On July 29, 2022, 1 completed an on-site inspection with Laura Siciliano, assistant irec or of St. Mary Daycare. Ms. Siciliano was able to confirm there is not a child with the name of Child A enrolled at their school nor is she aware of any such incident as alleged. On July 29, 2022, 1 spoke with Child A's Father at the family residence. Child AS Father confirmed hill A attends Felician Children's 3 Center in Jackson, Michigan. Child A's Father stated Child A told him another child, he believes it was Child B, touched her. He did not report it to anyone at that time. A while later, Child A's Aunt came to him and told him that Child A came to her and told her a child put his hands in her underwear and "touched her bits." Her "bits" being her or Child A's Uncle and Aunt provide care for her at times. Child A's ather stated when he picked Child A up from child care two or three days ago, he saw Child B "grope" another child while standing in line. However, he did not report this as he felt it would be turned against him as if he were doing something wrong. He reported to Sister Carolyn Ratkowski what Child A said to him and her aunt. He was told an internal investigation would be completed. Child A's Father stated he pays a lot of money for child care for Child A and for this kind of On July 29, 2022, I was present when spoke with Child A using the forensic protocol. Child A was able to tell Werencie between a truth and a lie. Child A agreed to be honest when speaking with Child A was able to demonstrate she could correct if she stated something that was not truthful. Child A guessed at the questions asked her to demonstrate what she would do if she did not know the answer to a question. Child A stated her "teachers" at school are Ms. Sabrina, Ms. Melissa, and Mr. Brayden. When she is at school, she likes to ride bikes, she plays with balls, with hoops, and with toys. Child A stated Child C and D threw sand at her eyes last week. Her `teacher" talked to them about it. Child A stated she is afraid of Child F because she almost smacked her in the face; Child G told the "teacher" and the "teacher" talked to Child F about what was going on. Child A stated one time Child C poked her in the upper right arm. Child A stated she does not feel uncomfortable around anyone at school, no one at school has ever touched her, or done anything to make her feel funny or uncomfortable. Child A stated she feels safe at home and at school. On July 29, 2022, ~ l spoke with executive assistant Kathrine Parr. Ms. Parr stated the incident 1"aeged inappropriate contact between Child A and Child B was reported to Sister Carolyn Ratkowski by Child A's Father at drop off. She does not know for sure the dates, however, she knows Tracy Smith the program director watched the video for the entire day in question and there was no incident on video. When asked if she could clip the video and send it to me, she stated she is unsure if that can be done with such a large content. She will ask Ms. Smith when she returns from vacation and let me know. Child A was present at the center the week of July 29, 2022, on Monday, Tuesday, and Wednesday. She was not present July 28, 2022, or July 29, 2022. According to Ms. Parr, Child B was not in attendance on the day he allegedly touched Child A. Child A has made comments about getting "whopped" by Child A's Father. Child A often arrives to school in unclean clothes and having an odor; the child care staff members purchased clothes to keep at the center and they clean Child A up, change her into clean clothes, and launder her dirty clothes. CI stated none of the children in Child A's classroom have ever had any sexualized behaviors. The restroom is a single restroom, one child goes in at a time, shuts the door, and comes out when they are done. On July 29, 2022, l spoke with child care staff member Melissa Kinaitis. Ms. Kinaitis stated she is not sure who, but someone told her about the allegations that another child touched

On 8/24/2021 I received a telephone call from Tracy Smith- Jackson informing me there was an incident where a child care staff member handled Child A in a rough manner. Ms. Smith-Jackson said there were no injuries to Child A and the child care staff member involved, Sammi Stitt has been placed on leave from the child care center. On 8/24/2021 I received an e-mail from Tracy Smith-Jackson with a video attached. I reviewed the video and observed a child care staff member go behind a child and place her arms around the child's arms and stomach area, then pick the child up moving the child away from a line of children. It then appeared as if the child care staff member pushed Child A away from the line after setting Child A back down on the ground. Child A stumbled a little but did not fall. On 8/24/2021 I received an e-mail from Tracy Smith-Jackson who informed me a law enforcement officer came to the child care center regarding the incident with Child A. Ms. Smith-Jackson provided me with the name Officer Kruso from the Jackson Police Department along with Officer Kruso's contact information. On 8/24/2021 I placed a telephone call to Officer Kruso. I left a voice message requesting a return call. I did not hear back from him. On 8/27/2021 I completed an unannounced on-site inspection at the child care center. I interviewed licensee designee and program director Tracy Smith-Jackson. I reviewed the video again with Ms. Smith-Jackson. Ms. Smith-Jackson identified the child in the video as Child A and the child care staff member who picked up Child A as Sammi Stitt. Ms. Smith-Jackson said on Friday evening, 8/20/2021C hild A's Mother called Ms. Smith-Jackson and reported that Child A told Child A's Mother child care staff member Sammi Stitt forcibly pulled Child A and picked her up to move her out of a line of children at the door. Child A's Mother requested to view the video footage of the incident. On Monday, 8/23/2021 Child A's Mother came to the child care center to review the video footage. Ms. Smith-Jackson also sent Child A's Mother a copy of the video per Child A's Mother's request. Child A's Mother was 3 very upset about the incident. Child A's Mother contacted law enforcement. Officer Kruso from the Jackson Police Department came to the child care center to review the video. I informed Ms. Smith-Jackson I had reached out to Officer Kruso but did not receive a response back. Ms. Smith-Jackson said Officer Kruso contacted Ms. Smith-Jackson today and informed her the incident is considered "an unfounded accusation of assault" and the case with law enforcement will be closed. Ms. Stitt and Ms. Arseneau reported to Ms. Smith-Jackson that on 8/20/2021 Child A was throwing objects around the room and ignoring verbal re-direction from the child care staff members. Ms. Stitt and Ms. Arseneau instructed the other children in the classroom to line up to go outside. Ms. Stitt asked Child A to pick up the items Child A threw before getting in line to go outside. Child A continuously ignored Ms. Stitt's requests to pick up the items then getting in line with the other children. After repeated failed attempts to direct Child A pick to pick up the things she threw, Ms. Stitt removed Child A from the line. The classroom videos do not have audio, but the child care staff members told Ms. Smith-Jackson they attempted various verbal de-escalation techniques to get Child A to calm down and stop throwing things. Ms. Smith-Jackson said Ms. Stitt is aware the way she handled the situation was not appropriate. Ms. Smith-Jackson did not have any concerns with Ms. Stitt's interactions with children prior to the incident with Child A. Ms. Smith-Jackson said Ms. Stitt has been employed at the child care center for less than a year and this is Ms. Stitt's first job in child care. Ms. Smith-Jackson believes Ms. Stitt's lack of experience in de-escalation skills was a factor in the incident. Ms. Smith-Jackson said she closed the child care center for th

On 12/11/2020 I completed an unannounced on-site inspection at the child care center. I informed program director, Tracy Smith-Jackson, of the allegations. Ms. Smith-Jackson said she was off work due to illness when the incident occurred with Child A at the end of October. Child A told her mother she was in the classroom and trying to get outside with her classmates. Child A's Mother then contacted Ms. Smith -Jackson to inquire what Child A was talking 611 W. OTTAWA. Ms. Smith-Jackson reviewed video footage and found that staff member Sister Carolyn Ratkowski signed Child A into the building, then opened the preschool classroom door directly across from the entry door to let Child A into her classroom. Child A was alone in the classroom for about 48 seconds when a staff member who was outside opened the door to let Child A outside. Ms. Smith-Jackson was informed of a similar incident that occurred with Child B about a month later. When Ms. Smith-Jackson reviewed video footage of the incident with Child B, she observed Ms. Ratkowski to open the door and let Child B into the classroom directly across the hall from the entry door. The students in the classroom were lining up to go outside. The outside door was open as the children walked out the door. Child B followed the rest of the classroom outside. Ms. Smith-Jackson said the video footage only remains for seven days so the incidents could not be reviewed as it has been more than seven days since the incidents occurred. On 12/11/2020 I completed an unannounced on-site inspection at the child care center. I interviewed staff member Sister Carolyn Ratkowski. Ms. Ratkowski said her job in the morning is to complete health screenings on children and sign the children into the child care center. Due to COVID-19 restrictions, parents no longer enter the building. Parents bring children to a side door where staff members sign the children in, take the children's temperatures, then take children to their classroom. Ms. Ratkowski said she remembers an incident several weeks ago where Ms. Ratkowski completed a health screening and signed Child A into the center. Child A's classroom is directly across the hall from the door where the children enter the building. Ms. Ratkowski opened the door to Child A's classroom and let Child A into the classroom. At that time, Child B came to the door to be signed in. Ms. Ratkowski went across the hall to the outside door to sign in Child B. Ms. Ratkowski took Child B into the same classroom across the hall. Ms. Ratkowski observed staff member Nicole Handshoe in the classroom with Child A. Ms. Handshoe said "we have her" then took Child A and Child B outside with the rest of the classroom. Ms. Ratkowski did not realize Child A was alone in the classroom for a brief period. Ms. Ratkowski said Child A would have been alone in the room only for the time it took for Ms. Ratkowski to complete a health screening and sign in Child B and bring Child B to the classroom. Ms. Ratkowski estimated that Child A was alone in the classroom less than one minute. Ms. Ratkowski said a few weeks after the incident with Child A, an incident happened with Child B. Ms. Ratkowski let Child B into the classroom directly across the hall from the entry door. The rest of the class was walking out the door to go outside. Ms. Ratkowski observed Child B to go to the end of the line to walk outside. Ms. Ratkowski said there have been some changes to the sign in process in the morning. Now two staff members are stationed at the sign in area. The side entry door is locked at 9:00am so parents must take their children to the main entrance if 611 W. OTTAWA. P.O. BOX 30664. The classrooms do not go outside until after 9:00am to assure that most of the children have arrived at the center before the teachers and students
