R 400.1911 · R 400.1911 Care; supervision; children. (3) A licensee and child care staff members shall be up and awake at all times when children are in care, except as provided in R 400.1922(2) of these rules.
On 02/08/2023 at 5:39pm, Ms. Hanson self-reported that she had fallen asleep in her recliner on the main floor of her home while Child A was in a pack-n-play on the upper level. An on site inspection was conducted on 02/09/2023. Ms. Hanson stated that due to issues with neck pain, she had been prescribed medication which she took only at night when there were no children in care. On 02/08/2023, Child A was the only child in care and Ms. Hanson's daughter-in-law had arrived at approximately 8:15am with her 13 month old son to assist Ms. Hanson as she was in pain. The daughter-in- law had assisted Ms. Hanson a "couple of times that week" and was upstairs "awhile alone with the children" while she was downstairs. Child A was taken to the upper level of the house by Ms. Hanson's daughter-in-law at approximately 12:00pm. Child A typically sleeps on the main level, but Ms. Hanson's daughter-n-law was unaware of this, consequently Child A was taken upstairs to nap. Ms. Hanson stated that she typically checks on sleeping children every 30 minutes, but had not done so the day of the incident. Ms. Hanson's daughter-in-law left with her son at approximately 12:30. Ms. Hanson cleaned the house up, turned the television on, and sat in her recliner. She awoke at at approximately 4:30pm when an adult household member (AHM) arrived. She looked at her phone and saw that Child A's Father had texted saying that he was on the way to pick Child A up. Child A's Father entered the house at the same time 3 as the AHM. Child A's Father went upstairs to get Child A who was not in distress. Child A's Father stated that he was calling 911 and left the house with Child A. Ms. Hanson received a text later that evening from Child A's mother stating that she was not pressing charges that she just "needed time to process." Ms. Hanson stated that Trooper Bahrman, Michigan State Police (MSP) arrived at approximately 5:00pm the day of the incident. He reviewed the prescription medications that Ms. Hanson was currently taking. He stated "if I asked you to take a drug test would you?" Ms. Hanson responded that she would and that she would put her shoes on and go "right now." He did not say anything but "thank you for your time" and left the house. The AHM concurred with Ms. Hanson's statement. The AHM stated that he had received a phone call from his daughter-in-law the day of the incident. Child A's father was at Ms. Hanson's house, and she was not responding to phone calls, texts, or knocks on the door. The door was locked. When the AHM arrived, Child A's Father was standing outside the house. They entered and observed Ms. Hanson asleep in a recliner. Child A's Father went upstairs to get Child A. He then left, stating that he would be calling 911. The AHM touched Ms. Hanson's arm to wake her up. A phone interview was conducted with Child A's Father on 02/10/2023. On a normal day, he picks one child up in Marquette and then picks Child A up in Ishpeming at Ms. Hanson's. Along the way, he texts Ms. Hanson to let her know he is on the way. She responds to the texts almost immediately. The day of the incident, Ms. Hanson did not respond. Upon arrival at Ms. Hanson's home, he found the door locked. He knocked, called, and texted Ms. Hanson but received no response. He looked in the window and saw no activity. He then called Child A's mother who in turn called Ms. Hanson's daughter-in-law. He knew Ms. Hanson had medical issues and thought something had happened to her. Child A's Father saw the AHM pull into the driveway. The two of them went into the house. He observed Ms. Hanson sitting upright in the recliner but not moving. The AHM could not wake her by talking to her. Child A's Father went upstairs to get Child A who was standing in a pack-n-play and not visibly distressed. He was aware that Ms. Hanson's daughter-in-law was helping and thought that the daughter-in-law was assisting full time as he was aware that Ms. Hanson was having medical issues. A phone inter
