The markings observed on Child A's legs were not the result of an injury. The markings were a result of Child A participating in an activity that involved water colored by food coloring. The child care staff members attempted to remove the food color from Child A's skin. The darker colors remained on Child A's skin a little longer than the lighter colors. The marks on Child A's legs and thigh came off after Child A's Mother bathed Child A. The child care staff members properly supervised the children while they participated in the colored water activity.

The center provided all parents with a weekly newsletter outlining the theme of the week of 6/20/2022 to be space and galaxies. Child care staff members posted pictures on social media and notified parents on 6/21/2022 that the children may have come home with coloring on their skin the previous day. Child A did not receive any injuries at the child care center that would require the child care staff members to report to Child A's parents.

On 1/2812021 1 received an e-mail from licensee, Liz Brown, Ms. Brown informed me that earlier this morning Child A's Mother told her that Child A disclosed to her that Child B stuck hand down Child A's while two teachers were present in the classroom and no dy else saw the inci=d ent. Ms. Brown spoke to Child B and asked Child B what ha ened. Child B told Ms. Brown was mad at Child A so that's why Child B stuck hand down Child A's s. Brown spoke to Child B's Guardian about the incident. Child B's Guardian said Child B is going through some tough changes in ■ life that have affected Child B's behaviors recently. 2 On 112812021 I spoke to Liz Brown by telephone to get clarifying information that was not included in the e-mail. 2/1/2021 1 completed an unannounced on-site inspection at the child care center. on I spoke to licensees, Liz Brown and Julie Everett. Both licensees were aware of the allegations and the possibility of an investigation. Child A's Mother told Ms. Brown she believes the incident occurred on 1/2712021. Child A's Mother does not know what time of the day the incident occurred., Ms. Brown said with Child A's Mothers E permission, she asked Child A what happened. Child A told Ms. Brown that while they were playing with to s, Child B lifted shirt; put hands down 'o and Child A's t. s. Brown said Child A ca is everything so Ms. Brown asked Child A ` ." Child A said Ms. Brown said she spoke to the staff members who work in Child A and 8's classroom. None of the staff members saw anything out of the ordinary between Child A and Child B on 1/27/2021. Ms. Brown said the staff members are currently trying to keep Child A and Child B separated in the classroom as much as possible. Ms. Brown does not have any concerns with the staff members who work in the classroom providing proper supervision. Child B does not have a history of acting out sexually in the classroom. Ms. Brown said Child B's Guardian did not report a history of Child B touching other children inappropriately. In the past, Child B did not exhibit any remarkable behavior problems. Since Child B has had a significant change in the amount of contact has with certain people in ■ life, staff members have very recently seen hild B to exhibit some aggressive type behaviors such as hitting and biting, but no indication of sexually acting out behaviors. Ms. Brown said only one of the staff members who works in Child A and B's classroom was present that day. The other staff member who regularly works in the classroom called in sick. I interviewed child care staff member, Hannah Reynolds. Ms. Reynolds said she was working in Child A and B's classroom on 1/27/2021. Ms. Reynolds does not recall anything out of the ordinary between Child A and Child B on this date. Ms. Reynolds said recently Child B has had some behavior problems where Child B will M attempt to hit staff members and children when is frustrated, Ms. Reynolds said she has never seen Child B act out in a sexually inappropriate manner in the classroom, Ms. Reynolds said Child A is usually quick to tell staff members if another child is doing something that does not like. Child A did not tell Ms. Reynolds about any incidents, Ms. Reynolds believes if any other children saw the incident, the other children would also tell a staff member. Ms. Reynolds said the staff members always spread out amongst the classroom to supervise all the children. At nap time children are spaced at least 18 inches apart so they cannot touch each other. Children go into the bathroom one at a time. Ms. Reynolds does not believe anything could have happened in the bathroom or nap time. Ms. Reynolds said she believes all the child care staff members supervise all the children both inside the classroom and during outdoor play time, Since Child A made the allegations about Child B, the staff members make their best effort to keep Child B separated from Child A and the staff members keep an even Moser- eye on Child B.
