    R 400.8125 · 1 R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    I interviewed Child A's Mother. Child A's Mother was not aware of the exact dates of the two incidents. CCSM, Ms. Williams was present when Child B asked Child A if she could smell his privates. Ms. Williams spoke with Child B about not saying that type of thing. CCSM, Ms. Briston was present when Child B wrapped her legs around Child A's head. Child A's Mother was told by Ms. Williams that Ms. Briston did not see how the incident started because she left the room to get something from the kitchen. Ms. Briston came back into the room and saw the Child A and Child B on the floor. Child A's Mother was told by Ms. Williams that both parents would be contacted, and that both children would be separated and watched more closely. Child A's Mother spoke with Child A. Child A told her that he was on the floor and crawling to get a toy. Child B was also on the floor and put her legs around his head, her hands near his neck, and had her "lips out." Child A remained in care at the center and there were no further incidents. Child A's Mother stated that prior to this incident, she had no other concerns regarding the children's care or supervision. Child A's Mother stated that "I am not worried about this. My child no longer goes there." She did not feel it necessary for me to interview Child A. I completed an on-site inspection at the center. I observed four children ages 3 years and older in care with Ms. Briston. The children were inside their classroom engaged in freedom of choice learning. The children were directly supervised. I interviewed CCSM and Administrator, Ms. Willaims. Ms. Williams was present when Child B (age 4 years) asked Child C, not Child A, if she could smell him. She was not certain of the date this happened, saying early August 2021. Ms. Willaims and Ms. N. Willaims were outside with nine children ages 3 years and older. The two CCSMs were spread out in the fenced in outdoor play area directly supervising the children. The children were engaged in freedom of choice learning, which included 3 climbing on an outdoor bridge climber. Neither CCSM heard what Child B said, but Child C approached her and told her that Child B asked him if she could smell his privates. Ms. Williams spoke with Child B. Child B did not give a reason for asking that question, but Child B expressed an understanding that this was inappropriate. Child B said she saw it on television. Ms. Williams spoke with both parents about what happened. Child B's Mother stated that she would speak with Child B about this behavior. Ms. Williams stated that that Child A's Mother was also present inside the center during her communication with one of the parents, so that may be why she thought Child A was involved, but he was not. There have been no further incidents of Child B speaking inappropriately. Ms. N. Willaims no longer works for the center. Ms. Williams stated that she was not present when the incident occurred between Child A and Child B in the classroom. She did not remember the exact date, stating it was the beginning of August 2021. Ms. Williams stated that CCSM, Ms. Briston told her that she left the room for a few seconds to get ice from the kitchen counter. When she returned to the room after a few seconds, she observed the two children on the floor, and she intervened. Ms. Williams was told that it was as if they were wrestling together. The children were not injured, and they were fully clothed. Ms. Briston asked Child A what happened, and he shrugged his shoulders. Child B said she was trying to give him a hug. The children were asked if it was appropriate, and they said "no". Ms. Willaims stated that she spoke with both parents. Based on this incident, the CCSMs increased their supervision of the children. Ms. Willaims believes that the children were not trying to be inappropriate, and that they were "just playing." Both children continued to remain in care after the incident.
