    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/27/2023, Child care licensing consultant, Karen Woodman and I made an unannounced visit to the center. Program director, Rachel Faulkiner was interviewed. She said CCSM 1 has informed her that she did not believe CCSM 2, who works in the infant classroom, was "doing enough" in the classroom. Such as decluttering the counters. When Ms. Faulkiner conducted classroom observations on CCSM 2 after hearing this concern, she was engaged with the children. She has addressed the concern with CCSM 2 to make sure counter spaces are cleared and cleaned so parents especially can have a place to put bottles on. CCSM 4 also shared these concerns as she felt she was usually the one to "tidy up" the classroom. CCSM 4 works in the infant classroom once CCSM 2's shift is complete. There was a time CCSM 2 was holding a baby and it had appeared she was sleeping in the classroom. When she heard this and walked in the classroom to check on her, CCSM 2 looked at her when she entered the room. Ms. Faulkiner asked if she was okay and CCSM 2 responded she was okay and that she had closed her eyes to get the baby asleep. Ms. Faulkiner said she does not have concerns about CCSM 2's ability to care for the children. She said no one else has reported any concerns about CCSM 2. She said CCSM 2 has never fallen asleep in the classroom. CCSM 2 complains about being tired, but Ms. Faulkiner does not have any concerns that this is impacting her ability to care and supervise the children. CCSM 2 has never said she felt she couldn't do her job because she was tired, she is a normal parent that feels tired. She is never groggy with the children, Ms. Faulkiner has no concerns for CCSM 2. The infant classroom currently does not have any more than four infants as they are wanting to hire more child care staff members in order to increase numbers in this classroom. I interviewed CCSM 2. She said she works in the infant classroom and provides adequate supervision to all the infants in her classroom. She said she recently changed the layout of the classroom so she could maintain a global view of the classroom. The only mention of her sleeping in the classroom was when she had a child that wouldn't fall asleep if they saw that her eyes were also open. She said she placed a blanket over them both and rocked the baby to sleep. She would close her eyes or keep an eye open. Ms. Faulkiner told her it appeared as if she was sleeping, but she wasn't. She said no one has ever complained about her supervision and she has never fallen asleep in the classroom. She said she has fatigue, but she can 3 reach out to Ms. Faulkiner whenever she needs to. All classrooms have phones in them as well and she uses this to reach out to her whenever needed. I interviewed CCSM 1. She said she works in the toddler classroom but has worked with CCSM 2. She has no concerns with the way CCSM 2 interacts with the children. Sometimes she complains that she is tired, and she has observed CCSM 2 to be sleeping in the infant classroom as she saw CCSM 2 with her eyes closed. She said this occurred sometime in mid-December 2022. CCSM 2 had her legs crossed and her head was down and was sitting on the floor, she was not holding any children during this time. She said she has been instructed by Ms. Faulkiner and Ms. Casebeer, licensee designee to open the door and wake CCSM 2 when she notices that she is "dozing off." She explained there is a door that leads into the infant classroom from her classroom, this door has a window on it where she can see CCSM 2. When she needs to, she opens this door and asks CCSM 2 if she is okay. She keeps the door open for a few minutes to ensure CCSM 2 is alert. Another time happened at the beginning of February 2023. CCSM 1 observed CCSM 2 sitting in a rocking chair, with her head down and eyes closed. CCSM 1 opened the door and asked her if she was okay, and CCSM 2 said she was. CCSM 2 was alert after she left. She notified Ms. Faulkiner of this as well and was told to

    On 02/27/2023 Program director, Rachel Faulkiner was interviewed. She said CCSM 1 is the lead caregiver working with toddlers. CCSM 1 has been documented for being on her cell phone as she had picked up a phone call while working in the classroom. The classrooms have intercoms where child care staff members can alert Ms. Faulkiner if they need to step out of the room for any reason. No one has ever complained about CCSM 1 being rough with children and she is very well liked and respected throughout the center. For discipline, the center focuses on going directly to the child to correct any behavior and redirecting to another activity. Ms. Faulkiner has observed CCSM 1's interactions with child care children and she has no concerns with this. The only moment she can recall where CCSM 1 took a child by the upper arm was when Child A tried to run out of the classroom towards Child A's Mother during pick up time on 2/15/2023. She observed CCSM 1 grab Child A by his upper arm to stop him from opening the front door, then led him back to the classroom by holding his hand. There were no marks or bruises as a result of this and this didn't appear to be inappropriate or in a rough manner. Child A's Mother was not concerned with how CCSM 1 reacted, and she followed CCSM 1 and Child A back into the classroom. I interviewed CCSM 2, child care staff member in the infant classroom. She said she has been working at the center since November of 2019. She has observed CCSM 1 interactions with children and has no concerns with the way CCSM 1 interacts with the children. She has never seen her grab the children in a rough manner or yell at them. She has never seen CCSM 1 act aggressively or be inappropriate in any way with the children. She said no one has ever complained to her about the way CCSM 1 interacts with the children. I interviewed CCSM 1. She said she works with the toddlers and uses redirection as the main form of discipline. If she needs to physically redirect a child, she places one hand on their shoulder and gently guides them or holds their hand to lead them to another space in the classroom. She said no one has ever complained about her A grabbing children and she has never left any marks or bruises on children. CCSM 1 said she has never grabbed a child by the wrist or upper arm to pull them. However, Child A recently tried to open the front door that leads into the hallway of the center as he saw his mother come into the building and was excited to see her. Therefore, she reached for his arm and caught the upper part of his arm, just below his shoulder to lead him back towards his classroom. Child A's Mother and Ms. Faulkiner were finishing up a conversation while this happened, near the door. She reminded Child A that door handles are for "teachers" and parents. There were no injuries on Child A as a result of this and no one complained about this. Ms. Faulkiner has never spoken to her about being inappropriate or aggressive with children. I interviewed CCSM 3. She said she has been with the center for 15 years and has worked with CCSM 1. She said she has observed CCSM 1 to use redirection. She has never observed CCSM 1 to yell, grab a child roughly by the arm or anything aggressive. She said CCSM1 "loves those kids". She has never observed CCSM 1 to do anything inappropriate to a child and no one has ever complained to her about CCSM 1. I interviewed CCSM 4. She said she is familiar with CCSM 1 and has worked in the classroom with her. For discipline, CCSM 1 will usually redirect the children to read a book or engage in another quiet activity if the child is upset. She said she has never observed her to grab a child roughly or engage in any inappropriate behavior with a child. She has never seen her be aggressive and no one has complained to her about CCSM 1 being inappropriate or rough to a child. She said she has no concerns with CCSM 1.     On 02/27/2023, Child care licensing consultant, Karen Woodman and I made an unannounced visit to the center. A walk through of the center was completed to check thermostats. Three thermostats were read that controlled varies child approved spaces and they each read either 68 degrees Fahrenheit or 69 degrees Fahrenheit. Program director, Rachel Faulkiner was interviewed. She said she has never seen the center's temperature fall under 65 degrees Fahrenheit before. If this were to happen, parents would be notified to pick up their child prior to the temperatures dropping. She said no one has ever complained that the center was too cold, sometimes the office can be cold as it is located by the front door, but the this isn't a child approved space. Typically, the center temperature is kept at 69 degrees Fahrenheit. I interviewed CCSM 2. She said the center never falls below 65 degrees Fahrenheit and she has never felt overly chilled while working here. Sometimes at nap time the room can be feel colder as the lights are off, but the lowest she has ever seen the center's temperature was at 67 degrees Fahrenheit. Child care staff members can increase the heat if ever needed. I interviewed CCSM 1. She said the center has never been below 65 degrees Fahrenheit, the coldest she has ever seen the center was at 67 degrees Fahrenheit. She said she arrives at the center around 6:00AM and turns the heat to 70 degrees Fahrenheit so the classrooms are warm. She has no concerns for the temperature of the center. I interviewed CCSM 3 and CCSM 4. They both said the center has never been below 65 degrees Fahrenheit, the coldest she has ever seen the center was 68 degrees Fahrenheit.

    On 7/1/2022 I placed a telephone call to child care licensing consultant Samantha Struppa. Ms. Struppa said during an interim inspection at the child care center she completed an exit conference with licensee designee Julie Casebeer. During the exit conference Ms. Struppa reminded Ms. Casebeer of situations where she should notify Ms. Struppa. Ms. Casebeer said she has a situation she believes she should report to Ms. Struppa. Ms. Casebeer said recently, Child A told her mother that child care staff member Belinda Anderson pulled down Child A's pants and spanked her bottom. Ms. Casebeer and program director Rachel Faulkner spoke to Ms. Anderson and learned that Ms. Casebeer told Child A her "butt-crack" was showing then went to Child A and pulled up Child A's pants and diaper. Ms. Anderson denied using physical discipline on Child A. Ms. Struppa said she spoke to Child A's Mother. Child A's Mother said Ms. Faulkner 2 informed her Ms. Anderson pulled up Child A's diaper and pants and made a comment about Child A's "butt-crack" showing. When Child A's Mother asked Child A if Ms. Anderson pulled up her pants, Child A denied Ms. Anderson pulled up her diaper and pants. Child A told her mother Ms. Anderson pulled Child A's pants and diaper down and smacked Child A on the bottom. Child A demonstrated an open hand on her own bottom. Child A's Mother told Ms. Struppa Child A's story has not changed since Child A's Mother asked Child A what happened with Ms. Anderson. Child A's Mother did not report any marks or bruises on Child A's bottom. On 7/6/2022 I completed an unannounced on-site inspection at the child care center. I informed program director Rachel Faulkner of the allegation. Ms. Faulkner said she is aware of the situation. Ms. Faulkner said she was at the child care center the evening of 6/14/2022 for an all-staff training. Ms. Faulkner said she happened to check her e-mail and found an e-mail from Child A's Mother stating that on the way home from the child care center on 6/14/2022, Child A said, "Ms. Bo cracked my butt." Ms. Faulkner confirmed that some of the children call child care staff member Belinda Anderson "Bo." Child A's Mother requested a face-to-face meeting with Ms. Faulkner in her e-mail. Ms. Faulkner questioned Ms. Anderson about Child A's statement. Ms. Anderson denied using physical discipline with Child A or any other children. Ms. Anderson was very upset about the comment made by Child A. About 10 minutes later, Ms. Anderson came to Ms. Faulkner because she remembered a comment, she made to Child A that might have cause a misunderstanding. Ms. Anderson said Child A was bending over and her pants and diaper were slipping down. Ms. Anderson said, "I can see your butt-crack." Ms. Anderson said she went over to Child A and pulled down her pants, adjusted her diaper, then pulled Child A's pants over her diaper. Ms. Faulkner said she called Child A's Mother the morning of 6/15/2022 to inform her of Ms. Anderson's response to Child A's allegation that Ms. Anderson hit her on the bottom. Child A's Mother called Ms. Faulkner back and said that Child A agreed with the scenario Ms. Anderson described where Ms. Anderson helped Child A to pull up her diaper and pants because her "butt-crack" was showing. Ms. Faulkner believed Child A's Mother's concern was resolved at that time. Later in the morning of 6/15/2022, Child A's Mother sent Ms. Faulkner an e- mail stating she and her husband decided to disenroll Child A from the child care center. Ms. Faulkner said Child A's Mother came to the center to retrieve Child A's belongings, but Child A did not return to the center. Ms. Faulkner said she has never had any concerns with Ms. Anderson's work performance. I interviewed child care staff member Belinda Anderson. Ms. Anderson said she was shocked when she learned Child A told her mother she hit her on the bottom. Ms. Anderson said "I wouldn't touch these children. I'm a mama bear. I love that baby."
