11.

On 9/8/2020 I left a voice message at the inquiring On 9/8/2020 I reviewed and found that Adult Household Member (AHM 1) completed a comprehensive background check on 7/14/2018 and was determined to be eligible to be an adult household member at a child care home. On 9/10/2020 I completed an unannounced on-site inspection at the child care home. I informed Maggie Foster a concern was brought to the attention of the department. Ms. Foster said AHM 1 owns a car shop and leaves early in the morning and does not return to the home until late in the evening. Most of the child care children do not arrive at the child care home until AHM 1 leaves for work and the children leave the child care home before AHM 1 returns home from work. It is rare for children to be present at the child care home while AHM 1 is at the home. AHM 1 has never been an assistant caregiver and has never been left alone with child care children. Ms. Foster was the only adult present in the child care area which is located on a separate level from the residential area of the home. I informed Ms. Foster the allegations stated that AHM 1 sexually abused Person 1 from the time Person 1 was —. Ms. Foster said those allegations are false. Ms. Foster said those things never happened. Ms. Foster said she believes someone is making false allegations out of revenge. 3 On 9/16/2020 i received a voice message from who stated On 9/17/2020 1 placed a telephone call to On 9/18/2020 1 completed an unannounced on-site inspection at the child care home. Ms. Foster signed a statement stating that AHM 1 would not have contact with any child care children during the investigation. Ms. Foster was the only adult present in the child care area. Ms. Foster expressed that she is very upset with the allegations. On 10/22/2020 1 contacted On 10/26/20201 completed an unannounced on-site inspection at the child care home. I informed Ms. Foster that has been involved with the investigation. 4 Ms. Foster has already told me everything about the situation with Person 1 and Person 1's boyfriend. Ms. Foster does not have any additional information. I asked Ms. Foster if she knew what caused Person 1 to cancel her interview with - - and refuse to schedule another interview. Ms. Foster said she did not know the answer to that question. Ms. Foster was not aware that attempted to interview Person 1. Ms. Foster did not receive any messages from . I informed Ms. Foster that if the allegations were untrue, it would be beneficial for Ms. Foster to encourage AHM 1 and Person 1 to cooperate with interviews to tell their side of the story. Ms. Foster said she does not know if AHM 1 would be willing to complete an interview with either myself or- -. Ms. Foster said she cannot force AHM 1 to complete an interview, but she will let AHM 1 know I will be reaching out to him for an interview. Ms. Foster said she and Person 1 are not on good speaking terms right now, so Person 1 will have to make• own decision on whether Person 1 wishes to complete an interview. On 11/2/2020 I completed a face to face contact at Person 1's apartment accompanied by Licensing and Regulatory Affairs Child Care Consultant, Tim Swope. A male answered the door and stated Person 1 was at work. I provided a business card and asked the male to give the card to Person 1 when returned home. Later I observed a missed call on my cell phone from Person 1's telephone number. There was no voice mail from the telephone number. I returned a call to the number and left a voice mail requesting a return call. I did not hear back from Person 1. On 11/5/2020 I sent Person 1 a text message requesting a return telephone call or return text. I did not hear back from Person 1. On 11/10/2020 I attempted a telephone call to AHM 1. I was not able to leave a message. I sent AHM 1 a text message requesting a return text or a return call. I did not hear back from AHM 1. On 12/22/2020 I left voice messages for Child A's Mother, Child B's Mother and Child C's Mot
